&lt;p&gt;Once in while we have requests from a business entity to rent a house.&amp;nbsp; The business may have moved an employee to our city and they want to cover the costs for that employee.&lt;/p&gt;
&lt;p&gt;It is our practice to take applications from the people that are to occupy the house.&amp;nbsp; It is too easy to dummy up a business and tax return, harder to dummy up a consumer credit report. Plus, a business may dissolve, but a consumer is not likely to dissolve.&lt;/p&gt;
&lt;p&gt;So, if a company wants to rent from you, tell them that the people living in the property must apply and qualify.&amp;nbsp; Ignore the (monkey) business!&lt;/p&gt;

    <title>What is the True Bottom of the Market?</title>

&lt;p&gt;There are many answers to this question, but for me, the true bottom&amp;nbsp;is when investors buy single family dwellings because the rent they can get on a cash deal will support the price.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;If a property will rent for $1,000.00 a month it will generate $12,000.00 in a year.&amp;nbsp; If that property can be purchsed for say $100,000.00 the return over a year on that investment is 12%.&amp;nbsp; (note:&amp;nbsp; the actual net might be something closer to $6,000.00 after all expenses, so the return would be 6%).&amp;nbsp;&lt;/p&gt;
&lt;p&gt;An investor would be attracted to this deal because the return is better than they can do in&amp;nbsp;bank, plus they have a chance for appreciation down the road.&amp;nbsp; It is unlikely the value will drop further since another investor will likely step up for that return.&lt;/p&gt;
&lt;p&gt;In Sacramento I have seen similar numbers in working class neighborhoods.&amp;nbsp; These prices then serve as a foundation for the next level up and so on.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;I think we are close to if not at the bottom, and things should at least stabalize at the low end.&amp;nbsp; Now if you are in more expensive neighborhoods, you may not see the benefit of this for some time.&amp;nbsp; It has to trickle up and that takes time, plus more foreclosures may delay improvement.&lt;/p&gt;    </content>

&lt;p&gt;&amp;nbsp;A shared fence is a fence built on the property line between two adjoining parcels.&amp;nbsp; Each owner shares the fence equally.&amp;nbsp; If the fence needs repairs or falls down and needs to be replaced, each owner should chip in one half the cost.&lt;/p&gt;

&lt;p&gt;There are many ways to handle the issue.&amp;nbsp; The two owners could spend the weekend buying the materials together and then jointly builidng the fence and then make a trip to the dump to get rid of the old materials.&amp;nbsp; In today's busy world, I suspect one owner will make arrangements and the other will simply write a check to cover their share.&lt;/p&gt;
&lt;p&gt;When a rental is concerned it can be a harder problem especially if one or both of landlords live out of town.&amp;nbsp; Out of sight out of mind.&amp;nbsp; Property management companies often have to deal with this issue and it is not fun.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;If an owner will not cooperate the solution would be obtain three bids.&amp;nbsp; Then write the neighbor a letter enclosing the bids and telling the owner that if they do not cooperate you will proceed and take them to court.&amp;nbsp; The owner would then have to sue the neighbor, small claims court would be best, and hopefully win a judgement.&amp;nbsp; Lot's of documentation and photos would be good to have for the court to support the case.&amp;nbsp;&amp;nbsp; Once the judgement is obtained the court will direct the winner how to collect.&lt;/p&gt;
&lt;p&gt;Fences in disrepair do create liabilites such as dogs entering a yard, kids getting out, and more.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;A fallen fence is an opportunity to get to know your neighbor!&lt;/p&gt;

&lt;p&gt;&amp;nbsp;Some of our clients want to rent their homes with some of the items "as is".&amp;nbsp; They might tell us that the washer and dryer can stay, but they do not want to fix them.&amp;nbsp; Or, they don't have a way to move their refrigerator, so can they leave it in the&amp;nbsp;house, but rent it "as is".&lt;/p&gt;
&lt;p&gt;Is this a good idea?&lt;/p&gt;
&lt;p&gt;I think it is a bad idea for a couple of reasons.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;First, what happens when the refrigerater goes out one week after the tenant takes possession?&amp;nbsp; I can tell you with some certainty, that the tenant will not be happy.&amp;nbsp; Their first thought will be that they just got ripped off.&lt;/p&gt;
&lt;p&gt;Second, what happens when the referigerator breaks down&amp;nbsp;a year later?&amp;nbsp; Well, I bet the tenant has forgotten about the "as is" by then and will call to request repairs.&amp;nbsp; Even the best intentioned owner or property manager could simply send a repair guy out to make the repair.&amp;nbsp; Oops!&amp;nbsp; Or, they remember and now the tenant has an unexpected bill, plus&amp;nbsp;the owner now has to haul the thing out of there.&amp;nbsp; &amp;nbsp;How do you spell NOT HAPPY?&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Pretty much, renting appliances "as is" is&amp;nbsp;a set up for poor customer service.&amp;nbsp; So, if you don't want to keep it in good repair, take it off the property.&lt;/p&gt;
&lt;p&gt;Next:&amp;nbsp; What appliances should be provided with a rental?&lt;/p&gt;

