Today he spoke about the Conficker virus, he emailed the following Q&A on the Conficker virus.

 Q: What will happen on April 1, 2009?
A: Based on our collective technical analysis, we've determined that systems infected with the latest version of Conficker will begin to use a new algorithm to determine what domains to contact. We have
not identified any other actions scheduled to take place on April 1, 2009.

Q: Will an updated version of Conficker go out to already-infected systems on April 1?
A: It is possible that systems with the latest version of Conficker will be updated with a newer version of Conficker on April 1 by contacting domains on the new domain list. However, these systems could
be updated on any date before or after April 1 as well using the "peer- to-peer" updating channel in the latest version of Conficker.

Q: Should the general public be alarmed? Why or why not?
A: No, the general public should not be alarmed. Most home users have been protected by Microsoft Security Update MS08-067 being applied automatically.

Q: Are there any other changes in the latest version of Conficker?
A: The latest version of Conficker also introduces a new "peer-to-peer" (P2P) updating capability. This capability could enable a system infected by the latest version of Conficker to receive a new version or
new instructions by contacting another system infected by Conficker rather than by contacting a domain determined by the domain generation algorithm.

Q: We hear talk of an impending second phase of attacks from Conficker. What do you anticipate happening next?
A: There may be a second phase of the threat at some point in time. However, we believe that with a situation like this-which has similarly taken place many times in the past-and given the tremendous
amount of attention that this worm has received, as well as industry and law enforcement monitoring, these efforts will be a deterrent to a large second wave of attacks. At the end of the day, we can't
speculate on the intentions of criminals, but what we can do is work to limit the impact of any second phase.

Q: Why does Conficker continue to spread even though Microsoft issued the update in October?
A: There is always some percentage of customers who don't apply an update at any given time, due to a variety of reasons. While most home users have been protected by the patch being applied automatically, once the worm gets a foothold inside an enterprise, it's difficult to remove and this is where people are having problems.

Q: Why is Conficker using domain names? Is this a new trend?
A: It is trying to download malware from these domains and it also uploads infection counts to these domains, but this is not a new trend.

Q: What is the Conficker Working Group doing about this new algorithm?
A: The Conficker Working Group has been working continuously to block access to domains that systems infected by Conficker attempt to contact. We are continuing this work and have expanded this effort to include those domains that will be contacted by the latest version of Conficker starting on April 1, 2009.

Q: What should people who are worried about April 1 and Conficker do?
A: We recommend that home users who have not yet enabled automatic updates do so and ensure their security software is up to date with the latest signatures.

My dear friend Elliott wrote this blog and I wanted to make sure it gets read. I experienced a new condo complex that got foreclosed on due to the financing restrictions on condo's. There was no need for it. Yes, there need to be guide lines, but how strict do they need to be?

In a recent article in the New York TIMES, problems besetting our industry were the main focus. Examples of people who had committed to purchase as yet unbuilt homes, free standing and condominiums,  and were now "trapped" by new FNMA/FHLMC Guidelines, which have made many financing programs much more restrictive, in terms of downpayment and sales of project units. While I did not generally recommend 95% and 90% financing to many of my clients, such programs were a fact a life as recently as 18 months ago, and that high leverage was often the only way a family could purchase the home of their dreams. New Condominiums were not limited to 70% pre-sale, either.

So, when FNMA and FHLMC developed more rigid standards for borrowing, at this difficult time in the housing industry, I have to ask myself "why". These entities are no longer owned by public stockholders. For all intents and purposes, they are part of our government. Yet, the very same government that has given lip service to the real estate recovery as being essential to an overall recovery permits these agencies to act in a manner which prevents real estate activity.

Who, if anyone,  is really benefitting from the new restrictions on residential lending? Certainly, the potential Buyer who has put down a deposit without a financing contingency is not benefitting. That deposit money is probably gone, as liquidated damages for the Buyer's failure to perform. So, not only is the contemplated sale up in smoke; so is any other real estate purchase for the Buyer losing his or her Deposit. "No sale" hurts the realtor, the mortgage originator, the closing agent and, ultimately, the Seller or Developer, because holding on to the Deposit is a poor alternative to making the sale of the property in question at the contract price.

It is time for each of us, whatever role we play in real estate, to inform our elected representatives in Washington, DC that these restrictions need to be eased. Dropping interest rates, alone, will not stimulate a  real estate recovery. Programs with some leverage need to be brought back. Pre-sale requirements need to be lowered. If we sit back and allow these new restrictions to continue, we have no one but ourselves to blame for what happens to our industry. Make the phone calls; send the emails, petition the people you put in office. The stakes are much too high to sit on our hands.

So I am showing my client that (after a year...) is ready to pull the trigger, a condo that he really likes. I call the listing agent to see if there is anything going on (would hate to write up an offer, get my client's hopes up and not get it because of other offers). Leave a voicemail message, sent an email and text message since I did not hear back.

So we continue our process, looked at some comps and wrote up the offer. The listing agent had in MLS instructions where to send offers to (yes, bank owned...).

So I faxed the offer (saved the confirmation through efax), scanned and emailed it as well (still don't trust the old fashioned paper faxes...). Three days later (no call, no response what so ever), I finally get a hold of him, " oh so sorry, it has been under agreement for TWO WEEKS, you are WAY too late.... (Mind you it has been on the market for 7 months....).

Is it me or is this just plain rude. I have done a deal with this listing agent several years ago, so he knows who I am (we had a interesting transaction before and got along great). More and more I hear the excuse, "Do you know how many listings I have?" - Well, my answer is this: ANSWER YOUR PHONE AND THEY WOULD HAVE BEEN SOLD! So stop complaining.

By the way, the next day and new listing came on, in better shape, more space, so my client is very happy (things happen for a reason!). Now I am waiting for the listing agent to call me and tell me that the deal fell apart and if my client is still interested....... (yes I have had that happen and the courteous agent that was responsive and kind, got it under agreement the next day).

So please, if you have 24 listings but are unable to answer your phone,  or do not want to pay an assistant, stop complaining. Other wise, hire an assistant to help you out. It made my life so much easier, I can definitely recommend it.
