    <title>The U.S. Senate Passes FHA Modernization Bill S. 2338</title>

&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&lt;img title="Washington DC" src="http://activerain.com/image_store/uploads/3/7/7/8/8/ar11979265188773.jpg" height="105" alt=" " width="140" /&gt;&lt;/p&gt;&lt;p&gt;I just got word from the National Association of REALTORS Action Center that the Senate has passed the FHA Modernization Bill. They have been working on this for some time now and the next step is to go to a conference committee where they can reconciled&amp;nbsp;the two versions passed, one&amp;nbsp;by the US House of Representatives and the new bill passed by the Senate.&lt;/p&gt;&lt;p&gt;I am hoping we get them to increase the loan limits to the conforming limit now of $417,000.&amp;nbsp; They are also looking into modifying the downpayment amounts to make it easier for borrowers to qualify for these loans.&amp;nbsp; The other terms they are working on is a 40 year amortization, possibly allow more condo loans, varianging the mortgage insurance premium, and other helpful programs.&lt;/p&gt;&lt;p&gt;It is not over by no means.&amp;nbsp; Who knows how it will all look at the end after they work through all of the issues, wants, and dislikes.&amp;nbsp; FHA has been needing to be Modernized for some time now.&amp;nbsp; We are on the right track at least.&lt;/p&gt;&lt;p&gt;Read what the bill actually reads:&lt;/p&gt;&lt;p&gt;&lt;a href="http://thomas.loc.gov/cgi-bin/query/z?c110:S.2338:" target="_blank"&gt;http://thomas.loc.gov/cgi-bin/query/z?c110:S.2338:&lt;/a&gt;&lt;/p&gt;&lt;p&gt;Here is a link to see how the vote when:&lt;/p&gt;&lt;p&gt;&lt;a href="http://www.govtrack.us/congress/vote.xpd?vote=s2007-432" title="GovTrack" target="_blank"&gt;http://www.govtrack.us/congress/vote.xpd?vote=s2007-432&lt;/a&gt;&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;    </content>

&lt;p&gt;&lt;strong&gt;Have you been wondering, when are we going to hit the bottom of this real estate cycle?&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;img src="http://activerain.com/image_store/uploads/9/5/6/3/1/ar119627417513659.jpg" height="169" alt=" " width="206" /&gt;&lt;/p&gt;&lt;p&gt;I know I have been.&amp;nbsp; Although I do not believe in fortune telling, I wish there was a crystal ball to tell us when things will change.&amp;nbsp; I have always been told that you can not tell the future of the real estate market.&amp;nbsp; However, we do know that&amp;nbsp;a full&amp;nbsp;real estate cycle is usually&amp;nbsp;around 6-7 year.&amp;nbsp; It is like a roller-coaster ride, it has it&amp;#39;s ups and downs.&amp;nbsp;&amp;nbsp;Most of us&amp;nbsp;are on the way down, but are we at the bottom, yet?&lt;/p&gt;&lt;p&gt;Each community is different and it has it&amp;#39;s own local real estate market.&amp;nbsp; One statement about the real estate market in general&amp;nbsp;will not fit all markets.&amp;nbsp; In fact what we hear about the National Real Estate Marketdoes not necessarily reflect&amp;nbsp;our local market.&amp;nbsp; &amp;quot;One size does not fit all!&amp;quot;&amp;nbsp; There are some real estate markets right now that are just thriving and the rest hurting.&lt;/p&gt;&lt;p&gt;In Northern California, more specifically, the&amp;nbsp;Sacramento region, the market has been on a down turn for almost 2 years now.&amp;nbsp; Most down turns do not last more then 2 to 3 years.&amp;nbsp; The market here locally&amp;nbsp;has plenty of homes for sale, so it is a Buyer&amp;#39;s Market.&amp;nbsp; People have been waiting for the bottom to hit before they buy.&amp;nbsp; People are trying to time the market just right to leap in.&amp;nbsp;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;IS IT TIME TO JUMP IN?&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;img src="http://activerain.com/image_store/uploads/9/4/3/5/8/ar119631748885349.jpg" height="259" alt=" " width="200" /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;strong&gt;&amp;nbsp; So my question to you is, &amp;quot;ARE WE THERE YET?&amp;quot;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;    </content>

