The Sea Colony I Townhomes in Santa Monica, CA offer ocean views and the ultimate So Cal lifestyle. They are in the prime location literally steps to Santa Monica's, Ocean Park Beach.

There are 3 different condo buildings all within walking distance of each other. Two of the three buildings are condo's. This building is different than the other two since they are townhomes. Sea Colony I in Santa Monica, CA was built in 1979, as unique townhomes that have their own private street, named Sea Colony Drive, and private 2 car garage.

Just listed is a townhome on the second row, 3 levels with ocean views on top floor, 2 bedrooms, 3 baths, 1,855 square feet, and the list price is $1,695,000. I previewed this last week for my client. It’s in great condition, really clean and a blank canvas ready for a new owner’s personal touch. They just replaced the carpeting, smoothed the cottage cheese ceilings and did a fresh coat of paint. Life Celebration! Loretta Brown, You Are Missed.

Life Celebration!

Loretta Brown had just joined our office in Prudential Santa Monica as the new Training Director. I was so happy for her to be at our office and training the newbies.

Our office is low key. During her first week she did training's You could hear her voice loud througout the office even when she was in the training room. This was quite an adjustment for our office. Her response was, “Yes, I’m known for my voice.” I just loved her directness and friendly positive attitude.

Her sudden passing was a total shock. She was not ill. I had spent time with her in the office Friday. Other agents had spoken with her over the weekend. She was found Monday morning in her bed.

We thank you for your time here with us. Although I’m really sad, will find a way to celebrate your life.

We get this question all the time, "What is a Berber Carpet?" The flooring gal, Debbie has a much better answer than we do. Read below for all the info you could want on berber carpet. Kristine :)

There seems to be a lot of confusion about the term Berber carpets. Part of the reason for this is modern use of the term berber vs. traditional berbers.

Modern Berber Carpets

Modern berber carpets are distinguished by a looped carpet construction, and they usually contain small flecks of darker or lighter shades vs. the background color. The size of the loops can vary. They typically come in neutral colors with no pattern (or a random pattern) and they tend to be less expensive and durable. They are less soft vs. a traditional cut pile or texture carpet you might put in a bedroom. As a result, they are popular for basements, family rooms and steps.

Traditional Berber Carpets

Berber carpets get their name from Traditional Berbers which are traditional hand-woven carpets made by the Berber people of North Africa. They use a distinct knot (which is similar to the knot of modern berbers), but they are brightly colored with designs. Traditional Berber carpets are completely different from the modern mass produced berber carpets usually known in the US and Canada. They are much more sophisticated and are made of natural materials while most modern berbers are made with synthetic materials

Berber carpet fibers

Just like other types of carpet, the quality of berber carpets differ based on the fiber used (the higher the quality, the higher the cost). Wools and nylons are better quality, but they are less common, as they cost more. Many berbers are a blend of fibers. The most common carpet fibers for berber are:

1. Wool berbers – highest quality, highest cost, last the longest

2. Nylon berbers – good quality, mid price

3. Olefin berbers (or polypropylene) – lower quality, lower price (also comes in PET/polyester). Most common type.

Benefits of berber carpet

Durable – they can often take a lot of wear and tear on heavy traffic areas. The loop construction gives the fibers more support vs. a cut carpet which will crush more both from furniture and foot traffic

Hide dirt better – most have flecks of color which help hide dirt and stains a bit better vs a solid color carpet. Note: it’s still advisable to vacuum regularly and use a professional carpet cleaner annually

Tend to absorb less moisture, bacteria and allergens – there is less room for the carpet to absorb these, so they are generally better for areas that have minor moisture (e.g. basements) vs. a plush cut carpet and are relatively better for those with allergies and allergens.

Often, they are less expensive (but this can vary based on the quality of the fiber and weave)

Drawbacks to berber carpet

They are a bit more challenging to install, even by a seasoned pro, and show seams easily. It’s extra important to have a reputable carpet store install berber carpets and optimize seam placement to show the least wear.

