Congress has extended the $8,000 first-time homebuyer tax credit and offered a new credit to other types of buyers, but some analysts are downplaying the controversial stimulus' effect on the housing market.

In a recent interview, Fox-Pitt Kelton analyst Robert Stevenson said the Senate's proposal for extending the $8,000 tax credit for new homebuyers will have a "limited impact" on home sales.

A Senate committee reached a deal to extend the $8,000 tax credit and offer a smaller $6,500 credit for some existing homeowners.  The main pitfall of the proposal is that it only pushes back the expiration of the tax credit to the end of April, Stevenson said.  It is currently set to go away on Dec. 1.  Stevenson said he's skeptical the tax credit will drive activity during the slower winter months.  The prime selling season for the housing market kicks off in the spring and tends to run through the warmer months.  "Of course, Congress could come back and extend it again," the analyst said.  "When the next selling season starts, the housing market will depend on the state of the economy and mortgage rates, rather than tax credits."

The $6,500 credit for some repeat homebuyers would let more buyers participate albeit at a lower level, "but a lot of those people are effectively trapped in their current homes," Stevenson said.

From their peak in 2006, U.S. home prices have fallen about 30% through the end of August 2009 during the housing downturn, according to the S&P/Case-Shiller home price index.  More Americans are falling behind on their mortgage payments or losing their homes in the recession as job losses pile up.  Rising foreclosures are another key worry. 

Yet hopes that a recovery is in place were fueled by a report showing the fourth straight month of rising home prices.  Some attributed the tentative rebound to buyers rushing to cash in on the expiring $8,000 tax credit.  The push to extend and expand the credit has been led by home builders, Realtors and other groups connected to the housing market.

"Failure to act now could derail the fragile housing recovery even before it has time to take root," said Jerry Howard, president of the National Association of Home Builders, in a statement urging Congress to stretch the tax credit.  "The consequences would be devastating for both housing and the economy."  Howard said the tax credit has already helped create nearly 200,000 jobs, drive home sales, stem foreclosures and stabilize prices.  Homebuilder stocks were up sharply in the wake of the news on the Senate compromise.  Still, some economists say the incentive's impact is overblown.

"I am not applying the recent home-price rebound to the tax credit," said Cameron Findlay, chief economist at LendingTree, in a recent interview.  "I don't think the tax credit makes as big an impact as people make it out to be, although it certainly motivates first-time buyers," he said.  "If it had expired, I don't think it would have shaken the housing market as much as some had predicted."

One potential snag with the extension of the tax credit is a recent government report that uncovered fraud and abuse associated with the tax credit.  Thousands of ineligible taxpayers have received millions of dollars under the program, according to the report.

Stephen East, an analyst at Pali Research, said the proposed new $6,500 credit would likely have some impact on the lower-end of the move-up market.  "In essence, this could slowly start to prime the pump," East forecast.  "That said, we remain wary that any measurable impact will be seen until after the holidays and investors need to reconcile their expectations to that."

While recently touring home with a buyer, one home stood out in particular and for all the wrong reasons. Bikes and trikes and pets running around in the front yard, not to mention that there was two cars parked on the front lawn as well. When you choose a REALTOR®, you will most likely sign a listing agreement - a contract in which you agree to allow the REALTOR® to sell your home during a given period. The amount of compensation you pay a broker is negotiable, but the REALTOR® will generally follow the company's policy regarding compensation. The amount of the fee will be spelled out in the listing agreement. Make sure you understand how the fee will be paid before signing.

Exclusive listing
Most REALTORS® will ask for an exclusive right-to-sell listing. This means that you will owe the broker a commission regardless of who finds a buyer during the listing period. In other words, if you decide to sell the house to your cousin, your broker still gets a commission. The advantage of this kind of arrangement is that the broker is motivated to work harder to sell your home.

It's possible that a REALTOR® from another company will find a buyer for your home. In that case, your broker is the listing broker, and the second agent is the selling or cooperating broker. Many times your listing broker will agree to pay the cooperating broker a fee from the amount you pay the listing broker. Your listing broker cooperates with other brokers who procure buyers interested in your property and offers to compensate the other brokers for procuring a buyer. I habe put some pointers together when Listing your home in Pensacola, Pace or Gulf Breeze. Regardless of when type listing you go with make sure there is an opt out feature in case the agent is not doing what you expected.  Just like all agents are not the same neither are listing fees or contracts.

As you interview REALTORS®, they may suggest a listing price on your home. Only you can decide what price to set, but you want it to be realistic. The listing price is critical. Set it too high, and you may not find a buyer. Set it too low and you cheat yourself out of money. NEVER GO WITH THE HIGHEST BIDDER AND ALWAYS ASK HOW DID THEY ARRIVE AT THE PRICE AND VERIFY IT.

Appraisal
Regardless of what you originally paid for your home and the cost of improvements you have made, the price your home can command is what the market will bear at the time you decide to sell it. You may consider hiring an independent real estate appraiser. An appraiser has specialized training and experience. Don't rely on assessed valuations made for tax purposes. Such valuations may not be reliable indicators of value as these valuations are made by mass appraisal techniques.

Comparative market analysis
Whether or not you get an appraisal, a REALTOR® can develop a comparative market analysis. This analysis will describe homes in your area that have recently withdrawn from the market. The analysis may compare specific features of your home to others - the value of a corner lot, a city view, or an extra bedroom, for example. The analysis may also point out market fluctuations caused by the opening of a new school or business, for example, as well as long-term trends.

If you do not have a good idea, based on reliable data, of what the price your home can generate, you may decide to set a higher price thinking that if it doesn't sell at first, you can come down. However, if you set it too high, you may keep away buyers who are looking at comparable homes with lower prices. Lowering the price later sometimes gives your home a negative image. On the other hand, you don't want to set the price too low.
