&lt;p class="MsoNormal" style="margin: 0in 0in 10pt;"&gt;&lt;span&gt;&lt;span style="font-size: small;"&gt;As a homeowner in Dekalb County, Georgia I was shocked at the continued and non-uniformed manner which the property taxes on my residence increased. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal" style="margin: 0in 0in 10pt;"&gt;&lt;span&gt;&lt;span style="font-size: small;"&gt;Even though my neighbors said &amp;ldquo;I went down there myself &amp;ldquo;and &amp;ldquo;you&amp;rsquo;re in real estate&amp;rdquo; I elected to seek out referrals from my fellow RE professionals and hired &lt;span style="text-decoration: underline;"&gt;&lt;strong&gt;Andy Goldstein&lt;/strong&gt;&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p class="MsoNormal" style="margin: 0in 0in 0pt; line-height: normal;"&gt;&lt;span style="font-size: small;"&gt;&lt;span&gt;I am sending you my invoice for the Dekalb County 2012 property value appeal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal" style="margin: 0in 0in 0pt; line-height: normal;"&gt;&lt;span&gt;&lt;span style="font-size: small;"&gt;I calculated the amount of the invoice by reducing the original tax bill of $8176.42 by 13.81% &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: small;"&gt;&lt;span&gt;which is the percentage of the reduction I was able to get at the hearing. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal" style="margin: 0in 0in 0pt; line-height: normal;"&gt;&lt;span&gt;&lt;span style="font-size: small;"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal" style="margin: 0in 0in 0pt; line-height: normal;"&gt;&lt;span&gt;&lt;span style="font-size: small;"&gt;The new tax bill should be $7047.26 which is a savings of $1129.16. My fee is 30% of the first&amp;nbsp;year&amp;rsquo;s tax savings which comes to $338.75. I really enjoyed working with you on this appeal and I am glad that I was able to get a good reduction.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div class="News-Date"&gt;While perhaps not a nationally significant or unusual deal by itself, U.S. Cellular's renewal this past month of an office lease in Madison, WI, succinctly depicts the current state of leasing. &lt;br&gt;&lt;br&gt;U.S. Cellular agreed to extend its lease with affiliates of Wells Real Estate at the U.S. Cellular Building, a four-story, 102,000-rentable-square-foot &lt;a href="http://www.showcase.com/Office-building" target="_blank"&gt;office building&lt;/a&gt;. The Chicago-based carrier leases 73% of the building and owns a 45% equity interest in the property. The amendment extends the lease from April 2013 to December 2017. As part of the deal, the monthly base rent will decrease 11% from $87,668 to $77,830. In addition, U.S. Cellular is entitled to a four-month rental abatement. &lt;br&gt;&lt;br&gt;Several things about this deal make it typical of other firms making lease renewal decisions in the current market. Landlords have a vested interest in holding onto quality paying tenants, or risk loss of income, more scrutiny from current and potential lenders, and face higher marketing costs to re-fill the space. &lt;br&gt;&lt;br&gt;Tenants, too, have a vested interested in staying put. While in this case, the tenant is part owner, in other cases, tenants face a disruption in their business and significant relocation and operational costs if they leave a good location. But the market reality is that there are good deals to be had out there as vacancies remain stubbornly high and money for refinancing commercial properties remains hard to come by. As a result, tenants are clearly making the decision to at least shop around. &lt;br&gt;&lt;br&gt;"In sectors like the office market, we're finding tenants taking the opportunity in a soft market to upgrade office image and pick-up additional amenities by moving from a Class B building to a Class A building, generally with minimal increases in their rent. The term you hear tossed around is 'flight to quality,' " said Ryan Walsh, principal of RadatzWalsh Inc. in Edina, MN. &lt;br&gt;&lt;br&gt;"To compete with the market, landlords are offering up free rent to keep tenants, somewhere around one month per year of the lease, (net or gross) depending on the situation and other terms," Walsh said. "Also, improvement money is being spent to upgrade finishes and make spaces more functional on extensions. Usually $10 to $20/square foot for 3- to 5-year deals and some additional credits or rent reductions if the space can be used as is." &lt;br&gt;&lt;br&gt;"It is all on a case-by-case basis," Walsh said, "but the savvy landlords factor in the costs of having the space sit vacant for a while, tenant improvements for new groups and other transactions costs. They generally come to the conclusion that it is in their best interest to work hard to keep a good tenant that they know pays rent on time." &lt;br&gt;&lt;br&gt;&lt;strong&gt;Editor's Note:&lt;/strong&gt; While tenants enjoy the upper hand currently, &lt;a href="http://bit.ly/yAHmDj" target="_blank"&gt;CoStar's latest market outlook sees big changes ahead for U.S. office markets.