I Short Sold My House. Per HAFA, I am supposed to $1500. How Do I Get It?

This is a great question. I see this referenced in all the paperwork my shortsale sellers get from the lender, i.e. "you may be eligible for up to $1500 in relocation assistance", but there is never any other info in the paperwork on how to apply. Can anyone help me here?

"I left a message for you. You didn't get it?"

Today I was showing property to a nice couple. I asked if they would like to look at some new homes in a particular area. They both looked at one another, and the husband asked his wife "is that where (agent name) works?" She nodded and they both answered my question simultaneously "NO!". They went on to explain that they had not had a good experience with the agent who represented the builder. The builder did not have a spec home of the model this couple was interested in so the agent had called a homeowner in the neighborhood to see if this couple could walk through. Once the agent found out that the prospects had not gotten their formal pre-approval (minutes before the viewing was scheduled), she advised them they would wait and look after the pre-approval came in. The faux paux occured when the agent thought she was calling the homeowner to tell them that the showing was cancelled due to the prospects not showing up. She actually called and left that message on the buyers cell phone, NOT the homeowners phone. Yikes! The buyers were infuriated when they heard the message! They did not want those sellers to think they were a "no show". Also, the husband was a policeman and did not take well to the non-truth. He said he would never trust this agent.

Three huge lessons here for me:

1. MAKE SURE I AM LEAVING THE RIGHT MESSAGE WITH THE RIGHT PERSON!

2. ALWAYS, ALWAYS, ALWAYS TELL THE TRUTH!

3. POSITIVE MENTAL ATTITUDE!

The agent who represents the builder is a good agent. Maybe they thought it was just a little white lie or it didn't really matter why the appointment was cancelled. Well, it did matter. We probably all have been guilty of telling the occasional white lie, but what I have learned is that almost everything matters.

As far as the buyers qualifying - they are great! What the buyers thought might hurt their credit was an outstanding loan! (which actually helps your credit when you pay on time) A few questions from the agent could have settled the concerns over credit. If the agent had had a positive attitude and went ahead with the showing (what would it have taken, 15 - 20 minutes?) they probably would have a sale right now. Oh well, their loss is my gain in more ways than one.

Owensboro, KY Habitat For Humanity Taking Applications January 2013

Owensboro-Daviess County Habitat for Humanity is taking homeowner applications for the entire month of January. HFH is a program where homeowners work to help construct their own home and then are given an interest free, 20 year loan from Habitat. Most homeowners make a payment of $350 - $450 per month. We have one homeowner this year who will be paying her home off! If you know of someone who does not have the income or good credit to qualify for bank financing, this is a great program. Families with children can pay what they would normally pay for rent toward owning their own home and have a yard for their kids to play in! Top 5 Buyer Mistakes in Owensboro, KY

1. Basing your offer on the listed price.

Some buyers always offer 10% less than the listed price. What if the property is listed for $150,000 and is overpriced by $20,000? Even if you offer 10% less / $135,000, you will still be paying $5000 too much. Many times I have heard buyers brag that they bought a home for $20,000 less than the original list price. The truth is, the house was overpriced by $20,000 from the beginning or it would have sold already. To protect you, I will provide information on recent sales in the area so you will know you are getting the best value.

2. Making A Ridiculously Low Offer

Contrary to what you see on TV and read on the internet, most sellers have not just fallen off a banana truck – they know what their house is worth – even if they overprice it initially. Like you are wishing for a stupid seller, they too are wishing for a stupid buyer. Writing low offers insults the seller and wastes everyone’s time. You also run the risk of another buyer stepping in and buying the house while you are in the midst of negotiations with the seller. Even if the seller counter offers to you, they can withdraw their offer at any time until written acceptance.

3. Not Giving Enough Earnest Money

Earnest money shows you are “earnest” or serious about the offer you are making. When your earnest money is low, it waves a red flag to the seller. They may counter offer and request a larger deposit, but once again you also run the risk of another buyer stepping in and buying the house while you are in the midst of negotiations. If there is an unusual circumstance for giving a low earnest money deposit, an explanation should be communicated to the seller when your offer is presented.

4. Not Getting A Home Inspection

The appraisal that the bank does IS NOT a home inspection! Home inspections are performed by licensed home inspectors, not appraisers. Home inspectors find all the things that our untrained eyes miss. This could save you thousands of dollars in repairs later. This is a must for all home buyers.

5. Not Buying Owner’s Title Insurance

Many buyers mistakenly believe that the title insurance the bank requires them to buy (lenders title insurance) will also protect them. THIS IS NOT TRUE! Buyers should also buy OWNERS title insurance. An owner's policy protects your interest in the property against such hidden defects as: mistakes in recording of legal documents, forged deeds, releases, or wills; undisclosed or missing heirs, liens for unpaid taxes, fraud and other claims that could prevent you from selling your home in the future. This is a fee that can be included in your closing costs and is well worth the investment.