Cheaper berbers can unravel, especially if the loops get caught in heels or pet claws.

Can be difficult to clean if dirt does get lodged in the fibers, and it may need dry cleaning or specialized service for deep cleaning.

Are Homeowners Relived Of All Debt Obligations When Doing A Short Sale, Series 8

If your home is considered residential 1-4 units, then yes, according to CAR legal series you are relieved of debt obligations. However, be aware, that there are many changes happening on the local and national level each month. They are in favor of the homeowner's doing short sales. Make sure you hire a seasoned short sale agent and potentially speak to legal counsel. A good short sale agent will have these resources for you. See below for exact info, part of an on-going series:

II. Effect on Borrowers of Short Sales

Q 8. Is the seller in a short sale relieved of all debt obligations owed to the lender?

A In general, as long as the property is a residential 1 to 4, then yes a seller in a short sale will be relieved of all debt obligations owed to the lender (see series 4).

However, for all other types of property the answer is more nuanced. Each lender is different, but some have borrowers sign a short sale agreement that releases the lien on the property without cancelling the promissory note. This allows a short sale of the property to proceed while at least potentially leaving the borrower responsible for any deficiencies on the loan. While there are no cases directly on point yet, it would appear that the anti-deficiencies statute that protects borrowers in foreclosures (Cal. Code Civ. Proc. § 580d.) do not apply when the property is sold as in a short sale.

STOP PAYING YOUR MORTGAGE? – FANNIE MAE SAYS YES!

Stop paying your mortgage in Santa Monica?

It must be your decision, and be sure to find out if your lender will consider a short sale on your home in Santa Monica prior to. Consult with your Realtor, call your lender, and an attorney. Another good person to have in your arsenal, is a credit repair specialist.

Via Richard Zaretsky, Florida Real Estate Attorney (Richard P. Zaretsky P.A. - Board Certified Real Estate Atty):

In a gradual and interesting development, Fannie Mae servicers have determined that short sale applicants that are not at least 60 days late WHEN THEIR SHORT SALE APPLICATION (CONTRACT) IS SUBMITTED will be rejected without review of the short sale contract. This is quite different from previous decisions by the loan servicers, whereas the loan (if Fannie Mae is the investor – see Fannie Mae Lookup Tool for your mortgage) needed to be late by 30 days before short sale approval. [Note – the 30 day requirement was later "changed" to 60 days and sometimes even 90 days.]

The February 22, 2012 version of the Loan Workout Hierarchy for Fannie Mae Conventional Loans gives a good indication of the reasons for the change. A borrower should understand however that the promulgated rules of Fannie Mae and their interpretation by the loan servicer that is the go-between and “appears” to be your lender, may be dramatically different than the language you see in the Fannie Mae guidelines.

Fannie Mae guidelines regarding loan modifications and short sales have changed over the years, but more than the Fannie Mae changes of guidelines, the servicer’s interpretations of the guidelines has been a more constant frustration to homeowners seeking financial relief. We have often battled with servicer “interpretation” (I use the word in its loosest term) where the written guideline has little semblance to the servicer application of the guideline.

The government cannot change your mortgage contract with the bank and the bank cannot change it without your agreement. It is important for homeowners to understand that the Fannie Mae guidelines, like the various “Obama Plans” are NOT LAWS. They are guidelines or voluntary programs. You must understand that the government cannot change your contract with the lender by mandate. (Remember the United States Constitution – there shall be no law made ex post facto (that applies to an earlier date) and there shall be no “taking” by the government without just compensation).