&lt;p&gt;I suggest that all property management companies verify who is on title of each new account.&amp;nbsp; This is an insurance policy for the property manager for a couple of reasons.&lt;/p&gt;
&lt;p&gt;First, you will know that the person signing the agreement is the owner.&amp;nbsp; There are scams out there where people obtain the keys of a vacant house and rent the home out to an unsuspecting tenant.&amp;nbsp; Taken one step further, this could be done via a property manager.&lt;/p&gt;
&lt;p&gt;Second, there may be a trust or other type of ownership holding title.&amp;nbsp; In that case the property manager should obtrain documentation on why the person signing the agreement has authority to do so.&lt;/p&gt;
&lt;p&gt;So checking the title and keeping a copy will give the property manager and the tenants they place in the property peace of mind.&lt;/p&gt;

&lt;p&gt;There is a big difference between what a licensed and insured property management company provides for an investor and what you can provide.&amp;nbsp; Besides licensing and insurance there is your liability to consider.&amp;nbsp; If you make a mistake and someone gets injured or killed are you protected?&amp;nbsp; How?&amp;nbsp; I ask this to make sure you get into&amp;nbsp; this venture with your eyes wide open.&amp;nbsp; Are you an employee of the owner or independent?&amp;nbsp; Is there a written contract?&amp;nbsp; Did you know that if there is a fair housing claim (many are over occupied property) that you are personally liable no matter what your relationship is to the owner?&lt;/p&gt;
&lt;p&gt;The issue of handling repairs is similar.&amp;nbsp; Are you acting as a general contractor (without a license) or an employee of the owner?&amp;nbsp;&amp;nbsp;&lt;/p&gt;

&lt;p&gt;This is a followup to my blog yesterday.&amp;nbsp;&lt;a href="http://activerain.com/blogsview/614095/Home-Warranty-Woes-Part"&gt;http://activerain.com/blogsview/614095/Home-Warranty-Woes-Part&lt;/a&gt;&lt;/p&gt;
&lt;p&gt;Since the warranty company refused to clear my drain I had to call my plumber.&amp;nbsp; He came out this morning and snaked my shower.&amp;nbsp; He then tested all the plumbing for 15 minutes to make sure everything was draining.&amp;nbsp; It was.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The warranty company's plumber told me that the warranty would not cover clearing the drain unless I had a main clean out.&amp;nbsp; In my old house I do not have one.&amp;nbsp; But, my plumber was able to clear the drain without using a main clean out.&lt;/p&gt;
&lt;p&gt;Do you&amp;nbsp; see my frustration with the warranty company?&lt;/p&gt;    </content>

&lt;p&gt;I have blogged before about home warranty companies and how property managers don't like them.&lt;/p&gt;
&lt;p&gt;Well, I purchased the house I live in this past March and it came with a home warranty.&amp;nbsp; On Saturday, our plumbing backed up in the downstairs shower from the laundry drain.&amp;nbsp; I almost forgot I had the warranty, but did remember before I called one of my plumbers.&amp;nbsp; I thought it would be a good test for the warranty companies that I had criticised.&lt;/p&gt;
&lt;p&gt;So Saturday at 3 pm I called and a half hour later I had a work order and a promise I would hear from the plumber.&amp;nbsp; I even&amp;nbsp;got the plumbers number, which was nice.&amp;nbsp; After an hour I called the plumber and the recording stated that they would return calls, but not on Sundays.&amp;nbsp; Since Saturday was fast ending, I figured it would be Monday before hearing again.&lt;/p&gt;
&lt;p&gt;Well, I did get a call Sunday!&amp;nbsp; It was to tell me that they would be out on Monday at 10 am.&amp;nbsp; Oh well.&lt;/p&gt;
&lt;p&gt;On Monday they called at 10 am and said they would come to the house at 1 pm.&amp;nbsp; At 1 pm they said they would come at 3 pm.&amp;nbsp; They arrived at 3 pm.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The house I bought does not have a clean out that I am aware of.&amp;nbsp; The plumber stated that without a cleanout, the warranty was voided and they could only provide a cleanout for $600.00.&amp;nbsp; They would not clear the line.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;So I guess the warranty I have, that cost around $300.00, is not worth much.&amp;nbsp; I know my tenants would be screaming by now.&amp;nbsp; I will update this blog with the what my plumber finds out tomorrow morning.&amp;nbsp; I have a 8 am appointment.&lt;/p&gt;

