divorce: Looks like I’m being called in to court (But, why? Isn't that your problem?) - 05/27/10 04:47 PM
As many of you remember a few months ago I helped a couple sell a home that was in the middle of a nasty divorce and wrote an article called “The Ex Factor… What do you tell a buyer’s agent when they ask about a divorce?” but, today it looks like taking and selling that listing will land me in court. Now, I have to say it isn’t what you think, they aren’t going after me, they are still going after each other. But, both lawyers want to use me against the other party. They say based on what

divorce: Make sure you update the IRS and state on amount you receive at close or you could be audited and fined! - 05/15/10 11:41 PM
Last year I sold a listing in Sexton Mountain neighborhood that was being sold because of a divorce. Now, the fact that it was a divorce is partially what lead to the problem that I got the call on today. You see this couple had equity in their home, they had owned their home 23 years and had never refinanced, so they really weren’t hit by the local slide in real estate sales prices. Well, at close all the proceeds went in to an escrow account for them to fight it out in court who got what and for how

divorce: The Ex Factor… What do you tell a buyer’s agent when they ask about the divorce? - 03/15/10 08:44 AM
By Todd Clark (Broker/Sales Coach) 503-524-9494 Last month I closed on a house, but there was something about the sale of this house I didn’t advertise because I didn’t want it to affect the sale. What was the issue? The sellers were in a nasty divorce and one thing is when buyers see divorce and they see a house for sale, they know that this could be the final step in the divorce and they low-ball offers hoping that the sellers just want to get the sale over with, so they can move on with their lives. (For the most

divorce: Is giving up $300 in commission worth it? You bet! - 10/11/08 10:50 AM
I had a situation early in 2007 where I was doing my first short sale and I was learning on the fly! I have to say, I wish I knew then what I know now! It was a very difficult transaction, but it didn't have to be a short sale, that is what was so interesting about it. You see, the bank made an error in their calculations. They estimated the amount due at closing to be more than actually was required, so this was going to be a short sale by some $2,500. Since this was a divorce situation and

divorce: Divorce and your home…What should you do? - 07/16/08 11:37 PM
Yesterday I got a call from a person who is friends with one of my clients. She had a question about her home and if one of the two people on the title could sign over the title to just one person. I asked what the reason was for taking the person off the title and if they were on the loan. She said it was because she and her husband were getting a divorce and that they wanted to transfer title to the other. I then asked to whom the title was being transferred? I told her that the title

divorce: Don’t let the threat of foreclosure cost you more than your home - 03/24/08 07:02 PM
When most people get in trouble in life the stress affects them in ways they are not prepared to deal with. Most divorces in America are caused by money issues, which I don't think is necessarily true. I think money is part of the problem, the other part is that when people get stressed they shut down, and all communication stops, because their body doesn't know how to deal with the stress. I think the best thing you can do is if you start to get in trouble with anything in life is to communicate. First of all, with your loved

divorce: WE BUY HOUSES or Do They? - 03/16/07 02:58 PM
Do you want to know the truth? They don't really buy house they buy problems. What is a problem? A problem is you are behind on your payments, death, divorce or you have a pending move and don't want two payments and other similar things. These people buy these problems fast because they know they can get homes for 50-70% of the fair market value just by scaring people. They buy these homes from sellers who think if they don't sell now they will lose everything, but if they sell quickly they can save a Realtors commission. Now let's look at the
