float: left;" width="200" />This Veterans Day I have not been able to get the events that happened in Fort Hood out of my mind.  We love flying our flags here in Texas and all these flags at half mast are a somber reminder of what happened at Fort Hood this last Thursday.  The picture I have posted is from the entrance to our subdivision and as I drive by my heart just cringes for the loved ones who were left behind.</p> <p>As most of you know our son just got out of the Army this last May.  While in the Army he was an Intelligence Analyst and did two tours of Iraq.  His first tour he was based out of a base in Germany but the second tour he was based at Fort Hood.  We weren't able to go to the welcome home ceremony when he got back from his 1^st tour so we were thrilled that he was based close enough that we could attend the welcome home  ceremony from his second tour.  I have included the video I shot so you can see the excitement when the plane lands on US soil.  We were in a large reception area which I think might have been where this all happened.   The Army knows how to welcome their soldier's home and it was a day I will always remember.  (I think the <a href="http://activerain.com/blogsview/973240/welcome-home-to-texas-4th-infantry-" title="Welcome home to Texas 4th Infantry" target="_blank">Welcome home - To Texas 4^th Infantry</a> post is probably my favorite post of all time).  I am one the lucky ones and feel blessed to have our son home safe and sound and now a college student after serving his country for almost 5 years.  (He was supposed to be in the Army for 4 years but was in for almost 5 because of getting the stop lost.)</p> <br><br><br><br> <center><object height="344" width="425"><param name="movie" value="http://www.youtube.com/v/AZfFiUi820M&amp;hl=en&amp;fs=1&amp;"></param><param name="allowFullScreen" value="true"></param><param name="allowscriptaccess" value="always"></param><embed allowfullscreen="true" type="application/x-shockwave-flash" src="http://www.youtube.com/v/AZfFiUi820M&amp;hl=en&amp;fs=1&amp;" allowscriptaccess="always" height="344" width="425"></embed></object></center> <p>As a former military Mom I can't imagine the horror of thinking your son or daughter is safely back in the USA and then having them killed by a terrorist on their own base.  <strong>YES I said terrorist;</strong> I see this as an act of terror within our own borders. in Newport Rhode Island while we were on vacation.  My sister has two Indian trees on her land in Colorado.  I have written a post on one of her <a href="http://activerain.com/blogsview/1079930/speechless-sunday-bent-indian-tree-" title="Bent Indian Tree" target="_blank">bent Indian trees</a>.  History has it that the trees were bent to mark trails through the forest.  It is thought this would have been done 100 to 300 years ago.  The Indians would twists the saplings by lashing their tops down with rawhide or vines, weighting them with rocks or soil, or pegging them down with stakes.  I thought maybe this was an Indian Tree but contemplating it I have to wonder if nature didn't cause this tree to bend.  What do you think?</p> set for constitutional amendments election in Texas.</strong></p> <p>In the wake of the Texas Legislatures 81st session there are several constitional amendments that will be up for public approval this November.&nbsp; Voter turnout is notoriously low for these type of elections but every citizen needs to appreciate their freedom to choose in this great nation and get out the vote on November 3, 2009!</p> <p><img title="Texas" src="http://activerain.com/image_store/uploads/5/0/8/3/4/ar125121185343805.gif" height="165" alt="Texas" width="174" /></p> <p><strong>Ballot order set for constitutional amendments election</strong>.</p> <p>Texans will go to the polls on November 3 to approve or disapprove of proposed amendments to the Texas Constitution that were passed by legislators during the recent legislative session. Legislators must pass any proposal to amend the constitution by a two-thirds majority vote, but an amendment is not effective until a majority of voters pass the measure. Section 274.002, Election Code, requires that if "more than one proposed constitutional amendment is to be submitted in an election, the order of the propositions submitting the amendments shall be determined by a drawing" held by the Texas secretary of state.