Making Home Affordable Program..Will it work or be a flop?

Its is said if you are familiar with the Short Sale process, throw all that knowledge out. Purge your memory! From what I read about the program, it may take a bit of relearning. Of the several new procedures, the one(s) that stood out were: we longer have to fight the lender on commisions, what ever is agreed upon by the seller is what it shall be, with a cap of 6%, the listing period will be set by the lender loss mitigation negotiator, and lastly the lender establishes the listing price.

Are the new Oklahoma Residential contracts contradicting the Real Estate code

According to

SUBCHAPTER 13. TRUST ACCOUNT PROCEDURES

605:10-13-1. Duty to account; broker

Under paragraph (c) Interest bearing account.

"(A broker shall not be prohibited from placing escrow monies in an interest bearing account; however, he or she must disclose in writing to all parties that the account bears interest and identify the party receiving the interest. The Commission does not prohibit the broker from receiving the earned interest. In the event the interest is credited to the broker, the broker should, upon final consummation of the transaction, immediately disburse the interest from the account or insure that the amount does not exceed a reasonable amount to cover normal financial institution charges. The broker is required to maintain complete and accurate records of the interest earned. The interest bearing account must be a demand type account; this prohibits the use of certificate of deposit or other types of time deposits as trust/escrow accounts.)"

So how can the new residential contract demand that the interest be paid to "Oklahoma Housing Foundation? The statement only appears in the Residential contract.

Lawton Area Construction Permits Remain Steady!

The construction permits topped out at over $8.2 million last month, due to steady new home construction along with commercial and nonprofit ventures. There were a total of 18 new home permits issued valued at nearly $3.1 million. This figure is down from the August total, but up from the same period last year.

The average number of closing also increased from an average 106.8 to 157 per month for the past six months (March - August), couple with an average price increase of approximately 13%. The new construction sales numbers increase from 149 (March - August 2008) to 181 for the same period this year (March - August 2009).

Many of these improvements are thought to be occuring for several reasons; improved consumer confidence in the Lawton area, very attractive interest rates, the arrival of new families (BRAC). Although the influx of the military families has not had any large immediate effect; many hold off from buying right away due to frequent deployments, having homes in other parts of the country that are not experiencing the same results as Lawton and the rest of Oklahoma has. But in the next two to three years there is expected another construction boost.

After the REOTRANS Name change...hopefully!!

Hopefully after the name change "Equator" will do something about the BPO form on their site. On several occasion I have filled in the entire form, hit save submit and it take me back to the login page....all data lost!! It does not have the capability to save input data as you go along, if you hit save it takes you out of the form. Normal input for me takes about 30 minutes if I do not have anyone distrub me. Has this happened to anyone else?

I name thee Equator!

I received this email only minutes ago. I guess this was or is to be announced this coming Monday, notice the date line of the message. They discuss how and why the change of name is to be made.

LOS ANGELES, CA - October 5, 2009 - REOTrans announced today it will be changing its name to Equator. The reason for the name change is to facilitate the expansion of its technology solution. Since its inception in 2003, REOTrans has grown beyond REO automation to become the epicenter of the Default Servicing Industry. The name change is scheduled to take place at the end of Q4, 2009.

"The founding principles that have earned our client's trust will remain, the only thing changing is the name," said Chris Saitta, CEO of REOTrans. He went on to say, "Growth requires change, to enable our growth we're changing our name to Equator." The company chose the name to represent its scope and purpose. The Equator is comprehensive yet precise and a point of change. It's also rich in metaphor to help communicate and perpetuate the company's identity.

REOTrans currently provides a comprehensive technology platform that automates and connects the Default Servicing industry. The platform includes a configurable workstation, vibrant marketplace, transactional web site and a borrower self-service portal. It automates everyone's daily process while connecting them and their disparate systems in a safe and transparent ecommerce environment.

Currently 51 Mortgage Servicers, 15,000 Default Vendors and 625,000 Real Estate Agents use the platform to manage over 150,000 transactions daily. There has been over $65 billion in foreclosed real estate sold through the platform

# # # # #

REOTrans
6060 Center Drive, Suite 500.
Los Angeles, California 90045

The Good Things About Oklahoma...Lawton and Surrounding Communities!

Relocating to Lawton/Ft Sill or leaving the community, let my relocation expertise be your guide. No matter where you are going or coming from I can get you there! Real estate in Lawton has been strong for many years and with the recent Base Realignment and Closure announcements (BRAC), all indications are that strength will continue. Home sales, including single-family houses, condos/ townhouses have appreciated dramatically.

This last year has brought about a big change in the Lawton/Ft Sill real estate market. After a long period of dramatic inventory increases, the local market seems to be leveling off on supply. This could of course be a temporary lull, but it could also signal the first step in a stabilization of the marketplace.

If you are looking to buy a home, this is still a great time to find that perfect home! With close to over 1000 homes to choose from, which include new construction pre-existing single family, single family with acreage, condo/townhouses and many anxious sellers waiting for an offer you could not have timed it better. Many of the home builders are now are offering large incentives on spec homes, assisting with the closing costs, free options, privacy fencing, yard sprinkler systems, and security systems among other incentives. Please remember if you wish to view or need information on any of the Lawton homes for sale, you can count on me.

Give me a call (580) 248-4400, or contact me paul@pauldurry-realestate.com to discuss your real estate needs.
The communities of Cache, Geronimo, Elgin, which surround Lawton/Ft Sill, offer unparalleled real estate opportunities. Fueled by many industries, a strong military presence, affordable home prices, a significant increase in jobs, and by good planning, all kinds of housing can be found in these areas. There are urban condos/townhouses, condos/townhouses on golf courses, and properties for both families and retirees.