There are several reasons that servicers interpret the Fannie Mae guidelines as requiring a late payment status. One of them is that loan workouts through modification or provide various amounts of compensation to the loan servicer if the loan is late. These fees are called “incentive fees” and under current programs in effect, those fees are up to $1600 provided the loan is less than 120 days late. The servicers interpret this to mean that the loan must be late (not current) but it seems the “must be 60 days late” is an arbitrary number created by the loan servicer regarding short sales. It is interesting to note that under new “Obama Plans” currently being worked out, the amount of the incentives will be increasing. Those new guidelines are to go into effect sometime in May 2012.

This development changes the theoretical applications that I noted in my earlier article SHOULD I PAY MY MORTGAGE? WHEN SHOULD I STOP PAYING MY MORTGAGE?

This only goes to prove that the short sale and loan modification process rules and procedures are a dynamic being pushed and pulled by both the loan servicers (without little if any oversight by any government or regulatory entity) and the investors (including but not limited to Fannie Mae and Freddie Mac). With such multiple influences upon the short sale process and loan modification procedures, it is no wonder that no one can seem to keep up with the “rule de jur” – not the attorneys, the borrowers nor the lender employees that are supposed to be uniformly applying these “rules”.

The Village, breaking gound in Santa Monica, CA is wonderful news and if you're a local you've been waiting for this news for a long time. The Village will be one of Santa Monica's largest mixed-use projects and will break ground in Santa Monica, CA. It's located near the Santa Monica Civic Center, adjacent to Rand Corporation, and the Third Street Promenade.

The area has been fenced of for years, and after 6 years of negotiations between the developer Related California and City of Santa Monica. The Village will break ground into a mixture of condominiums, apartments, parks, shops, and restaurants. Hopefully, we will see the final result before another 6 years have passed. This North of Wilshire condo has had an offer for the past few weeks, and we knew the foreclosure date was approaching. In the past, an offer submitted to Bank of America's Equator system will stop a foreclosure date within a few days. Not true. We have been diligently working to stop this foreclosure every day, utilizing all of our channels and contacts with Bank of America.

Last night, we still did not have confirmation the foreclosure sale for 11 am today was still not postponed. After several emails and phone calls to Bank of America, and a few minutes before 11 am; the sale date is postponed for another 30 days. What a relief. Since we had an offer in a couple weeks ago we were confident it would be postponed. And now we can begin obtaining short sale approval.

Adele, "Rolling In The Deep", Grammy's 2012 Performance, Music Mondays

It was a bittersweet Grammy's. Adele won 5 Grammy's, including album of the year, record of the year and song of the year! Her acceptance speech's were not scripted and revealed her authenticity. When she won best record it was hilarious. She said, "I'm sure a lot of you can relate. I wrote this record hurting from a rubbish relationship!" I would like to know who that person is...

After Adele won all of the Grammy's. There was a Whitney Houston tribute from Jennifer Hudson. I don't know how she pulled off the performance with out crying! I know I was just listening to her.

In Memory Of Whitney Houston, My Favorite Song...

It's beyond sad that another talented singer has passed away. She was found in her hotel room and died of unknown causes. I hope she finally found peace. What a talented singer. I remember watching her videos on MTV. My favorite video was, "I Wanna Dance With Somebody". She had pretty curly hair, nice big smile, pink lipstick, pink dress and streamers. It was so cute and fun. I'm posting it below in memory of her full life, 8/9/63-2/11/12.

In Praise of Pre-Inspections for SELLERS

If you're planning on selling your home in Santa Monica, and don't want any surprises when the buyer brings their inspector; a pre-inspection is the way to go. I'd say it saves you money, and potentially makes you money. Just as important as staging.

Dear Home Seller,

I know that when it is time to list your home you will have many opportunities to spend money on a property you are ready to leave behind. In fact it seems that by the time you call a real estate agent you're mentally already gone. Then why would a real estate professional add one more thing to buy, like a home inspection, to you're 'to do' list ?

