      <description>&lt;p&gt;The City of Saratoga, California may be considered a great place to live according to the 29,843 residents currently living within the city. The city is located at 412 feet above sea level and covers a land area of 12.1 square miles but has an average age of over 40 years old. The city has a medium population density with about 2,460 people in every square mile.&lt;/p&gt;
&lt;p&gt;There is only one college within Saratoga, the West Valley College, but there are seven colleges and universities within 20 miles of the city's limits. &lt;p&gt;Since Saratoga City is known for its green thumb, inside the city you will find the Villa Montalvo Arboretum and the Hakone Gardens. There are six major shopping centers in the City of Saratoga which include places like the Argonaut Place Shopping Center and Azule Crossing.&lt;/p&gt;
&lt;p&gt;There are several city parks in Saratoga City that includes Azule Park, Wildwood Park, Deer Park, Gardiner Park, El Quito Park and the Green Springs Park. The City of Saratoga is also home to an Amusement/Theme park called Bay Area Amusements.&lt;/p&gt;

      <description>&lt;p&gt;Judgment liens can be placed against ones home or other assets when they refuse to pay credit card bills, home improvement bills, or just about any other type of bill. All a creditor needs to do is pursue payment and if the homeowner is not able or unwilling to pay, the creditor can go to court and a judge can place a lien against the home of the person that owes the debt. While a judgment is often said to not be as serious as a tax lien, it is still something that someone should try to avoid and do away with if they have a judgment lien placed against them. Whether it&amp;#39;s a tax lien or a judgment lien, these things are best dealt with right away rather than ignored.&lt;/p&gt;&lt;p&gt;Of course, it goes without saying that if you really ant to avoid having judgment liens placed against your home that you should pay your bills. But, we&amp;#39;ve all been in a situation where we just can&amp;#39;t afford all of the things we need to pay. If you are in this situation, there is no shame in it because every now and again things come up and our bills just seem to grow and grow. Thankfully, judgment liens will not be filed the first day you have a late bill. If you are just going through a tough period where you need a little more time than usual, you&amp;#39;ll usually be just fine and will not even have to think twice about judgment liens. Judgment liens don&amp;#39;t happen when you&amp;#39;re a couple weeks late on your credit card bill or if you forget to pay the landscaper for a month or even two.&lt;/p&gt;&lt;p&gt;But, if you go for long periods of time without paying a bill and without responding to attempts to collect the debts you owe, you might have to deal with judgment liens. At this point it is a good time to swallow your pride and call the creditor and try to work out a payment plan that is something you can stick to in your financial situation and is something that the creditor will be happy with. In the end, no one wants to go to court, not you, or the creditor, so if you just communicate you can usually get him or her to stop the legal action and allow you to pay him or her off as you can, as long as you actually intend to do so. Most creditors will be happy to work with you, as they&amp;#39;ll make more money on the interest they can charge you! Also, a creditor loses money when they have to take the time to prepare their case against you for court, so they&amp;#39;d rather get the payments a little late than have to go through the court process.&lt;/p&gt;&lt;p&gt;If you receive a notice that a hearing is scheduled in the attempt to place a lien against your home for nonpayment for services or products, you should show up to the hearing. You should state your case, especially if you believe that you do not owe the creditor, or if you dispute the amount that they are charging. Creditors are often willing to forego late fees and even interest charges if you are willing to pay them off sooner rather than later. If you are not present to defend yourself, the court will assume that the debts are valid and will go ahead and place the lien against your home, so it is in your best interest to go to the hearing as the court will often order a continuance or even a dismissal if they think that the circumstances warrant it. The worst thing that can happen if you show up is that the court does order the judgment lien, the best thing that can happen is that you are given more time to pay the outstanding debts before any legal action is taken.&lt;/p&gt;&lt;p&gt;Judgment liens typically are not something that will affect you right away; it just means that you cannot sell your house without paying off the debt. This means that the lien placed against your home will be paid off before you see any of the proceeds from the sale. If the lien is small, perhaps this isn&amp;#39;t a big issue for you. If the lien is larger this might be something you want to think about because it could keep you from having a large enough down payment for a new home. Judgment liens typically have an interest rate attached to them according to state statute. This means that a lien isn&amp;#39;t just a long-term loan between friends; it means that the lean holder is compensated for not having been paid for their services or products right away. The interest on the lien can grow quickly, making the debt more and more difficult to pay off before the sale of the home.&lt;/p&gt;&lt;p&gt;The best thing to do is deal with your bills right off.       <title>What Is A Judgment Lien?</title>