</p> <p>Because there are 11 proposed amendments this year, Secretary of State Hope Andrade held the drawing in late July to determine their order on the ballot. Next month's Legislative Liaison will detail each proposal. You will notice that <strong>Propositions 2, 3, and 5 are appraisal-reform measures strongly supported by the Texas Association of REALTORS&reg;</strong>.</p> <p><strong>Proposition 11</strong>, also supported by the association, is the eminent domain measure referenced above.</p> <p><strong>Proposition 1</strong> - HJR 132 The constitutional amendment authorizing the financing, including through tax increment financing, of the acquisition by municipalities and counties of buffer areas or open spaces adjacent to a military installation for the prevention of encroachment or for the construction of roadways, utilities, or other infrastructure to protect or promote the mission of the military installation</p> <p><strong>Proposition 2</strong> - HJR 36-1 The constitutional amendment authorizing the legislature to provide for the ad valorem taxation of a residence homestead solely on the basis of the property's value as a residence homestead.</p> <p><strong>Proposition 3</strong> - HRJ 36-3 The constitutional amendment providing for uniform standards and procedures for the appraisal of property for ad valorem tax purposes.</p> <p><strong>Proposition 4</strong> - HJR 14-2 The constitutional amendment establishing the national research university fund to enable emerging research universities in this state to achieve national prominence as major research universities and transferring the balance of the higher education fund to the national research university fund.</p> <p><strong>Proposition 5</strong> - HJR 36-2 The constitutional amendment authorizing the legislature to authorize a single board of equalization for two or more adjoining appraisal entities that elect to provide for consolidated equalizations.</p> <p><strong>Proposition 6</strong> - HJR 116 The constitutional amendment authorizing the Veterans' Land Board to issue general obligation bonds in amounts equal to or less than amounts previously authorized.</p> <p><strong>Proposition 7</strong> - HJR 127 The constitutional amendment to allow an officer or enlisted member of the Texas State Guard or other state militia or military force to hold other civil offices.</p> <p><strong>Proposition 8</strong> - HJR 7 The constitutional amendment authorizing the state to contribute money, property, and other resources for the establishment, maintenance, and operation of veterans hospitals in this state.</p> <p><strong>Proposition 9</strong> - HJR 102 The constitutional amendment to protect the right of the public, individually and collectively, to access and use the public beaches bordering the seaward shore of the Gulf of Mexico.</p> <p><strong>Proposition 10</strong> - HJR 85 The constitutional amendment to provide that elected members of the governing boards of emergency services districts may serve terms not to exceed four years.</p> <p><strong>Proposition 11</strong> - HJR 14-1 The constitutional amendment to prohibit the taking, damaging, or destroying of private property for public use unless the action is for the ownership, use, and enjoyment of the property by the State, a political subdivision of the State, the public at large, or entities granted the power of eminent domain under law or for the elimination of urban blight on a particular parcel of property, but not for certain economic development or enhancement of tax revenue purposes, and to limit the legislature's authority to grant the power of eminent domain to an entity.</p> <p>I would like to thank the Texas Association of REALTORS for their dedication and vigilance in observing the political process in Texas and staying on top of the issues that affect our industry and the people we serve.&nbsp; float: right;" /> Saturday mornings on 740AM and ended up purchasing his book Gulf Coast Gardening.  His book is now tattered and dog eared but has helped us to find plants that are native to our area.</p> <p>We have heard Randy Lemmon talk about raised bed gardening for years but kept putting it off.  For our fall garden we finally started our raised beds.  We intend to make 5 raised beds but to start off we made two.  (We probably would have done all 5 but I wasn't ready to give up my okra).  I figured two beds were enough for my winter garden. </p> <p>We decided on a very simple process.  