Attention Buyers and those thinking about buying a home in New Hampshire

Did you know that New Hampshire is the Fifth healthiest State in the United States?

New Hampshire Healthiest StateNEW HAMPSHIRE IS THE Fifth HEALTHIEST STATE IN AMERICA

When the United Health Foundation, the American Public Health Association and the Partnership for Prevention compiled its 20th annual list, New Hampshire came in Number 5 in the Nation!

  •    Vermont #1
  •    Utah #2
  •    Massachusetts #3
  •    Hawaii # 4

The World Health Organization defines health as "a state of complete physical, mental and social well-being and not merely the absence of disease or infirmity."

Factors such as personal behaviors, the environment and community, policies of the national and state government as well as the care we receive are important components of what defines a healthy state.

New Hampshire received an excellent report card.

According to the report, New Hampshire has a low percentage of children in poverty ... 8.6 percent of persons under age 18, high immunization coverage with 85.0 percent of children ages 19 to 35 months receiving complete immunizations, a low violent crime rate at 157 offenses per 100,000 population, low geographic disparity within the state at 5.7 percent, a low premature death rate with 5,749 years of potential life lost before age 75 per 100,000 population and a low infant mortality rate at 5.7 deaths per 1,000 live births.

You can read more about New Hampshire's health as a state.

America`s Health RankingsTM is based on the perspective that, in addition to our individual genetic predisposition to disease, health is the result of four essential and controllable components:

  • Our behaviors
  • The environment of the community in which we live and work
  • The public and health policies and practices made by government and community leaders
  • The clinical care we receive

Check out where your state stacks up.

The 20th anniversary rankings features updated state-specific rankings and is accompanied by a supplemental reportwith estimates of the financial impact obesity is expected to have on the nation - as well as each state specifically - in the next 10 years. The 20th Anniversary Edition of America`s Health RankingsTM has lots of data which one can compare and share. New interactive Web site tools make it possible to quickly scan key state statistics, as well as search and sort 20 years of data by state and health measure.

In addition, New Hampshire recently was chosen as the Most Livable State in America! --

Get out and snow shoe, ski, take a walk, take the dog for a walk go to the gym and start your diet, adopt a healthy lifestyle, laugh and enjoy life!

New Hampshire - recovery

The New Hampshire Association of Realtors® released an enews letter today with good news for New Hampshire. According to economists at Moody’s Analytics, what is now being referred to as the Great Recession is technically over!

New Hampshire demographer and consumer markets expert, Peter Francese points out that until employment figures rise, it won’t feel so good. However, New Hampshire is in better shape than many states. The unemployment rate is now 7.2 percent (well below the national average of 10.2 percent). The good news is that it is not expected to rise above 7.8 percent before starting to fall sometime next year. The jobs report bodes well for the recovery of New Hampshire’s residential real estate values.

Median home prices in New Hampshire were still about 7 percent below October of 2008, but the difference is narrowing from monthly numbers that earlier this year ranged between 10 and 20 percent below 2008.

Francese opines that home prices in New Hampshire are stabilizing and will likely begin to increase in 2010.

New Hampshire has been considerably more fortunate with regard to home prices than many other states. Median home prices are expected to bottom out in 2010 at between 20 and 25 percent below their peak in 2005. Table I shows that residential home sales are likely to be about the same as last year, just above 10,000 units, and at a median sale price that will be within 10 percent of 2008. Table I shows residential home sales and median sale prices for first 10 months of 2009.

To New Hampshire consumers who may be considering buying a home or refinancing, this is an excellent guide to understanding APR.  If you want more information on how to select a reputable lender, please feel free to give me a call.  Thank you Bill for an excellent explanation.

Via Bill Ladewig Your FHA Guru - FHA and VA Loans Since 1970:

WHAT IS MORTGAGE APR, Can You Explain It?

APR Demystified and APR Predators Exposed

First, lets demystify Annual Percentage Rate (APR).

Mortgage APR was designed to allow consumers to use one standardized number to compare each lender's rate for the same type of loan while rate shopping.  It is supposed to represent the borrower's cost and it works like this.

If I lend you, $10,000  and, I charge a $500 Bump-ta-Bump Fee, you will actually receive $9,500, however you must still repay me $10,000.  Mortgage APR is my real yield and your real cost on this loan.

We agreed that you will repay the loan at 8% interest on $10,000, HOWEVER you only received $9,500 therefore I will earn more than the 8.0% interest rate I charge on $10,000.  In this case, my yield (APR) is 9.799% on the $9,500 you received.

APR is the lender's yield on dollars actually lent ($10,000 minus $500 = $9,500); in this case, the lender's yield (APR) on $9,500 is 9.799%   (APR is computed as if the above example is a 30 year loan)

The $9,500 also represents the Amount Financed in the Truth In Lending (TIL) disclosure.

For those of you who use spreadsheets the Rate Function will find APR.  Use the Amount Financed for Loan Amount and use the monthly payment on the actual loan amount.

Fees that must be subtracted from a mortgage loan to properly calculate Amount Financed for APR

  • Origination and Discount Points
  • Processing and Lender Fees
  • Pre-Paid Interest (Use 15 days when closing date is unknown)
  • Monthly Mortgage Insurance must be added to the payment of all FHA loans and Conventional loans greater than 80% loan to value.
  • The inclusion of Mi or MIP accounts for the large spread between Rate and APR on loans with mortgage insurance.
  • NOTES:  Fees Not used in APR calculation; third party fees such as appraisal and credit.  APR can only be compared on loans of the same type and amortization period

How Do APR Predators Work?APR Predator

Many sophisticated borrowers shop interest rates by searching for lowest APR which, if property stated, is a valid way to compare similar loans.  Unfortunately, APR is not always stated properly.

