      <title>$10,000 new construction tax credit in California on hold...</title>
      <description>&lt;p&gt;As of July 3, 2009, the franchise tax board in CA is&amp;nbsp;no longer accepting new home credit applications.&amp;nbsp; There has been discussion to expand this program and it has been a major factor in helping the real estate industry rebound in recent months.&amp;nbsp; Factor in the $8000 federal tax credit for 1st time buyers and it's easy to see why buyers are jumping off the fence.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;As shown in the numbers below, they&amp;nbsp;have received over $100 million in new home credit applications and more than 12,000 applications.&amp;nbsp; This means&amp;nbsp;the $100 million originally allocated for the program has been used up.&amp;nbsp; Any&amp;nbsp;additional applications will be subject to the availability of remaining credits.&amp;nbsp; The state&amp;nbsp;will continue to report certificates issued on a weekly basis until the full $100 million has been allocated and they&amp;nbsp;expect to complete processing all certificates in August and&amp;nbsp;notifications in response to all applications received, indicating the amount of credit allocated or denied.&lt;/p&gt;
&lt;p&gt;This tax credit is available for qualified buyers&amp;nbsp;who on or after March 1, 2009, and before March 1, 2010, purchase a qualified principal residence&amp;nbsp;that has &lt;strong&gt;never been occupied&lt;/strong&gt;. The buyer must reside in the new home&amp;nbsp;for a minimum of two years immediately following the purchase date.&lt;/p&gt;
&lt;p&gt;California&amp;nbsp;began accepting applications for allocation of credit &lt;strong&gt;by fax only&lt;/strong&gt; on March 1, 2009. The state&amp;nbsp;began processing the applications on a first-come, first-served basis, on May 1, 2009.&lt;/p&gt;

The company says its closings&lt;br /&gt;spiked 55 percent over the year as RealEstate.com embarked on an aggressive strategy of recruiting&lt;br /&gt;agents and buying companies.&lt;/p&gt;
&lt;p&gt;Launched in March 2006, RealEstate.com, Realtors now has 1,200 agents in 20 markets. It aims to continue that growth. &quot;Our company is starting in one of the worst real estate economies in our lifetime,&quot; says Victor Vaca, national vice president of sales at RealEstate.com. To keep growing, RealEstate.com, a division of Charlotte-based Tree.com, has built a call center recruiting team, Vaca says.&amp;nbsp;Our recruiters are calling agents to pitch the business model. A primary selling point: The leads generated by the popular&lt;br /&gt;RealEstate.com site.&lt;/p&gt;
&lt;p&gt;In March, it ranked 20th among Hitwise's list of the most popular real estate websites. Vaca's pitch: &quot;Say you're doing 10 deals a year. Imagine doing all the deals you're doing now, and we can feed you another five to 10 transactions a year.&quot; To generate leads, Vaca says, RealEstate.com is spending &quot;a ton&quot; on search engine marketing and search engine optimization. A typical RE/MAX agent, Vaca says, might spend $40,000 to $60,000 a year to generate online leads, RealEstate.com is doing the lead generation for them. &quot;We are going to fight this very expensive battle,&quot; he says.&lt;/p&gt;
&lt;p&gt;Agents do pay for the leads. For closed transactions where the lead came from RealEstate.com, the agent pays a 35 percent &quot;success fee.&quot; Even so, Vaca says, it's not all about the leads. &quot;You don't come here for the leads. You come here for the leadership,&quot; Vaca says. RealEstate.com brokers train agents how to respond to leads and how to build up their repeat and referral business. But responding to leads is a key part of the business model. A consumer who makes a request on RealEstate.com can be on the phone with the call center in seconds, and on the line with an agent in a couple minutes, Vaca says. &quot;We want to provide a worldclass consumer experience to the customer that's on the phone,&quot; he says.&lt;/p&gt;
&lt;p&gt;Leads are doled out based on where an agent does business and also based on the agent's success in converting leads. Vaca admits the demands of responding instantly to leads can be grueling, so agents are able to call time-out. If an agent will be out with a client or dining with their&amp;nbsp;family, they&amp;nbsp;can hit an online &quot;pause&quot; button that means leads won't come to them&amp;nbsp;for a time. But in a slow market, agents find RealEstate.com's lead machine a boon rather than a burden. &quot;They love having leads delivered to their cell phones,&quot; Vaca says.&lt;/p&gt;
&lt;p&gt;RealEstate.com has grown not only through recruiting but also through acquisitions. Its most recent deal, announced in late 2008, was for Tampa, FL-based New Homes Realty Inc., which had 200 agents and brokers. In 2007, RealEstate.com bought Distinctive Homes and Land of Tucson, AZ, and it also took over a brokerage in Salt Lake City. RealEstate.com has kept many of the agents after mergers, in part by keeping on a manager from the acquired company. &quot;Trying to keep that family whole is important,&quot; Vaca says.&lt;/p&gt;
&lt;p&gt;RealEstate.com has offices from New England to Southern California, but Vaca notes that the company isn't investing much in office space.       <description>&lt;p&gt;The CA Association of REALTORS just released information on Assembly &lt;em&gt;Bill 957,&amp;nbsp;a&lt;/em&gt;lso called &quot;The Buyer's &lt;em&gt;Choice&lt;/em&gt; Act&quot;.&amp;nbsp; The bill, authored&amp;nbsp;by Assemblywoman Galgiani,&amp;nbsp;will require fair treatment for real estate owned (REO) buyers in the choice of title and escrow providers.&amp;nbsp; Here is an excerpt form the e-mail sent out minutes ago by the CA Association:&lt;/p&gt;
&lt;p style=&quot;text-align: center;&quot;&gt;&lt;strong&gt;C.A.R. Achieves Compromise in AB 957, &lt;/strong&gt;&lt;/p&gt;
&lt;p style=&quot;text-align: center;&quot;&gt;&lt;strong&gt;Choice of Escrow Bill&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;C.A.R. achieved a compromise in AB 957, &quot;Choice of Escrow Bill.&quot; In multiple discussions with the author, C.A.R. worked with Assemblywoman Galgiani,&amp;nbsp;to come up with compromise language that will require fair treatment for real estate owned (REO) buyers in the choice of title and escrow providers.&lt;/p&gt;
&lt;p&gt;The new language now protects fair negotiation over settlement services, and has removed C.A.R.'s opposition.&lt;/p&gt;
&lt;p&gt;The new language will codify in California law the federal RESPA rules for selection of title insurance, and extend the same rules to protect buyers in the selection of escrow services.&amp;nbsp; In a nutshell, the sellers will have to negotiate the selection of title and escrow. Under the new language, if an REO seller wants to try and direct choice of escrow, the seller will have to pay for the privilege.&lt;/p&gt;
&lt;p&gt;AB 957 will also impose new penalties on REO sellers that violate the law, and will empower state regulators to go after both RESPA and &quot;steering&quot; violations.&lt;/p&gt;
&lt;p&gt;This has been an on-going issue in CA where many banks have been &quot;steering&quot; buyers into using the banks preferred escrow company even when a local option existed and in many cases was less expensive.&amp;nbsp; There was also a groundswell of opinion among real estate agents and brokers that&amp;nbsp;offers submitted to&amp;nbsp;banks were not getting a fair shake if they objected to using these preferred services.&amp;nbsp;&amp;nbsp;For more background on this bill visit:&lt;/p&gt;

