Many Homeowners have been struggling to decide what to do with regards to their home. I have spoken with many families who have tried countless times to try to modify their homes Trust Deed with no success. I'm sure this is not breaking news to those who are reading this. However, due to upcoming changes in the Modification process it will become even more difficult to modify your homes Trust Deed. Where will that leave the Homeowner? Banks are beginning to see that it is more beneficial financially for them to accept a Short Sale rather than Foreclose on the home. Infact, I have already begun to see fewer Foreclosures and more Short Sales in my market. That being said, when is a Modification right for the Homeowner? Do I or will I qualify for a Modification? Will the Short Sale process actually be the better option for your family? That is where the professionals at the Non-Profit H.E.L.P. (Homeownership Education Learning Program) come into the picture. Their goal is to educate the public and to help them determine what is right for them and their families! Here are some Tips that H.E.L.P. has made available to the public. 

1. Try to Modify. If no avail, short sale. NEVER WALK AWAY

2. Always do your best to keep accurate and detailed records of your attempts to reach out to your lender.

This may come in handy in the future.

3. A short sale is when a lender agrees to take a lesser payoff than the existing balance of the mortgage.

4. Discuss with a CPA the tax consequences of a Short Sale or Foreclosure BEFORE they actually happen.

5. Important questions to ask your tax consultant or CPA: Was the loan recourse or non-recourse? Will the loan forgiveness take place inside BK?, and Are you insolvent at the time of the debt forgiveness?

6. Non-profit, HUD approved housing counselors can be trusted to assist you with your housing concerns and needs.

7. Beware of foreclosure scams! Ads that read. "Stop Foreclosure Now!", "We guarantee to stop your foreclosure.", and "We have special relationships within many banks that can speed up case approvals. We can save your home. Guaranteed. Free consultation!" These companies should be treated with extreme caution.

8. Don't take your Lender's word that your sale has been postponed. GET IT IN WRITING!

9. You do not have to fall behind to request a loan modification. AND YOU DO NOT HAVE TO PAY UPFRONT.

With the deadline fast approaching for the expiration of the Federal Homebuyer's Tax Credit. You most likely have been been bombarded with questions from prospective clients as to what is going to happen when April 30th arrives? Well good news arrived in the form of the reinstatement of the California Homebuyer's Tax Credit Program several weeks ago. Now the California Association of Realtors has announced the opportunity to receive up to $18,000 in a combined homebuyer tax credit. This offer will only be available for a limited time. Californians have a brief window of opportunity to receive up to $18,000 in a combined federal and state homebuyer tax credit.

HOW TO TAKE ADVANTAGE OF BOTH TAX CREDITS:

A first-time homebuyer must enter into a purchase contract for a principal residence before May 1, 2010, and close escrow between May 1, 2010 and June 30, 2010, inclusive.  Buyers who are not first-time homebuyer's may use the same time-frames to receive up to $16,500 in combined tax credits if they are long-time residents of their existing homes as permitted under federal law, and they purchase properties that have never been previously occupied as provided under California law. Under the federal law slated to soon expire, a first-time homebuyer may receive up to $8,000 in tax credits, and a long-time resident may receive up to $6,500, for certain purchase contracts entered into by April 30, 2010 that close escrow by June 30, 2010. Additionally, under a newly enacted California law, a homebuyer may receive up to $10,000 in tax credits as a first-time homebuyer or buyer of a property that has never been occupied. The new California law applies to certain purchases that close escrow on or after May 1, 2010 (see Cal. Rev. & Tax Code section 17059.1(a)(4)).  California law generally allows buyers of never-occupied properties to reserve their credits before closing escrow, but buyers seeking to combine the federal and state tax credits will not be able to satisfy the timing requirements for such reservations (see Cal. Rev. & Tax Code section 17059.1(c)(1)(A)).  Other terms and restrictions apply to both tax credits.

Last weekend I was taking a walk by my home and came across a flyer advertising the openning of a new Bookstore here in Glendora, California. Both my wife and I are avid readers so I thought I would stop on by to check them out. The shop is called The Mustard Seed Bookstore. The stores owners are Lindsay & Liliana Johnson. The store features various Christian Books, School Texts, Tech and Trade Books, along with various Collectible and other hard to find books. Much of their inventory comes from their own personal collection as well as books supplied by various clients who have sold books from their private collections. Home owners looking for some tax relief may find just that if they were victims of the recent Station Fire & Palos Verdes Peninsula Fire. According to the Los Angeles County Assessor's Office damage must be more than $10,000 from the recent fires. Homeowners should submit an Application For Reassessment Property Damaged or Destroyed by Misfortune or Calamity. The damage must have taken place in 12 months of the occurance of the damage.

According to information gleamed from the Los Angeles County Assessor's website, Homeowners who qualify will receive a corrected tax bill or refund. Adjustments and prorations of taxes will be based on loss of value from the date of damage to the end of the fiscal year June 30, 2010 or until the structure is repaired.