&lt;/a&gt; &lt;br&gt;&lt;br&gt;Nelson Taylor, owner/broker of William Raveis Chapman Enstone in Providence, RI, said tenants are also leveraging the market to cut a better deal for themselves. &lt;br&gt;&lt;br&gt;"Many will approach their current landlords for lease/term reductions," Taylor said. "Tenants will approach me to give them comps to support their requests. More often than not, if their requests are reasonable, owners will agree to a reduction. If owners prove inflexible, tenants will move." &lt;br&gt;&lt;br&gt;"Owners are much more flexible with 3- to 5-year leases. At least 10% reductions in the overall lease costs," Taylor said. &lt;br&gt;&lt;br&gt;While U.S. Cellular merely extended its current lease, CoStar is also seeing landlords offering concessions to tenants who renew -- even if they are downsizing. Case in point, AeroGrow International Inc. amended its lease with Pawnee Properties LLC in November 2011 for its headquarters at 6075 Longbow Drive in Boulder, CO. AeroGrow renewed its lease but reduced its square footage from 16,184 to 9,868. The landlord reduced the monthly base rent 23% to $9,046 ($0.92/square foot/month) from $19,261 ($1.19/square foot/month). The lease was extended 18 months to September 2014. &lt;br&gt;&lt;br&gt;"My experience is that all my clients are reassessing their space needs, consolidating as necessary, removing redundancy and heavily incorporating hi tech where it can," said Guy Levingston, principal of Intermountain &lt;a href="http://www.showcase.com/" target="_blank"&gt;Commercial Real Estate&lt;/a&gt; in Boise, ID. "They will shop the market and present competitive bids back to landlord to see if the landlord will budge or meet the best deal. You call it landlord generosity; I call it "market rate" for 2012. I believe it is going to take some years for office market rental rates to climb back up to what was considered "normal" before the 2007 downturn." &lt;br&gt;&lt;br&gt;Kevin Postal, president/broker of Atlantic Property Group in Port St. Lucie, FL, agreed, adding that such short-term concessions provide a way for the landlord to ride out the down market. &lt;br&gt;&lt;br&gt;"Most landlords don't want to sign leases longer than three years at the lower rate hoping that there is light at the end of the tunnel for better returns on their investments," Postal said. "It is definitely a buyer's market, but landlords usually won't show their hand until it's absolutely necessary. I've seen reductions up to 30% in some office rents." &lt;br&gt;&lt;br&gt;"Although most tenants prefer to stay in existing locations, they are also economy-minded these days," Postal said. "Of course, they want to seek out the best deal in the market. I am finding that tenants are willing to move as far as 15 to 25 miles in any direction if it means saving money." &lt;br&gt;&lt;br&gt;Many tenants are also taking advantage of current conditions to expand at their current location while signing on for a lease extension. &lt;br&gt;&lt;br&gt;REVA Medical Inc. did just that for its corporate headquarters at 5751 Copley Drive in San Diego. REVA more than doubled in size, expanding from 17,018 square feet to 37,470 square feet under a new deal with landlord ARI Commercial Properties that extends its lease through January 2018. Under the terms of the lease amendment, the annual base rent for the leased space increases over the term from $37,000/month (80 cents/square foot) to $60,000/month ($1.60/square foot) at the end of the lease. Up until the amendment, REVA Medical had been currently scheduled to pay $1.60/square foot per month. &lt;br&gt;&lt;br&gt;"Many landlords have offered reduced rates to blend-and-extend for three to five additional years. I don't view this as landlords being generous but rather (they are) being strategic to lock-in longer lease terms, stagger expirations, and reduce capital expenditures," said Steve Rosetta, executive vice president | market leader, Cushman &amp;amp; Wakefield of San Diego. &lt;br&gt;&lt;br&gt;"We are seeing tenants shop around for better terms and more flexibility versus renewing," Rosetta said. "In the end, a tenant may renew but they are all testing the market. Landlords