Being close to Lawton/Ft Sill gives each of these communities easy access to the advantages of a major urban city while living away from it all.

Lawton OK Goodyear Plant Celebrates

With the Lawton Goodyear plant celebreting it's 30th year anniversary on Thurday, it showed the Goodyear's will continue to roll despite the downturn. The plant here had on hand special guest NASCAR driver Kurt Busch, where he helped in building a tire, and signed autographs for the fans in attendance. He stated "This was a blast", and his tour of the facilities.

The plant was also celebrating the production of it's 500 millionth tire, an occurance that is expected later on this month. When the demand for original equipment tire from the major automakers slowed, the plant switched gears, and moved production to mainly the after sector. With that strategy to company did not have to left go any of it's workers. in fact according to the plant manager they have hired about 200 new workers to help bring production up to full capacity. Goodyear does not reveal what production capacity is but the trade pubilcation Rubber & Plastics news said it is around 66,000 tires a day.

Oklahoma Military Relocation BRAC Style

Hello all from sunny Oklahoma. If all of you have been following the news of the last couple of years, there was a process called Base Realignment and Closures (BRAC). It has became unfortunate for many communities that have a military facility nearby. Many of these communities must make the adjustment of not having the revenue or the residents of these facilities.

On the fortunate side (for me), I am smack in the middle of the realignment side. Within a 110 to 150 radius are located a total of five military facilities (Vance AFB, Altus AFB, Ft Sill, Shepard AFB, and Tinker AFB. Thus out of these facilities Ft Sill is fairing the best. And guess where I am? Ft Sill traditionally has been know as the Home of Field Artillery, that was the old days, we are now called the U.S. Army Fires Center of Excellence and Ft Sill. You may ask why such an exotic name. Well here is why, as part of the realignment process Ft Bliss is loosing it's school - Air Defense Artillery (ADA) and being moved to Ft Sill. Constuction has already begun!

So here it comes, I am paying a 30% referral fee for all buyers that qualify and buy through me. Have anyone in mind?

Government Takes Control of Fannie, Freddie

Today the federal government has taken control of mortgage giants Fannie Mae and Freddie Mac. The Treasury Secretary said Fannie and Freddie posed a systemic risk to the economic health of the country and "cannot continue in their current form." Both of the top executives at both companies have been dismissed, and thus the recently formed Federal Housing Finance Agency (FHFA) has been appointed conservator of both of the GSEs, and is being held accountable for reorganizing and rehabilitating their business affairs.

Acapulco Property...Co-broker, and Promoting agents needed

At present I have a client that wishes to sell some acreage in Acapulco. My client has been appointed custodian and has special power of attorney. All fees will be paid in accordance with I.R.E.S. fee structure.

Here is an example breakdown of fee to be paid;

Co-Brokers 2= 2.5% each

*Promoting Agent (Procuring Agent)(s) = 2%

Buyer's Agent (Selling Agent)= 3%

*Promoting Agent can be anywhere in the world, if their promotion effects produce a buyer, their efferts are thus compensated.

So it must be official...Or is it?

While reading a blog the other day, the question was going around about who would replace OCWEN. Well one of our fellow agents Tom T Rogers came up with the answer. Countrywide will indeed be the next Property Management Contractor for the VA REO's. Here is the link that he provided; http://www.vba.va.gov/ro/cleveland/REO_sales.htm. Now as you will see there is no direct contact for you to sign up. They just provide an email at: rembrokercommunications@countrywide.com.

USRES and RESNET are they worth it?

I was offered listing today by USRES, but they said I must register with Resnet to get tyhe listing. They charge the agent $250 a year to be registered, then they dictate how the commission will be distributed, (listing agent 2%, selling agent 3%, and they take 1%). Should I take it.

The report, based on local and statewide polling sponsored by the Oklahoma Association of REALTORS® (OAR) contradicts national media coverage on a national residential housing downturn.

The report is part of OAR's "Good Thing You're in Oklahoma" campaign, a research-based effort to inform home buyers and sellers about the facts in Oklahoma's housing market.

Lawton residential real estate bucked the national trend in both home values and sates volume in '07. The average sales price for an existing home in Lawton rose by 5.68 percent last year, from $109,668 in 2006 to $115,902 in 2007. Statewide, the average sale price for an existing home in Oklahoma increased by 4-24 percent in 2007, from $143,669 in 2006 to $149,758 in 2007.

"While the real estate industry in some parts of the country is facing some serious challenges, today's report underscores the fact that home ownership throughout Oklahoma continues to be an affordable, stable and secure investment," said Tammy McCullar, OAR president "Our 'Good Thing You're in Oklahoma' campaign is designed to present the facts about the Oklahoma housing market, which remains an affordable, stable and secure source of value as a long-term investment."

Since 2002, the average sales price of an existing home in Lawton has risen by an average of 8.61 percent per year. The average sales price for an existing home in Lawton in 2007 reflects almost a 51 percent increase from the 2002 average sales price for an existing home of $76,702.

"The housing market in our part of the state is trending in a positive direction and not reflecting what's happening on a national level. That's why we believe it's important that Lawton residents know the facts about our community," said Betsy Parks, 2008 president of the Lawton Board of REALTORS® - one of the 25 OAR local boards in the state. "The most important fact emerging from our research is that home values remains a bargain, compared to almost any housing market in the nation, and a great investment in terms of the increasing value of our residential property".
