Produce the Note Theory in Foreclosure Defense
The last California homeowner I know who was in litigation to defend against foreclosure lost in court because the “produce the note” theory they were told by a “law office” didn’t work. This homeowner was told by the judge the court would not go down the road of the theoretical “produce the note.”
These litigation machinations serve two purposes: (1) people make money from distressed homeowners, and (2) it delays the foreclosure process so the homeowner gets an opportunity to apply for a loan modification.*
