Big corporations are finally opening their eyes and ears to consumer complaints through social networks like Facebook.

When I purchase goods or services from a company…I expect that the product works the way its supposed to and also that if I have an issue with it that they have good customer service.

One of my biggest pet peeves is when I get on the phone to get some assistance for the product or the services provided and all they do is sweep my complaint under the rug. I end up having to waste time trying to actually locate the proper department or person to handle the issue. I can’t tell you how many times I’ve spent a half a day of just sitting on hold and then find out that it’s the wrong person or that there is nothing they can do for me. Sometimes I get very angry and sometimes I’ve even try to go the “nice person” route and ask if they can help me out.

I decided to do an experiment and I thought I would be the perfect guinea pig.

About a year ago I heard that if you went on Twitter and complained about an airline.... they would respond faster and actually were willing to help you out. I have a Twitter account but rarely use it…I really don’t see any benefit for me personally but I figured I would give it a try. I went on there and found the companies twitter page and left a comment regarding an issue I had with Enterprise Rent a Car. Basically I told them that I’ve been a good customer for over 20 yrs and have rented many cars with them. At the time we rented a car from one airport and planned on returning it to another location based on our departure. When we turned the car in…the agent inspected the car and claimed that we had a quarter sized dent in the bumper.

I insisted that we never parked the car behind or in front of anyone so we believed the dent was there when we picked up the car and it wasn’t brought to our intention during the inspection. Apparently the agent still insisted on reporting it and the next day we received a bill for $225. I originally tried to call and speak to a supervisor and they told me they had pictures and we had to pay it.

After going back to see that there wasn’t any response on twitter…I gave up. The next day I decided to try the same tactic on their Facebook page. I basically posted a not so nice message on their page about how they won’t even help out or work with a very loyal customer. Within 5 hours I received a response that I would be getting a private email from the district marketing director for the airport. He told me he reviewed the pictures and also noted that the cost was under the normal wear and tear policy and that my money would be refunded. Unfortunately for me…. the drama wasn’t over…the check was lost somewhere in corporate for about a month and I kept calling this person to figure out what went wrong. He felt so bad that after I finally did get my refund….. he sent me an additional check from his claim departments personal account for the same amount and told me to keep both checks and also gave me the use of any car on his lot for 3 days for free when I had to travel a month later. I told him it wasn’t necessary but he insisted I take the offer. So in the end..I received my refund twice and the use of a car for free. His reward was that he just got back a good customer for the future.

After all this happened …….I thought to myself that I would definitely try this again if needed just to see if this really works. About 3 months ago I had a problem with a Flat screen TV I purchased through Samsung back in 2008. About a year after my warranty expired…we had a problem with the TV and had to spend money to repair it. 3 months ago the TV picture was turning black on the top part of my screen. I first called them on the phone and asked them for help and they said my warranty was over but they would send a local vendor out and do a one- time repair for free. They showed up and replaced a part after 3 yrs. We paid $1100 for it and told them that I spent in excess of $10,000 on other Samsung products. Within a few hours they responded to me and directed me to their Executive services for social media complaints. Within 4 weeks I was able to get them to send me a new TV with a new warranty and take the old one back. All I had to do was pay $150 replacement fee….all worth it to me considering it’s a brand new 2011 TV with newer features.

With a little patience…my experiment apparently worked not once but twice!.

So I’m 2 for 2 and I thought I would share this with consumers looking to get something back from the companies that we spend a lot of money on.

So what does this have to do with Real Estate? I guess it has more to do with customer service and how well companies and people respond to the consumers needs.

The month of December is usually the start of when our snowbirds and tourists return to the sunshine state. Snow fall will be forthcoming and this is the time for them to start their holiday vacations and what better than to spend it in our very warm and comfortable climate. Our weather here has been fabulous for weeks. The temperature in Hollywood Beach Florida has been mostly sunny in the 80's with virtually no humidity.

With such an inflated amount of condos for sale in Hollywood Florida....."it is an excellent time buy a home." Prices have come down quite a bit over the last 7 years and inventory levels are still pretty high. I've noticed that there are still many Canadians looking to buy condo's in Hollywood Beach Florida.

When we looked today...it showed that the Canadian dollar exchange rate has been hovering right under $1.00. That is still good news for our past,present and future clients. In general .."it is a great time to buy a home in Hollywood Beach FL."

