Does HST apply on real estate commissions in Ontario? In general, the 13% harmonized sales tax ("HST") applies on real estate commissions charged by real estate brokerages located in Ontario effective July 1, 2010. Prior to July 1, 2010, the 5% goods and services tax ("GST") applied to the real estate commissions. For transactions that straddle July 1, 2010, special transition rules apply such that part of the real estate commission may be subject to GST and/or HST. In some situations, it may be possible to claim (i.e. recover) the HST on the real estate commission back from Canada Revenue Agency.
