1. A mess

Anyone who is tuned in to what is going on in our country would probably agree that our economy is a mess right now. There is so much going on with bailouts, unemployment, foreclosures...who wouldn't have high anxiety in a time like this? So many Americans are in a state of panic for fear of losing their jobs and their homes. If you turn on the news every morning it seems as if there is always something new occurring. The unemployment and foreclosure rate is steadily increasing. It probably makes you nervous, it makes me nervous, it makes America nervous.

It's been a almost a year since I have crossed over to the leasing of homes. I do not know first hand how difficult the Real Estate industry is as of now because I am not involved in it. After listening to the news and hear say about the market continuing to drop, I wonder how many of my Real Estate friends are making it. Even though the buying and selling has slowed down, people are still leasing homes. I am only assuming this is because they do not meet the requirements to get a loan and can not afford it at this time. It seems as though many people who are wanting to buy a home are being forced to rent. I also assume that the leasing business has increased due to homeowners also losing their homes due to foreclosures. Every one is running around trying to find a place to call home.

Even though the leasing business is busy, the owners of the rental property are keeping their fingers crossed. Many owners have put their home up for purchase and/or lease. I know of several owners that have a "For Sale" sign up and a leasing ad in the paper. They are taking whatever they can get at this point. Remember when they were handing out loans like it was candy? Basically, if you had a pulse you could get a loan. Many people saw this as an opportunity to buy rental property. This was usually with a "adjusted interest rate". Most owners were counting on rising rents and low interest rates to cover their mortgage payments. The downward dip of house values and with the rise of their mortgage interest rates, owners are scraping to cover their monthly cost.

The way the economy is today, you would think that renting a home would be the safest bet. You can easily find a place for you and your family to live without the worries of the economy but this isn't exactly the case. You have to remember that the person you are renting from (ex. landlord, owner) is not exempt from the "Foreclosure" bug that is going around. Many renters are finding themselves in sticky situations, losing their rental homes to foreclosures. If you are a renter, it's important that you know what is possible in a time like this, what your rights are and how to take action. Here are a few questions that you might need the answers to:

1.The house that I am renting is being foreclosed on, does that terminate my lease?

Most likely, yes. When a rental home is in foreclosure, the renters lease is usually terminated. I've read that in most states if the mortgage was recorded before the lease was signed, the foreclosure will basically wipe out the lease.

2. If I can stay, who will be my new landlord?

You might want to think twice before staying in a home/apartment/condo that has been foreclosed. Most of the time the bank or the mortgage holder becomes the new owner. If this is the case, a servicing company might be paid to handle the property. You probably shouldn't expect to get the kind of attention you did from your previous landlord. Most of these companies are more interested in financial matters and the last thing on their mind is the leak in your bathroom.

If you are renting a home it's very important that you keep up-to-date about what is going on. I've actually had prospective tenants call me looking for a place to rent. They explain to me that the property they were renting went into foreclosure and they had no idea. They continued to pay the rent but it went straight into the landlords pocket and they were having difficult getting a response to maintenance needs. The landlord could have cared less because he knew he was losing the home. These renters were taken advantage of.

3. If I have to move out, how long do I have?

This really depends on the new owner. Sometimes you get lucky and you don't have to move asap. Some renters have at least thirty days to find a new place and move.Other renters might not be so fortunate. When a new owner takes over a property, they want the tenants out yesterday. They do whatever is legally possible, not giving the tenant more than three days to make arrangements.

4. What if I refuse to leave the property I am renting?

In my opinion, this is probably not a good idea. You probably won't have a leg to stand on. You might be face-to-face with an eviction lawsuit without any sort of legal defense. Wouldn't you rather just find another place to live than having to battle an eviction on your record? I just don't think it's worth it.

5. Why do new owners evict previous tenants? Wouldn't they want the money to pay their mortgage?

In theory, it makes sense but most of the time it isn't the case. Most new owners see their new property as investments. They assume that properties that are vacant are more likely to sell than those that are occupied. Some of these owners don't realize that it would probably be more beneficial to keep the previous tenants rather than evicting everyone and trying to sell it.

6. What are my rights? Do I have any?

Some people have tried to take their case to court, pleading the judge to let them stay in their home. Again, when there is a mortgage before a lease there is really nothing that can be done.

7. Why should I be the one to cover all of my moving expenses? The foreclosure wasn't my fault.

You're right, indeed. It wasn't your fault that the home you were renting went into foreclosure. As far as collecting cash for your expenses, there might be somewhat of a loop hole. When you entered into a lease with your landlord, it's usually for a year. There is a duty known as "covenant of quiet enjoyment". This basically states that if a landlord defaults on a mortgage, which causes the termination of a lease, it violates this convenant. You can then sue for the damages it caused.