If you were to cross over to the west side of A1A you will find a different perspective of a premium location. By having the beach on the east side as well as the the awesome west side with views of the inter coastal waters.

Don't be a Turkey on Thanksgiving...be a Turducken!

It's that time of year again...I like to re-post this blog since I'm so hungry right now!

Every year since I've written this blog post...I like to re-post this in celebration of being thankful. I've made a few changes to it.

I'm also declaring this a day of rest and enjoyment.....so take this time to enjoy the day off if you can!

Don't be a Turkey on Thanksgiving...be a turducken!

Back in Nov. 2007 I posted this blog so I thought it would be nice to revisit it by re-posting it for this years Gala Holiday Event.

Selling Real Estate can really be hectic at this time of the year and with the holidays approaching....I'm sure everyone is making big plans to spend extra time with their families. Today is Thanksgiving and I'm just here to talk a little bit about the food we eat on this gracious day.

Just remember that this holiday is for giving thanks and beside giving thanks I'm going to be eating quite a bit of food. "Ah...I can smell the aroma now...those candied yams...the cranberry sauce....the mashed potatoes with gravy and don't forget that stuffing...just to name a few."Of course to top it all off we usually have the traditional 40lb turkey or the that sweet succulent ham with brown sugar and pineapples on top. There is usually so many different types of foods and I'm not sure I have enough room to fit it all in my tummy and keep my girlish figure.

But I think this year we might try something a little different...has anyone ever heard of a Turducken? Yes..you heard that right....a Turducken. From the partial definition taken from Wiki......a Turducken is a de-boned turkey stuffed with a de-boned duck.. which itself is stuffed with a small de-boned chicken.

If you are a football fan you might remember a few years ago during the NFL double feature of games shown on CBS and later Fox....John Madden would talk about all the delicious foods and how he would have his annual Turducken as part of his holiday dinner. I remember he even went as far as to bring it during a regular season game after he saw a patron actually roasting one in the parking lot. John Madden is a big boy!

Thursday we get to enjoy not two ..but three games. I'll probably need to take a nap later in order to stay up and watch the 8:30pm game..HAHA!

Sharing food with your friends and family is a great way to catch up with people you haven't seen in a long time and another way to enjoy relaxing in your home. Photos are courtesy of MMFRUIT and lmingall from Flickr.

Do You Rely On Your Customer Satisfaction Survey'?

There is one thing that I concentrate on in my business more than anything else..more than just selling the Real Estate....and that's customer service!

You shouldn't have to and it's not a requirement but....I'd rather pay someone a little more or pay a higher rate to get great service.

I don"t know about you but I like to read them. I'm not too worried if I get a not so nice or a negative one because you can't always please everyone. I'll admit it... but sometimes early in the game when I list properties for sale or work with a buyer..they don't always move as quick as I'd like them to or they might not get as much activity as I expect but you live and you learn. In the end...my goal is for the client to be happy because the listing sold and the customer is happy that they were able to purchase the property and close.

Anyone will tell you that they love reading the one's that make you out to look like the Messiah of Realtors®. But then there are times that you'll see some that might make a few suggestions as to how you should change your ways or improve your business. Thankfully..in 18ys ...I've been lucky to get the majority of positive results versus the negative one's. And I'm not blaming the client at all. They have every right to get 100% total satisfaction ans superior service no matter what happens.

So if I get a negative comment...I use it as just some normal constructive criticism. This way..next time I can use it to my advantage and maybe even learn from my mistakes.

It brings me to a funny story that happened to me recently. I recently purchased a new car and although the car is great....the service sucked! I really couldn't blame the salesman since they really just sell you the car and then you're passed off to these so called "service advisors". Eventually the salesman tried to help expedite and follow up just so it looked like he was doing his job but throughout the wait..he kept harping on the survey I would receive and how it was very important that I rate him with all 10's because it would effect his "bonus". Of course I'm not that mean of a person to ruin his chances for a "bonus" so I gave him his name in lights. But I did tell him that I wouldn't be as nice towards the service department.

When I send out my surveys..I don't think about a bonus. I get paid at the closing. Of course...we all want to make a good impression and get positive responses but it's not bonus related....at least mine isn't. I use it more for future business and I've never asked any of my clients to give me the best or even the worst rating....just be honest...that's the best type of bonus anyone can get!

I try to send out one of these surveys to every client once the transaction is completed.... via email,fax or regular mail. Some people respond right away and some take their time and some just forget and never respond. I like to send some of them to my broker so they can see the service I provide to my clients.

