The percentage of short sales has held steady at a time when distressed sales overall are dropping. Short sales even increased slightly to 19.4% of all sales in September.

By comparison, sales of bank-owned foreclosed homes (REOs) decreased steadily throughout the year, falling from a high of 772 in March to 412 in September. September was the first month this year in which short sales outnumbered bank-owned sales.

Bank-owned sales also declined percentage-wise. In September, just 16.8% of all sales were bank-owned homes, compared to 44% at the start of the year.

Total distressed sales also declined this past year, falling to 37.2% of all sales from nearly 65% at the start of the year.

Soon to be the new in spot in downtown Fullerton, "Joe's" promises to be a crowd pleaser with its funky food 'n' fun. Joey Gomez and Jack Franklyn are the owners. They've leased the former Table Ten restaurant which recently closed and plan to make this another hot spot. Franklyn already operates Heroes and Roscoe's Famous Deli. He says that there will be lots of unusual choices for lunch and dinner, but not deep-fried Snickers bars. The plans for the new restaurant are being sumbitted to Fullerton planners this week. He also says that the new place will be a family affair, that's great to hear!

Calling all ghoulies and ghosties and long-leggedy beasties and things that go bump in the night:You'll feel right at home at Fullerton Market Thursday, Oct. 29.

The market will host its annual "Okto-BOO-fest" on the 29^th, featuring activities, games and special events for all ages.

"Okto-BOO-fest" festivities will begin at 5 p.m. There will be a costume parade for children, with trick-or-treat bags given to the first 500 who participate.In addition, there will be special Halloween and harvest-themed games and free arts and crafts activities presented by the Fullerton Museum Center.

The festivities will also include a pumpkin carving and decorating contest, with families and individuals invited to bring their carved and/or decorated pumpkin to be voted on by the market crowd.The winning carver/decorator will receive a gift certificate to a local store.

In addition, a special "Okto-boo-fest" flier for children to color has been sent to all elementary schools. Children who bring their hand-colored flier to "Okto-boo-fest" will receive a ticket for the bounce house.

Musical entertainment for the evening will be the popular Bubba and the Big Bad Blues.

"Bubba" is Christopher LeClerc, a Fullerton native, who formed his blues band in 1990.His credits include performances with such stars as Ike Turner, Joe Sample and Nat Dove.

The band willperform from 6:30-8:30 p.m.

Adults attending "Okto-BOO-fest" will be able to visit the beer garden, which will offer German beer and peanuts.

I can hardly wait, The Habit Burger Grill will open its second Orange County location and the 29th in its chain in the University Plaza complex ,that is currently under construction, across from Cal State Fullerton. The Habit, which will move into a 1,700-square-foot space, began as a hamburger stand in 1969 in the beach community of Goleta, near UC Santa Barbara. The signature menu item remains the Charburger with caramelized onions

The one-story, four-tenant building on Nutwood Avenue replaces the Indian restaurant that burned down several years ago. Young Lee, president of Costa Mesa-based Flame Broiler, said he has also signed a lease for a 1,200-square-foot space in the building next to the Cantina Lounge. Lee launched his Flame Broiler chain in 1995 at Chapman and Raymond avenues in Fullerton. Commuting after graduation from UCLA, he often looked for quick bites to eat, but had a difficult time finding a healthy alternative to fast food.

Russ Khouri, vice president of Investment Concepts Inc., of Orange - which owns the property - said Thursday he is looking for two additional restaurant tenants. Occupancy is slated the first part of 2010.

Fundraiser to benefit Boys & Girls Clubs, Fullerton Police Explorers.

October 3rd : Second Annual Fullerton Car Show in the Downtown Plaza.

Admission is free for the fundraiser, which is expected to draw 6,000 people from 8 a.m. to 4 p.m. in the Downtown Plaza. Last year, 3,500 attended the show.

The entertainment menu includes the Screaming Eagles, a classic rock band; a "G-rated" frozen T-shirt contest; and a dunk tank for police.

Fred Johnson, executive director for the Boys & Girls Clubs of Fullerton, said a portion of the proceeds will go toward club programs including the computer lab, learning center, athletics, leadership activities and the Teen Center at the Richman site.

The 40-member Fullerton Police Explorers program will benefit from additional funds. Explorers coordinator Hazel Perez said money will be used for equipment, uniforms and travel expenses for the police academy.

During the car show, the Explorers will be in charge of the Bounce House, dunk tank, opportunity drawing and traffic control.

Heroes restaurant owner Jack Franklyn will provide food and refreshments for sale.

Chief McKinley is At It Again ! Chief's safety seminar to benefit ASL patients..

FULLERTON - Marilyn Hobbs knows what it's like to be defenseless.