Will the REAL Business Casual please stand up?

I was surprised when Business Week Magazine had a feature about the rise and fall of business casual dress. They cited the top three business dress no-no’s as: 1) Visible tattoos, 2) cleavage and 3) “Hooker” earrings (whatever that is). I too have grown weary of cleavage in the front as well as in the back. So after reading the Business Week article I was inspired to make a list of my own about professional REALTOR etiquette and dress in general.

1. One Word – grooming. If you’re not clean, you’re not credible. If you MUST meet a client in exercise clothes or after mowing the yard, ask for permission by saying: “I’m happy to show you that property now, but I’ve just finished working in the yard. Is it okay if I’m still in my work clothes?”

2. Answer the phone! If you don’t, it may mean a missed sale. Most consumers who want to see a property won’t leave a voicemail – they will just keep calling numbers until they get a live body.

3. More skin = less credibility. I sometimes have to remind our agents that we sell houses, not hoochie! Don’t confuse social dress with business dress.

4. Never apologize for your appearance – you dressed yourself!

5. Dress conservatively for acceptance, and as a general rule, one level above your client. Remember, it is usually the female who makes the buying decision – if you alienate her with too much skin – you may not get the listing or the sale!

6. If you want to be respected as a professional, dress like one. You don’t get a second chance to make a good first impression!

7. And lastly, my favorite – just because they make it in your size, it doesn’t mean you should wear it!

Are You Working With Another Agent?

This behavior among buyers seems to be rampant across the entire country. We as REALTORS need to continue to be courteous and professional. I think most buyers do not know that having one agent show them the property, and another write the offer is a problem. Well, it is. It is a BIG problem involving ethics and breach of another agent's fiduciary relationship with their client. Read on below . . .

I'm seeing situations starting to pop up again in a lot of blogs around the internet.

Buyer calls an agent and asks them to show them a home. The agent asks THAT questions: "Are you working with an agent?" More times than not, the buyer responds with one of the following:

1. I am but my agent is on vacation/took the day off.
2. I am but my agent's office is alllllllllll the way across town and you're right next to that house.
3. I am but it's the weekend and I didn't want to bother him/her.
4. I am but your name came up next to the house so you can show it to me.
5. I am but ..... (fill in the blank).

If you're wondering why we ask - if you are working with another agent, you are contractually obligated to that agent. You have agreed to work with that agent to finding and purchasing your new home. If I were to jump in the middle of it, I would be in SERIOUS trouble with just about every single REALTOR® entity I'm associated with. I cannot legally help you.

A good agent will, in the case of their going on vacation or taking a day off, enlist the help of another agent in their office to cover clients while they are away. That agent can only be from their office...not a competing office. If your agent didn't give you the name of who is covering for them, call their office. If your agent didn't appoint anyone, someone from their office should be able to assist you.

Likewise, if you are doing an internet search via Zillow, Trulia, or other sites, agent names will pop up next to listings that are not associated with that listing. We agents buy advertising on these sites to be more prominent. Again, if you are working with an agent, you need to let that agent know that you are interested in the house. If you call me to see it or ask questions about it, I'm going to ask you THAT question and then refer you back to your agent.

There are a lot of legalities that come into play as a buyer's agent. The biggest one is stepping on another agent's toes. There is not one agent in this world that would do that. And, if there is - and you happen to run across them - turn around and go the other way. Quickly.

How to Get The Proverbial "Good Deal" - Owensboro, KY Real Estate

In 27 years of selling real estate I have worked with a lot of different people with different motivations for buying a home. The most interesting buyers have always been the ones who were focused on “the good deal”. Of course, everyone wants to get a good value – I’m not referring to those buyers. I’m referring to buyers who want to steal a property. The tragedy of this kind of purchase is that it may be a low price, (hence the perceived good deal) but there is always a reason the price is low, i.e.: small master suite, small kitchen, lack of closets or storage, etc. These homes always have one area that is knock your socks off. Add the reduced price and you’ve got sold! Keep in mind, if a house has an issue when you buy it, it will still have that issue when you sell it, and you too will likely end up selling at a reduced price. Here are the top three issues to consider when getting a good value:

1. Resale: You make money on a home when you buy it.

This is first and foremost in my mind when assisting buyers. My hope is that I will again be their agent when they get ready to sell, and I do not want to tell them that I can’t get top dollar for their home because they made a bad investment.

2. Make sure it’s a place you want to come home to everyday.

I recently sold a home for a gentleman who had lived there only one year. (b/t/w, I did not sell him this house.) He bought in an area outside of town (because he could get more house for his money) and then realized he loathed the daily drive, and disliked the community. He told me that he hated coming home every day. He sold his house at a loss just to get out of there!

