Portland home prices up, says report

Across the country, Americans saw home prices drop precipitously in the fourth quarter. That wasn't the case in Portland.

Portland was one of only three U.S. markets where home prices increased in the latest quarter, according to new data from Standard & Poor's. Only Charlotte, N.C., Portland and Seattle showed year-over-year increases in prices. Charlotte's growth was the biggest, at 2.3 percent, followed by Portland at 1.2 percent and Seattle at 0.5 percent.

South Florida home prices plunged. Home prices in the Miami area dropped 17.5 percent in the fourth quarter, the biggest decline in the country, according to Standard & Poor's.

Las Vegas and Phoenix were right behind, with a 15.3 percent year-over-year decline. Los Angeles, San Diego, San Francisco, Detroit and Washington, D.C., all posted declines in the double digits.

Nationwide, home prices fell 8.9 percent by Dec. 31, ending a full year of declining prices.

The S&P/Case-Shiller quarterly index tracks the prices of existing single-family homes nationwide compared with a year earlier.

"We reached a somber year end for the housing market in 2007," said economist Robert Shiller, a creator of the report, in a statement. "Home prices across the nation and in most metro areas are significantly lower than where they were a year ago. Wherever you look, things look bleak, with 17 of the 20 metro areas reporting annual declines and the remaining three reporting flat or moderate growth rates."

HOUSE PASSES BILL TO PROTECT OREGONIANS FROM PREDATORY FORECLOSURE SCAMS
HB 3630 is Second Republican Special Session Priority to Pass House

SALEM- House Republicans today announce the passage of House Bill 3630, legislation to

protect Oregonians from predatory foreclosure scams. HB 3630 is the second Republican

priority to be approved by the House of Representatives for the 2008 special session.

"This common sense legislation cracks down on scam artists who prey on homeowners facing

foreclosure," said House Republican Leader Bruce Hanna (R-Roseburg). "Rather than helping

Oregonians, these scam artists obtain deeds from homeowners and immediately move to kick

them out onto the street. HB 3630 prevents this unfair practice."

HB 3630 requires foreclosure consulting contracts to be in writing, and be provided to a

homeowner 24 hours in advance. It prohibits a foreclosure consultant from being the purchaser,

and requires that 82 percent of net proceeds from the sale of the house be given to the

homeowner.

"HB 3630 also ensures that homeowners facing foreclosure receive straightforward information

from their lenders regarding the foreclosure process and directs the homeowner to counseling

and assistance that is available to them," Rep. Hanna said.

Mortgage Financing in Oregon

I think everyone understands that mortgage loans are much harder to obtain these days. Many of you currently have mortgages that are no longer available. The State of Oregon is trying to make it even harder for Oregonians to obtain financing. If our elected officials pass SB 1040 it will have a devastating effect on the value of our homes and economy.

The grave reality is this bill is more about certain members of congress getting their name in lights than doing what is in the best interest of the people. Don't allow them to negatively impact your net worth for their personal gain!

I urge you to contact your Senator and Representative today and tell them LOUD and CLEAR to vote NO!!

The good news is they go home in a couple of weeks and we can beat them at their own game.

I have included some highlights if you are interested.

We have another call to action on SB1090 that requires your participation. We are asking you to get face to face with your Senator and your Representative. This is particularly true if your state Senator or Representative is a member of the Oregon Legislature Joint Committee on Ways and Means, as identified later in this email. Your participation is critical to our success as each of us can only visit our own legislators as constituents.

The present situation is as follows:

· The bill is still alive. SB1090 passed through the Oregon Senate Commerce and Labor Committee on Monday evening at around 7:45 PM on a 3-2 party line vote. Due to a projected financial impact of around $500K - $600K for the remainder of the biennium, it was sent to the Joint Committee on Ways and Means.

· It was the Dash 4 and Dash 9 amendments that were approved, and these amendments were handed out about 15 minutes into Monday's hearing. No one had advance notice or time to prepare for these amendments. The Dash 4 amendments require an elevated amount of mortgage lender and mortgage broker bonding at $100K (increased coverage) and the establishment of an Errors and Omissions coverage at $500K (new). The Dash 9 amendment is a complete re-write of the original SB1090 and is essentially a new bill.

· You are receiving this message after the OAMP Government Affairs Committee (GAC) has had time to review the content of the Dash 4 and Dash 9 amendments. Significant issues with SB1090, as amended, remain.

· The Joint Committee on Ways and Means is a committee comprised of 10 State Senators and 9 State Representatives. Having been referred to this committee, the bill can:

o Remain here for the remainder of the session (in other words, die).

o Be amended by the members of the joint committee or maintain its present condition. In either case, it can then be voted on by members of the committee.

o Be approved, as amended, by a minimum of 6 Senate and 5 House member votes within the committee to make it to the respective floors for a vote.