Bound to a wheelchair with the slow debilitating effects of ALS (Lou Gehrig's disease), the former nursing director at St. Jude Medical Center was recently by herself in a shopping area when she realized if a threatening situation occurred, she wouldn't be able to run.

She wouldn't be able to fight back.

She wouldn't be able to yell for help.

But she could encourage other women to learn about safety and awareness. At the same time, those women could help the ALS Association, Orange County Chapter fund a full-time nurse case manager for the Patient Services Program that serves 176 ALS patients and their families in the area.

Hobbs' liaison to safety and awareness is former Fullerton Police Chief Pat McKinley, author of the book "She Bear: Empowerment & Safety for Women."

McKinley, who has conducted dozens of safety seminars in the past years, will - for the first time - charge admission with all funds directed to ALS.

The "She Bear Seminar" will be held at 9:30-11:30 a.m. on Oct. 3 at St. Jude Medical Center with a continental breakfast and parking included in the $25 cost of the ticket. To register, call 714-285-1088, ext. 221.

McKinley, who racked up more than 40 years in law enforcement, says one in four women will be a victim of sexual assault in her lifetime. He's on a personal mission to change those statistics.

During his lectures, he outlines ways to outsmart a potential attacker.

Hobbs trusts McKinley's opinions. Indeed, she and McKinley's wife, Barbara, have been friends since attending Pomona Catholic High School 50 years ago. The two went to nursing school, and worked together at Queen of Angels Hospital in Los Angeles.

Little did the McKinleys realize that four years after Hobbs and her family moved to Fullerton, Pat McKinley would be hired police chief in the same city.

The women spent hours together, shopping until they dropped. They played tennis, swam and walked around Fullerton. Their families vacationed on Balboa Island, and they shared life's ups and downs.

The "big down" came in 2007 when Hobbs was diagnosed with ALS. The first symptom, she said, was weakness in the foot that eventually crept up the leg, then the trunk and then into her vocal cords.

Barbara McKinley's eyes welled with tears when she recalled "the way it was."

Hobbs is dependent on caregivers to help navigate the house. And she's fortunate to have the ALS Association's loan of a microphone so guests can hear her speak. The association also lent an easy chair and breathing machine.

"One man even gave me an expensive ramp after his wife died," Hobbs, 67, said.

She acknowledges the support from "my angels" at St. Jude, her four children and grandchildren.

"The goal for this seminar is to raise $8,000," said Pat McKinley, adding: "and to empower women."

'9th Annual Haunted Fullerton Walking Tours'

A ghostly hand selects the dinner music at one downtown Fullerton eatery, while an unseen prankster enjoys tossing pots and pans around at another and at a third restaurant, a ghost has been known to belly up to the bar and hoist a few alongside his living counterparts.

These and other restless spirits of Fullerton, considered by many to be one of the most haunted cities in Orange County, will soon move out of the shadows and onto center stage when the Fullerton Museum Center launches its 9th Annual "Haunted Fullerton Walking Tours."

Tours will be given Wednesdays and Thursdays Sept. 16 through Nov. 6. Due to popularity, the tours book up fast, and persons interested in participating are strongly advised to get their registrations in early.

Locations to be visited can vary and may include the landmark Plummer Auditorium, where the spirits of Louis E. Plummer and one known only as the "angry woman" are said to watch the shows presented there; the historic California Hotel, now Villa del Sol; and the home of Fullerton's first woman auto dealer.

Even Fullerton's Police Department is not without its own hauntings, and will be one of the locations visited on the tours. While most people enjoy a good ghostly yarn, the real draw of the tours is that participants learn about Fullerton's colorful history.

The tours leave the museum promptly at 6 p.m., and last approximately two and one-half hours. Ghost hunters should be prepared to walk approximately 1.5 miles, and the tours will include climbing stairs, wear comfortable walking shoes and bring a sense of humor with them.

The tour is not recommended for children under 13.

Cost of the tour is $15 for museum members, and $18 for the general public. The price includes a beverage at the end of the tour.

A Special Halloween tour will be offered Saturday, Oct. 31. Tickets for this tour are $25 for the general public and $20 for museum members.

Reservations and further information may be obtained by calling the Fullerton Museum Center at (714) 738-6545. Persons requiring special accommodations to participate in the tour are asked to notify the museum staff when making reservations.

The Fullerton Museum Center is located at 301 N. Pomona Ave., one block east of Harbor Boulevard, in downtown Fullerton.

Fullerton Fire Fighters "Flip Out" ~ Pancake Breakfast Fundraiser !!

The Fullerton Fire Department will be setting aside its ladders and fire hoses and picking up spatulas instead Saturday, Oct. 10, as the department hosts a fund-raising pancake breakfast.

The breakfast will be held from 7:30-11 a.m. at Fire Department Headquarters, 312 E. Commonwealth Ave., and will feature pancakes, eggs, sausage or bacon, and a beverage. Tickets are $4 per person, and free for children under 2.

