&lt;p&gt;&lt;strong&gt;GSE Loan Limits Extended&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;On October 29, 2009, the House and Senate passed legislation to extend government sponsored enterprises (GSEs) loan limits until December 31, 2010. Fannie Mae, Freddie Mac, and the Federal Housing Administration (FHA) can back loans as large as $729,750. President Obama is expected to sign the legislation soon. NAMB has advocated the extension of these loan limits in House and Senate testimony and letters to Congress.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;NAMB Supports Extension of First-Time Homebuyer Tax Credit&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;On November 2, 2009, NAMB sent a letter to the House of Representatives and the Senate requesting that they support the extension of the $8,000 First-Time Homebuyer Tax Credit. H.R. 3640, introduced by Representative Travis Childers (D-MS), would expand the tax credit to be made available for all prospective homebuyers, and allow for a one year extension of the program, changing the sunset date to December 1, 2010. NAMB supports any legislation in the Senate that would seek to extend the program. &lt;p&gt;&lt;strong&gt;NAMB CEO Quoted in HVCC Article&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;On October 31, 2009, NAMB CEO was quoted in an article by syndicated columnist Ken Harney entitled, "Home appraisal system could be dustbin-bound." The article highlighted the amendment attached to H.R. 3126 that calls for the Home Valuation Code of Conduct (HVCC) to be terminated early in the existence of a proposed new Consumer Financial Protection Agency. The amendment would require the agency's director to replace the code with an improved set of rules developed through the regular administrative procedures, with public comment periods, used by all federal agencies.&lt;/p&gt;
&lt;p&gt;DeLoach was quoted as saying that the current effect of the HVCC "is that we now have a dysfunctional system that's holding back the housing recovery. Incompetent, low appraisals not only hurt individual sales, but depress property values in entire neighborhoods unfairly."&lt;/p&gt;
&lt;p&gt;DeLoach also stated that NAMB will continue to fight the HVCC even if H.R. 3126 is not signed into law. "...a major committee of Congress has now sent a clear message" to Fannie and Freddie: "Your appraisal code is not acceptable."&lt;/p&gt;

&lt;p&gt;Dear NAMB Member,&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Today the House Financial Services Committee approved H.R. 3126, the "Consumer Financial Protection Agency Act of 2009" 39-29.&amp;nbsp; NAMB commends and appreciates your participation in the Calls-to-Action by contacting your Representatives and urging them to vote for specific amendments to the bill.&amp;nbsp; Two important amendments offered impacted the HVCC and RESPA.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;NAMB is pleased to report that an amendment under the leadership of Rep. Gary Miller (R-CA) and Travis Childers (D-MS) and offered by Miller, Childers, Donald Manzullo (R-IL), and Michele Bachmann (R-MN) to sunset the Home Valuation Code of Conduct (HVCC) and allow all loan originators, licensed or registered in accordance with the SAFE Mortgage Licensing Act, to order appraisals directly, was voted on and approved by the Committee to be included in H.R. 3126. Rep. Kanjorski (D-PA) played an influential role in crafting the amendment as language included in the amendment is consistent with Kanjorski's previously introduced appraisal independence language permitting brokers to order appraisals.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;An amendment offered by Reps. Rueben Hinojosa (D-TX) and Judy Biggert (R-IL) to postpone the Department of Housing and Urban Development's (HUD) RESPA Final Rule from the January 1, 2010 implementation date, among other details, was not agreed to as there were some technical questions on the delay time of the rule.&amp;nbsp; Chairman Barney Frank (D-MA) agreed to work with the bill sponsors as the bill moves to the House floor in the next few weeks.&amp;nbsp; The revised amendment will permit either GFE form to be used - the present GFE or HUD's new GFE - until July 1, 2010.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;What's Next?&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;The Consumer Financial Protection Agency Act of 2009 is expected to be merged with a number of other regulatory reform bills before moving to the House floor for a vote including some previously House approved bills such as H.R 1728, the "Mortgage Reform and Anti-Predatory Lending Act of 2009."&amp;nbsp; Companion legislation has not been introduced in the Senate although we expect to see such introduction in short time. Upon House and Senate approval of their respective regulatory reform bills, the bills may then be referred to a conference committee to resolve any differences in both bills.&amp;nbsp; Once a compromise bill is agreed upon by a conference committee, it will be sent to the President to be signed into law.&amp;nbsp; In the alternative, the Senate could approve a regulatory reform bill and then send it over to the House to approve.&amp;nbsp; After which the final product will be sent to the President for his signature.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;NAMB will continue to closely monitor this important legislation and update members going forward.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;Dear Representative Minnick,&lt;/p&gt;
&lt;p&gt;I am writing to you today on behalf of the National Association of Mortgage Brokers (NAMB) to urge you to vote for an amendment to H.R. 3126, the "Consumer Financial Protection Agency Act of 2009," submitted by Representatives Childers and Miller (CA). The amendment seeks to reverse the harmful Home Valuation Code of Conduct (HVCC) and calls on regulators to work together on one set of appraisal standards.&lt;/p&gt;

