      <title>Udpates for the New Year</title>
      <description>&lt;p&gt;Hello Friends, it's been a bumpy Dec./Jan. in the industry here in Denver, for sure.&lt;/p&gt;
&lt;p&gt;What once was LandAmerica, became Lawyers Title Co. and then was acquired by Fidelity - in itself not a bad thing at all, as Fidelity is a top shelf Company that knows how to run Title Operations.&lt;/p&gt;
&lt;p&gt;The challenge began just days after the acquisition; Dec. 24th the order came down to reduce the employee force by as much as 30% (here in the Denver Metro market area - I can't speak for the rest of the country on this).&lt;/p&gt;
&lt;p&gt;That left &lt;span style=&quot;text-decoration: underline;&quot;&gt;a LOT of wonderful and talented people out of work&lt;/span&gt; for the Christmas and New Year Holidays - and beyond.&lt;/p&gt;
&lt;p&gt;Unfortunately that also concluded my time with the organization. I will sincerely miss my comrades over at LandAmerica / Lawyers Title / Commonwealth Title and sincerely apologize to our clients for any inconveniences to their business caused by this merger/acquisition.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Well, - That's That!!&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;So, to explain why I haven't been blogging, I've been regrouping, thinking, and prayerfully considering that all important question: 'What Next?'&lt;/p&gt;
&lt;p&gt;More to come, I'll keep you all posted as we move forward together through this year of change and challenge - here's to a FABULOUS 2009 Everyone, All Around!&lt;/p&gt;

      <title>Commercial Real Estate Bailout - Do you Approve?</title>
      <description>This week some of our Nation's largest commercial real estate players approached the Administration (Congress, the Treasury Dept., and others) to ask for help in the form of bailout money due to the current economic picture. &lt;br&gt;&lt;br&gt;
Key to this is whether or not 'Joe and Mary' taxpayer approve - after all, we are the ones that will inevitably be paying this bill, not Congress. &lt;br&gt;&lt;br&gt;
Estimates were given that over the next 36 months and estimated $530 B (that's BILLION) in commercial mortgages will be due for refinancing. 2009 estimates are at $160 Billion. &lt;br&gt;&lt;br&gt;
The challenge lies in the collapse of the credit markets, which could potentially cause owners to go into foreclosure or even bankruptcy if they are unable to secure the new loans (refinance). &lt;br&gt;&lt;br&gt;
I don't think we've seen the end of industry execs heading to Washington with their hats in their hands, perhaps it's only begun. &lt;br&gt;&lt;br&gt;
My youngest made a good point in all of this, asking if 'this happened before or just now' -- we told him this was quite different than any other time in our Nation's history. &lt;br&gt;&lt;br&gt;
He said &quot;Well, he did say we'd get a change...&quot;&lt;br&gt;&lt;br&gt;&lt;br&gt;&lt;br&gt;Out of the mouths of babes, eh?!&lt;br&gt;&lt;br&gt;Merry Christmas 'rainers all!&lt;br&gt;&lt;br&gt;

      <title>What do you do to stay Motivated? </title>
      <description>&lt;b&gt;I was recently asked the question: &quot;What do you do every day to stay motivated?&quot;&lt;/b&gt;
&lt;p&gt;&lt;p&gt;

&lt;b&gt;First&lt;/b&gt; and foremost, the 'why' must be established. That is the critical Goal Setting component. Ask the question: &quot;Whatever it is you (we) do, what is our primary reason for doing it?&quot; (Helping others, making a difference, earning a living, paying it forward, climbing the corporate ladder, etc.)
&lt;p&gt;
&lt;b&gt;Next&lt;/b&gt;, every individual needs to find what motivates them and work an effective strategy tailored to their specific style, inner language of success, etc.
&lt;p&gt;
For example, one person may be motivated by pleasure e.g. the prospect of achieving great success, high commission checks, etc. Another may be motivated by pain: The loss of income, the limitation of their personal time, etc.
&lt;p&gt;
Once you get through the Pain/Pleasure component, you need to address the individual human needs that motivate: Words of Affirmation may be primary to one while plain cold hard cash might be 'it' for another.
&lt;p&gt;
&lt;b&gt;From there, it's a simple (not Easy!) process:&lt;/b&gt;
&lt;p&gt;
* Create affirmations that align with your goals. Typically 4 or 5 powerful statements is all that it takes&lt;br&gt;&lt;br&gt;
* WRITE IT DOWN! Now that your Goal and Affirmation are aligned, you MUST Write them down!&lt;br&gt;&lt;br&gt;
* Post and Focus: Written Goal(s) and Affirmations should be posted in plain view and also carried with you for daily/hourly review. ( I know of Top Professionals that review these dozens of times daily, embedding them into their subconscious)&lt;br&gt;&lt;br&gt;
* Sharing and Accountability: Tell an associate you TRUST what you are doing. Share your Goals/Affirmations with them (ActiveRain is a great place to find someone in your network for this!) and ask them to be an accountability partner for you.&lt;br&gt;&lt;br&gt;
&lt;p&gt;
Just as when you are driving and speaking on your mobile phone you are likely to miss your turn and delay your arrival at your Destination - not focusing on your Goals / Affirmations continuously can have the same effect on your results - and your overall Motivation.
&lt;p&gt;
So, to the original question:&lt;br&gt;
* Know who you are&lt;br&gt;&lt;br&gt;
* Know why you are 'here' (i.d. doing what you are doing)&lt;br&gt;&lt;br&gt;
* Focus on the Goal / Target (Keep your eyes on the prize)&lt;br&gt;&lt;br&gt;
&lt;p&gt;
Do this daily, hourly, - every minute if you have to and you'll find your success increasing steadily, whether you are in your 'dream job' or just filling in the gaps on the way to your desired position / situation.

