There are benefits when doing a short sale in CA. California homeowners that find themselves having to do a short sale have some benefits not found in other states. Calif state law does not allow the sellers bank/lender to ask the seller to contribute any funds toward the sale of the property. It's also state law that the bank or lender can not come back after the short sale seeking any payment toward the deficiency. When the short sale is approved and closed it's over with no recourse. Why would a lender agree to a short sale? The answer is simple: Lenders do not want to own houses. Lenders are in the business of loaning money, not in the business of stockpiling real estate. There have been numerous reports that banks can face fees of $30,000.00-$60,000.00 in the process of foreclosing on a property. Tenants and Short Sales not a good mix. Today on the last business day of 2011 I closed a most difficult Temecula short sale.This home went through 3 buyers,two declines and a tenant who would not vacate. We had to close todayor the short sale approval would be voided and I had no more extensions left. The seller had vacated early and had put a tenant in the house against my advice. Bank of America sent out a letter today that as of Dec 1 2011 they made changes to the short sale process that will reduce the time needed to complete a short sale. Emailed to me today....... After a long discussion amongst ourselves my wife and I have decided to withdraw our offer on the Catherine property.