· The mortgage broker and mortgage lender community, in unison with the other members of the United Financial Lobby (UFL), needs to continue to bring forth our collective message to the legislative body. Get in contact with your Senator and Representative in Salem and discuss the following talking points. Do so in a very respectful manner - our combined testimony and discussion on this important topic has been very professional and it needs to remain so - we are committed to improving state oversight and regulation of the mortgage industry, but SB1090 in present form isn't the answer:

o This is a rushed piece of legislation that affects a highly complex industry. Unintended consequences could lead to a real estate finance related disaster in Oregon.

o Subjectivity - SB1090, as amended, contains many subjective components which remain a cause for great concern, particularly with respect to the possibility of discrimination.

o Unlevel playing field - Oregon businesses would be forced to operate at a distinct disadvantage to large, out of state competitors.

o SB1090 has a current financial impact to the state estimated at between $500K - $600K. The regulated entities would end up picking up the tab via higher license fees. (Note - to legislators, this means "higher taxes", which none of them want to be linked to).

Congress Raising Conforming Loan Limits

Congressional leaders and the White House reached agreement late last week on a proposal to increase conforming loan limits as part of a larger economic stimulus package. Part of the package will include having the FHA loan limits increased from $362,000 to a high of $729,750 and the GSE (Government-Sponsored Enterprises - i.e. Fannie Mae and Freddie Mac) conforming loan limit would increase from $417,000 to a maximum of $729,750. Also, in order to provide an incentive for lawmakers to work on overall GSE regulatory reform, the loan limit increases for the GSEs are limited to one year. Currently, Californians are forced into more expensive non-conforming jumbo loans, decreasing homeownership opportunities for many and forcing others into more costly - and often riskier - loan products. This package will allow for more homeowners, with home loans up to $729,750, to qualify for better programs and potentially better rates.

While legislation is required to enact this package, Congressional leaders are indicating they will pass it soon.

What this may mean is that for those with loan amounts between $417k and $750k there may be an opportunity to take advantage of the lower interest rate environment until the jumbo market starts to function efficiently again. Just in case you have not heard. Fred Stewart recently decided to run for Portland City Council. He is running because he knows he can make a difference in how Portland moves forward into what will most likely be a rough economic period. His background and experiences have given him a unique perspective Portland needs. A friend of his, Commissioner Eric Sten, has decided to step down on April 4^th and there will be a special election during the May primary.

He needs your help as he has decided this weekend to try and participate in the voter owned election. This means he will need 1,000 people from Portland to donate $5 and sign a petition to grant his campaign with $150,000. This will mean he will commit to not seek financial support from anyone else, as the public is financing his campaign. He supports Voter Owned elections as he feel it makes the election process more credible and fair to the people of Portland as well as the candidates. He has 4 days in which to gather the needed signatures and donations.

Blogging For Consumers or Collegues?

It seems to me that a lot of people are blogging towards industry collegues instead of consumers. The point of blogging should be to get information out to the consumers and not other real estate profesionals. Perhaps you can get a referral from collegues, but the point of marketing yourself is to obtain/retain clients.

What is the success rate for those of you out there blogging on ActiveRain only? Are you gaining clients or just adding 200 points per blog? Why are people commenting and doing all the things they are in order to get more points to move up the ranking in your state, county, city, etc? I started gung ho on writing a blog every day to be at the top of the ranking and then I questioned if there was any new business coming from this particular site's blogging. The answer for me was no. How many new clients are you reaching? I would like to see ActiveRain doing more to promote the site to consumers and less to professionals. The obvious key is to link people away from your personal website to your ActiveRain blog. Is that owrth it to send people away from your own site, though? How do you guarantee they come back and not find someone else's blog interesting on ActiveRain or someone ranked higher?

I'm just stating my opinion, so if you disagree that's fine. Just write your own blog on your opinion.

Bank of America to Buy Countrywide

Bank of America Corp. announced today that it has agreed to buy Countrywide Financial for $4 billion in stock.

The purchase will make Bank of America the nation's largest mortgage lender and loan servicer.

"Countrywide presents a rare opportunity for Bank of America to add what we believe is the best domestic mortgage platform at an attractive price and to affirm our position as the nation's premier lender to consumers," Bank of America Chief Executive Ken Lewis said in a statement.

The sale will place the responsibility of sorting out the payment issues surrounding millions of dollars worth of troubled loans on Bank of America.

"There's still plenty of risk involved," says Bart Narter, senior analyst at Celent, a Boston-based financial research and consulting firm. "[Lewis] is brave to do it. But I think that it's very likely down the road to be profitable, maybe not immediately, but long-term."

The agreement has been approved by both companies' boards and is subject to regulatory and Countrywide's shareholders approval.
