Facing 30 Years in Prison For Violating Arms Length in Short Sale

This is the perfect reminder that when you are going to short sale a home or purchase a short sale you must abide by all of the rules. The economy is in enough trouble without people further trying to scam the system.

Just another story to read for those people planning on scamming their lender in a short sale. This is just one of several cases I've read about lately. This is why I refuse to list and help any homeowner navigate through a short sale if I detect they aren't 100% honest, or if they indicate that it's going to be a pain to get them to provide the information that will be needed to keep a short sale process on track and moving forward. Too many people are involved, and I don't want to waste peoples time if the seller thinks it's just a big game.

Yes, banks take Arms Length Agreements seriously. So if you think you're going to short sale your house to your parents or another relative, then rent it back from them with plans to buy it in the future, you are conspiring to commit a crime. Goodbye and good luck. Ask yourself, is the buyer connected to you in any way by blood or business? If yes, they are not eligible to purchase your short sale. Why do lenders like BOA ask for 5 digits of a potential buyers social security #? It's mainly so they can research and verify it's an Arms Length Transaction. I love the people that call me and say they want to short sale their house and they already have a buyer lined up, but they need an agent to help them.

Many people don't realize that these days lenders and FBI agents are actually going door to door to verify that buyers who checked the box on their mortgage application claiming he/she was buying a primary residence, are actually living in the property. I know of one case where FBI showed up at a house 2 months after a closing where buyer had claimed he was buying primary residence, and the tenant answered the door. They asked if he was the owner, and he said no, he was renting and had been there for 2 months. They put that buyer on their list to file mortgage fraud charges against, which they did.

What are you in for? Well, we bought this house for $600,000.00, then the bottom fell out of the market. We heard about how all these people were getting rich flipping houses, so we decided to short sale our house for $300,000.00 to my cousin, then we were going to buy it back from him for $400,000.00. It sounded perfect, we would reduce our mortgage by $200,000.00 and he would make around $100,000.00 for his trouble. We didn't understand what an Arms Length Agreement was. It's the banks fault.

Sugar Loaf, NY - For The Artist in You!

Several weekends ago we stopped in Sugar Loaf on our way home to take a quick peek and see if there was anything new. Sugar Loaf is such a quaint and interesting place and you never know what might be going on there. There are always locals and tourists to be found browsing the many shops.

Sugar Loaf is a hamlet between Chester, NY and Warwick, NY which lies within the Town of Chester and actually predates the Town of Chester. Sugar Loaf was originally administered under the Town of Warwick.

The Barn Sider Tavern is the place to eat in Sugar Loaf. Since 1980 they have served millions of guests in their sunroom or upstairs in their Eric Sloane room with gorgeous views.

This turkey has been hanging around the woods of my yard for the past few weeks. The other day I just happened to catch that she was standing in the woods when I saw the movement. When she wasn't moving you would never have even noticed she was there because she blended in so well with her surroundings from far away.

I grabbed the camera to get a shot; she stopped moving and for a minute I almost couldn't find her through the lens because she was hundreds of feet away and because she did blend so well.

George Souto - Always Willing to "Lend" A Hand

Last week I had a mortgage problem that was troubling one of my sellers and I was having problems getting a straight answer as to what was actual fact when it came to FHA guidelines in this situation.

Once again Active Rain became my saving grace. I turned to George Souto who was more than happy to look into this situation for me. He didn't have the answer right away, since he didn't deal with this particular situation on a regular basis if at all. Even though it was one day before the 3 day holiday weekend he was going to look things up and get back to me as soon as possible without blinking an eye.

Are You Doing Right By Your Buyer??

Recently my partner and I have listed a property for sale that has a cesspool instead of a newer septic or municipal sewer. In our area that is not uncommon since certain areas have much older and historic homes. Multiple buyers have loved the home when viewed with their Realtor. When you receive this type of feedback this is exactly what you are looking for as a seller and as a listing agent.

Next of course would be discussion of an offer which has been nipped in the bud because of nervousness over the cesspool and the claim that "FHA doesn't lend for properties with cesspools."

I have never found this to be the case, but wanted to clear this up once and for all, for the seller and for future reference as there are many homes in the Hudson Valley that still have cesspools.

PROPERTY ANALYSIS - SEWAGE SYSTEMS

If sewer systems are not connected to public systems the septic system must meet the requirements of the local health authority with jurisdiction. If the local authority does not have specific requirements, the maximum contaminant levels established by the EPA will apply.