Most people that bring their cases to the courts sue for application fees, moving and apartment-searching costs. They also can sue for the difference between the new rent and the rent under the old lease. You have to realize what you are going up against, though. If your landlord is dealing with foreclosure, he might not have the money in his pocket to give you.

8. You said that some renters have no idea what is going on. How can I find out about rental foreclosures?

I found a really neat website where you can search a database for free to find out if your rental property is in foreclosure or not. It's called Rental Foreclosures and it's free! You can't beat that!

Finding A Home Is A Lot Like Finding Love

You know, I was thinking ( I tend to do that sometimes) about love. I was thinking about how love and finding a new home are a lot alike. Two of the biggest decisions you will make in life is finding a dream home and finding a dream mate. Both decisions come with a lot of soul searching and it's something you will definitely put a lot of thought and heart into. Here are some things to think about when searching for a home:

1. Looking For Love
2. Playing The Field
3. Chemistry/Compatibility
4. Second Opinions
5. Making A Commitment

1. Looking For Love

- You never want to be looking for love in all the wrong places. When you are looking for a home you want to make sure it's an area you like and it's a place you feel comfortable in. Years ago, I can remember in Sunday School class when our teachers made us right down what we thought we wanted in a soul mate. My lists looked like this:

Dream Mate: Tall, Dark, Handsome, Witty, Funny, Stocky, Ambitious, Respectful, Caring, Generous, Giving, Loving, Compassionate, Spontaneous, Trustworthy, Dependable, Career Oriented, Nice smile, Good teeth, Cute feet, Fashionable, Successful, Hard working, Good relationship with parents, Clean, Musically inclined, Goes to church, Considerate, Goofy, Passionate, etc

Finding a soul mate is a lot like finding a home. You've got to know what you want before you get on the playing field. It's kind of like going to the grocery store without a list, you might end up with a lot of things that you don't actually need. Make a list of all the things you want in a home. No one ever said there was anything wrong with being picky and to the point. Just like finding a soul mate, you want to find something that you are going to be comfortable with, something you can enjoy and afford.

Dream Home: Brick, Hardwood floors, Ceiling Fans, Two-story, Fenced backyard, Tile Floor, Carpet, Vaulted Ceilings, Walk-in closets, Jacuzzi Tub, His & Her Sinks, Separate shower, Surround Sound, Security System, Golf Course, Pool, Office nook, Breakfast nook, Wet bar, 4BR/2BA, Bonus room, Laundry inside, Club house, 2 car garage, Patio, Landscaped, Dining area, Living room, Storage space, Stainless steel appliances, Attic, etc

So, when looking for a home (just like searching for that diamond in the ruff), it's good to know what you want. Don't be afraid to be picky. You wouldn't settle for less when choosing the love of your life so definitely don't settle for less when choosing your home.

2. Playing The Field

- I can't think or name one person that I know of that dated only one person, fell in love and got married. Can you? If so, great...if not, join the club. It's very seldom that you are going to view one home and buy it. Actually, I wouldn't suggest it. I have always told my friends to get out there, go date, meet new people. You won't know what you are missing unless you venture out. Even if you think you've found "the one", it's good to have others to compare them to. Who knows, the "others" might just make that one special house look even more fantastic. So, play the field when you are searching for a home. After you make a list of what you are searching for, show this to your agent. This will allow them to get an idea of what you are wanting. This will allow you to play the real estate field.

3. Chemistry/Compatibility

-Have you ever dated someone that was intensely hot but something was just...well, missing? It happens all the time, something just "isn't" there. You could find what you think is the home of your dreams but you just don't have that 'gut' feeling about it. It's very important that you have chemistry with the home that you buy, you and your home need to be compatible. Yes, I said compatible. This is where you will be waking up every morning and going to sleep every night. You wouldn't want to wake up to someone who you had no chemistry with would you? Don't answer that! :) Keep "Chemistry" in mind when searching for your dream home.

4. History

- I'm not sure what Dr. Phil says but if you want to know where someone is going, take a look at their history. History is usually a predictor of the future. I made the mistake of being engaged to someone whose history I knew nothing about. I only went on what I knew in the "moment", needless to say...I'm not engaged anymore. It's good to know a little history about your dream home. It's not something that will make or break the situation but it's always interesting to hear about where you will be living. Also, what about the history of the neighborhood? What kind of neighborhood is it?Do they hold yearly get together? Are the neighbors friendly? Is there a history of drunken block parties? Hey, block parties aren't that bad unless you, um, aren't really into block parties. If I could do it all over again I would have gotten a background check on everyone I dated growing up, maybe you should look a little deeper into the background of the home and neighborhood you might be moving into.