Below is an example of a simple way to make and send surveys to your clients. I try to make it short and brief because if it's too long...you'll lose the customers attention and they'll throw them out.

Yesterday I get a voice mail notification. I call back to listen to the message and it's all broken up so there was no way I could hear who was calling me or what they were calling about.

There is a return local number so I call it back so I could uncover who the mystery caller was. I figured that it might have been someone calling me about a property so I thought it was only right to return the call.

I could never understand why a listing agent wouldn't respond to a call to show a property they have listed...but this one was even worse...2 weeks later makes no sense. I would think they would have someone cover for them. If I was the client and knew this was the type of service the agent provides...I'd be looking for another agent.

Just my humble opinion!

Do you trust your Realtor®?

I've been a full time Realtor ® for around 18 yrs. ...and I'm primarily a listing agent but I do work with a selective amount of buyers as well. It seems that nowadays...I'm working with more buyers due to the change in the Real Estate market.

I think about this question almost every-time I'm working with a buyer..... "Why would a complete stranger trust their Realtor®?"

Most buyers that I work with may not even show up at the closing if they live many miles from the property. Because they aren't always familiar with the area...they're constantly asking me to recommend inspectors, title agents, mortgage brokers, attorneys and contractors...just to name a few...I guess they're just too busy and would rather let a professional handle it.

I'm not always comfortable recommending different trades because if they aren't satisfied with their services....I just don't want to feel responsible...but I will recommend if they insist. most of the time...they are satisfied but sometimes they might not be. I guess you can't satisfy everyone all the time

I can guarantee one thing....100% total satisfaction, total trust and that I've done everything to make them comfortable working with me.

I've had many of my clients tell me."You handle everything for me and I have complete trust in you that you'll do the right thing." Thankfully..I've been blessed that the majority are happy with the superior service I provide.

Let's face it....everyone wants the transaction to be a smooth one. No one wants problems...issues...whatever you want to call them. Sometimes.... no matter what we do...no matter how much effort we put into it...if it's out of our control...there can be issues.

I seem to attract many consumers who are from out of town and many of them will usually travel to Florida just see as many properties they can in one trip and then fly back and make the offer from home.

Most of them don't understand the entire process and they're not always aware of the fact that every state has different rules or laws.

I've even had many sellers that I've never met that will for some reason "put their trust in me" and just send me the keys and list their homes for sale. It's amazing how I never even meet most of them...but that's another sellers story for another day.

Let's take what I call the "simple approach" with an "all cash deal"........

The following simple steps are needed to be completed in order to get to the closing table.

The buyer wants to make an offer so we like to put it in writing so the seller will see that the buyer is serious. Once it is accepted...we now have a fully executed contract.
If it applies to the transaction... Homeowners association or condo docs are delivered to the buyer for their review.
We set up an inspection.
If the iinspection passed...we now moved onto the next step.
A title company is picked to be used and once they get the file started....they will notify both the buyer and the seller so they can gather any additional information and or documents that might be needed for the transaction.
If it applies...the buyer might need to fill out an application and or a screening package for approval.
We get the approval
Then we wait for the survey to be done and finally we set a closing date.
We do our walk through and if all goes well...we close!

Market Reports and Web 2.0 Flyers turn into business without even trying.

I haven't had much time to write a post that might be story related. In the past...my mind was full of many entertaining stories that most of my peers seemed to enjoy. It makes no sense to me just to write something so it gets picked up on the main dashboard. I guess it depends on what your agenda is. Writing a good story takes time and effort. For me...its easier just to do it on the fly. It seems to come out better.

My agenda is to post market reports and the listings I want to sell. Many agents will tell me that they don't like them because they seem static and really have no interest in reading them. I'll be honest with you..it's nice to see a few comments on my blogs and my market reports but in the end....it doesn't help me generate business.

The same goes for Web 2.0 flyers. Some people feel using these flyers are just a lazy way to post a listing. Some prefer just to write their own descriptions and place their photos on the page. I'm not saying there is anything wrong with that but I prefer to do it this way. To me...it just looks better and I'll admit that it is easier and faster for me to do it this way.

Counting how many comments you get is really more of a waste of my time. I have no problem answering back to the comments but if its a market report...I have found that the consumer that is reading them is not leaving me comments anyway. They are doing something better that none of my peers will ever see. "They are sending me emails and I can tell you most of them are real and end up a deal for me."

