      <title>Credit crunch for Home Builders</title>
      <description>&lt;p&gt;The National Association of Home Builder's is stating that the banking industry is making it extremely difficult for builders of single-family homes to obtain credit for their financing needs.&amp;nbsp; Lack of funding will continue put a damper on new home sales recovery.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Lenders are cutting off loans for viable new housing projects and producing unnecessary foreclosures and losses&amp;nbsp;to builders of single-family homes.&lt;/p&gt;
&lt;p&gt;Even with the extension of&amp;nbsp;the $8,000 first-time home buyer tax credit, the banking industry credit crunch&amp;nbsp;threaten to halt any positive developments that the&amp;nbsp;housing market in coming months.&amp;nbsp; Single-family home builders who build several homes a year are finding that it is impossible to obtain loans, even thou they have been in good standing prior to this newly created credit crunch.&amp;nbsp; In effect, putting these home builders out of business.&lt;/p&gt;
&lt;p&gt;A majority of home builders&amp;nbsp;have stated that the availability of credit for single-family construction loans worsened in the second quarter of 2009 and looks as if it will&amp;nbsp;continue on the downward spiral for the&amp;nbsp;upcoming months.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;A majority of new home builders stated that construction of single-family project are being put on hold until such time as the banking industry changes the deteriorating credit conditions being imposed by the banks.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;There seems to be a conflict of who is responsible for the tightening of credit to home builders.&amp;nbsp; The federal banking regulators state that they haven't instructed banks to stop making loans or to tighten the requirements.&amp;nbsp; The banks state that they are following the guideline set by the federal banking regulators.&amp;nbsp; A catch 22 situation.&lt;/p&gt;
&lt;p&gt;The National Association of Home Buildersrs&amp;nbsp;believe that regulators and lenders should provide more meaningful rules and processes which would provide&amp;nbsp;residential construction borrowers who have loans in good standing by providing flexibility on re-appraisals, loan modifications and perhaps more leewayon loans to give builders time to complete and sell their inventory.&amp;nbsp;&lt;/p&gt;</description>

&lt;p&gt;&lt;strong&gt;&amp;nbsp;&amp;nbsp;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;President Obama recently signed an expanded version of the $8,000 first-time homebuyer tax credit that was set to expire on November 30.&amp;nbsp;&quot;The new version of the tax credit has the potential to stimulate the housing market even more than the old version due to the fact that more people will qualify under the new rules,&quot; said Gibran Nicholas, Chairman of the CMPS Institute, an organization that certifies mortgage bankers and brokers. &quot;Although the tax credit remains at $8,000 for homebuyers that have not owned a primary residence in the last three years, it has been expanded to include a $6,500 tax credit for homebuyers that have lived in their current primary residence for at least five consecutive years out of the past eight years. Under the old rules, move-up homebuyers did not qualify.&quot; Consider these three examples:&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Example 1:&lt;/strong&gt;&lt;br /&gt;Jane purchased a home in 2002, lived there for 5 years as her primary home, moved out in 2007, and turned that home into a rental property. If Jane decides to buy a new primary residence today, she would qualify for the $6,500 tax credit based on the fact that she lived in the same residence as her primary home for at least five consecutive years out of the past eight.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Example 2:&lt;/strong&gt;&lt;br /&gt;Harry purchased a home in 2004, and lived there for the past 5 years as his primary home. If Harry decides to buy a new primary residence today, he would qualify for the $6,500 tax credit based on the fact that he lived in the same residence as his primary home for at least five consecutive years out of the past eight.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Example 3:&lt;/strong&gt;&lt;br /&gt;Nicole purchased a home in 2006, and lived there for the past 3 years as her primary home. If Nicole decides to buy a new primary residence today, she would not qualify for the $6,500 tax credit based on the fact that she did not live in the same residence as her primary home for at least five consecutive years out of the past eight.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The tax credit applies to homes purchased for less than $800,000 before May 1, 2010. &quot;If you sign a binding contract to purchase a home before May 1st, you would need to close on the transaction before July 1, 2010,&quot; Nicholas said. &quot;It works kind of like a gift certificate that can be redeemed for cash. You simply file a form with the IRS right after you buy your home, and the IRS will send you a check for the full amount of your credit.&quot;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The income limitation for single tax payers went up from $75,000 under the old rules to $125,000 under the new rules. For married tax payers, the income limitation went up from $150,000 to $225,000. &quot;This means that more people will qualify for the credit - especially in parts of the country with higher costs of living,&quot; Nicholas said. &quot;This should help stimulate parts of the housing market that may not have been impacted by the old version of the credit.&quot;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;There are many creative ways of structuring your home purchase transaction in ways that maximize the benefits of the credit. Here are a few examples:&amp;nbsp;&lt;/p&gt;
&lt;p&gt;-The credit applies to 1-4 unit homes as long as you live in one of the units as your primary residence - you could live in one unit and rent out the others&lt;/p&gt;
&lt;p&gt;-If two unmarried individuals buy a home, and only one of the individuals qualifies for the credit based on their income or past home ownership status, the individual who qualifies for the credit can claim the full credit. (Note: In the case of married couples, both spouses must qualify for the credit).&lt;/p&gt;
&lt;p&gt;-The credit applies even if you have co-signers on your mortgage loan&amp;nbsp;&lt;/p&gt;

