I had a very interesting situation that came up last Friday that I thought I would share with everybody. I received a phone call at 8:30 in the morning from someone that seemed very excited to make an offer on a home that I have listed. He wanted to meet at the listed proprety instead of my office, because it was more convenient. Being the hungry agent that I am, I agreed after I talked to my client. Then the problems start...

Problem #1 - The potential buyer gets to the meeting early so that he and his Realtor can discuss details before I get there. It turns out that his wife is a Realtor with another company. This just made me mad, but my client was smart enough to tell them to wait.

Problem #2 - The wife Realtor, did not want to let her company know that she was buying a house because she was afraid that her company would take their portion of her commission instead of allowing her to use it all towards the sale of the home. I told her that was between her and her broker, but that at closing, the attorney would issue a check to her company.

Problem #3 - I was talking to a co worker about this offer, and the potential buyers name came up in conversation. This friend of mine goes on to tell me this horror story about the potential buyer. It turns out that both of the buyers had been arrested for drug activity along with being thrown out of another subdivision.  I started to feel sick of course and decided to call the Real Estate Commissioner because my broker is out of town. Do I need to tell my client about this, or is it just considered hearsay? It turns out that I had a fiduciary duty to tell my client even though I did not know it  to be fact.

I ended up telling my client before the offer was signed, and managed to avoid a pretty big ordeal. I felt like a weight had been lifted off of my shoulders after all was said and done. It also confirmed that if a deal seems shady, it probably is. If you know of anyone looking to buy a home in Jackson county, please let me know. I hope that everyone has a great day.