&lt;p&gt;However, so far it's been a bit too hairy and I've resolved to get the question out there 'old school'.&lt;/p&gt;

&lt;p&gt;FYI: rumor has it that the money is on Blackberry for this one. I personally was in another meeting just this week when that familiar 'default' Blackberry 'ring' was going and no less than 4 people reached for their curves (Blackberry curves, that is... ).&lt;/p&gt;
&lt;p&gt;Personally, I haven't yet invested in the iPhone, my work phone is a Blackberry, and my personal favorite was always the Palm - although I haven't used nor seen one around for quite a while, and the last model I did check out (Centro) had such limited memory it was essentially pointless as a business / contact managing PDA device in the real world.&lt;/p&gt;

      <description>&lt;p&gt;I've seen many posts regarding the points, rankings, and placement opportunities here on Active Rain over the years.&lt;/p&gt;
&lt;p&gt;Today the question came up about just what the ROI is for 'moving up the list' and gaining points and ground in your local market (city, county, state, etc.).&lt;/p&gt;
&lt;p&gt;I'd like to hear from active AR folks out there as to what their tangible and intangible results have been from their blogging, commenting, etc. and the subsequent 'rise' in the points/results that ensued.&lt;/p&gt;
&lt;p&gt;For example, if you aren't a 'Featured' member in your market (city, county, state, etc.) - and there is only room for (2) two profiles/people there - who are likely to have a couple JILLION points anyway - what is the benefit points-wise other than the fun of the hunt/chase/etc.?&lt;/p&gt;
&lt;p&gt;Thanks for your input - let's all share a few ideas and RESULTS here - there must be something I've missed that I can pass along to this client as advice.&lt;/p&gt;

      <description>&lt;p&gt;&lt;strong&gt;I just wanted to take a minute to remember all the agents that have 'left the business'. &lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Add to that all of the &lt;em&gt;&lt;span style=&quot;text-decoration: underline;&quot;&gt;mortgage lenders, title reps, inspectors, appraisers,&amp;nbsp; - you name it &lt;/span&gt;&lt;/em&gt;- that are no longer able to offer us their excellent services and assistance.&lt;/p&gt;
&lt;p&gt;It's bittersweet to still be here working productively in the Real Estate - there are many many&amp;nbsp; talented business people that simply can not afford to offer their services given this economy.&lt;/p&gt;
&lt;p&gt;I know far too many people that have gone back to previous industries just to support their families, replace income lost by a laid-off spouse or family member, or have simply pulled way back in order to weather the current economic 'storms'.&lt;/p&gt;
&lt;p&gt;It may sound odd, but I'm quite serious when I say that I miss my friends and associates from years back. Going through my rolodex (I know, I know, old-school...) and stacks of cards I see the faces and the brands of some of the most wonderful people you could ever hope to work with.&lt;/p&gt;
&lt;p&gt;In Michigan for example, I personally estimate that as many as 2 out of 5 people in this industry (in my contact / referral lists) are no longer in the business.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;That's a MASSIVE shift!&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;So here is to everyone - us, and them - let's remember that we are truly blessed to be working, and doubly blessed to be working in Real Estate serving the needs, goals, and dreams of our fellow countrymen (and women) every day.&lt;/p&gt;

      <title>Creating your Personal Brand - Marketing to your Unique Strengths as a new agent</title>
      <description>I recently found a GREAT post from Michelle in the Nashville, TN market area. I think that her ideas of finding ways to differentiate herself from the local competition are evidence of her being 'on track' as a successful agent/broker. &lt;p&gt;

Now, many of us would say: 'just work hard and give great service', etc. - however the key to REALLY succeeding is to create a brand and identity for yourself and align your marketing to leverage that to your base/sphere/public... and STICK WITH IT. &lt;p&gt;

I like where she is going with this and the bottom line is - she's thinking like a BUSINESS with her personal BRAND in mind. Whatever she comes up with as her strategy, I'm confident we'll be hearing more about Michelle in her market - as a top producer!

