Negotiating Inspection Repairs: Don't Overwhelm the Sellers!

This article is so good I had to share. It will be beneficial for both buyers and sellers in Santa Monica's current real estate market. Especially since this is a common problem, and can be a distraction from the buyer's and seller's common goal. Best to keep the big picture in mind when negotiating repairs, and this blog is helpful for just that.

There have been more than a few transactions when my sellers were faced with an inspection repair list that took up three pages of single spaced, fine print, with demands that seemed to amount to rebuilding the entire home - and many of these homes were in more than good condition to begin with. The sellers, more often than not, went into overwhelm and refused to do anything.

Who needs these buyers anyway? Especially in this market.

All home inspectors have their styles, as do the buyer brokers who help their clients craft their to do list for the sellers.

Some focus on the important stuff - the major systems and appliances. Others note every nick in the paint, squeaky door hinge, burnt out light bulb and empty toilet paper holder.

My advice to my buyers is to stick to the important issues that you want the sellers to address.

If the issue is something that the sellers disclosed to you before you made the offer, then you should have factored it into the price and terms of the contract. If it was not disclosed, or even hidden, then asking the sellers to fix it is completely reasonable.

I put the electrical system at the very top of my list, because a failure could create total havoc.

Any item that could present a serious health issue also makes the list.

Plumbing can be important or not. Asking sellers to have leaks and drips fixed is usually reasonable, but I suggest my buyers leave off this type of repair for a bath or kitchen they plan to rip out and renovate.

I consider it to be rude to put anything on the punch list that can be fixed with a bottle of WD-40.

I've started to carry a test light bulb to inspections so we can tell if it's a bulb or the fixture.

Often, the request for inspection repairs sets the tone for the rest of the transaction. If you beat up on the sellers at this point, they will not look kindly on other requests that you might have to make of them down the line. What if something happens and you need an extension on the appraisal or financing deadlines? What if you have to come back and ask for a pre-settlement occupancy agreement?

And in many cases, unreasonable requests raise questions about good faith. Sometimes, especially if the buyers "won" a bidding war, they may appear to be trying to renegotiate the contract. Other times, the buyers may be sending a message that they want out of the deal. Even if you were to meet all of their demands, would they try to find another way to avoid buying?

I wanted to share this amazing workshop with all my female friends, especially Realtor's. Since we are constantly meeting and around new people every day. I have found these skills invaluable for my mind-body connection to relieve stress. Unfortunately, I've needed it a few times when people have tried to grab me while out showing homes. One time in particular a man reached out to grab me. I looked at him from the corner of my eye and as I did this he pulled his hand back. The difference was that I used the skills from this workshop and didn't panic inside. I instead signaled to him through body language and energy that I could take care of myself. My #1 Fear About The Silicon Beach Real Estate Market Shift

My #1 fear about the Silicon Beach real estate market shift from commercial to residential is listings. As you may know Los Angeles, especially the Westside, is being name Silicon Beach. The Los Angeles tech scene continues to grow. Large branded companies, and start ups are taking foot in Silicon Beach. Commercial space is getting more expensive, spaces like ROC are serving start ups who choose not to plunk down the cash in an expensive lease, and smartly are leading with revenue. As a result, residential real estate is heating up.

Back to my #1 fear, a shortage of listings.

Right now, we have more buyers than seller's in the Silicon Beach areas of Santa Monica, Venice and Playa Vista.

Every listing we place on the market for sale, at a market price, is greeted with dozens of showings and at least 5 offers. My #1 fear is that seller's will decide to hold on to their property in hopes the real estate market will continue to climb OR will choose to strike while the iron is hot and flood the market with too much inventory. Finding the balance starts with understanding and narrowing what is happening in your neighborhood, your street, and your building.

The seller of our listing in Playa Vista's Metro condo building had their choice of 6 offers, and potentially more.

They chose one offer, and have 5 backup offers. Now is the opportunity for another seller in a similar price point to come on the market. A motivated seller in Playa Vista's Metro building, would have at least 5 opportunities for a real qualified buyer to offer to purchase their home.