Now, if you are the one in a million, disciplined, natural born handyman of a homeowner with awesome building maintenance skills you may choose not to read on. However, if you are the normal, unskilled, busy, procrastinator home owner and you haven't read (and understood) an appliance manual lately or been on a ladder, or under a house lately or ever, you may want to think about a pre-inspection of the property you are about to list for sale.

At almost every listing appointment the Seller assures me that his home is is great shape. My response is usually, "Really, how do you know your home is in great shape? Have you been on the roof in the last few weeks? Do you know what a good roof looks like? Have you been in the attic lately? Have you cleaned the gutters in the last few months? Have you replaced the furnace filters? Do you own spare furnace filters?"

I humbly submit that the fact of the matter is that in the same way that driving a car doesn't qualify me to work on one, owning a home doesn't mean that you know what kind of shape your house is really in.

I know, OUCH! The truth stings sometimes. But if your goal is to sell, you may need to let an expert (like the expert the potential buyers will hire) look your place over. Read the Inspectors report and make a pro-active repairs in a pre-emptive move that will tell potential buyers that the expert agrees, your house is in great shape...after all.

As an agent I can tell you that houses sell better with someone living in them. Even if it’s not an entirely clean house. It has a warmth and personal feel to it. Vacant houses tend to have a cold empty feel to it. In terms of a business decision it’s better for the lender to work with a homeowner doing a short sale. See below for more info, Series 7, from CAR legal issues on short sales.

Q 7. Why Would A Lender Agree To Accept A Short Sale?

A Lenders may have ample incentive to negotiate a short sale with a distressed borrower. For example, should the lender take back a property pursuant to a foreclosure sale, the lender would become responsible for a variety of costs, including property maintenance, utilities, HOA fees, and might risk destruction of the property by vandalism. Furthermore, lender-owned properties (REO) may take a long time to sell, in part because so many REO properties are now for sale.

A lender will typically evaluate the financial situation of the borrower as well as current market conditions to determine whether or not to agree to a short sale. It is really a business decision for the lender to determine whether it would receive more money by accepting the short sale, or completing a foreclosure, reselling the property, and pursuing personal liability (i.e., deficiency judgment against the borrower and/or claims against guarantors, for loans on which those remedies are available.)

Santa Monica Open House, "Don't Stop The Party", BEP, Music Mondays

It’s Monday!! I thought I would keep the party going from our open house this Sunday in Santa Monica. The weather was gorgeous. We had a steady flow of buyers and agents. Lot’s of people smiling, happy to be out and looking at homes. 90% of the people coming through were serious buyers. We had really good conversations with people and they are really movtivated by the amazingly low interest rates.

We had the pleasure of calling our Seller today about 2 offers being written from the open house! Ya! We love making those calls!! I’m dedicating this Monday and all week with this song, “Don’t Stop They Party” by the Black Eyed Peas. Let’s keep it going...

I'm Considering A Short Sale On My Home In Santa Monica, CA. Can My Lender Sue Me? Is a question that comes up from luxury homeowners considering a short sale. Please read further for information directly from the CAR legal series on short sales.

Q 6. Can a lender avoid the "foreclosure process" and just sue the borrower on the note (i.e., treat it as an unsecured note)?

A No. In the event of a borrower's default, the lender has two options--a judicial foreclosure or a trustee's sale foreclosure (either one is referred to as the "foreclosure process"). However, a lender cannot opt to sue on a note secured by a mortgage or trust deed instead of going through the foreclosure process by treating the note as an unsecured note. This restriction is referred to under the law as the "one action rule" or "one form of action rule." (Cal. Code Civ. Proc. § 726.) A lender might prefer to sue on the note instead of foreclosing when the note is for a greater amount than the value of the property securing the note. That way, the lender can get a judgment and attach a lien against other property, personal or real, owned by the borrower. The "one form of action rule" prohibits the lender from this "third" option.

One exception to the "one form of action rule" is if the security for the loan has become "valueless" after the lender's security interest was recorded (e.g., this would be the case for a "wiped out" junior lien holder who now holds an unsecured note). In this case, the lender can sue directly on the debt (note) unless the borrower's loan falls into category (1) or (2) in Question 4.