In checking the FHA guidlines there is nothing that says they will not be covered. I went one step further and had a loan officer friend speak directly to underwriting and this is what I was told:

Properties that cannot connect to a public system and are served by an individual sewage system that is acceptable to the local health authority, the system is then acceptable to HUD/FHA. This includes numerous types of sewage systems including cesspools, individual pit privies (out houses), and mound systems. Individual sewage system inspections are only required if there is evidence of system failure, if mandated by state or local jurisdiction, if customary to the area, or at lender's discretion.

In those instances, the appraiser is to condition for an inspection by the local health authority, a licensed sanitarian or an individual determined to be qualified by the DE Underwriter and a certification that the system is operating satisfactorily. If the subject property water source is a well, the cesspool must be 100 feet from the well.

Having said all that, Investors do have their own overlays, and the Investor (not FHA) may choose to not accept a mortgage on a property that is serviced by a cesspool, so your Buyers should check with whom they are getting their mortgage through to make sure that Lender does not have an overlay that would prevent them from doing the mortgage. If that Lender does not allow for properties with a cesspool, then they may have to contact another Lender that does, since FHA will insure properties with cesspools.

In at least one of these cases the Realtor said "I always deal with this lender." If your buyer loves this house I ask again - ARE YOU DOING RIGHT BY YOUR BUYER?

Easy Peasy Lemon Squeezy Household Tips For Lemons

This is a post by Wayne & Jean from Union County New Jersey and I couldn't resist sending it out to my readers. We are always looking for ways to save money and use things we have around the house and here is a list of things you can do with lemons naturally instead of with chemicals. Great list!

Got lemons? Do something great around the house! Here are our favorite household uses for these tart citrus fruits:

Toss used lemons into your garbage disposal to help keep it clean and smelling fresh.

A few drops of lemon juice in outdoor house-paint will keep insects away while you are painting and until the paint dries.

Remove scratches on furniture by mixing equal parts of lemon juice and vegetable oil and rubbing it on the scratches with a soft cloth.

Mix one part lemon juice and two parts olive oil.

To clean piano keys, make a lemon juice and salt paste and wipe them. Rinse with a clean wet cloth.

To renew hardened paintbrushes, submerge them into boiling lemon juice and simmer for 15 minutes, then wash it in soapy water.

To remove dried paint from glass, apply hot lemon juice with a soft cloth. Leave until nearly dry, and then wipe off.

Rub kitchen and bathroom faucets with lemon peel. Wash and dry with a soft cloth to shine and remove spots from hard water, soap residue, or lime scale.

Create your own air freshener: Slice some lemons, cover with water, and let simmer in a pot for about an hour.

Fish or onion odor on your hands can be removed by rubbing them with fresh lemons.

Deter squirrels and cats from digging in the garden by burying citrus rinds just under the surface of the soil.

After a shampoo, rinse your hair with lemon juice and water to make it shine.

To remove rust, scrub with one tablespoon of lemon juice mixed with two tablespoons of salt.

Clean copper pots by rubbing with a paste of lemon juice and salt. Rinse with hot water, and polish dry.

Clean cutting boards with a cut lemon half. For stains, use coarse salt to help scrub.

Rub dull glassware like cloudy coffee pots or pitchers with lemon juice.

Polish brass and aluminum with a paste of lemon juice and cream of tartar.

Whiten shoes or socks by spraying them with lemon juice and placing them in the sun.

Add half of a lemon to the dishwasher and your dishes will come out sparkling and spot free.

Governor Cuomo Announces NY to Cover Local Share of Hurricane Irene Home Buyouts

In April Governor Cuomo announced federal approval of New York State's recovery action plan to help homeowners and businesses affected by Superstorm Sandy, Hurricane Irene and Tropical Storm Lee. This recovery action plan is supported with $1.7 billion in HUD CDBG-DR funds.

After the Lee/Irene Declaration the State announced a federally supported mitigation program. Affected counties and communities were given 3 opportunities to provide a letter of intent in 3 phases with the last one due on June 30, 2012. These Letters of Intent delineated specific mitigation factors for the affected communities including buyouts.

The 17 counties included are Albany, Broome, Chenango, Clinton, Delaware, Essex, Greene, Montgomery, Orange, Otsego, Rockland, Schenectady, Schoharie, Suffolk, Tioga, Ulster and Westchester.

Approximately 1143 properties in 17 counties have been processed already for buyouts under FEMA's Hazard Mitigation Grant Program. The estimated total project cost for the buyouts is over $194 million which puts the 25 percent non-federal share cost at approximately $48.5 million.

The devastation and destruction is still affecting New Yorkers almost a year later.

