As a Certified Distressed Property Expert (CDPE), there are many options that I can (and do!) suggest to Central Florida Sellers who are facing economic hardships and who are concerned about losing their home to foreclosure.

After five years of negotiation between the National Association of REALTORS (NAR) and the Department of Justice (DOJ), a settlement has been reached that has resulted in the requirement of new listing agreements that provide more options for Sellers, who can now elect what marketing efforts their brokers provide when listing their home for sale.
Specifically, the settlement requires that Central Florida Sellers now be given more choices when it comes to the display of their property on the Internet. No, I'm not a "paid" staff member for Trulia.

Protecting a Seller's interest is a Listing Agent's ethical and legal obligation. One of the ways I have found to be most effective in positioning the Seller for success is by having two separate files for the property.
The first should be the "official office file" and should contain the listing agreement, disclosures, MLS data entry form and any other required office forms. There should be no personal information about the Seller or the Seller's motivation to sell included in the office file, as this set of records is typically kept in a file cabinet in the main circulation room and every agent in the office … (6 comments)

sellers: Inspections Before a Contract? Now, that's an Interesting Concept! - 05/21/08 10:35 PM
In Florida, most real estate contracts are written with the contingency of satisfactory inspections and the ability of the Buyer to obtain financing. For those of us who have never lived in another state, or practiced real estate anywhere else, we've always done it that way and quite frankly, it seemed to make sense...why would the Buyer pay for inspections on a house that they haven't come to terms with the Seller on yet?