      <description>A judgment lien is a court ordered lien that is placed against the home or property when the homeowner simply fails to pay a debt. This doesn&amp;#39;t seem like a big deal, but when the homeowner has a judgment lien against his or her home and wants to sell it, the judgment lien has to be paid in full before the home or property can be sold. Judgment liens can be placed against the property for a variety of reasons such as unpaid credit card bills, utility bills, department store bills, landscaping or home improvement bills, and just about any bill that the homeowner has failed to pay in a reasonable amount of time. Any bill that can cause one to end up in court can result in a judgment lien.&lt;br /&gt;&lt;br /&gt;A judgment lien is different than a trust, in that the judgment lien holder cannot foreclose on the home or the property as trust holder can. Judgment lien holders can demand payment, but ultimately they must wait for the homeowner to sell the property before they can expect to be paid the money that they are owed according to the judgment. Luckily for the judgment lien holder, the court will typically assign an interest rate to these liens so that the lien holder is compensated for their waiting as the interest will continue to accrue until the debt is paid in full. Because the majority of people will live in their home for quite some time, the interest can make a judgment lien grow, and grow, and grow over the years so that it is quite large. Imagine what a lien of just $3,000 would grow to over the years if the interest rate were 15% annually and that would be an even bigger amount if the debt were $5,000 or $10,000! &lt;br /&gt;&lt;br /&gt;Of course, judgment liens require court action. A creditor will take the homeowner to court where the judge will determine if the homeowner does in fact owe the creditor any money. If the court decides that the creditor is owed the money, and the homeowner will not or cannot make payment, the judge will order that a judgment lien be placed against the property. The judgment lien will then be entered into land records offices for the city or county so that the home cannot be sold without repayment of the debt. Once the lien is filed with the land records office, the judgment lien is said to be attached to the property, meaning that it cannot legally be sold without paying off that lien. If the judgment lien is not listed at the land records office, then it means that the debt or lien is not legally attached to the property and does not need to be paid off to sell the home.&lt;br /&gt;&lt;br /&gt;A home or property can have numerous liens against it, which may present a problem when the home is to be sold. Fortunately, the law says that liens will be paid off in the order that they were attached to the property, meaning the first lien will be paid first, the second will be paid second, and so on. This is a law that was basically developed for when a home is foreclosed on. If a foreclosed home is auctioned it will first pay off the first lien, then the second, and the third until there is no money left to pay the debts that are still attached or associated with the home. Of course, all trusts against the house, such as mortgages and home equity loans, would be paid off before the judgment liens, so it&amp;#39;s not uncommon for these liens to simply go unpaid because there is no money remaining to pay these debts after the trusts are paid. If there is not enough money to pay for all of the judgment liens and trusts on the home or property, they are then wiped out and can no longer be collected on. Of course, the auction will usually attempt to pay for all of these debts, and they are paid for until there is no money. The reason for this is that the new owner will not be able to get any home equity loans or second mortgages with judgment liens already on the home. If there is money left over after everything is paid off, the remaining amount would go to the foreclosed homeowner as all debts are paid.&lt;br /&gt;&lt;br /&gt;You can look for judgment liens at the land records office, though you will typically not find them listed with trusts. Investors or homeowners looking to sell their home will have to look into both trusts and judgments, as they are listed in different areas. Investors can often be caught off guard when they realize how much debt is attached to the home, and sellers are often startled at old judgment liens that they had forgotten about and don&amp;#39;t want to afford to pay off in order to sell their home. It&amp;#39;s a good idea to go over all of this information before one bids on a home or attempts to sell it or put it on the market.&lt;br /&gt;&lt;br /&gt;Judgment liens are not something that anyone wants put against their home, but they are common enough.       <title>Understanding Probate</title>
      <description>&lt;p&gt;Probate is known as the legal process that settles the estate of the deceased and how the property of that person should be distributed. The probate process can really vary from state to state, so these are just general guidelines. If you are involved in the probate process you might want to seek legal counsel with an attorney that has experience with wills, or even those that have experience in probate court to protect your rights and really understand the probate system in your state. If you are looking for general information, you have come to the right place. Every probate is different because there are different sums of money, different pieces of property, different debts, and different people that want or do not want to take part in the process. Probate does not have to be an ugly process if all parties can agree to work together to preserve the memory of their deceased loved one. We&amp;#39;ve all seen the ugly probate hearings on television, but real life needn&amp;#39;t be so dramatic if the key players do not allow it to become this way.