Is a seller with a purchase money first and second protected by the law (in OR) in a foreclosure situation from any recourse or deficiency? This is a rental income property which was always operated at a loss. The owner lives in California. Any Advice?

foreclosures: Do the Banks follow Any Rules when doing Short Sales - 08/16/08 11:33 PM
I had blogged a few days ago about a short sale that was going to the bank. Well unfortunately it did. It was not for a lack of trying, the listing agent and the escrow agent both did their part. It seems like the more I educate myself the faster the banks change their rules and for no apparent reason.
When there was no more room for negotiating (there was a first and a second) the other agent and myself took a cut in commission, there's more, we also agreed to contribute $1500 each to the second on top of the … (8 comments)

The head lines in Yahoo this morning read "Foreclosures More Than Double In 2007", Ouch! I'm a forever optimist which drives my husband nuts, but I truly don't see what the banks are trying to accomplish here. First of all I know several people who have tried to work with the bank only to end losing their house. Theses are people who have jobs but their mortgage payment is too large now. Banks need customers, but if they keep foreclosing on them they won't qualify for any type of loan. Homeowner need to call Realtors before they are upside down, to see … (6 comments)

The headlines today on yahoo says " Foreclosures to rise no matter who is elected President". Enough already. It seems like every time I run an ad in the news paper That's the day they choose to print their doom and gloom on the housing market. I guess I'm just optimistic. If you sell at a lower price you buy at a lower price, common sense. Never borrow against your home what you cant make the payment on tomorrow. I know this doesn't help those already in trouble, but all the bad press just seem to offer is no hope. I … (3 comments)