may be reluctant to drop rates to keep a tenant initially but nearly all will reduce rates rather than loose a tenant to another building." &lt;br&gt;&lt;br&gt;NetSuite Inc., which leases 79,589 square feet for its corporate headquarters at 2955 Campus Drive in San Mateo, CA, extended its lease in December for another seven years until August 2019. In 2010, NetSuite had already amended its original lease signed in 2008 to reduce its space to its current size. With the extension just signed, NetSuite will be paying $40.20/square foot per year in 2013. Under its original 2008 lease, NetSuite had been scheduled to pay $63.88/square foot per year this year. So by extending long term, NetSuite has cut its scheduled rent more than a third. &lt;br&gt;&lt;br&gt;"At the beginning of a process, a [tenant] client may feel they will renew or give back space. However, after going through a real estate process it becomes quite clear what is financially and operationally more favorable," said Michael McKeever, senior vice president, UGL Services Los Angeles. "The smart landlords are offering concessions to maintain occupancy, so the tenant may renew but typically on much better terms than they originally thought. It's case by case. Some clients are reducing their rent by 20% and combined with space give back sometimes 40%+ reduction." &lt;br&gt;&lt;br&gt;We asked other commercial real estate industry professionals what they are seeing in terms of office renewal negotiating conditions in their markets. The following are some of their comments. &lt;br&gt;&lt;br&gt;
&lt;h4&gt;Staying Put&lt;/h4&gt;
&lt;br&gt;Over the past 18 months, I have seen tenants continue to operate in their current location. Occasionally they have tested the market but they prefer to stay put and typically pay a little bit of a premium to do so. Of course this premium does not take into account the costs and the disruption associated with the move. I have not seen the rent reduction in renewals. I have seen landlords reduce the rent if the tenant expands within the asset and commits for an additional seven to five years. Over the past 12 months, I have seen very little downsizing. If anything, I have experienced the tenant expanding if space is available. &lt;br&gt;&lt;em&gt;&lt;strong&gt;Todd Jones, Founder / Principal, Lone Star Realty Advisors, Irving, TX&lt;/strong&gt;&lt;/em&gt; &lt;br&gt;&lt;br&gt;[Tenants] are definitely shopping the market, but in most cases they are renewing their leases. It is expensive to move so if there is not a significant reason to leave their current building, most companies are staying. These companies are investigating the market and negotiating aggressive terms from landlords. Current landlords typically have the edge by being able to offer lower tenant improvement costs and still accommodate tenants. In addition, companies don't face expensive moving costs when they renew their leases and it is less disruptive to their business. &lt;br&gt;&lt;em&gt;&lt;strong&gt;Bill Rothstein, Senior Vice President / Brokerage Services, Cushman &amp;amp; Wakefield NorthMarq, Minneapolis, MN&lt;/strong&gt;&lt;/em&gt; &lt;br&gt;&lt;br&gt;All tenants are shopping around for better terms. However, a smaller percentage actually ends up relocating. Relocation costs vary depending on a number of factors and often times it can be the determining factor. Additionally, better terms generally come with longer lease terms, from which the majority of tenants in Orange County currently shy away. It depends on the ownership entity, the debt structure, where the asset sits in the lifecycle of the fund and the portfolio strategy. In some cases, we've seen savings north of 25% to 30%, whether through straight rent reduction, free rent or some combination of the two. It also depends how much lease term is left and position relative to market. &lt;br&gt;&lt;em&gt;&lt;strong&gt;Eric Antonini, Vice President, UGL Services Orange County&lt;/strong&gt;&lt;/em&gt; &lt;br&gt;&lt;br&gt;
&lt;h4&gt;Buying Rather Than Renewing&lt;/h4&gt;