3. Be certain the house meets your physical and lifestyle needs.

If having a place for the kids to play is a priority, then keep it a priority NO MATTER WHAT! If you find yourself making a concession in that priority area, then is it really a priority? Knowing what is really important to you will help you get the best value. The floor plan of any home you choose should be functional. In other words, you should not have to cut through rooms to get to a bathroom, and the floor plan should flow - you shouldn’t feel like a mouse going through a maze.

4. Be "smart" when you make the offer.

After you have looked at a few homes, you will start to get a feel for the standard room sizes and amenities in your price range. Your REALTOR can give you guidance regarding pricing trends and values in any given area.

Ask your REALTOR about the number of "days on market" for every house you consider making an offer on.

Also find out what the original listing price was and how many times it has been reduced. Sometimes, you will encounter homes that have been reduced as much as $50,000 from their original asking price.

Don’t kid yourself into thinking you are getting a good deal just because you are buying at the reduced list price. The market has already rejected that house at the higher price, which is why the house is still on the market.

Why Hasn't My House Sold?

After looking through the list of expired listings today, I took the time to actually examine the MLS data and listing photos. These properties reminded me of listings I have had in the past that have been a challenge to sell. If you are a home seller, or new to the real estate business, here’s my “Kiss of Death” list. “Kiss of Death” meaning; if your home has one or more of these characteristics, you will have a marketing challenge on your hands.

1. Country Blue!The carpet, the walls, yikes!

2.Wallpaper.No longer in style – dates the house.

3.Berber carpet.Ditto above comment.

4.Steep driveway. Not good for snow/ice, or children on tricycles!

5.No first floor master suite

6.Inadequate closet in master suite

7.Inadequate laundry facilities

8.Outdated kitchens and baths

9.Basement garage – who wants to carry groceries up the stairs?

10.Trashy neighbors ( i.e.: clutter and trash everywhere)

11.Houses that smell - “If you smell 'em, you can’t sell 'em!”

Obviously, a house in disrepair inside or out will be difficult to sell.Many sellers believe buyers will just make a low offer, however, that IS NOT THE CASE! What will happen is you will get NO OFFERS, period. Most buyers do not want to make repairs.They just want to move in and live happily ever after. The ones who will do repairs are looking to buy at a considerable discount!

Top 5 House Showing NO-NOs in Owensboro, KY

These really should go without saying, but here goes (again):

1. Houses That Smell (bad). Includes pet odors, litter box, food odors, cigar /cigarette smoke. "If you smell 'em, you can't sell 'em!

2. Dogs That Bark! Or cats that scream through the entire showing. Very distracting - the house will NEVER sell, period!

3. Dogs That Pee! Yes, I said it - and what's worse, they not only pee on the floor, but they pee on YOU because they are so excited. Yes, it really happens! Other favs are animals that poop on the rug in front of the door and as you open the door to enter the home, the poop is smeared EVERYWHERE! EWWWW!!!! NOT gonna sell that house that day.

4. Sellers Who Won't Leave For the Showing (and lay on the couch or bed) AWKWARD!

5. Dirty, Nasty Kitchens And Baths. PLEASE, no dirty dishes in the sink, a clean range and microwave (don't hide dirty dishes in there - the buyer is checking it out), bathrooms free of soap scum and mildew. And for heaven's sake, please, get rid of those toilet bowl stains! You can have wonderful decor with the latest accessories from Pier One, but if these are not sparkling - not gonna sale.

Most sellers do their best to make a superb presentation of their home - they want to sell! However, some sellers, well . . . .? Moral of the story: It only takes one "looker" to buy your property. You never get a second chance to make a good first impression. If you turn off your "one looker", you may have just blown the sale with other potential buyers as well. Not only do consumers share their horror stories, but agents do too.

When you list your home, get it looking GREAT, and keep it that way. Remove pets for all showings. It would be better to miss a showing and try to reschedule, than to have a dog that barks and growls the entire time. Only you, as the home seller have the power to turn these "no-nos" into "yes-yes"!

The Truth about the 3.8%, 2013 Real Estate "Sales Tax"

PLEASE STOP FORWARDING ME THE "3.8% SALES TAX ON REAL ESTATE" EMAIL!

There will be no 3.8% "sales tax" on real estate in 2103.

There will however be a 3.8% capital gains tax.

Congress approved, and the president signed a bill authorizing a 3.8% tax on the capital gains on real estate transactions over the existing $500,000 exemption for married couples ($250,000 for singles). Couples have to make more than $250,000 in adjusted gross income for the tax to apply to them (singles more than $200,000).

This tax WILL NOT affect all taxpayers as the viral emails (and Facebook posts) suggest. Only those homeowners who experience a taxable gain when they sell and/or those whose adjusted gross income exceeds the limits referenced above will pay the tax. Of course, the taxpayer will have to pay the 3.8% in addition to the existing capital gains tax. Current Capital Gains Tax Rates range from 5% to 39.6% depending on how the "gain" is classified by the IRS.