In addition to the breakfast, there will be informational booths on fire prevention and safety.

Fire crews will remain on active duty during the breakfast and there will be no disruption in service.

Proceeds from the breakfast will go to the department's public education program and to the "Community Emergency Response Team" (CERT) Program, which trains citizens to be prepared to assist in the city's overall disaster preparedness and recovery efforts.

What Is It ? and How Do I Get It ?

If you are sued in court and lose, the person who sued you may try to force the sale of your home to collect their money. A homestead makes it harder for them to do this.

A homestead protects some of the equity in your home. If your home is worth more money than you owe on it, you have equity. For example, if your home is worth $350,000 and you owe $300,000, you have $50,000 in equity. A homestead can protect the $50,000.

There are two types of homesteads, automatic and declared.

What is an automatic homestead?

If you live in the home you own, you already have one. It protects some of your home equity until you sell your home. You do not have to sign or file anything to have an automatic homestead

What is a declared homestead?

A declared homestead is a legal form that you record with the Registrar-Recorder's office. A declared homestead protects some of your equity for six months after you sell your home if the following three conditions are all true:

You sell your home and buy another home within six months;

The protected amount is used to buy another home;

You record a homestead on the new home.

Only the home you live in, qualifies for a homestead.

Who needs a declared homestead?

If you've been sued in court, lost, and have a large money judgment against you, a declared homestead can help. If you sell your home, it protects some of the proceeds for six months. This gives you time to buy another home and record another declared homestead.

How much does a homestead protect?

Both automatic and declared homesteads protect the same amounts:

$50,000 for an individual;

$75,000 if the homeowner lives with at least one family member who has no interest in the house;

$150,000 if the homeowner is 65 years of age or older, or is physically or mentally disabled;

$150,000 if the homeowner is 55 years of age or older and single with an annual income of $15,000 or less;

$150,000 for a married couple with a combined annual income of $20,000 or less;

A homestead does not protect you against:

Foreclosure of your home by mortgage lender if you are behind on payments. (See our brochure, Foreclosure);

The enforcement of a mechanic's lien;

A judgment for child or spousal support.

How do I file a declared homestead?

You can file a declared homestead by taking these steps:

Buy a declared homestead form from a stationery store, or download one online from the Registrar-Recorder's website at: www.lavote.net/GENERAL/PDFS/HOMESTEAD_DECLARATION.pdf .

Fill out the form.

Sign the form and have it notarized.

Contact the Registrar-Recorder's office where the property is located for fees and filing addresses. In Los Angeles County call (562) 462-2125.

Companies offering to help you file a declared homestead cannot charge more than $25.

Many people are being scammed or think they are being scammed by phony foreclosure rescue companies. They're not alone; The FBI has been looking into these cases and so far nearly 4,000 incidents have been reported!

According to the Federal Trade Commission, the scams advertise guarantees and high success rates to mislead consumers about their services. They charge upfront fees, that legitimate nonprofit organizations do not charge. They also use names or look-a-like Web sites that appear to be a nonprofit or government agency.

DON'T BE SCAMMED !! Remember that official government sites end with ".gov." Some of these scammers try to confuse people by using addresses that include a dash or slashh in front of "gov" or end in".us," or by using names that sound similar to legitimate programs.

Always be suspicious of unsolicited offers that look like government forms, or have logos that resemble government seals. These offers suggest you may be eligible for a modification program to save your home under a government program. Bewae of misspellings, dire warnings and references to government programs that you can't access without their help.

Check the company out, if you can't validate a company or if their privacy policy sounds fishy, it's most likely a scam.

Especially be careful of sites that contain only a single page where you fill out personal info to submit for a referral. Even if the ad appears in a magazine or newspaper it could just mean they paid for advertising.

Always be leery of promises of any type. RUN AWAY from any attempt to collect fees, and be wary of promises of a "free consultation" or a "money-back guarantee."

Remember, there are ligitimate nonprofit organizations that work with government agencies to provide FREE HELP for distressed homeowners. Contact the federal government's Hope Now program at: 1-800-995-HOPE, or visit www.hopenow.com to find legitimate assistance.

Great news everyone, new home sales in the US are surging. Sales have increased by 11% after falling for three years. Some say that this is a sign that the housing market has leveled out though others say it will get worse before it gets better. Falling prices and mortgage rates coupled with government incentives is the supposed driving force behind the increasing demand. Well my question is why is this happening? Why when so many homes sit empty throughout this country are we having a surge of demand for new homes? In a fairly recent census report, 18.6 million houses are said to lay empty (though this breaks down into several categories) while 759,101 remain homeless. This makes me wonder how far off have we diverged in the use of houses from their original intent.