I'm sure my market reports aren't all spiffy like others post but why should I change what is working for me?

Here is where it does help you with cultivating a lead or getting actual business from them. Did you ever check any of your blog posts to see how many times it's been viewed or clicked on? If you haven't...you should.

If you notice to the right of these fields...the first column is how many comments I've received. The second column is have many times the page was viewed and the third column shows how many times it was clicked on.

I really believe that the consumer doesn't care about how many comments we get on a market report or a Web 2.0 Flyer and it's obvious. Most of my peers don't even look at my reports so I know that the majority of these views are coming from a prospect.

Another interesting thing I figured out after doing this for a few years is most of these market reports above are for communities that cater to Sr. Living communities.

Here is a quick survey...if you ask most people if Sr. citizens are looking on the Internet to purchase or sell their properties..most of the time the answer would be "no". The thinking behind this is that most Sr citizens are intimidated with computers and the Internet. They simply would rather search the old way or traditional way by calling up the Real Estate agent and asking them to do all the research or would rather look at an advertisement in a magazine or newspaper.

Those people are mistaken and the reason why I say this is more than 95% of the leads I get and convert from these Sr citizens were because they viewed the market reports and Web 2.0 flyers that you see above.

I don't like to brag but just this week...I received two leads right on my blog from those lazy,stupid,static market reports and those ugly,lazy looking,non creative Web 2.0 flyers. They aren't the biggest sales I've ever made but if I told you I made a few grand this week from each of them...would you be happy with that? ...I am!

The good thing about this is at the end of the year I can tally up how much cash I've made just from this one source of my lead generation and it didn't cost me anything but my time.

Think about it next time when you're thinking about posting a blog, market report or Web 2.0 flyer.

Is the Home You've Listed Ready to Close?....Unknown Open Permits can delay the process.

I’ve been selling Real Estate for over 17 yrs. Most of my clients are from listings. I’m not saying that I don't work with buyers.... but the majority of inquiries I get are to list homes for sale. It’s something I’ve become pretty good at but I don’t know everything and I’m always learning new things.

When I take a listing…I have a set of questions that I will ask the homeowner. I need to find out as much as I can so in the end…there hopefully won’t be any surprises. Most homeowners are willing to tell you everything you need to know. Some prefer to keep certain personal things to them selves. I’m not looking to pry into their personal business unless it will materially affect the sale of their home.

Most of the questions that I ask them are general questions…for example…”When are you looking to move?” or “How much you owe on their mortgage. “ "If you put your home on the market…do you have a place to go?”

These are just a few of the questions that I might ask them. Over the last few year….I’ve added to my list and one of the most important questions I will ask them if it applies is “Are you aware of any open permits?" Typically the owner will already see this question as it is usually built into the sellers Real Property Disclosure. The problem is that sometimes people are too busy and distracted with other things. So when they fill out these disclosures…they don’t always pay close attention to that question. Also…sellers in my area are not obligated to fill them out any longer. It’s usually because they’ve inherited the property from a family member who might be deceased and they just decline to fill them out or sign them.

Here is when it makes my job a little harder….now I must make sure that before we close….there are no permits that are still open that might hold up a closing. I usually rely on the home owner to know whether or not they have any but after learning the hard way…I’ve decided that now I need to do a little more research just to make sure we are clear to close.

I’m briefly going to tell you about one that became a pretty big issue. I listed a home for someone who inherited a home that was previously owned by their father and also there was a live in girlfriend. After the father died….the girlfriend rented the home out for a few years. She had an arrangement to split all income with the deceased man’s son. After a few years …their agreement was to have her move on with her life and the son take over the property which included the tenant. "Sounds like a good deal right?” Well it was for a while….until the tenant stopped paying their rent. It was too difficult for the son to keep up with it as he was living in another state had not been to the property in many …many years and had no knowledge about the open permits. Eventually he was able to get the tenant out and we put the home on the market and within 60 days we were able to get a contract on the home. About 2-3 weeks before we were scheduled to close…I received a call from the title agent telling me that there were 3 open permits that were from 2005! HOLY MOLY! The agent told me that until these permits were closed and resolved…we couldn’t close.