"Can A Lender Obtain A Deficiency Judgment Against A Defaulting Borrower Following Foreclosure?" Series 5

One of the top questions Seller's ask when deciding to pursue a short sale. Will I be responsible for the unpaid balance, "deficiency" amount for my loan? See below for info on CA, anti-deficiency statues take from CAR legal services. Be informed, make the best decision you can with relevant information.

Q 5. Can a lender obtain a deficiency judgment against a defaulting borrower following foreclosure?

A It depends. California has "anti-deficiency statutes" that protect certain borrowers from deficiency judgments. A trustee's sale foreclosure does not involve the courts and does not permit the lender to go for a deficiency judgment. In order to be able to go for a deficiency judgment, the lender must use a judicial foreclosure (which involves a court proceeding).

Generally, there are five situations in which a deficiency judgment is prohibited:

1) Purchase Money. If the loan is obtained to purchase a residential 1-4 unit property all or part of which was intended to be owner-occupied at the time of the loan and the loan is secured by that property, the lender may not obtain a deficiency judgment against the defaulting borrower. This loan is entitled to "purchase money" protection. (Cal. Code Civ. Proc. § 580b.) However, should the buyer refinance the home, the new loan is no longer "purchase money." Thus, the buyer would lose the protection against a deficiency judgment in the event of a default.

2) Seller Carryback. If the purchase money loan for any type of real property is financed by the seller and secured by that same property, the lender/seller may not obtain a deficiency judgment against the defaulting borrower/buyer. (Cal. Code Civ. Proc. § 580b.)

3) Trustee's Sale. A lender may not pursue a deficiency judgment against the borrower should the lender opt to foreclose by a trustee's sale foreclosure (a non-judicial action). (Cal. Code Civ. Proc. § 580d.)

4) 3-Month Time Limit. An action for a deficiency judgment must be brought within 3 months from the time of judicially-ordered sale. (Cal. Code Civ. Proc. § 580a.)

5) Fair Value Limitations. A deficiency judgment is limited by the difference between the amount of the indebtedness and the fair market value of the property, unless the actual sale price exceeds that value. (Cal. Code Civ. Proc. §§ 580a, 726 (b).)

When a deficiency judgment is not permitted, a lender would opt for a trustee's sale foreclosure which is quicker and less expensive than a judicial foreclosure.

When a deficiency judgment is permitted, the lender may obtain one only following a judicial foreclosure, or when the security has become valueless (such as when security for a second trust deed loan is wiped out when the first trust deed lender completes its foreclosure). Holders of a junior deed of trust (second, third, etc.) should note that if the "wiped-out" junior lien is not purchase money or seller carryback, then the junior lien holder may sue on the note and the borrower on the junior loan may be personally liable. (Roseleaf Corp. v. Chierighino, 59 Cal. 2d 35 (1963).)

Aurora Bank, Trouble Closing Short Sale Escrows This January, Hold On...

This just in from our legal dept., we recently became aware of a problem with Aurora Bank transactions that we thought you should know about. Specifically, we have been informed that no deals involving an Aurora asset will close before January 24, 2012, at the earliest. Rather, Aurora has stated that every deal scheduled to close in January needed to be extended for a minimum of 15 days. In fact, although they are only requesting 15 days, Aurora presently has no specific closing time frame, and therefore does not know when closing will actually be authorized. Yikes!! All they have said is that they “hope” the delay will be “far less than 30 days.

Aurora expects to know more on or shortly after January 24. Until that time, extensions are required and, if the buyer will not agree, Aurora is willing to return their full deposit.

As a result, Sellers & Buyers, if you are in escrow you should be aware that Aurora deals scheduled to close this month will be delayed. Total length of delay is unknown at this time. Q 4. Under what circumstances is the lender prohibited from going after the "deficiency balance" as defined in Question 3 after a short sale?

