Extended and Expanded Tax Credit Expires 4/30/10

For prospective homebuyers who are on the fence about making a home purchase, the next few months represent a countdown of sorts as huge tax credits are about to expire. Here are important details for you to know:

Tax Credit for First-Time Homebuyers (FTHBs)
FTHBs (that is, people who have not owned a home within the last three years) may be eligible for the tax credit. The credit for FTHBs is 10% of the purchase price of the home, with a maximum available credit of $8,000. Single taxpayers and married couples filing a joint return may qualify for the full tax credit amount.

Tax Credit for Current Homeowners
The tax credit program now gives those who already own a residence some additional reasons to move to a new home. This incentive comes in the form of a tax credit of up to $6,500 for qualified purchasers who have owned and occupied a primary residence for a period of five consecutive years during the last eight years. Single taxpayers and married couples filing a joint return may qualify for the full tax credit amount.

What Are the New Deadlines?
In order to qualify for the credit, all contracts need to be in effect no later than April 30, 2010 and close no later than June 30, 2010. Those in the military do have some special extensions on the timelines available.

What's So Great About a "Tax Credit"?
The benefit of a tax credit is that it's a dollar-for-dollar benefit, rather than a "tax deduction", or reduction in a tax liability that would only save you $1,000 to $1,500 when all was said and done. So, if a first-time homebuyer who qualified for the entire benefit were to owe $8,000 in income taxes and would qualify for a tax credit of $8,000, she/he would owe nothing.

Better still, the tax credit is refundable, which means the homebuyer can receive a check for the credit if he or she has little or no income tax liability. For example, if a first-time homebuyer is eligible for a tax credit of $8,000 but is liable for $4,000 in income tax, she/he can still receive a check for the remaining $4,000!

Higher Income Caps
The amount of income someone can earn and qualify for the full amount of the credit has been increased. Single tax filers who earn up to $125,000 are eligible for the total credit amount. Those who earn more than this cap can receive a partial credit. However, single filers who earn $145,000 and above are ineligible. Joint filers who earn up to $225,000 are eligible for the total credit amount. Those who earn more than this cap can receive a partial credit. However, joint filers who earn $245,000 and above are ineligible.

Maximum Purchase Price
Qualifying buyers may purchase a property with a maximum sales price of $800,000.

It's also important to note another upcoming deadline as the Federal Reserve winds down a program that has been keeping home loan rates artificially low. The fact is that the lowest rates of 2009 were driven down to their attractive levels because of the Fed's Mortgage Backed Securities (MBS) purchase program, which the Fed once again emphasized in its January 27, 2010 Rate and Policy Statement will end on March 31, 2010. As the Fed's program winds down and ends, rates could rise over time since MBS will have less support from the Fed.

What is a Short Sale? A short sale means that the seller’s lender is accepting a discounted amount to release the excising mortgage. When dealing with a short sale, you are dealing with the Seller and the Lender. Both parties have to accept the offer.

Short sales don’t always mean that the seller has defaulted on the loan. As property values have declined, some houses are agreed to be sold as short sales because the value has dropped. The owners are over-encumbered, and owe more than the home is worth. So a bank’s “discounted” price, may bring the home’s value in line with what the current market value is- and not less. That ‘s why sometimes we see short sales and expect them to be a lot lower than the rest of the homes on the market - but a lot of times they are not.

If you have found a wonderful short sale property that you simply MUST have, call your agent and get a list of comparable sales. Make sure you are aware of the prices of PENDING sales as well. Short sales take an average of 2-3 months to close, and your pending sales market research, will become your comparable sales at time of closing.

Some short sales are priced very low and receive multiple offers. Price your offer closer to market value.

Make sure the property you want to purchase is represented by an agent that is savvy in short sale process. Your buyers agent cannot talk to the bank. The negotiation goes on between the sellers agent and the lender -not your agent and the lender.

Find out if the listing agent has received all of the qualifying paperwork; Sellers’ hardship letter, Tax returns, W-2’s payroll stubs and financial statements. These questions and preparations will help the process go a lot more quickly, and help you get into the house you want.

Foreclosure Solutions

The current U.S. housing market and national financial crisis has caused untold stress and heartache for many American families. Foreclosure is one of the most devastating financial challenges that a family can face and one that many times can be avoided. The options available to Stamford-area residents for foreclosure are many. Following is a brief explanation of these solutions, including their benefits and drawbacks:

Reinstatement
A reinstatement is the simplest solution for a foreclosure, however it is often the most difficult. The homeowner simply requests the total amount owed to the mortgage company to date and pays it. This solution does not require the lender's approval and will 'reinstate' a mortgage up to the day before the final foreclosure sale.

Benefit: Does not require the mortgage company or lender's approval.

Drawback: Requires that a homeowner be able to pay all back payments, fines and fees.

Forbearance or Repayment Plan
A forbearance or repayment plan involves the homeowner negotiating with the mortgage company to allow them to repay back payments over a period of time. The homeowner typically makes their current mortgage payment in addition to a portion of the back payments they owe.

Benefit: Allows the homeowner to make back payments over time.

Drawback: Requires that a homeowner be in a financial position to pay not only their current mortgage, but also a portion of the back payments owed. Some mortgage companies will require a homeowner to 'qualify' for forbearance.

Mortgage Modification
A mortgage modification involves the reduction of one of the following: the interest rate on the loan, the principal balance of the loan, the term of the loan, or any combination of these. These typically result in a lower payment to the homeowner and a more affordable mortgage.

Benefit: Reduces the payment a homeowner is required to make on a monthly basis and may reduce the principal balance of the loan

Drawback: Requires that a homeowner 'qualify' for the new payment and will often require full documentation. Lender has to be actively pursuing modifications.