We bought untreated wood and my husband put them together.  On Randy Lemmon's advice we put layers of newspaper before we put our soil in the beds.  I can attest to this helping with the weed problem. Randy recommended using two parts Rose soil and one part organic compost but we found that to be a bit expensive so we decided to use a garden mix.</p> <p><center><img title="Spring TX raised bed gardening" src="http://activerain.com/image_store/uploads/2/9/9/3/5/ar125609458753992.JPG" height="451" alt="Spring TX raised bed gardening" width="300" />  <img title="Spring TX Gulf Coast Gardening, Thanks Randy Lemmon" src="http://activerain.com/image_store/uploads/6/3/7/9/4/ar12560946449736.JPG" height="451" alt="Spring TX Gulf Coast Gardening, Thanks Randy Lemmon" width="300" /></center></p> <p>I am AMAZED at the difference I am seeing between the plants in the raised beds and the plants that are not in raised beds.  I found that I had more plants than I had room in the raised beds so I planted the same plants in the beds that were not raised.  You can look and see the difference for yourself.  We are already eating bib lettuce from the raised bed gardens but the bib lettuce in the regular garden isn't ready yet.  I thinks sometimes a picture speaks louder than a thousand words and I'm now a big proponent of raised bed gardening.</p> <p>Randy Lemmon was recently at our local Ace Hardware to answer questions and sign books.  I wrote a post about it at <a href="http://activerain.com/blogsview/1272365/the-woodlands-ace-hardware-customer-appreciation-day-" title="The Woodlands Ace Hardware Customer Appreciation Day" target="_blank">The Woodlands Ace Hardware - That is a time I am often out showing houses and I have learned so much listening to his program.&nbsp; I FINALLY decided to take his advice and do raised garden beds.&nbsp; We have finished two beds with three more in the planning stages.&nbsp; We used his recommendations from Gulf Coast gardening and the plants in the raised bed are <img title="The Woodlands Ace Hardware Customer Appreciation Day with Abby the monkey" src="http://activerain.com/image_store/uploads/6/2/1/4/4/ar125486492244126.JPG" height="233" alt="The Woodlands Ace Hardware Customer Appreciation Day with Abby the monkey" width="350" style="margin: 4px; float: left;" />twice the size of the same plants that are not in a raised beds.&nbsp; I was surprised to see him at my local The Woodlands Ace Hardware but found that very cool as I love that store.&nbsp; &nbsp;There was a line circling to the back of the store.&nbsp; It appeared he had sold out all the copies of his book but everyone was in line with their problem plants in hand.</p> <p>The Woodlands Ace Hardware has something for everyone so in not leaving the children out; they also had a clown with her monkey friend Abby.&nbsp; I was TOTALLY enamored with Abby.&nbsp; I have never paid much attention to monkeys but according to her owner someone forgot to tell Abby that she was a monkey.&nbsp; Monkeys tend to have a reputation for being a little on the mean side but Abby is a jewel.&nbsp; Her owner the clown was blowing up balloons and entertaining everyone with Abby all at the same time.&nbsp; Abby's owner said she had 4 monkeys but the other three lived up to that mean reputation.&nbsp; We lost our sweet chocolate Labrador named Abby this last January and Abby the monkey lived up to Abby's sweet loveable personality.&nbsp; To see more pictures of sweet Abby please visit <strong><a href="http://resultsrealtybuzz.com/post/1269461/speechless-sunday-monkey-see-monkey-do-" title="Speechless Sunday, Monkey see, monkey do" target="_blank">Speechless Sunday - Monkey See, Monkey Do!</a></strong></p> <p><img title="The boy scouts participating at The Woodlands Ace Hardware Customer Appreciation Day" src="http://activerain.com/image_store/uploads/6/4/5/9/2/ar125486452529546.JPG" height="233" alt="The boy scouts participating at The Woodlands Ace Hardware Customer Appreciation Day" width="350" style="margin: 4px; float: right;" />It was a beautiful day and the boy scouts were set up outside with a hot dog stand and sodas.&nbsp; I love seeing the scouts involved in our community. There was also free popcorn on the inside as The Woodlands Ace Hardware has a pop corn machine for their customers.</p> <p>I need to make a correction from my first post.