NAR estimates as many as 180,000 home buyers who were under contract by April 30 may miss the June 30 closing deadline. Patterns Among Strategic Defaulters Anyone who has not heard the phrase "strategic default" probably is not paying much attention to Real Estate and Lending. However, this is a hot topic, to say the least. As I read an article related to the peak in strategic defaults http://www.dsnews.com/articles/phenomenon-of-strategic-defaults-may-have-peaked-experian-2010-06-28 what caught my attention was the patterns noted among strategic defaulters. These are the types of patterns that servicers will be apt to keep an eye out for in determining if a borrower is truly a "hardship case" or a "strategic default."

New California Legislation Seeks To Help Prevent Avoidable Foreclosure Measures to create a system to prevent avoidable foreclosures are being put forth in the California State Senate. Senate Bill (SB) 1275 requires mortgage Servicers to to the following: 1. Notify borrowers of a right to seek options that would avoid foreclosure 2. Attach an application for a loan modification or other alternatives before issuing a notice of default (NOD) 3. Before filing an NOD, Servicers must evaluate a borrower who submits a written request for a loan modification 4. If a borrower is denied a loan modification then a separate letter (2 comments)