1st of all - I have to commend you for entering the business THIS YEAR! You are obviously a optimist and that attitude (can-do) is evident in your post.&lt;p&gt;

There are 'many ways to skin a cat' as you know, and I see alot of great ideas here already. The limit of 5 approach you mention is pretty cool - I agree that you'll need to market like the dickens to back it up - BUT - imagine the CALIBER of listings you'll be able to get :&lt;p&gt;

    * Priced RIGHT&lt;br&gt;
    * Clean &amp; Staged&lt;br&gt;
    * GREAT Location&lt;br&gt;
    * Creme' de la creme (best of the neighborhood, showcase properties)&lt;br&gt;
    * SERIOUS and committed sellers willing to do what it takes to sell&lt;br&gt;&lt;br&gt;

Regarding the '6th listing' etc., you could always take that on w/a partner or better yet, I've seen brokers offer differing 'levels' of service for their listings: Premier, Gold, Standard etc. (call them whatever you want).&lt;p&gt;

For example, you could offer a limit of 5 properties listed as Premier' - with all the benefits that your marketing plan offers them - and 6,7,8 etc. still get listed, but perhaps don't qualify at that level. This typically includes different commission % etc.&lt;p&gt;

Not all brokers can pull this off - and you may not want to go this route - in any case, differentiating yourself from the agent/broker/team with 100 listings is a great approach, and I like the way you think!&lt;p&gt;

      <title>New Law Closes Tax Loophole on Capital Gains</title>
      <description>&lt;p&gt;A popular tax-saving loophole regarding capital gains taxes on some primary residences has been impacted by the recently signed 2008 Housing and Economic Recovery act.&lt;/p&gt;
&lt;p&gt;If you have clients that you believe may be impacted by this latest ruling, and/or would like to learn more about this and other Real Estate issues, news items, and tax information - just let me know.&lt;/p&gt;
&lt;p&gt;I have access to a wealth of knowledge to share with all Real Estate professionals including the changes outlined above.&lt;/p&gt;
&lt;p&gt;Some key points of the recent modifications:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;The new law states that the gain may not be excluded for periods of 'nonqualified use' - basically the period of time when the house was not used as the taxpayer's primary residence&lt;/li&gt;
&lt;li&gt;This change the avoidance of capital gains tax by for taxpayers who previously sold their primary residence, claimed full exclusion, then moved into a 2nd or 3rd home (which they had owned for some time)&lt;/li&gt;
&lt;li&gt;The new law is effective only for sales beginning in 2009&lt;/li&gt;
&lt;li&gt;Partial exclusion may still be available, in specific cases&lt;/li&gt;
&lt;/ul&gt;

      <title>Are you celebrating Halloween?</title>
      <description>&lt;p&gt;How many of us are celebrating Halloween this year? On top of that, how many of us are dressing in costume @ the office today?!&lt;/p&gt;
&lt;p&gt;Here's a history of Halloween for you, from LandAmerica:&lt;/p&gt;
&lt;p&gt;HISTORY OF HALLOWEEN&lt;/p&gt;
&lt;p&gt;Over 2000 years ago, the Celts celebrated the beginning of their new year on November 1 with bonfires and a feast called Samhain.&lt;/p&gt;
&lt;p&gt;They believed that this turning point of the year, the end of summer and beginning of winter, was a time when the spirits of the dead and other magical beings could communicate with the living.&lt;/p&gt;
&lt;p&gt;In the early centuries of Christianity, church holy days were often set to coincide with existing pagan festivals in order to bring people into the Catholic faith. Pope Gregory III, in the 700s, moved the holiday of All Saints' Day from March to November 1.&lt;/p&gt;
&lt;p&gt;On that day, Allhallowmas (the mass of the holy ones) was said, making the day before All Hallows' Even, which became our Halloween.     Jumping ahead to more modern times, in the 1920s, kids at Halloween didn't put on costumes or go to neighbors for candy. Instead, it was mostly a time for pranks such as moving outhouses or taking gates off posts or tipping over ashcans.&lt;/p&gt;
&lt;p&gt;As time went on, these pranks turned into vandalism, and in the 1930s, neighborhood committees and clubs began promoting going door-to-door as a safer alternative. Home and shop owners provided treats on these &quot;beggar's nights&quot; in an attempt to keep troublemakers away. The phrase &quot;trick or treat&quot; begins appearing in national publications from 1937 onward.&lt;/p&gt;
&lt;p&gt;Halloween may also serve another purpose:&lt;/p&gt;
&lt;p&gt;Being scared increases adrenaline and other hormones, which raises your energy level as well as giving you a way to work through fears &amp;ndash; of monsters, death or the unknown &amp;ndash; in a safe, controlled way.&lt;/p&gt;
&lt;p&gt;Masquerades and playacting let you have fun pretending to be someone else for a while. That may be why Halloween is such a popular national holiday for children and adults alike.&lt;/p&gt;
&lt;p&gt;Whatever you are doing today have a Safe and Wonderful Day out there!&lt;/p&gt;

