activerain community support: LENN HAD AN EPIPHANY TODAY, ALL WE HAVE TO DO IS GET RID OF CHICKEN LITTLE - 11/07/07 10:55 AM
IT'S NOVEMBER, TRADITIONALLY ONE OF THE WORST MONTHS FOR REAL ESTATE SALES.
We all know that to be fact.  Over the years, many sellers take their home off market and wait for the Spring "home buying season".  Listing agents would often recommend taking a home off market because with the holidays coming, they knew that access might be difficult with sellers (and agents) busy shopping, decorating, traveling, entertaining, hosting house guests, and the many exciting things that many folks do in the weeks between mid-November and the first week in January.  Thanksgiving is the start of the slow season for real … (85 comments)

activerain community support: MY FIRST ACTIVE RAIN POST WAS ABOUT - YES! COPYRIGHT - 10/13/07 01:41 AM
"The more things change, the more they stay the same."
Yesterday, I filed my tax return for 2006.  Included as income for 2006 was $48,000 for money received for damages for copyright infringement.  This has been the average amount collected for the past 4 years.  In the future, statutory damages should be easier to collect with the recent jury decision in the music download case in Duluth, Minnesota:  "The recording industry won a key fight Thursday against illegal music downloading when a federal jury found a Minnesota woman shared copyrighted music online and levied $222,000 **** in damages. . . Things just got a lot hotter for folks who believe that they can just take resources and use them even when it violates the copyright of the rightful owner of the property.
This is a music download case where the defandant downloaded from the Internet and shared copyright protected music.
This is a landmark case and copyright protections just got more valuable.

activerain community support: COPYRIGHT ENFORCEMENT REVISITED with AN INTERESTING ANGLE - 03/08/07 01:19 AM
My latest adventure in copyright protection enforcement has taken a very interesting turn.  A local agent recently got caught with one of my maps on her web site.  This is a local agent of a national company.  The agent and her broker are presenting a new problem.  While my map is no longer on their web site, Google has it indexed in "Images" with a link to the agent's web site.  Google Images and images in general are a very popular search resource for consumers and every day that my map is sending visitors to a web site not my own is costing me traffic.  When … (65 comments)

activerain community support: MAPS CAN'T BE COPYRIGHTED?? WRONG - 01/16/07 01:42 PM
MORE INFORMATION ABOUT COPYRIGHT.
Kristal Kraft's article today about Plagiarism and Copyright was interesting.  She relates her experience in the past when confronting a copyright violators who stated "you can't copyright a map".
Behold RAINERS, one of the many Copyright Certificates of my maps.  What this Certificate gives to me is an automatic claim for STATUTORY damages if someone takes one of my maps and uses it.
However, I'm not limited to statutory damages.  When I discover that someone is using one of my maps, I don't give a warning.  I send the evidence, web page, images, etc. to my attorney who sends a Cease and Desist letter DEMANDING … (10 comments)

activerain community support: COPYRIGHT CONFUSION III and CRAB IMAGES - 11/06/06 07:53 AM
Many questions from the first copyright blog has kept this string going.  This should be the last.  I'll try to answer them below, but remember, I AM NOT AN ATTORNEY OR COPYRIGHT EXPERT.  I'm a real estate broker who has had some experience protecting my copyrights and collecting damages from folks who violated the law by infringing on my copyrights by copying and using images from my web sites on their own.  Of course, anyone is free to link to any page that I have on the Internet.  PERMISSION TO USE YOUR ARTICLESIf others want to use your articles, what's the … (6 comments)

activerain community support: COPYRIGHT CONFUSION - FOLLOW UP - 11/05/06 08:19 AM
<!--StartFragment -->I got some questions about my last blog about copyright.  NO, you cannot copy articles and use them as long as you credit the writer (copyright owner). This is the part of the copyright law that permits publishers, critics, etc. to use a short except or snippit when giving a review or example in an article.  The ability to use snippits is very limited.NO, I don't believe that using content, images, etc. in blogs is exempt.   Some may consider Active Rain non-commercial.  However, if someone takes my images and uses it on their blog, I will pursue them for damages and … (4 comments)

activerain community support: IS THERE REALLY COPYRIGHT CONFUSION? - 11/05/06 02:21 AM
WHAT IS COPYRIGHT PROTECTED?
There has been some blogging about copyright this week, so, although I AM NO COPYRIGHT EXPERT, I have some experience in the matter.
If folks have any confusion about copyright, don't be concerned about what you don't know.  Just think about what you DO know.  A person may not know if a writing or image is copyright protected.  But, everyone KNOWS what they did write or create.  If you DID write or create it, use it.  If you didn't, don't.  That is so amazing simple.
I believe that folks get copyright infringement education in the 8th grade Civics class. I remember quite well when I … (22 comments)