    <title>Can Renters Protect Themselves From Owners That Go Into Foreclosure?</title>

&lt;p&gt;
&lt;p&gt;&lt;strong&gt;I just had a tenant send me this message:&lt;/strong&gt;&lt;/p&gt;
&lt;/p&gt;
&lt;p&gt;&lt;em&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;I live in xxxxxxxxx, California. Recently, we inadvertently opened the mail of the owner of the property we're renting and discovered the property is in foreclosure. We've paid the guy six months in advance in rent (I know but we were desperate to get back to California). We have a six month lease.&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;&amp;nbsp;Anyway, our lease is up in 5 months. Do we have any recourse at all should we receive a 30 to 60 day notice to vacate? (I understand the law was changed this month to a 60 day notice on foreclosed properties)&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;&amp;nbsp;Also, how do we avoid such a thing in the future with the mortgage crisis being what it is in America? Is there any way to check on such a thing BEFORE we rent our next property?&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&amp;nbsp;There are a few things a renter can do to protect themselves.&lt;/strong&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;First, do not pay a lot of rent in advance.&amp;nbsp; Try to only pay a reasonable deposit, no more than a months rent, and the first months rent.&amp;nbsp; That way, if the property goes into foreclosure you will not lose too much rent money. &amp;nbsp;In California it is illegal for a&amp;nbsp; landlord to charge more than three months rent including the amount of deposits to a tenant.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;Second, If you get any mail addressed to the Owner from a bank, I suggest you look it over very carefully from the outside.&amp;nbsp; Does it look like a delinquent or foreclosure notice?&amp;nbsp;&amp;nbsp; Do not ignore letters and notices posted on your door.&amp;nbsp; If you do see such a letter or notice, contact your landlord immediately.&amp;nbsp; It may just be a situation where the mortgage was not paid to the right account, or was lost.&amp;nbsp; This information will help the landlord clear it up.&lt;/p&gt;
&lt;p&gt;There is not much else you can do.&amp;nbsp; Even a management company cannot guarantee that the owner will pay their mortgage, no matter what they tell you.&amp;nbsp; A management company could be terminated during your tenancy, so nothing the property manager tells you about how safe you are is really valid.&lt;/p&gt;    </content>

    <title>Meal Periods: Employers Must Only "Make Meal Periods Available," Not Ensure They Are Taken</title>

&lt;p&gt;Employers finally have a victory in the employee-dominated battlefield of meal and rest period litigation.&amp;nbsp; On July 22, 2008, a California Appellate Court held in Brinker Restaurant Corp. v. Superior Court that "while employers cannot impede, discourage or dissuade employees from taking meal periods, they need only provide them and not ensure they are taken."&amp;nbsp;&lt;/p&gt;
&lt;p&gt;This is a victory for employers and employees.&amp;nbsp; There are times when an employee does not want to take a break.&amp;nbsp; In the restaurant business a waiter could lose tip money when serving a big party.&amp;nbsp; Some commissioned sales people might lose income as well if break times were manditory.&lt;/p&gt;
&lt;p&gt;Manditory break times also put a burdon on the employer to enforce breaks throughout the day.&amp;nbsp; Aren't we all adults?&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Hopefully this ruling will stand but I have heard it will be apealed.&amp;nbsp; The attorneys make too much money suing businesses on behalf of their clients.&lt;/p&gt;    </content>

