ActiveRain posts tagged with "Copyright" by Lenn.  Sadly, posts tagged with "Copyright" just reached an even 50.
"HEY, I WROTE THAT!!!"   With Congress revving up to make copyright infringement a criminal act, including YouTube videos, more attention to copyright came our way this week.   Mike Saunders  writes about Congress getting into the plagiarism act.
A featured article by a member turned out to be a copy and paste of an article from another members blog.  This isn't the first time this has happened because, IMO, it's simply impossible for ActiveRain to police each and every post by each and every member.  The feature … (79 comments)

CRIMINALIZING COPYRIGHT VIOLATIONS and
CRIMINALIZING USING VIDEOS FROM YOUTUBE!
If I had the time, interest or inclination, I'd go back through my posts and re-post two old ones, and I mean old, like 2-3 years ago whereby:
SOME IN CONGRESS WERE MOVING TOWARDS CRIMINALIZING COPYRIGHT VIOLATIONS, and
I BELIEVE THAT POSTING YOUTUBE VIDEOS COULD VIOLATE THE OWNER'S COPYRIGHT.
Oh well.
O.K.  So it's O.K. to embed YouTube videos today, despite the law when the poster gives permission by uploading it.  That said, I took a lot of flack with the post below.

copyright: HIRING PROFESSIONAL PHOTOGRAPHERS CAN BE TRICKY! PROTECT YOURSELF! WHY I WANT THE COPYRIGHT TO THE PHOTOGRAPHER'S WORK, OR AT LEAST A WRITTEN PERMISSION TO REPRODUCE. - 02/19/11 12:30 AM
A POST OF FEB. 17, YOU DO NOT HAVE TO SUBSIDIZE YOUR COMPETITION! IF AN AGENT WANTS TO LIST YOUR EXPIRED LISTING, LET THEM EARN IT!! generated some interest and a few comments from ActiveRain members.
THAT POST ALSO GENERATED SOME PRIVATE E-MAIL.  I won't post the e-mail content here, that copyright thing, you know.   However, the content of the very long e-mail was interesting and I still don't know why the writer, "a Real Estate Agent in Lenoir City, TN." didn't post the comment directly to the post about listing agent utilizing photos from the MLS system that were entered into the MLS system by the previous listing … (28 comments)

YOU DO NOT HAVE TO SUBSIDIZE YOUR COMPETITION!
A provocative post by ERICA RAMOS inspired this post for members to think about those photos that are added to their MLS listing reports.  The post and comments are worth a read.  MLS systems have their own individual rules and regs about photo use.  Read the rules for your individual MLS for photo use.

FOUR ARTICLES COPIED AND POSTED ON ACTIVERAIN???   Jeff Belonger enters the sordid world of content thieves, copyright, plagiarism, pick your ethical conundrum.
HA!  IS THERE AN EPIDEMIC OF OF THE PLAGUE OF PLAGIARISM ON ACTIVERAIN?  Hopefully, it isn't contagious.
THIS LITTLE IMAGE HAS MADE THE ROUNDS on web pages and blog posts and comments published by agents and ActiveRain members with a view about the ethics of plagiarism that differs from the vast majority of agents and ActiveRain members.

REPRINT OR REPUBLISH????
There is a big difference.
Matt Stigliano describes the use of HouseLogic content.  So, being the inquisitive person I am when reading about copyright matters, I visited the site and READ THE GUIDELINES.
Interesting that the guidelines refer to "REPRINT" and not "REPUBLISH".  Big difference.
Had the rights to reprint not mentioned the requirement that a "hyperlink" to the source be included in the "reprint", I would have assumed that they permitted only PRINT AND DISTRIBUTE, not REPUBLISH.

