&lt;p&gt;Seems to me that in order for a town to be considered a Rivertown they must have frontage on the Hudson River. &amp;nbsp;Ardsley doesn't have any Hudson River waterfront yet a lot of people consider it a Rivertown. &amp;nbsp;I don't. &amp;nbsp;Ardsley, New York is a 1.3 mile Village. &amp;nbsp;Ardsley has Route 9A running through the center. &amp;nbsp;Proximity to the city, centrally located and close to all highways and great schools make Ardsley a popular place to settle. &amp;nbsp;However it is not a Rivertown. &amp;nbsp;In Westchester County the following communities have Hudson River frontage and would be considered &quot;Rivertowns&quot;:&lt;/p&gt;
&lt;p&gt;Yonkers, Hastings-on-Hudson, Dobbs Ferry, Irvington, Tarrytown, Mt. Pleasant (Sleepy Hollow), Ossining, Briarcliff Manor, Croton-on-Hudson, Cortlandt Manor and Peekskill.&lt;/p&gt;

I've got behind-the-scenes work to get done before my buyers see any of those homes. &lt;p&gt;Personnally I cna't imagine doing this but the National Assocation of Realtors, our beloved NAR, has amended their trademark policy and now allows members to use the &quot;Realtor&quot; logo on their gravestone. &amp;nbsp;Apparently, NAR gets one or two requests a year and has in the past granted verbal approval. &amp;nbsp;People in the business for very long periods of time, 60 plus years and families who believe this is appropriate.&lt;/p&gt;
&lt;p&gt;It seems some monument companies would not use the word &quot;Realtor&quot; without written permission from NAR and now with amended policy they are able to give the permission.&lt;/p&gt;
&lt;p&gt;In case anyone is interested this is now possible and easier to accomplish.&lt;/p&gt;

&lt;p style=&quot;text-align: justify;&quot;&gt;The first time I met them I asked about their financing and had they been to the banks. &amp;nbsp;They said no and I won't state the reasons why they hadn't here but this buyer had a reason, not a good reason, but a reason why they hadn't spoken to a banker. &amp;nbsp;When I approached this subject this would have been an excellent time for them to explain a little bit about what they were planning, a little bit about their finances and some of their issues. But they didn't. &amp;nbsp;They said nothing. &amp;nbsp;They asked nothing. &amp;nbsp;I sent them the name of a mortgage broker.&lt;/p&gt;
&lt;p style=&quot;text-align: justify;&quot;&gt;Two weeks later I get a phone call, can you show up this co-op this evening. &amp;nbsp;This evening! &amp;nbsp;This is urgent they must like something about this unit and if it is urgent then maybe they are ready to move forward. &amp;nbsp; They knew they didn't have the down payment but urgently that evening wanted to see this apartment. Why, I haven't a clue.&lt;/p&gt;

      <title>Don't Let the Big Banks Bully You! Something You Can Do.</title>
      <description>&lt;p&gt;With new bank regulations around the corner a lot of Americans are feeling helpless. &amp;nbsp;We are captive. &amp;nbsp;The reports state that the banks are going to increase fees and charge new fees and create new fees. &amp;nbsp;The folks at The Huffington Post came up with a rather ingenious idea. &amp;nbsp;The small guy can do something about this. &amp;nbsp;You can move your money to a community bank or credit union and take it away from the big guys.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;JP Morgan Chase, Bank of America, Wells Fargo and Citibank are the culprits. &amp;nbsp;Don't just take it!&lt;/p&gt;

      <title>New Standardized Good Faith Estimate Effective January 1 2010</title>

No standarization here means some lenders disclose a variety of information on the previous GFE while others do not disclose at all. In efforts  to facilitate a better shopping experience for the consumers, &lt;strong&gt;HUD requires all  lenders use the new standardized format for Good Faith Estimates effective  January 1 2010. &lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;At first glance, the standardized format of the Good Faith Estimate is easy  to read, understand and digest by the average borrower.&lt;/p&gt;

