In Phoenix there seems to be alot of confusion for homeowners with VA loans as to whether or not they can do a short sale. The answer is yes. I just recently assisted two homeowners, with VA loans, in the Greater Phoenix area, complete short sales. Those homeowners have now avoided foreclosure and they should be able to buy a home again in two years if they rebuild their credit during those two years.

I believe part of the confusion lies in the VA guarantee; homeowners think they have to pay that money back. In most cases the money does not have to be paid back; it is forgiven through the VA short sale process. However, a VA eligible borrower will not be able to use their VA eligibility to buy another home until any deficiency is paid back. But, there is nothing stopping that borrower from getting an FHA or conventional loan for the purchase of real estate after the two year period, providing the buyer has effectively rebuilt his or her credit.
A homeowner does need to prove a valid hardship, and a military transfer or deployment is a valid hardship if your home is worth less than what you owe on it and as a result, you cannot sell.
The best thing to do is simply give me a call and we will discuss your lending structure, hardship and home value, and then call your loan servicer to confirm required paperwork and eligibility for a short sale. You must ALWAYS be aware of ALL your options before committing to a strategy.
I explain to buyers all the time that buying the biggest and baddest is not the way to go either. The smaller the buyer pool the harder a home is to sell and to the ones that think they will never move again WRONG you will or someone will sell that home eventually. As I show buyers homes, I am constantly pointing out features that will, and will not, make it easier to sell in the future. I think it is critically important to consider resale, even as you are selecting the home you want to buy.
If you are considering a condominium, for example, it is  best to buy the model that has the features most in common with the other units in the development. You might be attracted to a 3 bedroom, 1 bath model, but remember, when you go to sell, that might not be the most popular model available if most of the others feature 2 bedrooms and 2 bathrooms (easier for roommates or to rent out a room).
If most of the townhouses in the neighborhood that you like are 3 bedroom, 2.5 bathrooms, then you might want to walk past the 2 master suites model (2 bedrooms, 2.5 baths). Why? It will not appeal to the greatest number of purchasers when you go to sell.
That neighborhood with the colonials will attract buyers who like the colonial style. You might be attracted to one of the few contemporaries in the neighborhood, because it is unique and different. Just keep in mind, that it might be harder to sell a contemporary in a neighborhood of colonials.
When it comes to buying a house, remember it is just as important to consider how easy the home will be to sell as it is to consider what you want to buy. While unique, different and special are great personality traits, they don't always translate into a quick and easy sale.

How is buying a home that is bank owned or managed different from other home purchases? Usually, when buying a home, you deal with a seller who lives in the home. On foreclosure or bank-owned homes, the bank has acquired the home through foreclosure, deed in lieu of foreclosure, or forfeiture.
Tips for buying a foreclosure:
Most foreclosure properties are managed by a bank or third party asset manager, which in turn gives the listing to a Real Estate Agent. Buying a foreclosure is a different process and can be very confusing, therefore make sure you have an experienced buyer's agent representing you and your best interest.

Once a foreclosure has gone to auction and failed to sell, it becomes a Real Estate Owned, or bank owned, property. Most homes do not sell at auction, most fail to even get any bids.
An REO property is the least likely of the foreclosure properties to represent a bargain, but it is also the least risky. The property can be fully inspected, any title issues can be found and dealt with, and the sale can be subject to a mortgage. REO properties also tend to be in better condition than other foreclosure properties.
Another thing to keep in mind when purchasing a foreclosure is that some states have a redemption period that allows the original owner to buy back the property by paying the remaining balance owed. You may be able to have this redemption period waived, so check the state laws on this topic before purchasing.
