If you were an investor or 2nd home owner who defaulted you may want to look closely at whether or not your deficiency after the foreclosure or short sale is going to fall under this microscope. Many states allow mortgage holders several years to come after losses so the clock may still be ticking for you.  In WA State that clock was 6 years from the sale (by foreclosure or short sale) but it recently (2012) was moved down to 3 years, but that's not retroactive for the years prior.

Seriously, folks here in WA, this is BIG news that is positive for upside down homeowners doing short sales or who may be foreclosed on later this year. I know reading bills enacted into law is pretty dull, but the drop from 6 years to 3 years for a lender to come after a homeowner for wiped out debt is fantastic!
Here is the bill that covers the new change from a 6-year period reducing it down to 3-years plus other items that were in the same legislation.

washington state: It's no April Fool's joke - carbon monoxide alarms must be in WA homes during POS - 03/23/12 02:39 AM
I had to let my clients know about a memorandum that came out updating status of carbon monoxide alarms in residences in Washington State.  One client said "thanks for the notice and I'll put it on the list of preparations" and another was questioning having to do something else before his home sale closes on April 2nd. I understand his trepidation, but I told him I was only a messenger in this one and the State is who makes the call.

washington state: The resurgence of lead based paint testing in the State of Washington - 03/05/12 02:25 AM
Powell Homes is a company that we've worked with in the past and they also have a remodel division. In this article they discuss issues around lead based paint (LBP). In older homes, if you'll be disturbing drywall or siding where there might be LBP, and the State of WA requires contractors to be certified to deal with proper handling of it. If you're about to have work done, we recommend LBP testing first to determine if there is any to be disturbed.

washington state: Is there really a drop in foreclosure auctions in Washington State? Maybe... But distressed properties are still here. - 02/15/12 03:12 AM
I’m not sure I agree 100% with their assessment of WA State in this DS News article which says Washington State is going down in the number of foreclosure auctions. Just because lenders have slowed down their foreclosure auction rate here, doesn’t mean we don’t still have a backlog of distressed homes. We’re seeing plenty of them coming on market after the auction after no investors have purchased on the courthouse steps. We’re also seeing more lenders willing to work out a short sale thus delaying auctions or foregoing them all together if a short sale occurs.