With the passage of SB 458, effective July 15, 2011, after the short sale of a residential property of one-to-four units, the holder of any senior or junior deed of trust cannot pursue the borrower (seller) for any deficiency under the note. If the lender consents to the short sale in writing, as long as the proceeds of sale were tendered to the lienholder as per the buyer and seller's agreement, then no deficiency can be collected or is even owed, and no deficiency can be rendered or even requested. The borrower (seller) is protected even if the loan is refinanced as long as it's secured by a trust deed.

An exception to SB 458 occurs if the borrower (seller) has committed fraud with respect to the sale of the property or has committed "waste" of the real property (e.g., severely damaged the property) (Cal. Code Civ. Proc. § 580e (b)). Under these circumstances, the borrower (seller) may still be liable for the deficiency balance.

Note: SB 458 doesn't apply if the borrower (seller) is a corporation or political subdivision of the state (Cal. Code Civ. Proc. § 580e (c)).

"What Is A Deficiency Judgment?" Short Sale Questions & Answers In CA. Series 3.

Q 3. What is a deficiency judgment?
A A deficiency judgment is a judgment obtained by the lender in court against the borrower for the difference between the unpaid balance of the secured debt and the amount produced by sale or the fair market value of the security, whichever is greater, in a judicial foreclosure. (Cal. Code Civ. Proc. § 726 (b).) A lender may obtain a deficiency judgment only with a judicial foreclosure. With a trustee's sale foreclosure, the lender cannot go after a deficiency judgment.
With a short sale, except under certain circumstances--see Question 4, the lender may demand the balance still owed on the note that the sales transaction did not cover (e.g., short sale of the property pays the lender $120,589.23 but the full amount owed on the note is $250,000). This difference may be referred to as a "deficiency balance." It is not really a "deficiency judgment" since no court has issued such a judgment as part of a judicial foreclosure.

Short Sale Questions & Answers In CA. Series 2. "What Are My Options With My Lender?"

"What are my options?" Is a common question most homeowners want to know when meeting with us. Listed below are the options lenders offer to their clients in trouble. But, a lot of these options depend on your current financial situation, potential future financial, and current loan guidelines.

(Best advice anyone can give if you are facing this type of situation is :Be informed, be in the know and seek help to support your situation.)

Lender's Options Upon Borrower's Default (Cont.)

Q 2. What other options may the lender consider instead of foreclosure when the borrower is delinquent?

A Depending on the situation, a lender may consider one of the following:

Loan Workout: Basically, a loan workout is any resolution of a problem loan between the lender and borrower that modifies the original loan agreement. Some of these options include forbearance (e.g. forgiving a portion of the debt or late charges); deferment; renegotiating interest rate, monthly payment amount, principal amount, maturity date; or the enforcement an acceleration clause in the loan.

Deed in Lieu of Foreclosure: After the borrower is in default, the borrower voluntarily delivers title to the lender for consideration and the lender accepts the conveyance of the property in full satisfaction of the mortgage debt. Using this method, the lender saves the costs of foreclosure and the borrower avoids having a notice of default on his/her records. (Hamud v. Hawthorne, 52 Cal.2d 78 (1959).)

Short Sale*: A short sale is a transaction in which a lender allows the real property securing the loan to be sold for less than the remaining mortgage amount due and accepts the proceeds as full payment of the loan. A lender may accept a short sale when the borrower is in severe financial straits and market conditions make a short sale the best choice to mitigate the lender's damages. Like a deed in lieu of foreclosure, this saves the lender the costs of foreclosure and the borrower avoids having a foreclosure on his or her credit report.

Short Payoff*: With a short payoff, the lender accepts less than the remaining mortgage amount as full payment of the loan. The property need not be sold.

*Note: Some lenders do not differentiate between a short sale and a short payoff.