&lt;br&gt;More of my clients are looking for &lt;a href="http://www.showcase.com/Office-Space-for-Lease" target="_blank"&gt;office space&lt;/a&gt; or land to purchase, seeing this down market as an opportunity to buy their own instead of continuing to lease from others. Activity is definitely up, with more work to do than I could have imagined. &lt;br&gt;&lt;em&gt;&lt;strong&gt;Mark W Kidd,, President, M Kidd Properties Inc., Houston, TX&lt;/strong&gt;&lt;/em&gt; &lt;br&gt;&lt;br&gt;From my perspective, we are still seeing tenants actively looking to evaluate the office market alternatives in order to make an informed decision about leases expiring. Some tenants want to upgrade their office space to better buildings for office rents close to the same that they are currently paying. I am still seeing quite a few tenants that prefer to renew or short term extend leases in place to not incur the costs of moving. Lastly, I am seeing some smaller tenants 5,000 to 15,000 square feet looking to purchase buildings at reasonable prices to take advantage of low interest rates and opportunities to own. &lt;br&gt;&lt;em&gt;&lt;strong&gt;Robert J. &lt;h4&gt;Renewal Process Starting Well in Advance of Expiration&lt;/h4&gt;
&lt;br&gt;Our clients are making the effort to renew their lease well in advance of the renewal date. I think there are two business reasons: Taking uncertainty of real estate space out of the business climate; and locking in the cost of real estate in a down market for a predictable period of time. Property owners in general are resisting this effort and are holding the out to the last possible moment to renegotiate, running the risk of tenant alienation. To the extent lease terms includes an arbitration clause, this resistance includes resolving rent related issues by use of arbitration. &lt;br&gt;&lt;em&gt;&lt;strong&gt;John Guillory, President, Northridge Group, Oakland, CA&lt;/strong&gt;&lt;/em&gt; &lt;br&gt;&lt;br&gt;
&lt;h4&gt;Landlords Holding on Tight to Tenants&lt;/h4&gt;
&lt;br&gt;Landlords are still holding on tight to their tenants and are willing to be more aggressive on renewal lease terms. Landlords can't afford the downtime/loss of revenue; therefore, they are willing to reduce renewal rents. Because of the favorable renewal rates, tenants are signing up for additional square footage to lock in today's low rates. In most cases, there has been pent up demand for more space and coupled with the low renewal rates is driving the rollover expansion of space. Landlords are still providing free rent to maintain face rates. Free rent is applied to parking and storage space as well. The majority of landlords are still providing turnkey improvements instead of a fixed improvement amount. Overall, concessions haven't reduced but have remained fairly steady. &lt;br&gt;&lt;em&gt;&lt;strong&gt;JR Pearce, Crown Acquisitions Inc., Laguna Niguel, CA&lt;/strong&gt;&lt;/em&gt; &lt;br&gt;&lt;br&gt;For a couple of years now, our percentage of transactions related to renegotiations and renewals has increased dramatically. The past two years, 75% of our transactions have been renegotiations and/or renewals. We have reduced tenants' rates as far as 18 months before expiration. In new leases, we are seeing one month free for each year of term. We usually are able to negotiate for at least that, maybe more. Most landlords are clinging to their TI dollars. But some healthy ones use TI dollars as needed especially to attract tenants, as corporations aren't able or wanting to use their capital for TI's. &lt;br&gt;&lt;em&gt;&lt;strong&gt;Denis Mehigan, Principal, The Mehigan Co., San Francisco&lt;/strong&gt;&lt;/em&gt; &lt;br&gt;&lt;br&gt;
&lt;h4&gt;A Tenant's Market Can Turn on Dime&lt;/h4&gt;
&lt;br&gt;The few firms that are growing are expanding and securing good lease rates and terms. However, most corporations have learned to do more with less and are leaving very little room for expansion. On renewals most are holding or taking less. With the lack of new construction and the improving fundamentals, many tenants could be surprised at how fast the office market can turn from a tenants' market to a landlords' market. We believe 2012 will continue to slow demand and gradual occupancy improvements. &lt;p&gt;The above letter illustrates the results of working hard--a happy client.&lt;/p&gt;
&lt;p&gt;The three properties were refered to as "elephants" from the client since the dollar amounts were &lt;em&gt;&lt;strong&gt;very&lt;/strong&gt;&lt;/em&gt; significient. Being an estate sale there was high motivation to sell.&lt;/p&gt;
&lt;p&gt;The strategy I used was to market and sell to firms which would "use" the properties opposed to investors. Almost all investors have been&amp;nbsp;only purchasing&amp;nbsp;destressed properties at a 40%-60% reduction in the properties historical pricing.&lt;/p&gt;
&lt;p&gt;Fortunitionally the strategy worked--all three properties were sold to "users" opposed to investors so each were sold at respectable retail prices.&lt;/p&gt;
&lt;p&gt;My job is done---I am now looking for three properties to sell since these all have new owners!&lt;/p&gt; &lt;div class="agent_signature"&gt;