&lt;p&gt;&amp;nbsp;This funding is being distributed from Jan.'08-Dec.'08, (while funds last,) to &lt;strong&gt;people with&lt;/strong&gt; &lt;strong&gt;developmental disabilities&lt;/strong&gt;, living in &lt;strong&gt;Sacramento County&lt;/strong&gt; who can demonstrate emergency need of financial assistance to avoid eviction, avoid utility disconnection, have utilities reconnected, or are in need of an emergency motel voucher for temporary shelter.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;Applicants &lt;span style="text-decoration: underline;"&gt;must&lt;/span&gt; provide identification and proof of emergency need; i.e. eviction notice, utility disconnection notice, or other documents that will demonstrate/verify emergency situation.&amp;nbsp; Upon verification of need, qualified applicants will receive assistance for the minimum amount necessary to avoid utility disconnection or eviction, to restore utility service, or a voucher for a designated amount of time at a motel.&amp;nbsp; Payments will be made directly to the agency, landlord, or utility that is demanding payment, or to the motel where voucher is given.&amp;nbsp; Persons receiving assistance from &lt;strong&gt;Housing Now&lt;/strong&gt; will be asked to enroll with a payee service to help avoid future financial emergencies.&lt;/p&gt;

&lt;p&gt;&amp;nbsp;I wish I had news that rents were rising and vacancies dropping.&amp;nbsp; Instead, the market has pretty much stayed even the past two quarters with neither landlords or tenants getting the upper hand.&amp;nbsp; Some investors are losing their homes to foreclosure while some homeowners are electing to rent their homes rather than sell.&amp;nbsp; We expect the coming months to see a small increase in rents but a lot is dependent on the overall economy.&amp;nbsp; Properly priced rental property is renting at a good pace.&lt;/p&gt;

    <title>A New York Vacation in 4 Days</title>

&lt;p&gt;Now that the economy has dictated that staying in the USA for a vacation makes economic sense, it may be worth checking out NYC for your next getaway.&lt;/p&gt;
&lt;p&gt;I am lucky, my daughter is currently living there on Wall Street.&amp;nbsp; So my wife and two sons, that live in Sacramento, went to visit her this past week.&lt;/p&gt;
&lt;p&gt;So I can report that NYC can be seen pretty good in 4 days if you skip the museums.&lt;/p&gt;

&lt;p&gt;DAY ONE:&amp;nbsp; Take a city bus tour out of Times Square uptown including Central Park. Watch out for branches and bring water in the summer heat.&amp;nbsp; Be prepared with ear&amp;nbsp; plugs&amp;nbsp; when the sirens start wailing&amp;nbsp; Tour the Empire State Building for first timers.&amp;nbsp; There is a line and it costs, but is worth the view.&amp;nbsp; That evening go to a play.&amp;nbsp; Get tickets in advance for Wicked or Jersey Boys or check online for others.&amp;nbsp; That evening walk through Times Square, you can do this all night if you like to people watch or just see the lights.&lt;/p&gt;

&lt;p&gt;DAY FOUR:&amp;nbsp; Take a stroll down 5th Avenue and Broadway and do any shopping.&amp;nbsp; If you have kids be sure to visit the NBA Store and the NBC Store.&amp;nbsp; Both are fun.&amp;nbsp; Eat lunch in Little Italy and then walk down Canal Street if you dare.&amp;nbsp; More junk here per square foot than any other place I know.&amp;nbsp; You will have time to visit the Metropolitan Museum if you wish.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;During your visit you will learn how to use the subway and taxis.&amp;nbsp; It is a tiring 4 days and you will&amp;nbsp; be ready to come home and rest.&amp;nbsp; But, it is fun.&lt;/p&gt;    </content>

&lt;p&gt;This week we had one of our property management clients ask us to start advertising a property for rent.&amp;nbsp; The property is&amp;nbsp;an REO property they were purchasing and escrow had not closed.&lt;/p&gt;
&lt;p&gt;I can think of the following reasons not to do it:&lt;/p&gt;
&lt;p&gt;1.&amp;nbsp; The bank would need to give approval, good luck with&amp;nbsp; that.&lt;/p&gt;
&lt;p&gt;2.&amp;nbsp; Since the client did not own the property, they could not sign a management agreement which assigns liability to the owner.&amp;nbsp; The property manager would be at risk.&lt;/p&gt;
&lt;p&gt;3.&amp;nbsp; The escrow might get delayed so we could not give a move in date with any certainty.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;4.&amp;nbsp; Working on or moving into a property in escrow is one of the biggest mistakes a buyer could make.&amp;nbsp; It really plays havoc with negotiations that might be necessary during an escrow.&amp;nbsp; Bad idea.&lt;/p&gt;
&lt;p&gt;We told the owner we could only help them when they had title to the property.&lt;/p&gt;

