Do you really need an attorney to buy or sell real estate in Westchester County? I was posed this very question by a first-time buyer recently. I asked Lisa Fantino, attorney, author, and friend, for her perspective.
I cringe each time a realtor tells me the seller or buyer is going to represent themselves in the sale or purchase of a home.  I'm a lawyer and I would NEVER represent myself in the biggest financial transaction of my life (not counting law school tuition payments!)  I know that we are all looking to cut back these days but why would you look … (6 comments)

Here in New York attorneys are an integral part of the transaction process. The following occurred this past Monday on a home I listed where an old deal resurfaced from when the home was listed with a prior agent.
I got a call from the attorney's office of the purchaser of my listing. I was told told that if I could deliver copies of some papers needed that they would give me their deposit check for my client's attorney to deposit. attorney issues: Pre-possession or Escrow? - 12/18/08 11:53 PM
After a rather arduous marketing effort, I have a listing under contract with a cash buyer who can close at any  time. The cash isn't his; a generous friend is holding a private mortgage. Even though my seller client bought the house only 2 years ago, we found out that the deck and downstairs bathroom do not have certificates of occupancy. It is only a formality, but those things have to be filed for and provided.
All parties have agreed to escrow funds so that we can close this week and ensure that the compliance issues will be handled. No big deal. … (4 comments)