I realize this doesn't sound much like a fear. It is a fear, I fear that I will have more buyer's that can't get their offer accepted because their are 5 others competing. I fear that every listing and seller I serve in the Silicon Beach real estate market, and increased pressure to manage the stress of agents, non-stop phone calls, texts, and emails about getting into the property, details about what the seller is looking for in their offer...and having to be the bearer of bad news, "I'm sorry, your offer did not get accepted."

It is my passion to represent sellers of Silicon Beach Real Estate.

This is a good fear, and a good problem for seller's to have right now. I'm not complaining, but sharing my fear with you. My #1 fear about the Silicon Beach real estate market shift is lack of inventory, and it's happening right now. Los Angeles has a network of secret stairs. Long forgotten stairways once used to create access the beach, and parts of the city not easily reached on foot. Charles Fleming wrote the book on the Los Angeles' secret stairway. His story is inspiring on how he used these walks to improve his well-being.

Back to the walk itself. It's a beauty, and not as busy as the work out/gym stairs found on Adelaide. Castellammare is perched above PCH, is just North of Sunset and neighbor to The Getty Villa. How Is the California Real Estate Market?

The California real estate is on the upswing. February's numbers are in, and we are nearing the end of the first quarter for 2013. Low inventory, and low interest rates are driving the local market here in Santa Monica.

Another factor pushing value and demand upward is L.A.'s tech community affectionately named Silicon Beach. Commercial space is in demand, therefore the talent and executives are seeking homes and rentals.

According to California Association of Realtors, February Home Sales Report:

“The demand for homes remains solid, but a shortage of homes for sale, especially in the lower-priced segments, is negatively impacting housing sales,” said C.A.R. President Don Faught. “Sales of homes priced above $500,000 continue to be strong, posting nearly 31 percent higher than a year ago, while homes priced below $300,000 were down 27 percent from last February due to fewer available homes for sale.”

California Association of Realtor's Cheif Economist, Leslie Appleton-Young, confirms the timeless economic law of supply & demand stating: “With housing inventory dropping nearly 39 percent from a year ago, supply constraints continued to propel strong gains in the median price, but also intensified market competition. With an imbalance between supply and demand, home buyers have been fiercely competing with each other. More than half of home sales are receiving multiple offers, with homes getting an average of four to five offers, and some even more.”

Seller's have been waiting for values to increase, and it's happening. Buyer's are hoping the traditional selling season for Spring and Summer bring more inventory. The question is will we continue to seek multiple offers, and bidding wars? In my humble opinion, seller's who price their home competitively will see multiple offers. And buyer's who understand the market, have a Realtor in their corner, and have their funds and financing in place will have the winning offer.

I'm Considering A Short Sale In Santa Monica, CA. What Info Does My Lender Need?

The larger banks, Bank of America, Wells Fargo, Chase, etc., want your financials. Below is a list of required items:

* 3rd Party Authorization

* Hardship Letter

* Financial Worksheet

* Proof of Income, past 30 days

* Tax Returns, Federal all pages, 2 most recent years

* Banks statements, 2 most recent months

* Listing Agreement

* Purchase Agreement

* HUD-1

This is enough info to get the short sale initiated with the short sale lender. They will begin the review process for the short sale. They may ask for your income and bank statements each month until closing. Each lender is different due to their investor guideline's for each individual loan.

Extra, special attention should be given when writing the hardship letter. This is a working document that is used by all parties when doing the short sale similar to a business plan. I just can't stress how important these letters are to explain your situation. We spend quite a bit of time in the beginning with our clients to create a solid hardship letter. That's one of the reasons we have been so successful in getting our short sales approved!

Short Sale Question: "If I Do A Short Sale Can I Buy Again?" Santa Monica, CA

A lot of homewoners are concerend that if they do a short sale they can never buy again. It's a valid question since most homeowners are not making their mortgage payments when doing a short sale. They wonder if the banks will ever lend to them again.