&lt;p&gt;I wanted to follow up with a few success stories on how we have used this information to actually&amp;nbsp;close transactions.&amp;nbsp; First, it is important to note that there is a lot of misinformation out there about these credits and how they work...so be sure you are getting information from a reliable source and always verify it with your tax advisor.&amp;nbsp; On the surface the tax $8000 tax credit in and of itself may not be enough to get you to&amp;nbsp;put pen to paper and make an offer.&amp;nbsp; But&amp;nbsp;in some cases when coupled with other incentives, it may be just what you need to jump off the fence.&amp;nbsp; After all who can't use $8000- $18,000?&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Last month we had 6 offers accepted for clients that specifically bought because of the credits.&amp;nbsp; In two cases they also bought new consturction, so they qualified for the $8000 federal new home buyer credit plus the $10,000 CA new construction credit.&amp;nbsp; Additionally we negotiated with the builder to add some incentives and got them to buy the client out of a lease for $5000.&amp;nbsp; That totalled up to $24,000!&amp;nbsp; A significant incentive to say the&amp;nbsp;least.&lt;/p&gt;

&lt;p&gt;The reality of this market and economy&amp;nbsp;is that there are great deals out there!&amp;nbsp; Companies are negotiating on everythig from cars to household items to homes.&amp;nbsp; Don't be shy in asking for incentives or credits or closing costs.&amp;nbsp; Keep in mind however that when it comes to&amp;nbsp;foreclosed homes competition is fierce and people are paying over list price.&amp;nbsp; Lenders are pricing these homes to move so go in with your eyes wide open,&amp;nbsp;look at recent sales comparables and work with a strong agent that knows how to structure the best deal possible for you and your family.&amp;nbsp; Stay tuned for my next blog on the recent auction I attended, and get&amp;nbsp;the inside scoop on how they work and if they are really the place to get a killer deal on real estate.&lt;/p&gt;