Honestly…I was a bit nervous because the home was in a different county than where I did most of my business. The first thing I needed to do was look at the docket to see what the permits were for and then I had to call the building department to see how to resolve them…and quickly. The other problem was the we were approaching a major holiday and I knew if I did not act fast….we would never close on time. I drove an hour and a half out of my way and managed to meet in person with the head inspector of the building department. He was very helpful and explained what I needed to do to expedite this.

I had to drive about an hour out of my way down to the building department so I could pay for each permit to be reopened and then closed. My client needed to mail money to me first to pay for the permits and I had to fill out all the paperwork for him. I then had to meet 3 different inspectors at the property on 3 different days and basically sit in front until they showed up. The biggest problem that held everything up was that one of the items that were repaired had been inspected 3 times and all the times it failed. But There wasn’t any evidence as to why and I could not find out because the contractor was no longer in business!...YIKES!

Eventually I was able to get a new licensed contractor out there and had the item re-inspected and we finally closed. I did have to have the title agent hold money in escrow to only be released after we had verification in writing that the matter was resolved.

We closed and about a week later…the escrow was released to the seller.

So next time you list a property for sale….take a little more time to research it and make sure that there aren’t any open permits or it will surely hold up the sale of the property.

Our Realtor® left us hanging at the closing table!

I'm sure that this post will have some controversy and I'm sure that there will be some that agree and some that don't.

I still firmly believe that sometimes we have to be there for our clients. Whatever floats your boat and works for you is the most important thing.

I know that some of you are going to say..." We have qualified people to go in our place" or "We're too busy to go" or "Our clients don't care if we're there or not" or "the property is a short sale and vacant and there is no need to be there" I've heard all those reasons before. ..I've heard them all.

There are always going to be a few exceptions but I can tell that one time a buyer was sitting at the table across from me and said they would remember me for their next transaction. I did not in any way steer them into saying that...they just volunteered it. One time the buyers vented their dismay so I asked them why their agent didn't show up...they told me they didn't even remember his name since they had virtually no contact with them throughout the entire process.

Remember...some consumers need their hand to be held and expect to have some sort of dialog with their agent and not be passed off to another person who never even developed the relationship with them.

I was pretty busy all though out 2010. Maybe I had a month or two where I was a bit slow..but generally kept busy. As a matter a fact....December was probably my busiest month in 2010 so I'm grateful. Staying in this business takes a lot of thick skin...a lot of effort and a lot of work. There is so many hours in a day to manage your time. But one thing I try to do is show up to every closing. There a going to be a few exceptions to the rule...for example...when I list a short sale or an REO property...the chances of the sellers coming to closing are very slim. On a short sale....it's either the seller has moved out and wants no part of showing up especially when they really have nothing to show up for. No proceeds to them and it's much easier for them to just sign all the documents via mail. REO's can be similar accept the owners are already out of the picture and the bank or the asset holder usually won't come to the closing. But in the end...if I'm the listing agent...I like to show up and get paid! After all...I've just spent all these months trying to close these difficult deals so it actually feels good to show up...get my check and know that I can pinch myself in the morning and know the deal closed...my clients are happy and I'm happy!

Now on traditional transactions where there is actually a seller who is going to receive some proceeds go...they still do not have to be there but in that case if it's a mail away...most of my clients expect me to be there on their behalf whether its to POA their HUD or be there in case something goes wrong...AND WE ALL KNOW THAT THINGS CAN GO WRONG!

For example...a few weeks ago I closed one of the hardest short sale listing I've taken. It was a major challenge from the beginning. The sellers weren't attending but I wanted to be there so I showed up. The buyers were there but their Realtor was no where in site. The only person that they could rely on was the title agent. They didn't know me so I didn't expect them to just jump up and hug me but I did see tension on their faces. Eventually they opened up and disclosed that through out this transaction...they had little or no dialog with their agent...in fact the buyers agent went out of the country and left them with their transaction coordinator. The buyers agent was a nice person and seemed to know what they were doing and their transaction coordinator seemed nice as well but didn't have the same relationship with the buyers from what they told me. One thing that I thought was a bit odd was before we were to close...the transaction coordinator called me and asked if I would meet the buyers at the home and conduct their walk through. I said "no". I felt very uncomfortable and stated that I wasn't going to be put in an awkward position if they had questions. I like to help people...don't get me wrong but it's not my clients.

While they were signing their documents...they kept venting. Apparently they weren't told of these things until they were at the table. I just sat there and kept my mouth shut. They basically told me "Our agent didn't show up but you showed up and you didn't have to"

The funny thing was... I received a message a few hours after the closing from the buyers agent asking me how the closing went because when they tried to call the buyers...they didn't return the 3 messages.

