I came across an article by First Tuesday about the banks regulating themselves in the current environment we are in. I can vouch that this is NOT an acceptable solution, as we HUD Housing Counselors continually run in to situations where the Big Banks do not abide by the rules, guidelines and laws they've agreed to follow. States and their Attorney Generals are working toward resolving the many gaps in our systems to make protection available to our consumers, but we aren't quite there yet. A Rulemaking Hearing is scheduled on March 20, 2008 at 9:00am by the Department of Consumer and Business Services, Division of Finance and Corporate Securities. This hearing is to go over proposed changes pertaining to Mortgage Lending Rules for licensees in the State of Oregon, more specifically Deceptive Practices, which include advertising and "transactions with borrowers". It mentions in the Notice that during 2007, the Department of Consumer and Business Services received 75 complaints about deceptive advertising, which are 75 too many, but in the big picture is a pretty small number.