&lt;br /&gt;&lt;br /&gt;In most states, if someone has passed away without completing a will or trust, the property of the deceased will automatically become the property of his or her spouse and there is no need for probate. Yet, there are cases where the surviving spouse does not automatically get the deceased individuals property, and then it is necessary to divide the estate of the deceased, whether or not the decedent had a will. The probate court, the court that has jurisdiction over such matters, will help those involved decide how the property is divided, and that it is divided in a legal manner. The laws vary from state to state, and this is where the division of property can get quite tricky if you or the people are you are working with do not know the laws well.&lt;br /&gt;&lt;br /&gt;A will generally names an executor, which is a person that has the huge task of ensuring that the will is carried out according to what the deceased wanted. Obviously, the most common job of the executor is to organize the whole assets with the help of the probate system. If there is not a will and there is not an executor of the estate, then the probate court or another court that has jurisdiction can appoint an executor. The appointed representative of an intestate estate is called an administrator instead of an executor. If the representative of the estate is anyone other than the named executor they are known as the administrator with the will annexed or administrator c.t.a. from the Latin phrase cum testamento annexo. &lt;br /&gt;&lt;br /&gt;What to expect during the probate process&lt;br /&gt;&lt;br /&gt;The first task of the executor or administrator is open the case with the court. This process differs from state to state, but is generally not all that difficult. Next, the executor will need to inventory and collect the property of the decedent. Some of the decedent&amp;#39;s property will not be involved because they will pass through contracts from one person to another, so there is no reason to probate these items. Items such as life insurance policies, bank accounts, or other things that clearly name a beneficiary or have a &amp;quot;payable on death&amp;quot; clause that so names another person will not be a probate issue they will simply transfer to the named individual. After all of the assets have been inventoried and organized, the executor will pay any debts and taxes that are owed. Then, the executor has the task of actually distributing the remaining property to the beneficiaries of the decedent as they have been instructed to do so in the will, or if there is not the will, according to the law.&lt;br /&gt;&lt;br /&gt;It is not uncommon for there to be disputes during this process. Anyone can make a claim on an estate by petitioning the executor or the court. If the court rejects the claim, the individual with the claim may file a lawsuit to attempt to prove their claim and collect the money or the objects that they are saying they are entitled to. If there is a lawsuit, the court is more inclined to treat the probate process more formally, which makes the process much more difficult as it must approve of every single transfer of property in the will.&lt;br /&gt;&lt;br /&gt;How to avoid probate&lt;br /&gt;&lt;br /&gt;Unfortunately, probate can take quite awhile. It is not uncommon for the probate process to take more than a year and for all property to be distributed. The best way for people to avoid putting their loved ones through the probate process is to establish a living will. A living will is a separate entity that enables a person to transfer ownership of all of his or her real property such as houses and cars from him or herself to a trust that can be revised at any time. If the person passes away, the people named as the beneficiaries in the trust are now the owners of the trust and the property mentioned within. The great thing about the living trust is that it&amp;#39;s not a public process, so it really helps to preserve the privacy of the deceased as well as his or her family members. When probate is required, an estate tax is generally required as well and a living will can help avoid this, too. While a living trust may reduce the estate taxes, some will generally have to be paid regardless of whether there is a living trust or not, but every little bit helps!&lt;br /&gt;&lt;br /&gt;Because probate can take a long time, it&amp;#39;s understandable that people would want to avoid it. The problem is that avoiding probate takes foresight that many of us simply do not have. After the grace period a closing will take place, so that the new owner can formally take the title to the property.&lt;/p&gt;&lt;p&gt;What Happens, Now?&lt;/p&gt;&lt;p&gt;The purchaser can do what he or she intended to do with the property, whether it is to move into the home or to sell it for full market value. The money paid by the purchaser will be distributed in order of priority, first of which would be taxes. After taxes money will be paid to the mortgage, then the second and third mortgage if applicable. If there is still money after paying these debts, remaining money will be paid to lien holders and creditors. There is a very slim chance that there will be money left over after all of the debts are paid, if this is the case then the monies will be paid to the former home owner.&lt;/p&gt;&lt;p&gt;What about the Original Owner?&lt;/p&gt;&lt;p&gt;The original owner will often be at the auction so that they can bid on their home, and this is legal as long as they have the deposit required. If the owner of the home that has been foreclosed does bid on the home they must remember that the deposit is not refundable and the deposit assumes that they will be able to finance the home within the grace period. Owners must also remember that if they buy the property back old debts may merge and become reinstated such as second and third mortgages that became void when the first mortgage foreclosed on the property unless one has filed bankruptcy and is truly free and clear of these debts. Owners will often drum up the funds to make the deposit so that they can have another 30 days to try to save their home.