I wonder why...

Realtors® Step up to the plate for your clients!...Don't rely on your Title agent to check for any open permits...check yourself!

I've been a Realtor® for more than 15 yrs. I mainly list properties so I try to make sure that I cover all the bases regarding the Real Estate part of the transaction.

You might be wondering what I mean by that. For example...during the process from contract to closing...I have to make sure that everything is moving a long on my end. I try not to step on any ones toes so I'll usually take a step back when it comes to the other parties involved. I have to be pretty confident that they will do their part and stay focused. Unfortunately there are times when other people get lazy and let things fall through the cracks and then at the 12th hour I find out that these issues could have been addressed at a much earlier date.

When that happens...then we all have to scramble to make sure we meet our deadlines.

I've seen a lot of mistakes and issues in my career and I'm sure a long the way I could question whether or not I could have done something different. It's a learning process and no matter how many years of experience you might have...there will always be something new that pops up.

This is a two part story....recently on two consecutive closings...I ran across similar issues with both of them. Below...I will explain.

The first one went this way...

Client number 1 - Seller employed me as their listing agent. The property was a Trust sale as the parent was deceased since 2003. The owner's son was the trustee and lives out of state and from what I was told...he never has been to the property. There was a lot of leg work I needed to do first before I could even put it up for sale. There was a tenant that needed to be evicted due to not paying rent for several months and was not responding in any way. The property was left in terrible condition so I made arrangements to have some things repaired.

Once I put the property up for sale....we had a buyer within 30 days. We had a closing date that was met but about 2 weeks before the closing was to occur...the title agent ran across 3 open permits. Most title companies won't check for open permits and liens until a few weeks before a closing...some won't check until a few days before the closing. I think they wait just in case the deal falls through and they aren't out the time and money they have to put up front for these searches.

Because the client was from out of state...I was the only one who would be able to take care of this so I did. Two of the open permits were fairly easy to remedy. All I had to do was drive an hour out of my way and meet with the head building inspector and he assured me they would reinspect the next day. I did have to pay a few hundred dollars up front but my client gladly reimbursed me.

The third one was a bit of a problem because it was more complex and didn't pass the original inspection due to mechanical failure and a no access into the property.

These open permits were from 2003 and back then these inspectors didn't have a system with notes so there wasn't muh information as to the exact reason it didn't pass. the only thing I could find out was that an A/C unit failed 3 inspections and the original contractor went out of business. My dilemma on this was that we needed to close in a few days and it was right around the holidays. My only solution was to escrow an estimate of all the costs..close on the property and take care of the permits in 2011.

As of yesterday...the book is closed on this property and it all worked out...the remaining escrow was released to the owners son and he was happy.

Client number 2 - I was hired by the seller to list the property as a short sale. In the state of Florida...when you purchase a home...you hire a title company to do their work...run all their searches to assure a clear title and they issue you title insurance. The seller had purchased this property about 10 yrs ago and at that time they assumed there wasn't any liens or open permits. Unfortunately this particular transaction was a bit more complex. So we go through the short sale process and we get the approval. This also happened right before new years. The process from contract to closing actually took about 4 months which isn't so bad for a short sale these days. But a weeks before the closing the title agent contacted me to let me know they found an open permit that went back 14 yrs!

Yes ...that's right...before the seller purchased the property!...there was an open permit for a faulty fuse for the alarm system! Although this was pretty bogus in my mind...the last title company closed with the outstanding permit still intact! All I know was we only had a few days to close on this with the lender. And with the buyers deadline and he holidays approaching...we didn't have time to chase the prior title company down or get a hold of the underwriter.And there was no time to get the HUD changed so we couldn't hold any escrow. It was finally settled with the building department just in time and we closed. In the end...it was pretty obvious that this title company didn't do their job properly.

I've actually had another seller in the past that was sold a property with a cloud on the title and had difficulty closing and more time was wasted hunting down the prior title agent to clear it up. This is why we pa for title insurance. If it needs to be cleared...the prior agent must clear it for free.

The moral to this story is that I think as a Realtor®...we need to check these things out ourselves way before the transaction is to close. This way if we had more time...we wouldn't have had to scramble at the last minute. It isn't a very difficult task to accomplish. All you need to do is look up the address and the record at your local building department.
