California's New Anti Deficiency Law Goes into effect January 1st! - 12/30/10 01:47 AM
Senate Bill 931 is California's New Anti Deficiency Law and affects Elk Grove Short Sales.  This new law  was signed by the governor on September 30th and goes into effect on January 1, 2011.  Until now the law allowed banks to pursue a homeowner for a deficiency judgement after the short sale was completed unless the loan was a purchase money deed of trust. 
The Legislation applies to any note secured by a first deed of trust for a dwelling of not more than 4 units.  It protects homeowners as well as investors and includes refinances and hard money loans.

The recent downtown in the housing market has resulted in a drop in rental rates, but rents are back on the rise while the cost of home ownership has dropped!  As average apartment rental rates have slightly decreased nationwide, the decline has been moderate in comparison to home values, which have declined nationwide by 30 to 40 percent since the peak of the housing boom.

Every major price index points to a housing market that has hit bottom and is moving in a positive direction. After 30 months of declining values, home prices appear to be stable or appreciating in nearly every U.S. market.
In August of 2010, the median home price was $182,600, amounting to an 11% increase over the low that was reached in February of 2010 at $164,000. Staying on the fence and waiting for prices to drop further is OVER!

Mortgage rates are at rock bottom and won't stay there forever! 
The national average on a 30 year fixed rate mortgage dropped to a 4.36 prcent in August 2010...lower than it's been in the past half century.  Interest rates for the same time last year averaged 5.19 percent, representing a difference of $90 in the monthly payment on a $200,000 home with 10 percent down, as well as a savings of $32400 into the life of the loan.

What is Bank of America thinking? Or will this roller coaster ever end? - 12/01/10 01:25 AM
I received a counter offer today from Bank of America on one of our Galt short sale listings.  The offer made by the buyer was at $135,000 and the counter came back at $160,000 today.
But this isn't the real problem....let me give you some history on this Galt Short Sale.  The seller came to us a few months ago after not paying his payments for 18 months.  We listed the home and received an offer at $135,000 within a week or so.  We started negotiating with Bank of America as well as with the second.  After a couple of months … (5 comments)