      <title>So tired of getting blamed for the mortgage meltdown!  Wall Street needs to be looked at!</title>
      <description>&lt;p&gt;It is time someone spoke up and shed the light on the right folks that are really to blame for the mortgage meltdown.&amp;nbsp; I have attached some old rate sheets from Chase.&amp;nbsp; We brokers&amp;nbsp;sold products given to us by our lenders,&amp;nbsp;in this case, Chase.&amp;nbsp; All the lenders had similar programs.&amp;nbsp; Keep in mind brokers do not underwrite loans and brokers do not fund loans, the Lenders do!&amp;nbsp; These loans were created by Wall Street, packaged into securities by Wall Street and sold to investors all over the world by Wall Street.&amp;nbsp; It was not the lenders or brokers that brought these loans into the country.&amp;nbsp;it was the Federally Regulated Chartered entities!&amp;nbsp; State lenders and brokers had to follow their own state predatory lending laws.&amp;nbsp; Lenders like Chase, Wells Fargo, Bank&amp;nbsp;of America preempted these laws, received a bailout and the irony of it all is they are now blaming the lenders and brokers&amp;nbsp;for the whole mess!&amp;nbsp; Wall Street NOT Main&amp;nbsp;Street is where Congress should focus&amp;nbsp;their efforts to assure this does not happen again!&amp;nbsp; I am a small broker in Alabama and I see the clarity of the situation and do not see why our Congress does not!&amp;nbsp;&lt;a href="/xSites/Mortgage/pfaganmortgage/Content/UploadedFiles/ChaseFlyer.pdf"&gt;ChaseFlyer.pdf&lt;/a&gt;&lt;/p&gt;</description>

&lt;p&gt;Dear Chairman Frank and Ranking Member Bachus:&lt;/p&gt;
&lt;p&gt;As the Financial Services Committee considers H.R. 3126, the Consumer Financial Protection Agency Act, the undersigned organizations representing the real estate finance industry urge the committee to adopt an amendment, expected to be offered by Representative Judy Biggert, that would require the Department of Housing and Urban Development (HUD) to provide for a more gradual implementation period for its Real Estate Settlement Procedures Act (RESPA) rule.&lt;/p&gt;
&lt;p&gt;The RESPA rule is scheduled to take full effect on January 1, 2010 - less than three months from now. Despite the best motivations of HUD, and the sincerest efforts of the industry, there are simply too many unresolved issues to allow the industry to be fully RESPA-compliant by the first of the year. HUD's guidance has come far too late in the process and has been inadequate and often contradictory. Due to unresolved issues and critical unanswered questions, many lenders and settlement service providers are unprepared to comply. This, in turn, will cause very inconsistent implementation and confusion for consumers seeking to purchase a home.&lt;/p&gt;
&lt;p&gt;The Biggert amendment would require HUD to postpone the implementation date of its RESPA reform rule for a reasonable amount of time and take several steps to achieve effective implementation. It would also allow both new and old forms to be used during the transition period. And it would require that, going forward, HUD and the Federal Reserve coordinate their regulatory efforts to ensure comparable RESPA and Truth in Lending Act (TILA) disclosures.&lt;/p&gt;
&lt;p&gt;RESPA reform is important to consumers and the industry. Passage of the Biggert amendment would give all participants the additional time they need to get it right and assure full compliance.&lt;/p&gt;

