      <title>Don't Let This Happen To You!</title>
      <description>&lt;p&gt;A woman&amp;nbsp;arrived home from work only to find the doors to her home locked last week.&amp;nbsp; Not unusual, right?&amp;nbsp; I mean, we go home every day and &lt;span style="text-decoration: underline;"&gt;expect&lt;/span&gt; the doors to be locked, right?&amp;nbsp; That means our home and belongings are safe, right?&amp;nbsp; But we usually expect the doors to open when we put our keys in the locks.&lt;/p&gt;
&lt;p&gt;Unfortunately for this poor woman, the locks had been changed on all the doors.&lt;/p&gt;
&lt;p&gt;So she called a real estate agent who had been keeping in touch by sending her&amp;nbsp;mortgage crisis information.&amp;nbsp; Upon assessing the situation, the agent realized that this woman was in a very bad situation indeed.&amp;nbsp; After months and months of ignoring the calls and the letters from the bank, they finally did what was inevitable.&amp;nbsp; They essentially repossessed the house.&lt;/p&gt;
&lt;p&gt;Imagine what that poor woman was feeling at that moment&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;&lt;em&gt;embarrasment at the situation;&lt;/em&gt;&lt;/li&gt;
&lt;li&gt;fear of what would happen now;&lt;/li&gt;
&lt;li&gt;confusion as to how her life got to this point;&lt;/li&gt;
&lt;li&gt;despair because she can see no way out.&lt;/li&gt;

&lt;p&gt;1. When you get behind on your payments, contact your bank! Contrary to what you may think, the bank does not want to foreclose on your house. They are willing to work with you if you give them the opportunity to do so.&lt;/p&gt;
&lt;p&gt;2.&amp;nbsp;If you feel there is no way you can keep making your mortgage payments, contact a mortgage lender.&amp;nbsp; They can help you assess your ability to refinance your loan.&amp;nbsp; If you can refinance,&amp;nbsp;the lender&amp;nbsp;can often configure your payments to be lower than what you've been paying.&lt;/p&gt;
&lt;p&gt;3. If you cannot refinance, contact a licensed real estate agent to help you assess if you can sell it.&amp;nbsp; It is far better to sell the home and keep yourself from unnecessary stress than to struggle when you don't have to.&lt;/p&gt;
&lt;p&gt;In Louisville, there are several great realtors and mortgage lenders who can assist you if you find yourself in this situation.&amp;nbsp; Don't despair - you can avoid this situation!&lt;/p&gt;

Renting.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: #000000;"&gt;&amp;nbsp; Consider moving in with someone else for a while and renting out your home.&amp;nbsp; Depending on the location, condition, and size of your property, you may even get more in rent than your monthly mortgage payment.&amp;nbsp; Or, you could just rent out an extra bedroom.&amp;nbsp; That will bring in additional income to help pay your mortgage payments.&amp;nbsp; Signs for houses for rent can be purchased at most any home improvement store and ads for homes for rent can also be placed in the classified section of the Louisville Courier-Journal.

Short Sell.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: #000000;"&gt;&amp;nbsp; Perhaps there is enough equity in your home to sell it and pay off your loan.&amp;nbsp; If so, in order to keep your credit in good standing, this may be the perfect option - especially if you either can't afford to keep the house or don't need the investment anymore.&amp;nbsp; A short sell, or letting the bank take over selling your property, could be just what you need to relieve you from the burden of your mortgage payments.

&lt;p&gt;&lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;2.&amp;nbsp; Refinance.&lt;/span&gt;&lt;/strong&gt;&lt;br&gt;If you currently have an adjustable rate mortgage (or ARM loan), refinance into a fixed rate mortgage.&amp;nbsp; A fixed rate mortgage means that your interest rate will not change or fluctuate.&amp;nbsp; It will always be the same for the life of the mortgage.&amp;nbsp; This will allow you to more easily budget your monthly mortgage payments.&lt;/p&gt;