&nbsp; I had said that I thought The Woodlands Ace Hardware was a franchise.&nbsp; I heard back from the owner and it is a coop.&nbsp; This means that each store is independently owned.&nbsp; The Ace Corporation is a privately held corporation which is&nbsp;actually owned by the store owners.&nbsp; There are 4900 Ace stores and 2800 stockholder.&nbsp; No matter how many stores you own you only get one vote.&nbsp;&nbsp;</p> <p>I have been so pleased with our new The Woodlands Ace Hardware located just 5 minutes from where I live in Spring.&nbsp; I use to yawn when my husband said he needed to go the hardware store but now 9 times out of 10 I tell him I will go along.&nbsp; They are doing a great job of providing a wide assortment of items.&nbsp; My husband can find sprinkler accessories for our sprinkler system while I am shopping for exotic spices and soups.&nbsp; I just heard recently that most of their items are made in America.&nbsp; I don't know how true that is I guess I need to check that one out with the owner of The Woodlands Ace Hardware.&nbsp; As they have become young adults I have found that a little harder to do.&nbsp; I would never have thought that Active Rain points would be a way to keep track of important moments.&nbsp; In a weird way that is just what has happened.</p> <p>Most of these AR moments happened to do with our son's military deployments.&nbsp; The first one happened when I hit 50,000 points.&nbsp; My post read <a href="http://activerain.com/blogsview/109837/50-000-points-and-our-son-back-in-the-united-states" title="Tarren Peterson back in the United States" target="_blank">50,000 points and our son back in the United States. </a>&nbsp;I was excited as he had been based in Germany and was just getting back from a tour of Iraq.&nbsp;</p> <p>You won't find a post when I hit 100,000.&nbsp; At 100,000 points I had just found that our son was getting the stop lost and would be heading back to Iraq.&nbsp; As I was passing the mark <strong><em>"100,000 points and our son on his way back to Iraq"</em></strong> kept going through my head. &nbsp;There was NO WAY that I was writing that post but I know that's when it happened.</p> <p>By the time I hit 200,000 points our son was back in Iraq and I wasn't really even planning on writing a post.&nbsp; I had ended up with my daughter's old computer and wrote a post <a href="http://activerain.com/blogsview/493832/200-000-ar-points-and-how-to-do-a-screen-shot-with-vista-" title="Windows Vista YUCK" target="_blank">Windows Vista so far I'm not thrilled</a>. &nbsp;Bob Stewart called me as I hit the exact mark and I was able to take a screen shot of my points being 200,000.&nbsp; I had to slow down my points a little to make the two coincide but it gave me something to do as I waited for the tour to be finished.&nbsp; My second favorite post of all time was just a few days later <a href="http://activerain.com/blogsview/973240/welcome-home-to-texas-4th-infantry-" title="Welcome home to Texas 4th Infantry" target="_blank">Welcome home to Texas 4^th Infantry</a>.&nbsp; &nbsp;If you have not been to a welcome home celebration for a returning soldier please visit my post and watch the videos. I can't tell you how many times I have read it and watched the video (and I wrote the post).&nbsp; It was so exciting to have our son back safe and sound!!</p> <p>The day our son flew back to the United States was a very surreal day.&nbsp; Our daughter is now an International Flight Attendant flying for a charter company that moves our troops.&nbsp; Our children literally passed in the sky one going out of Kuwait and the other one going to Kuwait to pick up some troops.&nbsp; In my wildest dreams I did not see this in either of our children's future!</p> <p>Our son is now out of the Army and a college student.&nbsp; I'm approaching 400,000 points right now and I don't know that there's going to be a landmark going on but to be honest; I AM TOTALLY OKAY WITH THAT!!&nbsp; I'm one of the lucky one who now has my son home but please pray with me for all those men and women who serve to protect us.&nbsp; Freedom is not FREE!!</p> <p>It will be interesting to see my future AR point landmarks.