The answer is, "Yes!" you can buy again. Let me share with your our experience and what our clients are doing after the short sale. We started doing short sales in late 2007. At that time homeowner's would have to wait 6 months before buying again. Kind of odd, right? Only 6 months. We had clients that would do a short sale, and live with family for a few months while looking for another home. However, now the wait period is 22-24 months before a bank will lend to the homeowner again. We start working with our clients around month 20 or 21 to get prepared for the loan. They receive competative rates and loan choices. Their mortgage is much less than the previous one. Even when they decide to get a 30 year fixed rate instead of an adjustable like before.

Silicon Beach, as the white-hot start up market in Santa Monica is referred to, is exploding with activity. Albeit the second fiddle to its well known uncle up north, Silicon Valley with a number of high-tech success stories to lay claim such as Google, Paypal, and Logitech, the Silicon Beach market is a fervor of action from all sides of the start up equation. Several components that make up and set the stage for a vibrant start up market to develop have to be present and strong, sort of like a perfect storm! Talent, Capital, Education and acceptance of the alternative are all conditions that have to exist and surge together in order to foster a dynamic start up environment.

Is this happening in Silicon Beach? Well let's see! Talent and Education - USC, UCLA, Pepperdine, in our immediate market, have undergraduate and graduate programs that focus on start up or entrepreneurial education. They are becoming the most popular programs for students disillusioned by the bleak stories of their predecessors for the lack of worthy employment opportunities post graduation. What’s Not Selling In The Silicon Beach Area Of Venice, CA 90291?

It’s a great market for Venice Beach and is heating up with each new listing and closed sale. Properties are selling quickly, within the first two weeks, and sometimes over night. We have low inventory. But is anything that comes on the market selling like it did in the last hot market? What is NOT selling?

Here is a list of properties in the Silicon Beach Area of Venice, CA 90291 that have been on the market for 60 days or more:

The reasons for not selling sooner are luxury and high price like the listing at 57 Windward Ave for $11.9M with 13,796 sq ft.

Another property on 745 Millwood Ave, has 3 charming bungalows and is well taken care of cosmetically and structurally. However, the price tag of $5.4M doesn’t work.

ACCESS AND VISUAL CONNECTIONS

Along its central axis, a single path connects entry plazas at the Park’s east and west edges, uniting it in a single perspective. Echoing the historic Howard Hughes runway which once crossed the site, this trajectory is further defined by elongated stripes of color and light, visible not only within the Park but also to aircraft landing at the nearby Los Angeles International Airport. Long allées of jacarandas crisscross the Park from east to west, blooming in the spring and early summer to create strong unifying bands of color. The Park is akin to a campus, its tightly integrated network of pathways and programs open and unscripted in access and use.

AN ICONIC BANDSHELL

Beyond the courts, a large amphitheater slopes to the north, shaping sight lines to a Bandshell at the Park’s center. Rising above the park, the Bandshell’s circular iconography is defined by three rings that arc above the pedestrian paths, extending trajectories of movement from the adjacent landscape into its dynamic form. The three steel hoops structure the shell’s envelope, a pleated membrane that floats above the landscape, its glowing form visible throughout the Park and beyond as day gives way to night. The Bandshell incorporates a flexible lighting grid and an expansive stage which can support a wide range of performances, including theatrical productions, outdoor movies, and concert events." Big Mango Cafe, Silicon Beach Eats

Today was one of those days where the phone is ringing and the emails are collecting more and more every minute. It happens when you have 2 closings in a week. You get emails from buyers, sellers, escrow, title, lenders and anyone else that thinks they are involved.

On top of that the painters decided to come today to do touch up’s from wear and tear. I talked to them 2 weeks ago. They had time today! Today! When we have a really busy morning and week.

I didn’t have time make lunch and have been working all morning. Luckily there is this new cafe in Playa Vista in the middle of the Silicon Beach offices. It's called Big Mango Cafe. I just love their Chinese Chicken Salads. They have them made and ready to go. Their meat is Boar’s Head white shredded chicken. It’s really healthy and tasty. Made my afternoon a little better then the morning.

Culver City is quickly fueling the appeal for great food choices. With the exception of Google, most tech companies do not have an all-inclusive campus.

Residential communities of Silicon Beach are Santa Monica, Venice Beach, West Los Angeles, Brentwood, Marina del Rey, Mar Vista, Culver City, Playa Vista, Westchester, and El Segundo.