&lt;p&gt;&lt;img src="http://activerain.com/image_store/uploads/7/7/4/9/4/ar119572122049477.JPG" height="183" alt=" " width="284" /&gt;&lt;/p&gt;&lt;p&gt;I wanted to share a press release that just came out today November 20, 2007.&#160; This is big news in California because there has been a steady stream of Foreclosures that have been flooding the real estate market for the last couple of years.&#160; The outlook has also been negative with more foreclosures to&#160;come the next few years.&lt;/p&gt;&lt;p&gt;The continued forclosures brings the sales price lower as the REO are sold at rock bottom prices.&#160; Buyers have just been waiting and the lack of sales&#160;drives prices down.&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;em&gt;California's Foreclosure Rate Twice the National Average&lt;/em&gt;&lt;/strong&gt; &lt;/p&gt;&lt;p&gt;The Governor of California with the cooperation of some of the bigger lenders&#160;Countrywide, GMAC, Litton and HomEq has agreed to&#160;streamline "fast-track" procedures to help keep more subprime borrowers from losing their homes.&#160; These four companies service more than 25% of the loans that are subprime.&lt;/p&gt;&lt;p&gt;Governor Schwarzenegger said:&lt;/p&gt;&lt;p&gt;"With this type of cooperation from loan services, we can save tens of thousands of people from being added to the foreclosure lists. This common-sense approach does not involve a government subsidy or bailout."&#160; "Borrowers need to do their part too.&#160; If these lenders are willing to meet more than halfway, it's important that consumers don't run when they reach out. It was a two-way street that got us into this mess and it will be a two-way street that gets us out."&lt;/p&gt;&lt;p&gt;&#160; &lt;/p&gt;

&lt;p&gt;DO YOU HAVE A HOME INSPECTOR LOOKING INTO YOUR NEW HOME?&lt;/p&gt;&lt;p&gt;&lt;img src="http://activerain.com/image_store/uploads/7/9/2/4/1/ar119546562614297.JPG" height="330" alt=" " width="233" /&gt;&lt;/p&gt;&lt;p&gt;One of the major terms in most California purchase agreements is a home inspection by the buyer.&amp;nbsp; This inspection is recommended to make sure the buyer is fully aware of the condition&amp;nbsp;of the property they are buying.&lt;/p&gt;&lt;p&gt;Caveat Emptor = &amp;quot;let the buyer beware.&amp;quot; (Latin)&lt;/p&gt;&lt;p&gt;The buyer should&amp;nbsp;examine the goods and/or property and buy&amp;nbsp;it at&amp;nbsp;his own risk, except for latent defects.&amp;nbsp; In California we practice &amp;quot;Full Disclosure&amp;quot;.&amp;nbsp; The seller and the agents need to disclose any material defects or material facts&amp;nbsp;know or discovered during a transaction.&amp;nbsp; Seller&amp;#39;s who hide know defects from a buyer can be subject to legal suites.&amp;nbsp; &lt;br /&gt;&lt;br /&gt;The home looks perfect! You are all set to buy it and fulfill your dream. Don&amp;#39;t let this dream turn into a nightmare because you did not get a home inspection.&amp;nbsp; Agents should recommend you get a home inspection on your home purchase.&amp;nbsp; In the California Association of REALTORS purchase agreement, it usually has the provision to have a whole house inspection performed by a professional.&lt;br /&gt;&lt;br /&gt;According to a study conducted by the American Society of Home Inspectors and the National Association of REALTORS&amp;reg; in 2001, 77% of all home buyers insisted on a home inspection prior to purchasing their property, and 97% of that group believes the service was a good value for the price.&lt;br /&gt;&lt;br /&gt;A home inspection is the second major contingency after the financial contingency, before you decide to purchase your home. This is where you have the right to back out of the deal, if the report indicates serious problems.&lt;/p&gt;&lt;p&gt;It is recommended that you checkout the reputation of the Home Inspector and to see if they have E&amp;amp;O Insurance.&amp;nbsp; You also need to check on warranty of their inspection and if it is transferable or not.&amp;nbsp; If you are a buyer and get an existing home inspection report from another buyer who did not go through with the deal, you need to check if the warranty and inspection is transferable or not.&amp;nbsp; In most cases, it is not transferable.&lt;/p&gt;&lt;p&gt;Protect yourself!&amp;nbsp; &lt;/p&gt;&lt;p&gt;Ask your agent for guidance and help!&lt;/p&gt;    </content>