COPYRIGHT INFORMATION FOR ACTIVERAIN MEMBERS!
COPYRIGHT TIME.  Several posts in the past few days about copyright and some pretty risky advice contained in some, made me think that it's time to do the copyright thing again.
I'm not an attorney.  These posts reflect my experience in pursing copyright violators, folks who copy and past content created and published by me from my web pages, Google images, etc.  I have over 100 Copyright Certificates and pursue each and every violator for damages.
$30,000 JUDGMENT RECEIVED.  I received a note from my attorney's office last week that a Default Judgment against a copyright defendant … (90 comments)

DON'T CONFUSE GOOGLE WITH COPYRIGHT LAW.  WHAT 20% RULE??  "DANGER, DANGER WILL ROBINSON!"
Inspired by Linda Lohman's FEATURED article of Sept. 11 @ 3:46 p.m. about Google and ActiveRain posting (no link or reBlog because it's Members Only), I was left with more questions than answers.
Linda relates an experience at a barcamp  wherein a speaker advised that . . . . . . "It's OK to Copy Someone Elses Blog and Change 20% then Call it Your OWN?"
WHAT???
I DISAGREE with that statement and would not suggest that anyone engage in the practice of publishing even partial works of others when the original content is altered by 20% … (132 comments)

WAY BACK TO 1996?  You bet and it's been a blast from day one in August 2006 to today in August 2010.
ROBERT SWETZwrites a lovely post about my first post on ActiveRain.  Sorry, can't re-blog it because it's MEMBERS ONLY.  Do drop by Robert Swetz's  blog.
Copyright and Real Estate Web Sites, My Experience

HA!  Yes, copyright was my first subject.  Even in 2006, I had experienced copyright infringement and the subject was fresh.  I believe I was writing about it on the RealTalk listserve forum at the time and just continued on ActiveRain.
My ActiveRain experience hasn't changed much since August 2006.  … (36 comments)

ANOTHER ADVENTURE IN COPYRIGHT CONVERSATION!
William Gallahue writes about copyright with advice to folks who receive notices of copyright infringement, the dreaded Cease and Desist letter, from an attorney representing the owner of a copyright.
William proposes that a person has a reasonable expectation that content, template, image or photo purchased, that the content is legal to use.
TO PROTECT YOURSELF, PERHAPS A DIFFERENT PERSPECTIVE IS NEEDED.
I submit that there is no reasonable expectation that any image, template or photo is free of copyright protection.

SOMETIMES EVENTS SIMPLY DEFY DESCRIPTION!
At RainCamp in DC last Wednesday, while having a lovely conversation with a friendly agent I've known "remotely" from ActiveRain for a few years, we were interrupted by a person who introduced himself to me.
I held out my hand to give him a friendly hand shake, which he ignored.   Oops!  After a morning of hugs and handshakes from ActiveRain members, this cold stare said to me that something was different.
ALERT!  . . .  ALERT!   UNFRIENDLY AURA NEAR?
He introduced himself and I immediately recognized the name of his company.

YEAH, YEAH, MORE COPYRIGHT "STUFF" FROM LENN by way of ALAN MAY.
Actually, this little jewel is from Alan May and it's priceless.  This is also pithy and I do love pithy.
For the record, my attorney just sent my Affidavit to "the Judge" on one of my copyright actions against a real estate agent in Northern Virginia who took, not only my Fairfax County map, he took an entire page of content from one of my web sites whic coincidentally contained a photo of my home.

COPYRIGHT IS NOT JUST FOR THE PROFESSIONAL WRITERS OR PHOTOGRAPHERS.  YOUR WEB SITE HAS VALUE.  YOU CAN PROTECT IT.
Inspired by C Tann-Starr who writes about the electronic copyright registration process,
I am not an expert.  I am not an attorney and the below is not intended as legal advice.  The below represents my experience protecting my online advertising content.  I receive many inquiries from ActiveRain friends about an experience they have had when they've discovered that a competitor is using their content on a competing web page.  My first question is usually, did you register your web page, image, photo, … (34 comments)

copyright: Your Local MLS. Friend or Foe? - 05/21/10 11:28 PM
MRIS is, IMO, a great MLS system.
There is a big difference between owning a listing, which MRIS does not, and owning the published listing reportcontained in the MRIS display.
There is a big difference between owning a copyright of a photo and the limited copyright that brokers give to MRIS when an agent uploads their own photos.
If agents what to own the copyright of the original photos contained in their MLS listing reports, all they have to do is take and upload their own and not wait for MRIS to send the MRIS photographer to shot and upload the photo.