&nbsp; The first item that comes to mind is of course funds to close. I have had a few Veterans who did not have to bring funds to the closing <img title="You will need to bring certified funds for your Texas home closing" src="http://www.agentwithresults.com/blog/wp-content/uploads/2008/02/certifiedfunds.jpg" height="97" alt="You will need to bring certified funds for your Texas home closing" style="margin: 4px; float: left;" width="200" />table but not many. With the changes in the loan industry most 100% loans are gone so you will need some cash.</p> <p>The money to pay all your fees and closing cost will need to be in the form of "guaranteed funds" such as a Cashier's Check. Your agent or escrow officer will notify you of the exact amount. You will receive a closing document required by HUD that outlines the settlement cost. The Title Company prepares this document. The HUD statement is a little difficult to read as you read it backwards. You start with page two and then go back to page 1. Page 1 is the page that shows the funds you need to bring for your real estate closing. For additional information on <a href="http://homebuying.about.com/cs/titleescrow/a/hud1_settlement.htm" title="Texas HUD statments" target="_blank">HUD statements go here</a>.</p> <p>In a perfect real estate world a Spring TX first time home buyer  would receive the HUD statement the day before closing so you would have time to go over it before closing. Unfortunately real estate is not perfect; I can't tell you how many times we get the HUD from the Title Company at the closing table. I honestly don't know why it takes so long but it is a very complex process. Should that happen you can bring a check using the figures your lender have come up with from your good faith statement. Should you not bring enough money you can write a personal check to the title company for up to $1500. A number of years ago I had a client who was moving to another state. He came back to Spring TX for the closing and to get his furniture. A few days before closing I found out that he had turned in his driver's license to the other state and only had a piece of paper for a drivers license. He did not have another picture ID. Back then I talked the title company in to letting us get a membership at Sam's Club and using it as a picture ID. The builder has a professional representative watching out for his needs, and you need the same expert representation.</p> <p>I want to repeat that last part again.&nbsp;<strong>The builder has a professional representative watching out for their needs and you need someone that is watching out for your needs.</strong>&nbsp; Typically these professional representatives are very nice people but keep in mind that they represent the builder's interest not yours.&nbsp; Buying a new home in Spring TX is a little more difficult and time-consuming that buying a resale home.&nbsp; It is important that your interest be professionally represented.&nbsp;</p> <p>I will give you an example of a new home that sold here in Spring TX where the couple did not have representation.&nbsp; This home happened to be in the subdivision that I live in.&nbsp; The lot that the home was built on in my opinion should have been reserved as a subdivision park.&nbsp; This lot is on the main road coming in to the subdivision, backs up to a mobile home park and is across the street from the community clubhouse.&nbsp; When buying a home it all comes down to location, location, location and in this particular instance this location was not a good location.&nbsp; I can't tell you how many times I told my husband that I was sure that the couple who bought that home did not have a real estate agent looking out for them.<img title="Using a REALTOR to help with the details of your Spring TX new home" src="http://activerain.com/image_store/uploads/9/0/8/0/4/ar125304406540809.jpg" height="200" alt="Using a REALTOR to help with the details of your Spring TX new home" width="175" style="margin: 4px; float: right;" /></p> <p>Several years later I was called to go on a listing appointment for this house.&nbsp; In the course of the conversation I found out that as I suspected they had not been represented by a REALTOR.&nbsp; I explained to them that this house was not going to be worth as much as other homes because of where it was located.&nbsp; Needless to say I did not get the listing. I watched the other agents sign languish in the yard for over a year until the price got down to what I had told them.&nbsp; This is a long story to explain some of the pitfalls that can happen when you don't have representation while buying your new Spring TX home.