“CURTAILMENT” short sale payment not on HUD is still fraudOn a short sale contract in Oakland, CA, I was told about payment out of escrow as “CURTAILMENT” which is defined as: The act or process of reducing a company's operations in order to bring stability to the company. Curtailment usually occurs when the company has been experiencing unsustainable growth that it is unable to manage effectively. Tactics of curtailment include spinning off subsidiaries, laying off staff, and generally focusing the company's operations on the best products that it is able to create effectively. One day, some realtors were talking about their recent sales. One agent commented that all she has at that time were "little" sales. When asked what she meant by "little." She said, "Oh, just under $200,000." As we all know, all those "little" sales add up. But what would you consider as a "little" sale? Just WHAT DOES $200,000 BUY in your neck of the woods? So close! Why, why, why back out when we're about to get short sale approval? In spite of all the effort expended to explain to all parties what a short sale entails and how long it may take, it is not unusual to have buyers back out after waiting for so long for the short sale approval. WHY? What could we have done to keep the buyer's commitment to the process and interest in the property outside of the requisite frequent updates and communications, and occasional glimpse into the market reports and trends?
