A Short Sale is when the lender of record agrees to discount their payoff to accommodate a sale of a house when:1) The borrower has experienced hardship and is unable to repay the mortgage 2) The value is proven to be less than the amount needed to pay off all loans, encumbrances and real estate selling costs 3) The loan is delinquent or in default.Often when a house in which the proceeds of a sale will fall short of what the home owner still owes on the mortgage, lenders will accept the lesser proceeds as a short sale. Kern unemployment rises to 15.8 percent - 01/22/10 12:21 PM
The unemployment rate in Kern County rose to 15.8 percent in December, according to data released Friday morning by the state. That's up from 15.1 percent in November. And it's far above the 11.8 percent of a year ago. Statewide, unemployment was at 12.1 percent.

By: Carrie Bay 12/01/2009 Amidst the high-profile news Monday about the administration's actions to coax servicers into making more mortgage modifications permanent, the Treasury Department also laid out finalized guidelines for carrying out short sales under the Making Home Affordable program. [IMAGE] The administration is urging participating servicers to follow through with short sales as an alternative to foreclosure for those homeowners that don't qualify for a reworked mortgage under the Home Affordable Modification Program (HAMP). No. Notice to a tenant cannot be in the alternative. A 30-day notice to a tenant is not proper unless it makes a clear demand for possession with no alternative (Turney v. Collins (1941), 48 Cal. App. 2d 381, 392). By nature, "a 3-day notice to pay or quit" or a "3-day notice to cure a covenant or quit" gives the tenant alternative actions. A landlord would give the tenant a "3-day notice to pay or quit" if the tenant hasn't paid the rent in full. The U.S. Dept. of the Treasury recently announced the Home Affordable Foreclosure Alternatives Program (HAFA), which provides instructions for lenders and servicers participating in the Making Home Affordable Program and Home Affordable Modification Program (HAMP). The purpose of HAFA is to create an alternative to foreclosures for homeowners unable to successfully modify their troubled mortgage under HAMP. The HAFA program simplifies and encourages short sales and deeds in lieu of foreclosure by: . Allowing pre-approved short sale terms before a property is listed; . To help provide first-time home buyers with peace of mind when purchasing a home, the CALIFORNIA ASSOCIATION OF REALTORS® Housing Affordability Fund (C.A.R.H.A.F.) is offering a mortgage protection program to first-time home buyers. Through the C.A.R. Housing Affordability Fund's Mortgage Protection Program, first-time home buyers who lose their jobs due to layoffs may be eligible to receive up to $1,500 per month, for six months, to help make their mortgage payments.