Mr. Charlie Barger an seasoned insurance executive and President of &lt;strong&gt;Premier Benefit Administrators&lt;/strong&gt; chose to be a &lt;strong&gt;Tenant&lt;/strong&gt; at TownPark Commons &lt;span class="st1"&gt;&lt;span&gt;a Class A campus-style office development in &lt;/span&gt;&lt;/span&gt;suburban Kennesaw, Ga. &lt;span class="st1"&gt;&lt;span&gt;for their Corporate office. &lt;a href="http://www.danielcorp.com/portfolio-office-townpark.html"&gt;&lt;span style="color: #800080;"&gt;http://www.danielcorp.com/portfolio-office-townpark.html&lt;/span&gt;&lt;/a&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Mr. Barger examined the building pictures, locations on the map, and floor plan for each of the potential suites.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p class="MsoNormal" style="margin: 0in 0in 10pt;"&gt;&lt;span class="st1"&gt;&lt;span&gt;&lt;span style="font-size: small;"&gt;Special consideration was given to access of I 75 for employees and clients. In addition it was important to be in close proximity to Kennesaw State University for recruitment of talent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p class="MsoNormal" style="margin: 0in 0in 10pt;"&gt;&lt;span class="st1"&gt;&lt;span&gt;&lt;span style="font-size: small;"&gt;Once Mr. Barger determined which locations would work I contacted each building representative and to set up our tour. The visits were quick, the information provided was concise and it became evident quickly which locations would work. An interesting point which should be noted was there were only a small number of suites that fit Mr. Barger&amp;rsquo;s requirements for the firm.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p class="MsoNormal" style="margin: 0in 0in 10pt;"&gt;&lt;span class="st1"&gt;&lt;span&gt;&lt;span style="font-size: small;"&gt;Once a short list was established of the available suites the negotiations began. Very important considerations were given to abated rent, turnkey tenant improvements and when the suite would be ready for occupancy. The base rent was important but not &amp;ldquo;the most&amp;rdquo; important factor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p class="MsoNormal" style="margin: 0in 0in 10pt;"&gt;&lt;span style="font-size: small;"&gt;&lt;span class="st1"&gt;&lt;span&gt;I soon learned from the Landlord Agent &lt;/span&gt;&lt;/span&gt;&lt;span&gt;John E. Zintak of Daniel Corporation that we were going to get a &amp;ldquo;fair deal&amp;rdquo; but not a &amp;ldquo;Buckhead deal&amp;rdquo;. Mr. Zintak knew his market and the quality of his client&amp;rsquo;s property. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p class="MsoNormal" style="margin: 0in 0in 10pt;"&gt;&lt;span&gt;&lt;span style="font-size: small;"&gt;With three weeks of negotiating a Letter of Intent and lease combined with tweaking of the tenant improvements a lease was executed. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p class="MsoNormal" style="margin: 0in 0in 10pt;"&gt;&lt;span&gt;&lt;span style="font-size: small;"&gt;Immediately thereafter the contractors begun the Tenant improvements, Mr. Barger ordered his furniture, computers and a new Mitel IP telephone system.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p class="MsoNormal" style="margin: 0in 0in 10pt;"&gt;&lt;span style="font-size: small;"&gt;&lt;strong&gt;&lt;span class="st1"&gt;&lt;span&gt;Premier Benefit Administrators&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span class="st1"&gt;&lt;span&gt; is now located at 225 Townpark Dr NW, Suite 415 Kennesaw, GA 30144 and the Building owners &lt;/span&gt;&lt;/span&gt;&lt;span&gt;MetLife Inc. &lt;p&gt;Its a done deal- We located the choices for a Professional Office in &lt;strong&gt;Buckhead&lt;/strong&gt;, narrowed down to three with one being the favorite and negotiated the terms. All parties, the &lt;strong&gt;tenant,&lt;/strong&gt; Landlord and Brokers negotiated in good faith and made the process smooth and easy.&lt;/p&gt;
&lt;p&gt;The tenant a CPA firm now has a first floor upgraded lobby suite, covered parking, full amenities etc.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;To seize the low rates which are present in &lt;strong&gt;Buckhead &lt;/strong&gt;the &lt;strong&gt;tenant &lt;/strong&gt;signed a 5 year lease with controllable increases in rent.&lt;/p&gt;
&lt;p&gt;This was a direct r&lt;strong&gt;eferral&lt;/strong&gt; from an Active Rain&amp;nbsp;member who is the firm's attorney--thank you.&lt;/p&gt;

The attorney has a business relationship with a CPA who has been practicing for 19 years. The CPA and her associates have determined it is the right time to start their own firm. I am fortunate to have been engaged to locate and assist in the negotiations for their new office.&lt;/p&gt;