&lt;p&gt;The summary of the loan  is displayed on the 1st page with answers about the loan such as:&lt;/p&gt;
&lt;p&gt;(1) Can your interest rate rise? (Indicates if it is an adjustable rate  mortgage)&lt;br /&gt; (2) Even if you make payments on time, can the loan balance rise? (Indicates if  it is a negative amortization loan)&lt;br /&gt; (3) Even if you make payments on time, can your monthly amount rise? (Indicates  if the account is escrowed or not)&lt;br /&gt; (4) Does the loan have a pre-payment penalty?&lt;br /&gt; (5) Does the loan have a balloon payment?&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Lenders are held to a higher standard of accountability with the use of the  standardized  Good Faith Estimate&lt;/strong&gt;. &quot;Good faith&quot; in the past will now be more of certainty,  especially when it comes to the Lender charges. HUD requires that Lenders be  sure to know how much they intend to charge their borrowers based on the  information the borrowers provided.&lt;/p&gt;
&lt;p&gt;The &lt;strong&gt;new Good Faith Estimate also utilize the Lump &amp;amp; Dump concept&lt;/strong&gt; whereby HUD feels that the borrowers have been provided too much information in  the previous good faith estimates. Items &quot;A&quot; on Page 2 of the GFE includes all  origination charges. They are no longer broken down into Loan Origination Fee,  Processing Fees, Tax Service Fee, Funding, Lender Feeds, Doc Prep Fees, Broker  Yield Spread Premium, etc. Only information that could affect the loan is broken  down into 2nd part of &quot;A&quot;. According to HUD, the &quot;bottom line&quot; numbers is what  the consumers care about.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;This section of the Good Faith Estimate must be the same (ie. Zero  Tolerance for differences) and borrowers can expect them to be the same on the  HUD-1 settlement statement&lt;/strong&gt; - if the terms and conditions of the loan are the  same. Should there be a difference, HUD considers this Breached Tolerance and  this breach will be cured with a credit at the closing table or writing a check  to the borrower within 30 days of closing.&lt;/p&gt;
&lt;p&gt;This brings Lenders to more accountability towards the accuracy of their good  faith estimates to their clients. It is a good thing.&lt;/p&gt;
&lt;p&gt;Other considerations could be expected should there be &lt;strong&gt;changed  circumstances on these No Tolerance items above (ie. Lender charges)&lt;/strong&gt;. A changed circumstance may  include acts of God, war, disaster, new information not known by the Lender,  other information found not to be inaccurate.&lt;/p&gt;
&lt;p&gt;There are other charges associated in purchasing the property. These items  are found as part of &quot;B&quot; on page 2 of the GFE.&lt;/p&gt;
&lt;p&gt;The similar lump &amp;amp; dump concept for Title charges in Section 3, 4, 5 and 6.  These charges can deviate up to 10% on the HUD-1 statement - assuming that the  borrowers services identified by the Lender. The total of these charges of page  2 on the GFE constitutes the &quot;B&quot; total.&lt;/p&gt;

However, this is NOT to be confused  with Cash Needed for Settlement. Items A and B DOES NOT account for Seller's  concessions, property tax and HOA prorations&lt;/strong&gt;, etc.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;The use of the form is MANDATORY&lt;/strong&gt;. In the past, lenders have created  their own formats and some not providing one at all. The new rules as directed  by RESPA must be furnished to borrowers:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;&lt;strong&gt;Within 3 days of loan application.&lt;/strong&gt;&lt;br /&gt; A loan application is deemed taken by a lender with the borrowers' names,  	social security numbers, incomes, estimate purchase value, loan amount,  	other information deemed necessary by lender and property address.&lt;br /&gt; This form must only be utilized if there is a specific property address.&lt;br /&gt; While home buyers have used the GFE to shop for lenders, they could no  	longer do that. Without a property address, the industry believes that  	lenders will come up with &quot;preliminary&quot; GFEs without the actual property  	address.&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Without 10 days of GFE issuance.&lt;/strong&gt;&lt;br /&gt; The GFE will be good for 10 days after the borrower receives it. The  	borrower MUST express an intent to proceed with the terms and conditions of  	the loan based on the GFE provided within 10 days business. After 10  	business days, the lender is no longer bound by the issued GFE.&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;This is HUD's effort in facilitating consumer comparison shopping of  Lenders. &lt;/strong&gt;It is not the most perfect version out there but it is a much  simpler method for an average consumer to understand. &lt;strong&gt;What this new GFE does  not address is it does not specify the loan product&lt;/strong&gt; (FHA, Conventional, VA,  etc.) and &lt;strong&gt;it also does not inform the borrower the actual monthly payments in  Principal, Interest, Property Taxes and Home Insurance (PITI).&lt;/strong&gt; It only  addresses the Principal, Interest and Mortgage Insurance (if applicable).&amp;nbsp;  The lender may furnish these information on other documents.&lt;/p&gt;