</p> <p>My mentor years ago told me to never sell a home that I could not re-sale.&nbsp; I took this message to heart and I'm always looking to make sure there's nothing that would cause a home to be difficult to sale later on.&nbsp; This also applies to any changes that you make in the floor plan.&nbsp; For instance I recently saw a home where they had put two small bedrooms together to make one large bedroom.&nbsp; By doing this they made the home functionally obsolete.&nbsp; In our area there's not a very large market for 2 bedroom homes.</p> <p>Typically you DO NOT get a price break for NOT using a real estate agent.&nbsp; Most builders build the real estate commission in to the price of the home.&nbsp; Just as in any re-sale Spring TX home the seller (which in this case is the builder) pays for the real estate agents fees.</p> <p>In our current, f<img title="Marchel Peterson Spring TX REALTOR" src="http://activerain.com/image_store/uploads/9/3/8/1/7/ar125304420471839.jpg" height="242" alt="Marchel Peterson Spring TX REALTOR" width="200" style="margin: 4px; float: left;" />ast-paced real estate market, there are many new home communities to choose from. You need to ask yourself some pertinent questions when looking for a new home. Is this a good builder? Does he have a solid reputation?&nbsp; How many years has he been in business? How does the quality of this builder's product compare to that of other builders? What are the existing inventories of the various builders? How do builder models meet your needs (floor plans, square footage, and location)? If I sell in a few years, what upgrades should I include to be competitive?</p> <p>When you find the answers to these questions, ask yourself if the time spent in researching these answers was time well spent - put a dollar value on your time. Real estate professionals can be a valuable asset in collecting information in areas which may affect your decision on the purchase of a new home.</p> <p>It only makes sense to have your own representation.&nbsp; Your new Spring TX home is probably one of the biggest expenses of your lifetime.&nbsp; You would not think of buying insurance without an insurance agent or making a trip to Europe without a travel agent.&nbsp; If you depend on people in the service industry for travel needs, filing a claim for hail damage to your roof, or other legal matters, then why would you want to This last Independence Day <a href="http://www.lcsaonline.net/" title="Lake Conroe Sailing Association" target="_blank">Lake Conroe Sailing Association</a> hosted a boat parade on Lake Conroe. </p> <p>I posted pictures from a <a href="http://activerain.com/blogsview/1227116/speechless-sunday-the-flyover-" title="Flyover from Lake Conroe Sailing Association Boat parade" target="_blank">flyover of that parade on Speechless Sunday</a>.  I had a lot of people that thought it was an air show and as much as I love air shows this was a flyover the boat parade. I don't know anything about the planes but they were Incredible. <a href="http://activerain.com/blogs/williamjohnson" title="William Johnson" target="_blank">William Johnson</a> came up with the idea of doing a post the day after submitting "Speechless Sunday" pictures to explain the pictures. I decided I did not want to post an Independence Day Boat parade on Labor Day so I waited until Tuesday to explain the pictures.</p> same time.  Our daughter was taking the pictures and our son was at the helm.  We were supposed to be motoring but it was a windy day and our son wanted to know why we were not sailing. allowfullscreen="true" allowscriptaccess="always" height="340" width="560"></embed></object></center> <p>It TOTALLY touched my heart this morning and made me think of all those men and women in our armed services that are in harms' way.  Our son got out of Iraq from his second tour this last March and out of the Army in May.  He is now a college student and I'm breathing a huge sigh of relief.  I have to be honest now that our son is safe I have not been as diligent praying for our troops.  They need our prayers now more than ever as August was the deadliest months for our troops in Afghanistan but you will be hard pressed to find much in the news about it.  I googled "Afghanistan August 2009" trying to find a good article to use here and I'll be honest it was hard to find.  I found this blurb below that gives the statistics.