Like most real estate instructors, I am spending more and more time teaching on Short Sales and Foreclosures.  I firmly believe that starting off on the right foot, covering your bases and establishing expectations with the Seller is the key to getting these difficult transactions done. 
Part of the Listing Agent’s job, should they accept the responsibility of the Short Sale listing will be to work with the lender.  Negotiations and Asset Managers typically will not discuss the Sellers information without a release from the Seller.  Also, they are going to request from the Seller a lot of information.  Jennifer and I … (3 comments)

Recently I wrote a post on AgentGenius.com regarding Loss Mitigation Officers, and the frustration that Realtors tend to have.  This spawned some interesting conversations on the blog, as well as in my classroom.  One of the concerns is if the Seller should disclose their status as one pursuing a Short Sale. 
I think it’s important to know that in accordance with the Realtor Code of Ethics and many state’s statutes, that a Seller pursuing a Short Sale is confidential financial information.  The Listing Agent MUST have the Seller’s permission to disclose such information.  My argument is that it is … (8 comments)