&lt;p&gt;I had an accepted all cash deal going the past 90 days that was supposed to close a month ago.&amp;nbsp; All the money has been in escrow for over 30 days waiting for the bank to sign off the title company to record the deed.&lt;/p&gt;
&lt;p&gt;Yesterday I called the title company and they said the bank, which had bought out the original bank that had the loan, had not returned the final signatures and they had no idea why.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;I then called the listing agent who told me he had a total of three cash deals and all were waiting for the bank to sign off.&amp;nbsp; He had no solution.&amp;nbsp; Mine was the longest overdue.&lt;/p&gt;
&lt;p&gt;So, I informed escrow to send me back the money minus the original deposit and sent an addendum over to the listing agent to get a release of the deposit money.&lt;/p&gt;
&lt;p&gt;Who knows what vandalism has taken place in the last 30 days?&amp;nbsp; I cannot take that risk any longer to keep this deal together.&amp;nbsp; There are too many other deals out there to wait around for this one.&lt;/p&gt;

&lt;p&gt;We signed a contract recently to rent out a home for a new client.&amp;nbsp; Things were going well until the owner stopped over on a Sunday afternoon to see their house while it was still be marketed.&amp;nbsp; The problem is they ran into a potential tenant and showed them the house.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The owner then proceeded to call their property manager and me, while still at the property, to see if we would get them applications and rent the property to&amp;nbsp;them.&amp;nbsp; Our client could not understand why we could not be available 24/7 to show and make decisions to rent their property.&lt;/p&gt;
&lt;p&gt;Those of us in the property management business know the demands and know that quickness rarely leads to good decision making.&amp;nbsp; We want to see a detailed application and take 2-3 business days to verify all the information and run a credit report.&amp;nbsp; Acting too quickly can lead to a missed bit of information that could lead to allowing an unqualified person gettting the keys!&amp;nbsp; Do you know how to spell EVICTION?&lt;/p&gt;

&lt;p&gt;I know that owners want their property rented quickly.&amp;nbsp; But, there is an associated risk.&amp;nbsp; Property Managers and Owners need to be like a tortoise more than a hare.&amp;nbsp;&amp;nbsp;Rental applicants that are in a hurry may be just throwing up a smoke screen of urgency to get the weak property manager or owner to give them a key just to get rid of them.&amp;nbsp; Believe me, you will regret that decision.&amp;nbsp; The harder they push, the slower I get.&lt;/p&gt;

&lt;p&gt;Over the past 7 days I have traveled from Los Angeles to Mount Shasta and personally witnessed the smokey skies of California.&amp;nbsp; This is a spread of over 600 miles and it is smokey all&amp;nbsp; the way!&lt;/p&gt;
&lt;p&gt;During most of my driving there was a haze on the horizon, but&amp;nbsp;in Redding we saw the fires burning.&lt;/p&gt;
&lt;p&gt;One interesting&amp;nbsp;thing is how dry&amp;nbsp;Mount Shasta is this time of year.&amp;nbsp; It&amp;nbsp;normally&amp;nbsp; has a lot more snow on it, but it is mostly melted this year.&lt;/p&gt;
&lt;p&gt;I live and manage property in Sacramento, CA and we have had some of the worst smoke as it lays in the&amp;nbsp;valley and literally smokes us out.&amp;nbsp; But&amp;nbsp;us Sacramento dewllers better&amp;nbsp;plan a trip&amp;nbsp;either to the coast or out of state to get some relief, it will be smokey for a while yet.&amp;nbsp;&lt;/p&gt;    </content>

&lt;p&gt;But, it can be tough because a lot of other people are trying to locate a suitable rental home over the summer before school&amp;nbsp;starts.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;So, at the same time many want to take time off, the demands&amp;nbsp;of property management&amp;nbsp;rise to&amp;nbsp;take all possible free time away.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;We property managers have to&amp;nbsp;plan time off to coincide&amp;nbsp;with the slow times, which seems to come ever less frequently.&lt;/p&gt;
&lt;p&gt;No complaining here,&amp;nbsp;I would rather be busy than not busy.&amp;nbsp;&lt;/p&gt;