&lt;p&gt;To be close to their clients and prospects the new CPA firm has selected the Buckhead &lt;strong&gt;Atlanta &lt;/strong&gt;market as their preferred location. I have scoured the market and located 12 possibilities, by looking at building pictures, floor plans and economics they narrowed their considerations to six suites.&lt;/p&gt;
&lt;p&gt;Yesterday we toured the six suites; they have selected three for me to send a request for proposal to the landlords. I need to work fast since they wish to move in by January 15&lt;sup&gt;th&lt;/sup&gt;.&lt;/p&gt;
&lt;p&gt;This is a perfect Active Rain referral and hopefully a soon to be success story. Assignments requiring quick decisions from professional organizations are a commercial real estate tenant rep's dream come true.&lt;/p&gt;

&lt;p&gt;A current &lt;strong&gt;Atlanta Commercal Tenant Leasing assignment&lt;/strong&gt; I am working on developed into an interesting situation.&lt;/p&gt;
&lt;p&gt;Our search brought us to a "close to perfect office&amp;nbsp;suite". The location was great, the layout worked well, and with leveraging the tenants strong financial position we negotiated generous concessions and an acceptable lease rate.&lt;/p&gt;
&lt;p&gt;In plain view to all on the tour we saw a removed vinyl baseboard in one office. The honest leasing agent explained that there was a past water intrusion. He further informed us (confirmed later with the property maintenance person) that the water was from an outside drain and a waterproofing company had stopped the water from future intrusions and sealed the wall.&lt;/p&gt;
&lt;p&gt;The tenant was concerned about its employee's health and requested the ownership to have an air quality test preformed. The building owners &lt;span style="text-decoration: underline;"&gt;refused&lt;/span&gt; stating that they did not want to be in possession of an environmental report which may or may not be favorable. If a sale of the property ever took place the owners would be required to turn over the report in the due diligence period.&lt;/p&gt;
&lt;p&gt;The landlord agreed to cut the sheet rock for a "non professional" visual inspection. As you can see from the pictures below &lt;span style="text-decoration: underline;"&gt;black mold&lt;/span&gt; was present. The owners offered to have it physically remediated without an air test.&lt;/p&gt;

&lt;p&gt;The Tenant elected to "hit the easy button" and eliminated that suite from consideration. They were concerned even if the damaged area was cleaned and remediated without an air quality test one would never know if the HVAC, Carpet and air was mold free.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Even though this adds to my time and work finding &amp;amp; negotiating an alternate space, I know the tenant made the correct decision. In today's environment the tenant also would have been susceptible to legal action if an employee had become ill.&lt;/p&gt;
&lt;p&gt;The lessons to be learned is be observant and help protect your Tenants.&lt;/p&gt; &lt;div class="agent_signature"&gt;

&lt;p&gt;Developed by the &lt;a href="http://en.wikipedia.org/wiki/U.S._Green_Building_Council" title="U.S. Green Building Council"&gt;U.S. Green Building Council&lt;/a&gt;(USGBC), LEED is intended to provide building owners and operators a concise framework for identifying and implementing practical and measurable green building design, construction, operations and maintenance solutions.&lt;/p&gt;
&lt;p&gt;Since its inception in 1998, the U.S. Green Building council (citation LEED for existing buildings v2.0 reference guide page pg 11) has grown to encompass more than 14,000 projects in the United States and 30 countries covering 1.062 billion square feet (99&amp;nbsp;km&amp;sup2;) of development area.&lt;a href="http://en.wikipedia.org/wiki/Leadership_in_Energy_and_Environmental_Design#cite_note-Green_Building_by_the_Numbers-0"&gt;&lt;sup&gt;[1]&lt;/sup&gt;&lt;/a&gt;The hallmark of LEED is that it is an open and transparent process where the technical criteria proposed by USGBC members are publicly reviewed for approval by the almost 20,000 member organizations that currently constitute the USGBC.&lt;/p&gt;

The extra cost for the minimum benefit has been estimated at 3%, with an additional 2.5% for silver.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Absorption&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Net absorption for the overall Atlanta office market was positive 270,472 square feet in the second quarter 2010. That compares to negative (290,337) square feet in the first quarter 2010, negative (989,956) square feet in the fourth quarter 2009, and negative (511,026) square feet in the third quarter 2009.&lt;/p&gt;