5. Second Opinions

- You know, while looking for love through out my life there have been several occasions where I just wasn't "sure". You know, sometimes we live in our own little bubble and it's hard to see things for how they really are. My fathers is one opinion that I trust 100%. Sometimes other people can see things that we can't. If you are "iffy" about the home you are looking at, get a second opinion. Granted, you will be the one that is living in the home but sometimes it just makes us more at ease knowing that we are making the right decision and someone else agrees.So, if you are confused with what your gut is telling you, do what I did...and get someone else's opinion.

6. Making The Commitment

- Eeeck, what a scary word, right? It doesn't have to be. After doing your soul searching, making a list of what you want, playing the field, finding the chemistry, researching the history and getting a second opinion...you just might have found "the one". Now, it's time to but the petal to the metal and make that commitment.

Active Rain Can Make You Famous.....Well Almost!!

I just wanted to post an exciting story! Have you ever heard of the group "Inspired By Song"? This is one of my favorite groups because people post songs that truly inspire them and also, my favorite are the contests that Adam and Jason hold each month. It really stimulates my creativity and I also enjoy reading everyone's posts.

A few months back, we had a contest that pushed us to write about our first concert ever. I remembered it like it was yesterday, it was the New Kids On The Block. Now, if you are around my age you will have no trouble remembering that but if you are a little bit older the name might be nothing to you. Let's just say my favorite band of all time reunited...it was really like the Beatles getting back together for me and thousands of other women.

After writing my contest entry, someone found me and my entry. It was the Baton Rouge 225 magazine. Now, if you're not from here that probably doesn't ring a bell. If you are from here, then you know that 225 is one of the most popular magazines IN Baton Rouge. 225 called and wanted to do an interview with little ole me. I was so excited. I'M GOING TO BE FAMOUS, WELL ALMOST!

We met at Starbucks to do the interview. Of course, I had no trouble going on and on about my favorite band. I was so excited that I was going to be going to their concert months later. *Note- The concert was one of the best concerts I had been to in my entire life, granted I've only been to a few* Weeks later the photographer came over to take pictures for the magazine. They took pictures of me and another friend that were going to the concert, we said cheese and took loads of pictures.

After the magazine came out, I had several people call me and tell me that they saw me. I felt somewhat famous. The one question every one wanted to know was, "How in the world did they find you?", "How in the world did you get to do that?". I wanted to just say, "Well, you know, I KNOW PEOPLE", but I really had to tell them that it was Activerain! So you see, you never know who is reading, who is surfing...you never know when you might be ALMOST FAMOUS!

Oh yes, this has been a very popular topic before and it continues to be popular. What kind of car do you drive?o Do you think it really matters? While some people believe that a car is a car, others believe that it actually says something. Do you think your clients judge you by your car? In this materialistic world, you better believe it!

A now Ladies & Gents...A Story: My ex-fiance owns his own company. A year or so ago, he drove an older model car. Yes, it was a 96 Jimmy. Now, for those of you that drive Jimmy's, please do not get offended. Anywho, one day he ran into an old friend and they went to lunch together. After much conversation, his friend looked at his ride and said "Man, business must be bad". Can you believe that? He actually SAID that! Needless to say, the ex carried his butt to the dealership and came back with a 07 F150, Harley Edition.

So, whether we like it or not...people DO judge a book by it's cover. This isn't to say that you should go out and buy the next Lexus. You should never make a purchase on impulse nor should you really make a purchase to please someone. You know what the best kind of car is? One that is paid off, right? I don't care if that baby is riding on all donuts, if it's paid off....I'll drive it until the wheels fall off.

Here's something to make you think. In Forbes magazine, they actually did an article on what YOUR car says about YOU! See if you can relate to any of these:

Corvettes: Drivers are in control, aggressive and seek adventure.

Monte Carlo: image concious, looking for an acceptable way to be a rebel, self-indulgent

Lexus Sedan: family-oriented, values politeness

Honda Accord: Might possibly like to vaccum out their garage, very clean.

Aston-Martin: You are self-made and not showy.

Bentley: You are more interested in rewarding yourself than making a statement.

Escalade: You speak your mind and are sometimes unapologetic. You enjoy life and do a lot of entertaining.