</p> <p><strong><em>"From NBC's Courtney Kube and Jim Miklaszewski</em></strong><em> <br />August has been the deadliest month for the U.S. military in the entire Afghanistan war.</em></p> <p><em>As of this afternoon, 51 American service members have been killed in Afghanistan this month. That breaks the previous record set only last month when 45 Americans were killed in July.</em></p> <p><em>With four months to go, this is also already a record year for American casualties in Afghanistan -- 182 U.S. service members have been killed so far this year, compared to last year's 155."</em></p> <p>We have a lot going on in our home land right now but we need to take some time each day praying for the safety of our troops as well as praying for our nation.</p> <p><em><strong>If my people, who are called by my name, will humble themselves and pray and seek my face and turn from their wicked ways, then will I hear from heaven and will forgive their sin and will heal their land. 2 Chronicles 7:14</strong></em></p> Marchel Peterson Spring TX Real Estate E-Pro ABR (Results Realty) Thu, 03 Sep 2009 12:45:41 -0500 http://activerain.com/blogsview/1223218/pray-for-our-troops-especially-for-those-in-afghanistan- http://activerain.com/blogsview/1219191/spring-tx-first-time-home-buyers-guide-why-you-need-to-live-in-a-hoa-part-8- <p><img title="Why you need to live in a HOA in Spring TX" src="http://activerain.com/image_store/uploads/4/9/1/0/2/ar125176932920194.jpg" height="240" alt="Why you need to live in a HOA in Spring TX" width="300" style="margin: 4px; float: left;" />I am continuing my <strong>Spring TX first time home buyer </strong>series.&nbsp; In this post we are going to talk about home owners associations.&nbsp; &nbsp;On a regular basis I have people asking me to find them a home that is not in a homeowner's association.&nbsp;Usually this is someone moving here from another state and usually the area that they are moving from has zoning in affect.&nbsp;&nbsp;I am going to tell you why I don't think that is a good idea living in the Spring area.</p> <p>The problem with not buying in a subdivision in Spring TX is that <strong>WE DO NOT HAVE ZONING&nbsp;IN SPRING TX.</strong>&nbsp; Since we don't have zoning it is a free for all.&nbsp; People can build whatever they want wherever they want it.&nbsp;It is not uncommon to see a nice home next to a trailer on cinder blocks in unrestricted areas..&nbsp; &nbsp;</p> <p>I will never forget when I found out that the Houston area did not have zoning.&nbsp; We moved to the area in 1996 and as I was taking the classes to get my real estate license one&nbsp;of the instructors nonchalantly said "well you know we don't have zoning in the Houston area".&nbsp; I almost fell off my chair<img title="Home Owners Associations in Spring TX" src="http://activerain.com/image_store/uploads/3/6/4/4/7/ar125176907074463.jpg" height="273" alt="Home Owners Associations in Spring TX" width="300" style="margin: 4px; float: right;" />. I had thought every area was zoned.&nbsp;Well that is not the case the Houston area is one of the few large cities if not the only large city that does not have zoning.</p> <p>I have lived in three different states besides Texas.&nbsp; Those states being&nbsp;Kansas, Colorado and North Carolina.&nbsp;&nbsp;All of the areas I lived in&nbsp;had zoning so it was no big deal not living in a home owners association (HOA).&nbsp;I was a little apprehensive about living in a&nbsp;HOA and having someone telling me what I could and couldn't do with my&nbsp;own house.&nbsp;The longer I have lived here I have&nbsp;realized&nbsp;the value of living&nbsp;in a HOA.&nbsp; By having deed restrictions it&nbsp;helps me to maintain my property values.&nbsp; To give you an example a few years ago&nbsp;my husband worked with someone who bought out in the country in a non-restricted area.&nbsp; The guy loved it until the house next door was sold and the new owner decided to make it in to a salvage yard.&nbsp; His property values took a nose dive when the salvage yard opened.</p> <p>The good news is that there is just about something for everyone as far as homeowner's associations go.&nbsp;There are associations with all kinds of restrictions such as in master planned communities and there are&nbsp;HOA's that allow you to have mobile homes.&nbsp;&nbsp;In Spring you can find subdivisions all the way between the two extremes.