&lt;p&gt;The Class-A office market recorded net absorption of positive 95,960 square feet in the second quarter 2010, compared to negative (13,602) square feet in the first quarter 2010, negative (605,126) in the fourth quarter 2009, and negative (81,977) in the third quarter 2009.&lt;/p&gt;
&lt;p&gt;The Class-B office market recorded net absorption of positive 289,566 square feet in the second quarter 2010, compared to negative (108,535) square feet in the first quarter 2010, negative (274,351) in the fourth quarter 2009, and negative (215,241) in the third quarter 2009.&lt;/p&gt;
&lt;p&gt;The Class-C office market recorded net absorption of negative (115,054) square feet in the second quarter 2010 compared to negative (168,200) square feet in the first quarter 2010, negative (110,479) in the fourth quarter 2009, and negative (213,808) in the third quarter 2009.&lt;/p&gt;
&lt;p&gt;One might conclude that business owners are trading up to nicer Class A or B offices for the same or lower occupancy costs as in the Class C market.&lt;/p&gt;
&lt;p&gt;Net absorption for Atlanta's central business district was positive 85,611 square feet in the second quarter 2010. Compare that to the negative (174,507) square feet in the first quarter 2010, negative (175,128) in the fourth quarter 2009, and negative (104,085) in the third quarter 2009.&lt;/p&gt;
&lt;p&gt;Net absorption for the suburban markets was positive 184,861 square feet in the second quarter 2010. That is compared to negative (115,830) square feet in first quarter 2010, negative (814,828) in the fourth quarter 2009, and negative (406,941) in the third quarter 2009.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Vacancy&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;The vacancy rate was 17.4% at the end of the first quarter 2010, 16.7% at the end of the fourth quarter 2009, and 16.4% at the end of the third quarter 2009.&lt;/p&gt;
&lt;p&gt;Class-A projects reported a vacancy rate of 19.8% at the end of the second quarter 2010, 19.9% at the end of the first quarter 2010, 18.7% at the end of the fourth quarter 2009, and 18.1% at the end of the third quarter 2009.&lt;/p&gt;
&lt;p&gt;Class-B projects reported a vacancy rate of 15.7% at the end of the second quarter 2010, 15.9% at the end of the first quarter 2010, 15.8% at the end of the fourth quarter 2009, and 15.6% at the end of the third quarter 2009.&lt;/p&gt;
&lt;p&gt;Class-C projects reported a vacancy rate of 15.1% at the end of the second quarter 2010, 14.9% at the end of first quarter 2010, 14.5% at the end of the fourth quarter 2009, and 14.3% at the end of the third quarter 2009.&lt;/p&gt;
&lt;p&gt;The overall vacancy rate in Atlanta's central business district at the end of the second quarter 2010 decreased to 14.3%. The vacancy rate was 14.5% at the end of the first quarter 2010, 14.0% at the end of the fourth quarter 2009, and 13.5% at the end of the third quarter 2009.&lt;/p&gt;
&lt;p&gt;The vacancy rate in the suburban markets decreased to 17.7% in the second quarter 2010. The vacancy rate was 17.8% at the end of the first quarter 2010, 17.1% at the end of the fourth quarter 2009, and 16.8% at the end of the third quarter 2009.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Sublease Vacancy&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;The amount of vacant sublease space in the Atlanta market decreased to 2,944,126 square feet by the end of the second quarter 2010, from 3,228,548 square feet at the end of the first quarter 2010.&lt;/p&gt;
&lt;p&gt;Atlanta's Class-A projects reported vacant sublease space of 2,137,712 square feet at the end of second quarter 2010, down from the 2,295,757 square feet reported at the end of the first quarter 2010.&lt;/p&gt;
&lt;p&gt;Class-B projects reported vacant sublease space of 750,355 square feet at the end of the second quarter 2010, down from the 873,132 square feet reported at the end of the first quarter 2010.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Rental Rates&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;The average quoted asking rental rate for available office space, all classes, was $18.98 per square foot per year at the end of the second quarter 2010 in the Atlanta market area. This represented a 0.6% decrease in quoted rental rates from the end of the first quarter 2010, when rents were reported at $19.09 per square foot.&lt;/p&gt;