Rent the Property
A homeowner who has a mortgage payment low enough that market rent will allow it to be paid, is able to convert their property to a rental and use the rental income to pay the mortgage.

Benefit: Allows homeowner to keep property indefinitely.

Drawback: The issues that can arise with a rental property are many, and rent often does not cover the full cost of property ownership and maintenance.

Deed in Lieu of Foreclosure
Also known as a 'friendly foreclosure', a deed in lieu allows the homeowner to return the property to the lender rather than go through the foreclosure process. Lender approval is required for this option, and the homeowner must also vacate the property.

Benefit: Many times in a successful deed in lieu, the lender will forego their right to a deficiency judgment.

Drawback: Requires that a homeowner vacate the property, and a deed in lieu may be reported to credit bureaus as a foreclosure.

Bankruptcy
Many have considered and marketed bankruptcy as a 'foreclosure solution,' but this is only true in some states and situations. If the homeowner has non-mortgage debts that cause a shortfall of paying their mortgage payments and a personal bankruptcy will eliminate these debts, this may be a viable solution.

Benefit: Does not require lender approval.

Drawback: If a homeowner cannot afford their mortgage payment, a bankruptcy will only stall—not stop—the foreclosure process. Bankruptcy can be costly, is damaging to credit scores, and can only be declared once every seven years.

Refinance
If a homeowner has sufficient equity in their property and their credit is still in good standing, they may be able to refinance their mortgage.

Benefit: In some cases, this will lower payments.

Drawback: In today's market, a refinance will almost always raise mortgage payments, and is an expensive process.

Servicemembers Civil Relief Act (military personnel only)
If a member of the military is experiencing financial distress due to deployment, and that person can show that their debt was entered into prior to deployment, they may qualify for relief under the Servicemembers Civil Relief Act. The American Bar Association has a network of attorneys that will work with servicemembers in relation to qualifying for this relief.

Benefit: If qualified, this will lower payments on all consumer debt in addition to mortgage payments.

Drawback: Must be active military to qualify.

Sell the Property
Homeowners with sufficient equity can list their property with a qualified agent that understands the foreclosure process in their area.

Benefit: Allows homeowner to avoid foreclosure and harvest some of their equity.

Drawback: In many cases today, homeowners do not have sufficient equity to sell their property without negotiating a short sale (see next solution).

Short Sale
If a homeowner owes more on their property than it is currently worth, then they can hire a qualified real estate agent to market and sell their property through the negotiation of a short sale with their lender. This typically requires the property to be on the market and the homeowner must have a financial hardship to qualify. Hardship can be simply defined as a material change in the financial stability of the homeowner between the date of the home purchase and the date of the short sale negotiation. Acceptable hardships include but are not limited to: mortgage payment increase, job loss, divorce, excessive debt, forced or unplanned relocation, and more.

Benefit: A short sale allows the homeowner to avoid foreclosure and salvage some of their credit rating. This also keeps foreclosure off the individual's public record, and in many cases will allow the homeowner to avoid a deficiency judgment. Borrower may qualify for another mortgage in as little as 24 months (as opposed to five years for a foreclosure).

Drawback: Short sales can be a trying process in which a homeowner is best served by contracting with a qualified real estate agent to guide the way.

The Georgia Sea Turtle Center on Jekyll Island, Georgia

The Georgia Sea Turtle Center designed for sea turtle rehabilitation, research and education on sea turtles opened in June 2007 on Jekyll Island, Georgia.

The Center is very much like an emergency room and rehabilitation center for injured and sick turtles in addition to scientific research. You get to see the various patients that are in rehabilitation at the Sea Turtle Center on Jekyll Island, Georgia and find out about their injuries and illnesses.

Freshwater turtles (like you find in ponds or in pet stores) have flat feet and webbed toes for swimming while a sea turtle's feet are flippers used for swimming. A freshwater turtle can move its neck into an S shape to put its head inside its shell while a sea turtle cannot.

One of the things you learn at the Georgia Sea Turtle Center on Jekyll Island, Georgia is the development of sea turtles from eggs all the way through adulthood. Sea turtles dig in the sand and bury their eggs. Several months later, the baby turtles crack out of the shell and stays hidden in the sand for several nights until all of the turtles are out of their shells. About 100 turtles start digging for the surface and emerge in the dark on the beach and race toward the sea. Many become victims to seabirds, crabs and other predators. Sometimes they head in the wrong direction toward the lights buildings behind dunes because they think they are headed into the light of the ocean's horizon. During certain times of the year, you can see the hatchings on beach walks sponsored by the Georgia Sea Turtle Center. The USDA Rural Housing Guaranteed and Direct Loan Programs are available in eligible portions of Glynn County and all of most of the surrounding counties. The Wall Street Journal's recent article on USDA housing allows for a good overview of this program that still allows a buyer to buy with no money down and with no private mortgage insurance.

The USDA Rural Housing Guaranteed and Direct Loan Programs have helped a lot of people in Georgia realize the dream of owning their own home. This is a basic overview of the loan programs:

502 Guaranteed Single Family Housing Program: Loans for families to purchase homes. The program is 100% financing, no down payment. All of these loans are for 30 years and the interest rate is currently around 5% fixed according to Garreth Thomas of Silverton Mortgage. The families must show repayment ability and have good credit. This program is for families to purchase homes but is not limited to first time home buyers. These loans are for families with higher income (moderate income families). These loans are actually made by a participating lender and have no loan limit.

Direct Single Family Loans are available at 4.625% Fixed Rates on 33 year terms. This program is also 100% financing and no down payment. If you don't have a credit score, alternative credit will be considered by the USDA.