      <description>&lt;p&gt;&lt;img src="http://www.namb.org/images/namb/Namblogo_Resized.jpg" alt=""&gt;&lt;br&gt;&lt;br&gt;TO: All NAMB Members&lt;br&gt;FROM: NAMB Government Affairs&lt;br&gt;&lt;br&gt;Dear NAMB Members:&lt;br&gt;&lt;br&gt;On September 18, 2009 the Department of Housing and Urban Development (HUD) released Mortgagee Letters 09-28, 09-29, 09-30. These mortgagee letters contain provisions similar to those seen in the Home Valuation Code of Conduct (HVCC). Mortgagee Letter 09-28 prohibits "FHA-approved lenders... from accepting appraisals prepared by FHA Roster appraisers who are selected, retained or compensated in any manner by a mortgage broker or any member of a lender's staff who is compensated on a commission basis tied to the successful completion of a loan." Mortgagee Letter 09-29 states, "In cases where a borrower has switched lenders, the first lender must, at the borrower's request, transfer the case to a second lender." Mortgagee Letter 09-30 changes the appraisal validation periods from 6 months for existing properties and 12 months for proposed or under-construction properties, to 120 days for both.&amp;nbsp; All three of these Mortgagee Letters go into effect for case numbers on or after January 1, 2010. &lt;br&gt;&lt;br&gt;These letters are of great concern to NAMB, as we believe mortgage brokers should be able to order their own appraisals. This is such a great thing for first time home buyers.&amp;nbsp; Buyers have to CLOSE by Nov 30th, not be under contract, but CLOSE.&amp;nbsp; With that date&amp;nbsp;coming up, roughly 12 weeks from now, you might want to knock this out early on and not be a part of the last minute insanity.&amp;nbsp; I am sure there will be disappointed home buyers that don't get closed for one reason or another and this is gonna stink!!!! So, my advice, since we do not have an extension on the Tax Credit right now, is lookie loo, you need to be signing on the dotted line right now!!!!&lt;/p&gt;</description>

      <description>&lt;p&gt;To get the $8000 Tax Credit you must purchase a home BEFORE Dec 1st.&amp;nbsp; If you have clients looking, with turn times and underwriting guideline changes, I would STRONGLY suggest they go ahead and enter into a contract ASAP!&amp;nbsp; If they want to go Rural, I certainly hope you already have in a contract!!!! Their turn times are months now!! That is right, not a month but MONTHS!&amp;nbsp; Some companies are revising their HVCC policies in place, which is helping on turn times in that area.&amp;nbsp;&amp;nbsp;I hope you all have a great weekend!&amp;nbsp; I am seeing two of my six grands, so life is definately GOOD!&lt;/p&gt;</description>

      <description>&lt;p&gt;Since I have not posted a blog in a week I thought we could just catch up.&amp;nbsp; Mortgage land is ever changing.&amp;nbsp; Rural Housing's underwriting system GUS has been DOWN for three days.&amp;nbsp; To compound that issue, the local RD office is on a 15 to 20 day turntime, IF THEY EVER GET GUS back up and running.&amp;nbsp; I have said prayers for the RD folks, cause they really need them.&amp;nbsp; This is greatly affecting my underwriting turn times.&amp;nbsp; How about I have a friend who's last RD loan took three and a half&amp;nbsp; months to close!&amp;nbsp;&amp;nbsp;Moving on, HVCC has tripped me up on one of my loans, to the point of just being down right stupid.&amp;nbsp; FHA is the product of choice for so many reasone, HVCC being one of the MAIN ONES!&amp;nbsp; I do have loans closing and rates are great.&amp;nbsp; VA is clicking right along too!&amp;nbsp; No issues there!&amp;nbsp; I am gearing up for another 203ks loan to close, I love doing these gems!&amp;nbsp;&lt;/p&gt;</description>
