I came across an add this week which stated that real estate professionals do not take the time to compare and choose a Title company for their clients. Further, that these Realtors and Mortgage Brokers want to send title needs to someone with whom they have a relationship or obligation, based upon the idea that it is not "unheard of for a real estate broker to actually own a part of a title company and heavily encourage his employees to bring in the extra business."
If I was still a Realtor I would be greatly offended at their advertising! That kind of statement makes it seem like most real estate professionals primarily look out for themselves, and do not have their clients best interests at heart. I know that there are a lot of agents who actually have that mind-set. However, I would really like to believe that most real estate professionals intend to fulfill their fiduciary responsibility!

Most of you who have been in the business for a while know something about loss of priority & mechanic's liens. However, it never hurts to be reminded of things that can cause a time delay or a potential claim. Mechanic's liens can be one of the largest sources of loss experienced by the Title Insurance industry. Losses from mechanic's liens can be particularly high in times of economic downturn, where real estate prices are in decline. I would say that todays' market qualifies.
Therefore, when a Company is asked to insure Title where mechanic's lien exposure exists, such insurance may only be given when a thorough analysis of the project causes the Company to agree to accept indemnification. A Statement of Information is a written statement of facts relied upon by Title insurers to assist in the identification of persons involved in a real property transfer. The form will often help me process your orders much faster. Most of the time there are liens and judgments that show up when a property and/or a person's name has be "run." Basically it works as a process of elimination. Recorded documents that have individuals with similar names can then be eliminated, after verifying that it does not attached to our transaction. If lien or judgment does attach, it will help Escrow order the demand that much sooner! And...Title will not have to add the exception requesting an "S of I" be completed.
Therefore, it is extremely helpful with common names like "Johnson." So, here is a great tip: Do not wait for the Title Plant to ask you for a Statement of Information! Provide it when you open the order, especially when our party has a common name. It will save you from having to go back to the borrower and asking them to fill this simple form out, and then forward it to Title. Even after Title gets this form, they must go back and review, update, and distribute the Preliminary Report back to you. Then, you will be sending the report back to the borrower and/or the Lender!
I always ask my clients for the borrowers' SSN# when they open Title and Escrow. If it is a common name, I always suggest to have the borrower fill out a Statement of Information before the Title Report or Commitment is completed. In this way, we can both service our clients faster and more efficiently!

Since I deal with a lot of people outside of CA, I often get the question, "What is a PECOR?." Each state has particular compliance requirements. The state of CA is not an exception!
In CA, a Preliminary Change of Ownership Form (PCOR) is required to be filed when deed(s) transferring title are recorded. This report must be filled out with the County where the property is located. It is actually required by State law for real property transferees (buyers) to complete this form and file with the County Recorder's Office. The form must be signed by the transferee or an officer of the transferee.
When this form is not filed as required, the County Recorder charges an additional fee of $20.00. Basically this information which the transferee furnishes helps the County Assessor to determine whether there is a change in ownership. If this is the case, the fair market value of the property is adjusted. This two page form that is submitted to the County Assessor-Recorder must be originals, with original signatures.
This document is not a "public report." Therefore, it is not necessary to record it! But remember, the information is used by the County Tax Assessor in determining annual property tax amounts.
