It was an interesting night, the first vote on the bill ended up 2 votes short, so the final vote was delayed and then recalled 30 minutes later and at the that time they gathered 62 votes for it to pass. The legislation has passed the House and will be in the Senate today for a vote. If this legislation is not acted on tonight, it will take 3/5 majority instead of simple majority starting June 1, 2007. We need your help NOW to make these calls and asking for a no vote. See the talking points below We were presented the actual legislation for the first time at 11:15am on Tuesday, May 29. Larry Gold, Legal Counsel; Jeff Glass, Lobbyist and Marve Stockert, on behalf of the industry met with Speaker Madigan?s staff yesterday after we saw the legislation. We gave them alternatives to make the legislation work and we were told that if we did not endorse the bill or at least stay neutral that they were going to remove a $900. roll back of the licensing fees, which was not going to be guaranteed past July of 2008, he in fact did remove the roll back in the version going through the House. We said no and laid out our alternatives and at 7:30pm last night we were told that the Speaker was not interested in any alternatives and that he was going to proceed.
1) There is a fiduciary responsibility on all loans in the state of Illinois, thus private right of action by the consumer, charges by Attorney General or IDFPR can be levied against your personal assets. 2) Stated income loans as we know them to day are gone in the state of Illinois 3) Counseling, as it was in the new 4050 rules that we made comments on, will result in the real estate system imploding because of all of the counseling that is going to be required and the lack of quality counselors. 4) There are many other items, but these are the main three items 5) The full version of SB1674 is on the front page of http://www.iamb.org/ . Statistical Data Jeff Metcalf, the owner of Record Information Services for over 15 years, compiled Cook County foreclosure numbers that originated with mortgage brokers and those that originated with banks, finance companies, credit unions, s&l's and owners financing. According to Record Information Services (RIS) mortgage brokers originate 55% of the loans in Cook County. Also according to RIS, the number of foreclosures in Cook County originated by mortgage brokers versus everyone else is listed below Year Mortgage broker Everyone else '04 56.57% 43.44% '05 57.02% 42.98% '06 55.66% 44.34% '07 50.22% 49.78% The number of loans that are in Cook County that are in foreclosure that are sub prime loans and traditional loans; Year Sub Prime Traditional '04 21% 79% '05 22% 78% '06 16% 84% '07 15% 85% If mortgage brokers were the main cause of the foreclosures than the percentage of foreclosures originated by mortgage brokers would be well over 80% and that is clearly not the case. Brokers originate 55% of the loans in Cook County and, on average, 55% of the loans in foreclosure are originated my mortgage brokers. This means the other 45% are originated by banks, savings and loans and credit unions.