POSTING COPIES OF E-MAIL???  DANGER WILL ROBINSON, DANGER!!!  YOU MAY VIOLATE THE WRITER'S COPYRIGHT.
NOTICE:  I'm not an attorney and I do not give legal advice about copyright or anything else.
However, I have about 5 years of experience in copyright matters through the adventure of collecting damages from people, mostly real estate agents who copy and paste my COPYRIGHT PROTECTED MAPS from the Internet and using those graphic images on their own web pages - and in the process are using my COPYRIGHT PROTECTED graphic images to compete with me.

A COPYRIGHT MYSTERY. . . . THE CASE OF THE MISSING SCISSORS
ANOTHER IN A CONTINUING SERIES OF COPYRIGHT WARNINGS!
IS IT SELECTIVE READING?
ActiveRain members who believe that they can interpret copyright warnings to suit their needs may be disappointed when they are served with a COMPLAINT FOR CEASE AND DESIST ORDER and DAMAGES FOR COPYRIGHT INFRINGEMENT.
ACTIVE RAIN IS A COMMERCIAL SITE.  Don't look for excuses to cut and paste content from web sites that advise, in their copyright warning, that their images are not available for commercial use.

COPYRIGHT THIEVES CAN RUN and THEY CAN HIDE, BUT THEY WILL NOT GET AWAY!
WHILE REVIEWING WEB SITES ADVERTISING REAL ESTATE SERVICES IN NORTHERN VIRGINIA, a few months ago, I discovered that a real estate agent was using my content for most if the main page of his web site.  I got a chuckle because, not only did he use one of my copyright protected maps, he also use a full page of content from one of my web sites and included a photo of my home.

ACTIVERAIN IS WATCHING YOU!. . . .  YES, YOU!. . . . IF YOU THINK YOU CAN JUST COPY AND PASTE CONTENT THAT YOU DIDN'T WRITE TO YOUR ACTIVERAIN BLOG, THINK AGAIN. . . . YOU CAN'T HIDE!
IT'S THAT TIME AGAIN.  The incidence of ActiveRain posts that contain plagiarized content is still a problem.  Either members do not understand that to copy and paste content that they did not actually write is a violation of the ActiveRain Guidelines AND a violation of the copyright law, or they don't care and figure no one will notice.

PLAGIARISM OR COPYRIGHT VIOLATION???  WHAT'S IN A WORD?
Sally Cheeseman's article HOW DOES IT FEEL TO BE A PLAGIARISER? is MUST reading for ActiveRain members.
Sally's post is timely notice to ActiveRain members who steal or infringe on the literary or artistic creations of others.  However, I have long felt that there is too much focus on the word plagiarism.
I believe that one of the problems is the use of the word plagiarism.
CALL IT WHAT IT IS!  A VIOLATION OF THE LAW.
I prefer to use the term copyright violation, or, copyright infringement.

copyright: COPYRIGHT INFRINGEMENT IS NOT A FORM OF FLATTERY! - 05/18/09 10:29 PM
Inspired by a thoughtful post by Jacob Clayton, it's time for an attitude change about copyright infringement.
Folks who have had their copyright protected content (any original writing, image, photo, video, etc.) copied and published by another person, usually have pretty typical reactions:
Shock!
Sick to the stomach!
Disbelief!
Anger!
WE ARE NOT FLATTERED!  Are these the emotions of a person who has just been flattered?  If you find that any property has been stolen, do you feel flattered???  I don't.  Telling me that I should feel flattered when my property has been stolen is to demean the value of my published content.  Our content has … (53 comments)