The Small Business Recovery Program -Eligible Businesses Should Apply For Aid

THE SMALL BUSINESS RECOVERY PROGRAM

Assemblyman (D-Woodbury) James Skoufis is asking all eligible small business owners affected by Superstorm Sandy, Hurricane Irene, or Tropical Storm Lee to apply for aid through the NY State Small Business Recovery Program. This program was developed to assist individually owned and operated small businesses with 100 or less employees as they continue to recover from these weather disasters in the recent past.

Many businesses are still trying to recover, dealing with lost inventory in the hundreds of thousands or the complete destruction of their offices and buildings. The potential aid from this program could help offset some of these enormous costs of rebuilding and restocking.

Grants and loans may be provided to help repair equipment, replace lost inventory, renovate buildings and will provide miscellaneous funding for small businesses directly affected by those disasters noted above.

I usually stay away from anything even remotely political but when I read this I knew I had to add this post to my blog. There is something seriously wrong when people are working as hard as they can especially in more than 1 job and cannot realize their goal and the joy of the "American dream" of owning their own home.

Danielle graduated college and is having difficulty getting full-time employment. She has taken two part-time jobs, 24 hours a week for one and 20 hours for the other since getting out of school.

One of her goals after graduating was to purchase a home instead of renting. Her parents are going to gift her the down payment, so she came to me to get preapproved for a mortgage.

Here is the problem, she doesn’t have a full-time job, rather two part-time jobs. Neither of the two employers she has, want to take on any additional full-time employees because they will soon be liable for health insurance. She told me that both employers are reducing their full-time employees in preparation of the health care laws that will be going into effect in 2014.

Almost all Lenders view Danielle as having part-time employment and won’t approve a loan for her, even though she has the two part-time jobs and is working over 40 hours per week and certainly makes a sufficient income to pay a mortgage. I will keep searching for a lender that will understand Danielle’s situation and be able to do a mortgage for her.

Danielle is just one of the many victims of Obamacare and there will be many more. I recently read an article about two companies that were sharing employees to avoid full time employment. In the months ahead, more of these situations will come to light. Obamacare is a disaster and the sooner it is repealed the better for America.

High Point State Park Sussex New Jersey

Last week I stopped by High Point State Park in New Jersey which is just over the Orange County, NY border. High Point in Sussex County, NJ is the highest elevation in the state of New Jersey with a height of 1803 feet at its peak in the Kittatinny Mountains.

There is a monument at the peak named for the park which can be seen for miles around. It is a 220 foot obelisk that was built in 1930 as a monument to the war heroes of New Jersey. When at the top of this very scenic peak and monument site you can see New York, New Jersey and Pennsylvania.

Entry fees are charged to the park from Memorial Day through Labor Day each year by the carload.

The land for this particular park was donated by Anthony and Susie Dryden Kuser of Bernardsville, NJ and was dedicated as a park in 1923. The monument site is part of a 14,193 acre park where you can bike, swim, hike, ski, fish, camp and more. The park is administered by the New Jersey Division of Parks and Forestry.

So if you are planning to visit any time during the year don't forget to bring your camera!

Pay It Forward - Ditch Your Car & Save A Horse!

The other day I was on my way to a listing appointment when I went around a bend and saw a horse in the road. The car that was ahead of me just swerved around the horse and kept going as if it were a deer. This was definitely the last thing I ever expected to see in the road at this point in my day.

I pulled off the road and ran to the only house in that area and couldn't find anyone. By the time I came back the horse had wandered further down the road and was now grazing on the side instead of still being in the middle thank goodness.

I called to him/her and she came at me at a run. aarrgghhh! Now what? What if she/he didn't stop? Luckily there were no cars coming in either direction so I held my breath and just planted myself right in the horse's path and the horse stopped right where I was looking for food. Thankfully she/he had a bridle on so I was able to grab hold. That was when the horse decided they weren't going back to the field. He/she gave a few good yanks that lifted me right off my feet but I wasn't about to let go. Anyone who knows me knows how I feel about animals and I was not going to leave that horse where it might get hit by a car.

So after a couple good yanks he/she could tell I meant business and she/he went quietly along with me as I walked back down the road to the gate (which was wide OPEN!!) went through and then tried to secure it. When I looked in the field at the other horses and all the cows I was thankful only 1 horse had managed to sneak its way out.

I had a story like this a couple years ago - same thing on my way to a listing appointment and ran into a bunch of loose cows; only that time there was a bunch of us running around trying to get them off the road so no one damaged their car or got hurt. Aaaaahhh country life!
