If you remember it was just a few days ago that I posted about Bank of America and how a Daytona Beach real estate seller is still getting billed...still receiving phone calls...and cannot file their taxes due to mishandling of their short sale in the closing department....

A Note To all Lenders and Financial Institutions If you want to get it right and get properties sold..I would concern yourself with the agents selected to do BPO's.  Friday I received and order and I declined it...while some would think it was crazy...I did what was best for the market. 

 
In all fairness don't think for a minute I do not need the income..I'm not above doing BPO's...and just like many others I need the income coming in or I won't sleep at night then again...doing something that I believe would hurt other parties..would cause insomnia!

Yesterday I received a call from a buyer..not just any buyer..but another REALTORS buyer.  Angry...Screaming...and misinformed.
It seems they called "the bank" to find out what is up with his offer...now this buyer claims the bank told him to tell the REALTOR to submit the offer...that REALTOR being me.  
This irate voice attempted to bully...threw accusations about the seller...and turned around and demanded that the seller sign their offer.
Until I set the record straight.

An important message from  "THE NEGOTIATOR!" 
Quoting the negotiator..."It's the banks policy, to reduce the commissions! The commission will be cut to x% when there is two REALTORS involved!"   
Would I have owed them money if I brought the buyer in myself...Just asking?
Yes the bank needs to net a certain amount of money but regardless of the offer or numbers ...they expect to pay no more than X% commission on any file.  And the negotiator has spoken!
I don't call it the banks net..I call it simply cutting my hard earned commission!  Happy Monday and I Love those shortsales baby !  Now to get … (16 comments)

If you recall I posted about attending court on behalf of a seller...fortunately for us...the attorney did not show..we now have submitted our short sale package...and if it gets accepted we have little to worry about.

 
Last week our top producer called me...she has a beautiful listing..and with an offer...but the bank gave her a hard time..and the offer was not accepted..
As she finished her story I reminded her I had gone to court for my customer..  When she heard this...her ears perked up she could not wait to hear the outcome because a date had been set … (10 comments)

Recently I went to court not because I am in trouble...but someone important to me...our real estate seller!  See they live about 6 hours away..and yes the process of foreclosure has started.  Laid off..injured car (needs repairs) and could not make the trip. So what was this seller to do?
They Asked Me To Appear in Court! Rather than no one appearing...I told them to type a letter..and if the judge will even acknowledge me..and read the seller's letter...there might be some hope to get the offer they received ..to the closing table...all we need is time..time to get the short … (93 comments)

I love my bank...as a matter of fact recently they have added $20.00 into my account..all because I use my check card often..when I walk in...they are warm..cordial and always wanting to assist!  When I call them they answer my questions or when I make an inquiry on line...I can count on a response within 24 hours.  I know they appreciate me..because when I walk in the door..not one but most will greet you before you get in line!

Yesterday I was working away in the office...and the next thing I know...someone in our office was being served docs and notified they must give a deposition...two magazines battling back and forth!  Yes this has been ongoing and I personally think it's a silly lawsuit at that!
The worst of the worst comes out of people when times are tough! The interesting thing was when I introduced myself as Midori..he already knew who I was and was pretty excited, "Are you Midori Miller?"  A legend in my own mind! :)   I knew then it must be Activerain efforts.

Recently I have had to step into another transaction.  Not an easy one..one going on for sometime.  Short sales, why does it take so darn long?  I'll tell you why, its just my opinion and pertains to many banks!
Banks need to take this situation a bit more serious from the Executives all the way down the chain!  You see when you call a bank and the best advice to give you is call and check on it tomorrow, you have to wonder are they a bank trying to prevent foreclosure or are their methods similar to the stereotype … (9 comments)

A few days ago an agent who I know very well called on one of our shortsales.  Its seems because of who they are..they felt I was wrong in the time frame of acceptance by the bank even though this information was available to the agent via the agent remarks but because of who they thought they are these rules would not apply.

 
If someone is going to show one of our shortsales I make it a point to tell them that the turn around from the bank is X amount of days.

Friday I was on the phone with a bank, funny thing there were 3 of us who contacted the bank and three of us who spoke to the bank and all with different info. A couple of things you should think about before working on short sales..
1. Get the seller involved, if the seller will cooperate with you in getting docs in a timely fashion to you, speak the truth and assist with correspondence with the bank..you have solved about 60% of your challenges. Recently I have been contacted by two different parties in regards to short sales..investors....investors with empty houses, with equity lines and with assets they are afraid they will lose.   Both investors extremely intelligent but like the rest of the world never expected things to turn out the way they have.  Vacant properties...no tennants..and digging in their assets.

Don't assume anything about anyone requesting a shortsale...
Don't assume they do not want to pay for their mortgages...
Don't assume they do not want to find alternative solutions and please don't assume they want to file bankruptcy.