&lt;p&gt;The average quoted rate within the Class-A sector was $21.76 at the end of the second quarter 2010, while Class-B rates stood at $16.75, and Class-C rates at $14.33. At the end of the first quarter 2010, Class-A rates were $21.84 per square foot,&lt;/p&gt;
&lt;p&gt;Class-B rates were $16.88, and Class-C rates were $14.45. The average quoted asking rental rate in Atlanta's CBD was $18.45 at the end of the second quarter 2010, and $19.03 in the suburban markets. In the first quarter 2010, quoted rates were $18.79 in the CBD and $19.12 in the suburbs.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;New Buildings in the Market&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;During the second quarter 2010, &lt;span style="text-decoration: underline;"&gt;only one building totaling&lt;/span&gt; &lt;span style="text-decoration: underline;"&gt;6,000 square feet&lt;/span&gt; was completed in the Atlanta market area. This compares to 10 buildings totaling 1,732,106 square feet that were completed in the first quarter 2010, five buildings totaling 112,106 square feet completed in the fourth quarter 2009, and 1,435,497 square feet in 22 buildings completed in the third quarter 2009.&lt;/p&gt;
&lt;p&gt;There were 258,971 square feet of office space under construction at the end of the second quarter 2010.&lt;/p&gt;
&lt;p&gt;Some of the notable 2010 deliveries include: 12th &amp;amp; Midtown, a 752,710-square-foot facility that delivered in first quarter 2010 and is now 16% occupied, and Phipps Tower, a 479,041-square-foot building that delivered in first quarter 2010 and is now 5% preleased.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Inventory&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Total office inventory in the Atlanta market area amounted to 278,927,021 square feet in 12,692 buildings as of the end of the second quarter 2010. The Class-A office sector consisted of 112,150,498 square feet in 491 projects. There were 5,019 Class-B buildings totaling 120,546,056 square feet, and the Class-C sector consisted of 46,230,467 square feet in 7,182 buildings.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Comments&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;The opportunity continues for tenants to lower their occupancy costs and/or improve their firm's workplace.&lt;/p&gt;
&lt;p&gt;It should be noted that the tenant/landlord time-line for lease negotiations is taking much longer. Bothsides withgood reason are concerned with each other's financial condition andworking through each side's "security" involves extended time, Quality tenants are requesting unprecedented low rental rates combined withabundant concessions. Landlords desperately needing the tenants carefully evaluate the demand which slows the process; in the end the terms favor the tenant's interests.&lt;/p&gt;
&lt;p&gt;It is advisable for a tenant to allot approximately 50% more time in the search for new space compared to their historical experience.&lt;/p&gt;

&lt;p&gt;The Association for &lt;strong&gt;Clinical Pastoral Education Inc. &lt;/strong&gt;(ACPE) has purchased the 15,068 square foot office building formerly known as The McKinney Building near the Decatur Square. The building will either be completely renovated or demolished and a new LEED Certified building will be built in its place.&lt;/p&gt;
&lt;p&gt;The $1.025M purchase was made possible entirely through donations to the non-profit organization ACPE. The property was listed by &lt;strong&gt;Gene Kansas &lt;/strong&gt;Development. The purchaser was represented by &lt;strong&gt;Rick Ferguson&lt;/strong&gt;, with &lt;strong&gt;Bull Realty&lt;/strong&gt; whose practice focuses on working with office buyers and tenants.&lt;/p&gt;
&lt;p&gt;The Association for Clinical Pastoral Education, Inc. is a multicultural, multi-faith organization devoted to providing education and improving the quality of ministry and pastoral care offered by spiritual caregivers of all faiths through the clinical educational methods of Clinical Pastoral Education.&lt;/p&gt;
&lt;p&gt;It was important for the organization to be in a vibrant downtown area that is pedestrian friendly and culturally diverse. Also playing a major part in the site selection was the close proximity to the Emory University campus.&lt;/p&gt;
&lt;p&gt;"The ACPE which provides education and provides pastoral care to spiritual caregivers plans to relocate from their current Clairmont Road office to a newly designed and built LEED Certified building," said Ferguson. "Adding to Decatur's fine education institutions, this new landmark facility will house the association's Academy for Continuing Education, a conference center and their national administrative office."&lt;/p&gt;
