Mather CA – In 2010, an agent I know talked to the person at Bank of America in charge of the Loss Mitigation Department.
He was the top manager in the department that handles short sales, loan modifications, and foreclosures. He contacted this agent because agents were banding together to educate the public on the mistakes he thought that Bank of America was making.
Today, almost 2 years later, Bank of America is starting to make a few, small changes to the short sale process. This agent recommended small changes to how Bank of America handled the short sale process.
He recommended several changes that would be easy to implement. But, it still took almost 2 years for them to implement those small changes. Why?
We think it was because Bank of America has been in crisis mode since the beginning of 2009. It's hard to make proactive changes when you are putting out fires every day.
Will Bank of America ever recover? Will the ever fix the processes they use to handle loan modifications and short sales?

Folsom-El Dorado Hills CA – The National Consumer Law Center wrote a White Paper on how banks handle loan modifications, short sales and foreclosures.
They titles their White Paper "Why Servicers Foreclose When They Should Modify and Other Puzzles of Servicer Behavior." Check out the White Paper at this link: http://www.nclc.org/images/pdf/pr-reports/report-servicers-modify.pdf.
The "servicer" they are referring to is a bank that is handling a mortgage for another entity.
As an example, around 80% of all of Bank of America's mortgages are not owned by Bank of America. Instead, they are owned by another entity like Fannie Mae or a hedge fund.
Bank of America is simply handling the accounting, tax filings, and the foreclosure and collections process. The Consumer Law Center thought it was "puzzling" that servicers preferred foreclosure over loan modification.
The reason that the servicers prefer it is because it is less work and they make more money in the process. But, I don't think it is puzzling. Why not?
Because there is almost zero accountability! The owners of these mortgages never check in on the process. They don't know that a servicer denied a short sale offer for $385,000, only to see the property sell for $230,000 as a foreclosure.
Because they are not checking on things Uncle Sam and the owners of these loans are seeing huge, unnecessary losses. Pretty sad, isn't it? Thinking about a short sale?

But, you need to remember that Banks are not in the business of making life easier for its customers, much less anyone trying a short sale.
Banks are in business to turn a profit. The main reason Bank of America has initiated the Cooperative Short Sale is to increase the bank's bottom line profit.
They increase their profit whenever they cut losses on loans that are in default. The bank faced several problems:
1. They have a bad reputation for taking too long to process short sales and loan modifications.
2. Due to the length of time to buy a short sale, buyers are making lowball offers.
3. Many agents are in experienced on short sales and unsure of what to do. As a result, many agents were in the dark on where to price a short sale property.
Before listing the property, Bank of America will provide the terms such as the list price and deficiency judgments. In doing so, the bank is able to provide a shorter decision time once an offer is received.
In fact, Bank of America claims that once an offer is received, they will provide a decision in 10 days!
This simply means that Buyers will be less frustrated with the purchase process and more willing to wait for it to be completed.

Here was our answer to his question. You can still do a short sale. It is a fact that lenders are more motivated to do a short sale on a property that needs repairs than on a property that doesn’t.
Most lenders understand that the risk of loss goes up when they foreclose on a property that needs lots of work. Here is an easy way to get a discount approved for a short sale.
Show your lender that a lot of repair work is needed to bring the property back up to a marketable condition so it can be sold. Lenders are simply not set up to get any repair work done.
They are in the loan business, not the repair or handyman business. It really doesn’t matter the type of house or condition, all mortgages can be discounted.
The very best types of properties to perform short sales on are houses that are in rough shape and need repair work because the bank will often allow a bigger discount for it.

That means that if a property is foreclosed upon, then they still have to be paid. They don’t go away for any reason.
This is also why most lenders want to charge you monthly and then pay the property taxes themselves. They know that the taxes are a big bill that only comes once a year.
Not everyone can afford that big bill. Because your lender knows they will still have to pay the taxes after a foreclosure, they are willing to pay them during a short sale.
A foreclosure is a liquidation of the property to simply get what they can and move on. A short sale has been proven to net them more money than a foreclosure.
So if they are liquidating the property, why net more money from the sale with a short sale and avoid a foreclosure? That’s why they will pay the taxes when you short sale.

Folsom-El Dorado Hills CA – If you are selling your home, then ask the buyer to write a letter about why they want to purchase the home. If you are a buyer, then write that letter.
The listing agent will submit that letter along with the short sale paperwork. With a little luck that letter will help “grease the wheels” and cause the short sale to be approved faster.
Short Sale negotiators are human beings. They have emotions that can be touched by a good story.
These letters might sound like a joke, but they can make a huge difference. I’ve even seen home owners lose money on their sale because the liked a certain buyer over another one.
In that case, the seller sold their home for several thousand dollars less to a buyer that they liked. The other buyer had been rude and the seller didn’t like them.
If that made a difference when the seller was losing their own money, then think about the difference it will make to a short sale negotiator who isn’t losing their own money.
Put a good story in your letter. Here are a few examples.
You might say something like this: “We are a first time home buyer looking for our first home. We just want to move out of our cramped apartment and are looking forward to our first home where we can plant a garden.”
Or, maybe it would be like this: “We have looked for a while and finally found this home on Elm Street that we love. We are selling our current home so we can buy a house with a yard.
Our two boys, Tim and Julian, have been begging us for a swing set. We never had room in our old condo.
If you approve our short sale offer, then we will finally be able to give them the large, fenced backyard they’ve always wanted with a swing set.
We’ve already picked out the swing set plan and Tim and Julian are so excited about it. So, don’t approve the short sale offer for us, approve it for them.”
See how I’m pulling the negotiator’s heartstrings. Unless your short sale negotiator is absolutely heartless, it will make a difference for you.