      <title>MORTGAGE DEBT CANCELLATION RELIEF, Send SidCo your Short Sales</title>
      <description>&lt;p&gt;&lt;strong&gt;&amp;nbsp;&amp;nbsp;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;MORTGAGE DEBT CANCELLATION RELIEF&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;H.R. 3648 - Public Law 110-142&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;Signed December 20, 2007&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&amp;nbsp;&amp;nbsp;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;Summary: Generally, individuals who are relieved of their obligation to pay some portion of a&lt;/p&gt;&lt;p&gt;mortgage debt on a principal residence between January 1, 2007 and December 31, 2009 will not&lt;/p&gt;&lt;p&gt;be required to pay income tax on any amount that is forgiven.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;Background: A fundamental principle of the income tax is that a taxpayer must recognize&lt;/p&gt;&lt;p&gt;income and pay tax any time a debt of the taxpayer is forgiven or discharged. Exceptions are&lt;/p&gt;&lt;p&gt;provided in several circumstances, including bankruptcy, insolvency (as defined by state law)&lt;/p&gt;&lt;p&gt;and for some investment real estate. Until this new rule was enacted, however, no exception&lt;/p&gt;&lt;p&gt;applied to any amount debt forgiven on a mortgage for a taxpayer's principal residence. Thus,&lt;/p&gt;&lt;p&gt;until now, when some portion of a mortgage debt was forgiven, that amount has been treated as&lt;/p&gt;&lt;p&gt;taxable income and the borrower has been taxed at ordinary income rates on the forgiven&lt;/p&gt;&lt;p&gt;amount, even though there is no cash.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;The newly-enacted relief for mortgage debt forgiveness is Congress's response to the problems&lt;/p&gt;&lt;p&gt;generated by the subprime crisis, short sales, rising foreclosure rates and price corrections in&lt;/p&gt;&lt;p&gt;some markets. Thus, when a lender forgives some portion of a borrower's mortgage debt in a&lt;/p&gt;&lt;p&gt;short sale, a foreclosure, a workout with the lender or some similar circumstance, the borrower&lt;/p&gt;&lt;p&gt;will not be required to recognize income or pay tax on the forgiven amount. This relief applies&lt;/p&gt;&lt;p&gt;to debts forgiven between January 1, 2007 and December 31, 2009.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;Provisions: General&lt;/strong&gt;&lt;strong&gt;&lt;em&gt;.&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;&lt;ul&gt;
&lt;li&gt;No income limitation: All borrowers receive the relief, no matter what their income.&lt;/li&gt;
&lt;li&gt;Dollar limitation: No more than $2 million of mortgage debt is eligible for the exclusion&lt;/li&gt;
&lt;/ul&gt;&lt;p&gt;($1 million of debt for a married filing separately return).&lt;/p&gt;&lt;ul&gt;
&lt;li&gt;Relief applies only to an individual's principal residence.&lt;/li&gt;
&lt;li&gt;The forgiven mortgage debt must have been secured by that residence.&lt;/li&gt;
&lt;li&gt;No relief is available for cash-outs, whether the cash-out takes the form of a refinanced&lt;/li&gt;
&lt;/ul&gt;&lt;p&gt;first mortgage, a second mortgage, home equity line of credit or similar arrangement.&lt;/p&gt;&lt;ul&gt;&lt;li&gt;Eligible debt is what is called "acquisition indebtedness." This is debt used to acquire,&lt;/li&gt;&lt;/ul&gt;&lt;p&gt;construct or rehabilitate a residence.&lt;/p&gt;&lt;ul&gt;&lt;li&gt;Refinanced debt qualifies, so long as the debt does not exceed the original amount&lt;/li&gt;&lt;/ul&gt;&lt;p&gt;of the debt. (Same rule as Mortgage Interest Deduction)&lt;/p&gt;&lt;ul&gt;&lt;li&gt;Home equity debt (or second mortgages) qualifies &lt;em&gt;if &lt;/em&gt;the funds were used to&lt;/li&gt;&lt;/ul&gt;&lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; improve the home. (Borrower must have adequate records, as under current law.)&lt;/p&gt;&lt;ul&gt;&lt;li&gt;See cash-outs, above. No amount of a cash out may be treated as acquisition debt.&lt;/li&gt;&lt;/ul&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&amp;nbsp;This is awesome news.