&nbsp;&nbsp;There are not many country subdivisions left in Spring.&nbsp; There are a few scattered around but if you want country living you might want to look at Magnolia.</p> <p>The HOA's fees also vary greatly.&nbsp;I have seen fees as low as $10 a year and as high as $1500.&nbsp; There are even a few subdivisions that have deed restrictions but no fees.&nbsp; Most of the suburb HOA's have similar restrictions.&nbsp; If there is something in particular you are interested in doing it is a good idea to look the deed restrictions over before you ever put an offer on a house.&nbsp;It is a fairly easy process to get the deed restrictions; usually you can get them from a local title company. It is important to decide what kind of&nbsp;restrictions you are looking for and find your home in a&nbsp;HOA that meets your needs.&nbsp;</p> <p>This is a <strong>Spring TX first time home buyers series</strong> and as I add additional post I will add the links.&nbsp; float: left;" />I am continuing my <strong>Spring TX first time home buyer</strong> series.&nbsp; In this post we are going to talk about your Spring TX title policy.&nbsp; In Texas we close at Title companies and if you are getting a loan you are going to be required by your lender&nbsp;to have a title policy.&nbsp;</p> <p>Title insurance provides protection against title defects that were unknown to you at the time you purchased the policy.&nbsp; Before writing a policy, a title company will check for defects in your title by examining public records, including deed, mortgages, wills, divorces, court judgments, tax records, liens, and encumbrances.&nbsp; The company will then defend in court any claims to the property that are covered by your policy, subject to certain limitations.&nbsp; If the company loses, it will pay you for covered losses up to the amount of your policy.</p> <p>In Texas, the two most common types of title policies are "mortgagee policies," which protect lenders, and "owner policies," which protect buyers.</p> <p>Most lending institutions won't loan you money to buy a house or other property unless you purchase a mortgagee policy.&nbsp; This policy will repay the balance of the mortgage if a claim against your property voids your title.&nbsp; Mortgagee policies remain in effect until the loan is repaid.&nbsp; Most lenders will require you to buy a new mortgagee title policy if you refinance your home.&nbsp;</p> <p><img title="Spring TX title policy" src="http://activerain.com/image_store/uploads/5/4/0/6/4/ar125132263746045.jpg" height="190" alt="Spring TX title policy" width="250" style="margin: 4px; float: right;" />Owner policies insure property owners against the specific kinds of claims listed in the policy.&nbsp; Any owner policy remains in effect as long as you or your heirs own the property or are liable for any title warranties made when you sell the property.&nbsp; You should keep your owner policy, even if you transfer your title or sell the property.</p> <p>In Texas our title policy forms are standardized.&nbsp; This mean the policy language is the same, regardless of the company. Here is a <a href="http://www.alamotitle-austin.com/library/20/TexasOwnersTitleInsurancePolicy.pdf" title="blank title policy form Alamo Title" target="_blank">blank title policy from Alamo title </a>so you can see the standardized language.&nbsp; Pay special attention to "Schedule B" of the policy which explains any limitations, exclusions, exceptions and special.&nbsp;&nbsp;You may want to discuss these exceptions with an attorney before you close.</p> <p>Schedule C is not shown on the blank copy above but it will be there when you get your title policy.&nbsp; This is the schedule that shows the requirements that must be satisfied for the title policy to be issued. This is our daughter's cat Elle.&nbsp; Our daughter is a flight attendant for a Charter company flying Internationally so&nbsp;Elle lives with us as our daughter is&nbsp;flying around the world.&nbsp; Our daughter commutes and so she gets to see Elle quite a bit.&nbsp;</p> <p>Our other cat Calvin has always had a favorite chair but as I was retiring this bag Elle decided to make it her favorite suitcase.&nbsp; I just think it is appropriate that our daughter's cat would pick a suitcase as her bed (lol).&nbsp;I make a good surrogate Mom but as soon as our daughter comes home Elle knows who she belongs to or should I say who belongs to her.&nbsp;