I didn't quite understand what a fax machine was or how it worked, how did the paper fit into the phone line? &amp;nbsp;We got a fax machine way back then with rolled paper. Then came the plain paper fax where we could use 8.5X11 sheets and didn't have to cut the faxes we received with a scissor. &amp;nbsp;For some of you I must sound like a dinosaur. &amp;nbsp;We are now almost 30 years down the road and if that employer were to ask me if we could use a fax machine in our business today my answer would be the same probably not but for different reasons, fax machines are becoming obsolete so let's try an internet fax number instead.&lt;/p&gt;

Now I can upload entire folders and give access to whoever needs it right on the computer. &amp;nbsp;I have an iDisk and can upload multiple documents into a folder with instant access to whoever I send it to, all password protected. &amp;nbsp;The individual receiving the documents doesn't have to click each link, save onto their computer what they need they can just go to MobileMe and access what they need. &amp;nbsp;&lt;/p&gt;

      <title>Kudos to Sen. Frank Lautenberg</title>
      <description>&lt;p&gt;I don't know if any of you have been following the story of Sean Goldman but I have found it heart wrenching. &amp;nbsp;His father David out of love for his son has fought for five years to regain custody of his son and today they are reunited. &amp;nbsp;Everyone once in a while our Government does something that I applaud and that happened in this case.&lt;/p&gt;
&lt;p&gt;This has been a tug of war between a father and maternal grandparents in another country, many legal battles and finally last week the legal fight appeared over whe a Brazilian appeals court ruled that Sean should be handed over to this father. &amp;nbsp;Then another court ruled against this.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;United State Senator Frank Lautenberg then blocked the renewal of a trade bill with Brazil and when news came through that father and son would be reunited Senator Lautenberg lifted his opposition and the trade bill was passed unanimously.&lt;/p&gt;
&lt;p&gt;Kudos to Senator Lautenberg, power used for the good.&lt;/p&gt;

&lt;p style=&quot;text-align: justify;&quot;&gt;Some of the stores at this mall are Nordstrons, Neiman Marcus, Tiffany, Ann Taylor, Victorias Secret, The Apple Store and the Gap among many others. &amp;nbsp;For food there is the food court, P.F. Changs. &amp;nbsp;Across the street is the Cheesecake Factory, Morton's. &amp;nbsp;Down the road is Bloomingdales. &amp;nbsp;In White Plains there is also a Wal Mart, Barnes and Noble, Macy's, and Legal Seafood plus a variety of other restaurants and stores. &amp;nbsp;White Plains is definitely worth a visit if you are in the area.&lt;/p&gt;

&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p style=&quot;text-align: justify;&quot;&gt;My buyer and I worked together for about two years. &amp;nbsp;They were not in a rush to buy and looked more aggressively at certain times than at others, this was pre internet and pre sharing of listings on line. &amp;nbsp;We spent a lot of time together in the car and we chatted and got to know each other. &amp;nbsp;At that time there was only sub agency which meant that I was working for the seller, who &amp;nbsp;I might add I had never met, but according to New York State law at the time my loyalties in a negotiation were to the seller. &amp;nbsp;I had no obligation to disclose that to the buyer and so the buyer thought that because we &amp;nbsp;spent so much time together that I ha her best interests at heart. &amp;nbsp;She disclosed her entire financial history to me and I knew what she could afford, how much she really wanted to spend and how much she like a particular house which meant that I could gauge how much she might spend on any particular house and since I worked for the seller and it was my obligation to obtain as much money for the seller as I could when I presented an offer I could tell the listing agent that &quot;I know that the buyer will go higher and can spend considerably more so please plan accordingly when you counteroffer, I believe that the seller will be happy&quot;. &amp;nbsp;We did not even consider at that time the possibility that there was something wrong with that - that was the way it was done. &amp;nbsp;Back then if my buyer said &quot;I would like to offer let's say $900,000 and my top number is $1,200,000 I could disclose that to the listing agent&quot;.&lt;/p&gt;
&lt;p style=&quot;text-align: justify;&quot;&gt;Doesn't seem fair does it. &amp;nbsp;Now if you are a buyer and you have a buyer's agent working with you and you say &quot;I would like to offer $900,000 and my top number is $1,200,000&quot; that can not be disclosed. &amp;nbsp;We are working for you, the buyer, and trying to get you the best price. &amp;nbsp;Recently one of my buyer's wanted to bid $575,000 on a house, that was the number that he and his wife felt would be fair. &amp;nbsp;I knew that was too high and I told them to please rethink their offer and consider a lower number which they did and they bought the house for a considerably lower amount.&lt;/p&gt;