      <title>Business Method Patents Ruling - What effect on Real Estate Models?</title>
      <description>&lt;p&gt;There's a lot of hullabaloo in the startup world today about the recent ruling by the US Court of Appeals about Business Method Patents. On the surface, it would seem that the 1300+ Business Method Patents registered in the US last year are, as of today, INVALID.&lt;/p&gt;
&lt;p&gt;I haven't yet seen the research or looked into any specific 'Real Estate Model' method patents, however I do recall hearing that there were quite a few 'new' model companies filing for protection under this process.&lt;/p&gt;
&lt;p&gt;I've read that the court ruled there to be a two-pronged test to determine whether a software of business method process patent is valid:&lt;/p&gt;
&lt;p&gt;(1) it is tied to a particular machine or apparatus, or&lt;/p&gt;
&lt;p&gt;(2) it transforms a particular article into a different state or thing.&lt;/p&gt;
&lt;p&gt;We'll see what comes of this in the weeks and months to come, and I'll keep you updated once I've found which, if any company (models) this may affect.&lt;/p&gt;
&lt;p&gt;The good news for startups: Perhaps with the protection lifted here, we will see faster and further innovation&amp;nbsp; - making things better and clearing the way for the 'next' iteration of Web 2.0-meets-Real Estate...&lt;/p&gt;
&lt;p&gt;Or?...&lt;/p&gt;
&lt;p&gt;Who knows.&lt;/p&gt;

&lt;p&gt;Consider this: there are now many many ways to 'blog' as we know it.&lt;/p&gt;
&lt;p&gt;Twitter - and all of it's variants (personally I like Where's GPS Twitter function on Blackberry)&lt;/p&gt;

&lt;p&gt;Other short-message updates&lt;/p&gt;
&lt;p&gt;Feeds and archiving tools&lt;/p&gt;
&lt;p&gt;Active Rain (http://www.ActiveRain.com), WannaNetwork (http://www.WannaNetwork.com), RISMedia and other forums and top blogging sites&lt;/p&gt;

      <description>&lt;p&gt;Just wanted to put in a NON-POLITICAL plug for &lt;span style=&quot;text-decoration: underline;&quot;&gt;&lt;strong&gt;early voting&lt;/strong&gt;&lt;/span&gt; here.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;GET OUT AND VOTE!&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;And if you are so inclined, I highly recommend early voting if it is available in your local area.&lt;/p&gt;
&lt;p&gt;My own experience was fantastic - no lines, no crowds, no rush, no bad weather, no drunks (always nice), no parking issues, no crowded booths, no B.O. wafting over from the happy people next to you (there were no people next to me), no broken / shut-down machines, it was in a word - EXCELLENT!&lt;/p&gt;
&lt;p&gt;On top of that, there were PLENTY of 'I Voted' stickers, which I highly treasure each election season.&lt;/p&gt;
&lt;p&gt;So, to sum up here, Get out and vote, and vote EARLY if you are able!&lt;/p&gt;
&lt;p&gt;My guess is many others have had the same positive experience in their early voting - feel free to share it here as well.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;BPO Definition:&lt;/strong&gt; BPO is an abbreviation or acronym which is used in Real Estate for &quot;Broker Price Opinion.&quot;&lt;/p&gt;
&lt;p&gt;Brokers and Agents typically create CMA's (Comparative Market Analysis) for their real estate clients - but BPOs are different.  A lender, bank or loss mitigation company my have homeowners with delinquent mortgage payments. Oftentimes in the period before foreclosure the lender(s) will pay a real estate Broker. Agent, or Appraiser to complete a BPO on the property. Usually the lender has their own form and criteria for how the valuation will be verified, however it has become more common for 'BPO Services' to provide standardized reports due to the current shift in the housing markets Nationally.&lt;/p&gt;

In these cases, typically the cost to procure the business is paid for rapidly with just a few BPOs&amp;nbsp; completed.&lt;/p&gt;
&lt;p&gt;As in any opportunity for business, ROI (Return on Investment) is a key consideration and that is exactly what we are talking about in the point above.&lt;/p&gt;