&lt;p&gt;SOME STATE DO NOT ALLOW DUAL AGENCY, BUT WHAT IS THE PRACTICE?&lt;/p&gt;&lt;p&gt;&lt;img src="http://activerain.com/image_store/uploads/6/1/7/7/1/ar119536843717716.JPG" height="233" alt=" " width="351" /&gt;&lt;/p&gt;&lt;p&gt;We have been having a discussion on my blog on&amp;nbsp;&amp;nbsp;&lt;a href="http://activerain.com/blogsview/263444/Right-or-Wrong-Dual" rel="bookmark"&gt;Right or Wrong? Dual Agency&lt;/a&gt;&amp;nbsp;&amp;nbsp;and it has been discussed that it is illegal to practice &amp;quot;Dual Agency&amp;quot; in some states.&amp;nbsp; I would like to open up this blog to the discussion on how the practice of real estate is performed in the states that do not allow &amp;quot;Dual&amp;nbsp;Agency&amp;quot;.&amp;nbsp; I am from California and we have &amp;quot;Agency&amp;quot; and can practice &amp;quot;Agency&amp;quot; with either buyer or seller or represent both parties in a transaction under &amp;quot;Dual Agency&amp;quot;.&amp;nbsp; The &amp;quot;Agency Relationship&amp;quot; needs to be disclosed in writing as to the duties and responsibilities an agent has to their clients.&amp;nbsp; We also need to confirm the relationship when a transaction is entered into in California.&lt;/p&gt;&lt;p&gt;But, I would like to know what is the practice in states that do not allow &amp;quot;Dual Agency&amp;quot;.&lt;/p&gt;&lt;p&gt;What disclosures need to be provided?&lt;/p&gt;&lt;p&gt;How do you handle fiduciary responsibility with a client and what is your responsibility to a customer?&lt;/p&gt;&lt;p&gt;How do refer a customer to another agent from another firm to represent them?&amp;nbsp; And, are you able to collect a referral fee?&lt;/p&gt;&lt;p&gt;What are the pros and cons to this practice?&lt;/p&gt;&lt;p&gt;I know that each state has different laws and rules so I would like to have some of these topics discussed here in this blog.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;See other blogs associated with these topics provided by myself and other members in Active Rain:&lt;/p&gt;&lt;p&gt;&lt;a href="http://activerain.com/blogsview/263444/Right-or-Wrong-Dual" rel="bookmark"&gt;Right or Wrong? &lt;p&gt;&lt;img src="http://activerain.com/image_store/uploads/2/3/7/4/5/ar11947631254732.JPG" height="258" alt=" " width="182" /&gt;&lt;/p&gt;&lt;p&gt;I was just passing a bank&amp;nbsp;recently when I saw on the window an advertisement which said, &amp;quot;DECLINED - Do you need a second chance?&amp;quot;&amp;nbsp; Wow, I thought to myself, that is good.&amp;nbsp; I sat&amp;nbsp;there in&amp;nbsp;traffic for a couple of minutes waiting for the light to change to green.&amp;nbsp; I sat there thinking, everyone needs a second chance.&amp;nbsp; I know I always do.&amp;nbsp; I know my clients who have been coming to me&amp;nbsp;lately about&amp;nbsp;their real estate problems with foreclosures, shot sales, not being able to refinance or sell, they need a second chance.&amp;nbsp; I just meet with a young man who had been in trouble most of his youth and is now trying to get his life together, he needs a second chance.&lt;br /&gt;&amp;nbsp;&lt;br /&gt;If you are reading this online right now, you live in a world that is moving so quickly with information flying all over the world in milliseconds.&amp;nbsp; Our world has never seen this kind of progress and innovation in such a short period of time.&amp;nbsp; Our culture in America and Canada is also in high gear with work, school, and play.&amp;nbsp; We almost don&amp;#39;t have the time to smell the roses.&amp;nbsp; We do not think or meditate on the here and now.&amp;nbsp; &lt;/p&gt;&lt;p&gt;It is no wonder that so many people stick their&amp;nbsp;heads in a hole not wanting to see what is going on. &amp;nbsp;We need time to meditate on what is really important in life.&amp;nbsp; Failures are a part of life.&amp;nbsp; When we get denied or if we fail, we need a second chance.&amp;nbsp; I personally believe in a God of second chances.&amp;nbsp; In fact He is a God of 3rd, 4th, 5th chances.&amp;nbsp; &lt;/p&gt;&lt;p&gt;Let&amp;#39;s give grace to our families, to our friends, to our clients, and to our communities!&lt;/p&gt;&lt;p&gt;Let&amp;#39;s be people who will help people get second chances!&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;You can check out another blog that may give you  hope, too, in the game of real estate!&lt;/p&gt;&lt;p&gt;&lt;a href="http://activerain.com/blogsview/269178/Don-t-Worry-Be" rel="bookmark"&gt;Don&amp;#39;t Worry Be Happy - The Next Game Will Be Starting Soon!&lt;/a&gt; &lt;/p&gt;    </content>