      <title>Refinance Vs. Loan Modification...What's a homeowner to do?</title>
      <description>&lt;p&gt;I know there is a lot of debate about the stimulus and just who will benefit.&amp;nbsp; Well,&amp;nbsp;in looking at the actual guidelines, there may be plenty of help on the horizon.&amp;nbsp; We are opening new transactions monthly and are tracking to record numbers come 2nd quarter.&amp;nbsp; Most of our business is buyer side and REO based.&amp;nbsp; There is a lot of activity and homes are selling fast and for more than list price!&amp;nbsp; It's a bit like the Wild West and it is a great time to buy.&amp;nbsp; Anyway, I sent this info out to my 250 agents this morning and thought I'd post it here as well.&amp;nbsp; The link below takes you to the Treasury Department&amp;nbsp;outline for the guidelines under the Stimulus Package.&amp;nbsp; Those of you that own property should also look at your own mortgage situation and see if there is anything you can do!&amp;nbsp; There are some&amp;nbsp;basic rules to qualify, along with other guidelines.&amp;nbsp;&lt;/p&gt;
&lt;ol&gt;
&lt;li style=&quot;text-align: left;&quot;&gt;&lt;strong&gt;Must be a first position loan on your primary residence&lt;/strong&gt; &lt;/li&gt;
&lt;li style=&quot;text-align: left;&quot;&gt;&lt;strong&gt;Loan originated on or before January 1, 2009. &lt;/strong&gt;&lt;/li&gt;
&lt;li style=&quot;text-align: left;&quot;&gt;&lt;strong&gt;Must modify between now and December 31, 2012 &lt;/strong&gt;&lt;/li&gt;
&lt;li style=&quot;text-align: left;&quot;&gt;&lt;strong&gt;Income must be documented&lt;/strong&gt; &lt;/li&gt;
&lt;li style=&quot;text-align: left;&quot;&gt;&lt;strong&gt;Must show a financial hardship in making your payments&lt;/strong&gt; &lt;/li&gt;
&lt;/ol&gt;
&lt;p&gt;Generally speaking your mortgage payment&amp;nbsp;could&amp;nbsp;be reduced to 31% of your monthly income.&amp;nbsp; All sources of income must be documented and you must provide tax returns, etc.&amp;nbsp; Banks and servicers will actually be offered incentives to work with homeowners.&amp;nbsp; A few more key points:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;The program will share with the lender/investor the cost of reductions in monthly payments from 38% DTI to 31% DTI. &lt;/li&gt;
&lt;li&gt;Servicers that modify loans according to the guidelines will receive an up-front fee of $1,000 for each modification, plus &quot;pay for success&quot; fees on still-performing loans of $1,000 per year. &lt;/li&gt;
&lt;li&gt;Homeowners who make their payments on time are eligible for up to $1,000 of principal reduction payments each year for up to five years. &lt;/li&gt;
&lt;li&gt;The program will provide one-time bonus incentive payments of $1,500 to lender/investors and $500 to servicers for modifications made while a borrower is still current on mortgage payments. &lt;/li&gt;
&lt;li&gt;The program will include incentives for extinguishing second liens on loans modified under this &lt;/li&gt;
&lt;/ul&gt;

      <title>Realistic Buyer Expectations...</title>
      <description>&lt;p&gt;One of the challenges both buyers and buyer's agents face today is determining what price to offer on a property.&amp;nbsp; As an agent we want to get the best deal possible for our client and the buyer feels the same.&amp;nbsp; The problem&amp;nbsp;is both the agent and the buyer can't be right!&amp;nbsp; Buyers watch TV, read the paper and&amp;nbsp;think they have&amp;nbsp;all the info they need to get that best deal.&amp;nbsp; But what happens when they have written 20 offers and not been sucessful in getting an offer accepted?&amp;nbsp; Perhaps we did a poor job of setting expectations.&lt;/p&gt;
&lt;p&gt;Our job as agents is to help our client get what they tell us they want.&amp;nbsp; The question is, &quot;What do they really want?&quot;&amp;nbsp; They tell us they want a deal yet we don't help them understand the realities of the market.&amp;nbsp; &quot;Mr. Buyer, this house is listed for $275,000, it sold for $418,000 3 years ago...that's a deal!&amp;nbsp; Let's look at the recent comparable sales in the area, see how prices are here?&amp;nbsp; If you want this home you need to write $10,000 over.&quot;&amp;nbsp; There is no reason they have to write 20 offers!&amp;nbsp; Write one really good offer and get into escrow!&lt;/p&gt;
&lt;p&gt;Using comps is the most powerful way to help your buyer understand the market.&amp;nbsp; Just as you would review comps with a seller, you must do the same with buyers.&amp;nbsp; This is the most powerful method to help your buyers know what is happeneing and set you up as the agent to help them.&amp;nbsp; Use testimonials from recent buyers to make your point.&amp;nbsp; Let others tell their story to reinforce what you are telling them.&amp;nbsp; Know your market.&amp;nbsp; What are the best deals?&amp;nbsp; What is the market time, average price, declining areas, improving areas, other top agents that work there.&amp;nbsp; Knowing the in's an out's of your local market will help you impart information that allows buyers to make the best decisions...and make them sooner.&lt;/p&gt;