      <description>&lt;p&gt;CNN said that the&amp;nbsp;House of Representatives passed legislation today to extend and expand the current first-time homebuyer tax credit.&amp;nbsp; The House action follows the Senate's approval on Wednesday and we anticipate President Obama will sign the bill in very short order.&lt;br /&gt;&lt;br /&gt;The bill extends the current $8,000 first time homebuyer tax credit (which was due to expire at the end of November) through April, 2010.&amp;nbsp; It also includes a tax credit of up to $6,500 for qualified move up buyers and increases the borrower income limits for both credits to $125,000 for individuals and $225,000 for couples.&amp;nbsp;&amp;nbsp;&lt;br /&gt;&lt;br /&gt;Homebuyers will qualify for the full credit as long as they have entered a binding contract by April 30, 2010 and they close the transaction by June 30, 2009.&amp;nbsp; The tax credit is limited to homes with a purchase price of $800,000 and below..&amp;nbsp; The bill also includes anti-fraud language that gives the IRS the authority to do greater oversight during the processing of the return.&lt;br /&gt;&lt;br /&gt;In addition, the legislation waives the recapture provision for members of the armed forces who are called on extended duty.&amp;nbsp; These members of our military and uniformed services, who are out of the country for at least 90 days, will also be eligible to use the tax credit upon their return through April 30, 2011.&lt;br /&gt;&lt;br /&gt;The extension and expansion of this tax credit is a major legislative victory for MBA and its single family members, and culminates months of MBA advocacy activity (along with some allied trade associations) working to educate policymakers&amp;nbsp; on the critical role the credit has played in stabilizing the housing and mortgage markets&lt;/p&gt;

      <description>&lt;p&gt;Mixed Messages For Real Estate Buyers&lt;/p&gt;&lt;p&gt;&amp;nbsp;&amp;quot;It&amp;#39;s a great time to buy,&amp;quot; says the National Association of Realtors (NAR). Alternatively, says NAR, existing home prices in February 2007 were down 1.3 percent when compared with a year earlier. &lt;/p&gt;&lt;p&gt;So can this really be a great time to buy if home values are falling? The answer is yes. &lt;/p&gt;&lt;p&gt;Increased real estate ownership is a national goal which has produced helpful and useful national policies. For instance, we encourage homeownership by tilting the tax system to favor owners. As a property owner you can write off property taxes, you can deduct mortgage interest in most cases and when you sell you can shelter profits of up to $500,000 if married and $250,000 if single from federal taxes. &lt;/p&gt;&lt;p&gt;We do these things because we believe that ownership gives people a greater stake in local communities and because owning a home affords individuals a certain ego, status and financial standing. We also encourage ownership for a very simple reason: Money. In addition to all the good qualities associated with ownership, each real estate transaction generates substantial transfer taxes, brokerage commissions, loan fees, insurance charges and legal fees. &lt;/p&gt;&lt;p&gt;As to renting, not so much. There are no transfer taxes to be paid when someone leases, no closings, no new mortgages, few if any legal fees and only small real estate commissions. &lt;/p&gt;&lt;p&gt;And yet as a society we need renters and we recognize that not everyone benefits from homeownership. We need renters because without &amp;#39;em investment real estate would make little sense. Also, not everyone should buy, especially individuals who will be short-term residents in a given community; those with small, declining or uncertain incomes and, often, individuals who live in areas where both jobs and people are leaving. &lt;/p&gt;&lt;p&gt;Real estate ownership is not a good short-term option because of the costs to acquire and sell property, but it routinely makes sense for those who expect to hold for a lengthy period, say eight to ten years. &lt;/p&gt;&lt;p&gt;NAR says it&amp;#39;s a great time to buy or sell because interest rates are near historic lows, &amp;quot;prices overall have stabilized,&amp;quot; there&amp;#39;s a positive outlook according to Alan Greenspan and during the past decade real estate has been a great investment. &lt;/p&gt;&lt;p&gt;&amp;quot;The national median price of homes bought ten years ago has increased 88 percent. The number of US households is expected to increase 15 percent during the next decade, creating a continued high demand for housing,&amp;quot; says NAR. &lt;/p&gt;&lt;p&gt;The points made by NAR are all true -- and each deserves to be examined with some care. &lt;/p&gt;&lt;p&gt;&lt;br /&gt;Interest rates are near historic lows and that means borrowers should grab fixed-rate loans rather than elastic ARMs, a form of financing where rates can rise and the advantage of low monthly costs can be lost. &lt;/p&gt;&lt;p&gt;To say that prices have &amp;quot;stabilized&amp;quot; is a good example of creative wordsmithing. This is a cute expression, but irrelevant. The important issue to check real estate trends with local brokers because some communities are seeing price increases, some are seeing declines and what happens nationwide may not reflect local market activity. &lt;/p&gt;&lt;p&gt;Alan Greenspan, the former chairman of the Federal Reserve, is quoted by NAR as saying that &amp;quot;most of the negatives in housing are probably behind us. The fourth quarter should be reasonably good, certainly better than the third quarter.&amp;quot; The thoughts of the Chairman Greenspan are no doubt interesting, but quarterly results are for Wall Street and not homeowners. The real question is where local values are headed in five or ten years, something unknown. &lt;/p&gt;&lt;p&gt;Price increases during the past decade have plainly benefited most owners in most communities. However, as they say on Wall Street, past performance does not guarantee future results. What happened before does not tell us what will happen tomorrow. One way or another, we just do not know. &lt;br /&gt;The view here, for whatever it&amp;#39;s worth, is a little different: People ought to buy real estate because it&amp;#39;s an investment that provides shelter, tax breaks, amortizing loans, the potential for appreciation and encourages the joy of individualism, having something of your own to shape and develop as you wish -- an option unavailable to tenants. &lt;/p&gt;</description>