How is advertised Mortgage APR is misstated?

    • Prepaid Interest is not included - most common deception and true on all online Rate sites   i.e.: Bankrate.com, Interest.com, Mortgage101.com, ShopRate.com, etc.
    • Prepaid Interest is understated - must be 15 days when closing date is unknown.
    • MI or MIP is not included in the APR on any online rate sites, Bankrate etc.
    • Some lenders do not include MI or MIP on their web sites such as Amerisave.com
    • Lender fees are either understated or not included in the APR calculation.  This is a tricky one because No or Low Lender Fees does not necessarily indicate a predatory lender.  Some lenders charge a higher rate and no points or fees for their so called "Zero Cost" loan.  However, the "Zero Cost" rate will always be higher than a rate with points and/or fees.
    • Notes to the above:
      • there is no such thing as a Zero Cost loan and some states prohibit lenders from advertising Zero Cost Loans.
      • The spread between Rate and APR on loans greater than 90% LTV should be at least 0.700%.  When it is not... you are being scammed

Rate - Points - Fees are all interdependent

The best way I can explain this is show various Rate - Point - Fee combinations where the lender is making the same gross profit on each combination.

In the examples below, we will use a $200,000 loan amount and Lender gross profit of $1,000, on a day when the Lender's cost for a 5.000% rate is par (0 point).

Best Rate:  $1,000 Lender profit in various combinations of points and fees

The point here is that lenders design their loans to provide talking points for their sales staff (loan officers).  They all require a certain profit margin and it is not important the way the loan is structured as long as the closed loan delivers their required profit margin.

This illustration also points out the value of correctly stated APR as a way of comparing mortgage loans.  For the sake of these illustrations, prepaid interest was not used.  If 15 days PP was calculated it would have increased each APR by 0.019%.

     Victorian for Sale (with ghosts)

    ghost

The Stambovskys found a nice Victorian home  in the Village of Nyack, New York in 1991 and they made an offer.  The purchase price was $650,000. The Buyers made a down payment of $32,500.

A couple of months after the contract was signed, Mr. Stambovsky was horrified when he learned that the home was known in the community to be HAUNTED!

Apparently, the phantasmal reputation of the house was commonly known in the Village of Nyack.

Surprisingly, the Sellers had publicized the ‘hauntings" to the local media and Reader's Digest. In 1989, the house was included in a five-home walking tour of Nyack and described in a November 27th newspaper article as "a riverfront Victorian (with ghost)." The Stambovskys were not from the area and did not know about the poltergeists.

The Stambovskys brought a legal action and alleged that the Seller and the Seller's agent should have disclosed the presence of ghosts.   They wanted out of the contract because the presence of ghosts was not disclosed.

The trial court said no way!  However, the case went up on Appeal and the Appellate court ruled that the Stambovskys could get out of the contract because, "As a matter of law, the House is Haunted".

    The Appellate Court stated:

"While I agree with the Supreme Court that the real estate broker, as agent for the seller, is under no duty to disclose to a potential buyer the phantasmal reputation of the premises and that, in his pursuit of a legal remedy for fraudulent misrepresentations against the seller, plaintiff hasn't a ghost of a chance, I am nevertheless moved by the spirit of equity to allow the buyer to seek rescission of the contract of sale and recovery of his down payment."

The court reasoned that because the Seller had promoted the hauntings to several publications, she could not now deny the existence of ghosts.  Therefore, the Appellate court ruled that under the equitable principals of the law, the Stambovskys were entitled to a refund of their down payment.

This was the Amityville house ~  Stambovsky v. Ackley (169 A.D.2d 254, 572 N.Y.S.2d 72).  It was decided in 1991 by the New York Appellate Court.

When I first moved to New Hampshire and began my career in real estate, I was showing an older home in Atkinson, New Hampshire.  It was a charming home --  All of a sudden, we heard a loud noise --the wind was whistling and a door slammed shut.

We all were trying to act like it wasn't any big deal.  Then the lights started to flicker.  I didn't know what to think - and up until that time, I hadn't thought about whether I REALLY believed in ghosts.  My clients were very nervous.

Then to my surprise, the Real estate agent, said "Well, I guess that I should tell you that this house may have a ghost and the seller wanted me to share this with you."  He went on to explain that a young child had died from a serious illness many years before, and the child could be heard crying from time to time.  Some had speculated that the child's soul was "stuck" in the house.

The clients were not familiar with "haunted houses" and they decided they would buy a new contemporary instead!

There is also a "haunted" restaurant in Nashua, New Hampshire.  The Country Tavern was built in 1741.  It is a lovely restored farmhouse and is the home of a friendly ghost known as ELIZABETH.

The "haunted restaurant has been featured on "Hard Copy and "unsolved mysteries".   I haven't met Elizabeth, but some staff members have met her.   They say she is very friendly and likes to play pranks on the staff!

Here is a list of  "haunted homes" and attractions in New Hampshire!

A Haunting Question:     Got Ghosts?  What is the DUTY TO DISCLOSE IN YOUR STATE?

                - Does the seller's agent have a duty to disclose the phantasmal reputation of the premises?

                -  Does the seller have a duty to disclose the presence of ghosts?

                -  Does the buyer's agent have a duty to disclose the presence of ghosts?

What is the duty to disclose stigmatized property in your state?
