Owners Title Insurance? - A Good Case

Attention buyer agents! Do you recommend your buyer clients get a title insurance policy? Remember it's required with most mortagages but that's actually the lenders policy. The lenders policy does offer some protection but it still leaves the buyer open to, let me explain.

I actually heard this on the Neal Boortz radio show. Among other things Neal used to practice as a real estate attorney. On his show he went as far as to say that if a real estate agent ever told a buyer they didn't need a title policy because the lender had a policy, the offending agent should be slapped upside da head.

Anyway, we all know the purpose of the title policy, the insurer will make good on issues in title chain that affect current ownership, how the property can be used, etc., that for what ever reason were not found during escrow. In the story Mr. Boortz was telling an entire development was found to be in jeopardy. Someone proved that somewhere down the line a mentally incompetent party signed over the property in question which invalidated the chain of ownership from that point on.

As you'd expect the title insurance company made good to the insured lenders. As they did so the promisorry notes for each home loan became the property of the title insurance company or companies. And guess who was left holding the bags..., the borrowers. The borrowers or buyers as we call them still owed, and were required to pay, the home loans without getting the houses, unless of course they had an owners title policy.

Ask your local closing attorney about simultaneous issue of an owners title policy for your buyer client. It shouldn't cost much more since the attorney gets a commssion from the lenders policy which can be as much as.. wait for it... 60%. Wow I wonder what our clients would say to that figure, hmmm?

The $8000 Tax Rebate Fact Sheet

Government Takes Control Over Banks With TARP

One more reason I don't trust the current crop of politicians. It seems there are some banks that want to return TARP money but the Government just ain't gonna have it. Few on the outside really understand just why but one reason could be that it's all about control. Think about it, many banks were coerced into taking TARP money and now that they have, they are subject to all sorts of crazy demands on how they conduct their business.

Personally I don't understand how a lender, in this case the federal government, can refuse repayment of a loan. It sounds like something a loan shark or a mobster might do to work you over for a little bit extra. Chicago politics? Aren't these guys supposed to be protecting the public? Instead it looks like they're running a protection racket.

Existing Home Sales Report 2008 - Fayetteville NC Real Estate

I know I should have posted this before now but hey I'm only human, right? The latest existing construction report for Fayetteville NC homes shows the market holding steady with about 3 percent appreciation. Aveverage days on market are slightly higher. The number of homes sold is down about 4 percent and sellers are getting about 97 percent of their asking price. For more detailed analysis including charts click here and view the complete report.

Fayetteville NC homes market reports are now being hosted at my stand alone blogsite. I say blogsite because right now I have about 24 static pages, not just blog posts, up with information on Fayetteville nc real estate as well as the Fayetteville NC area in general. Fayetteville NC Homes Sales and the Nation's on the Rise

Fayetteville NC homes got a boost in February as did the national market. Fayetteville's MLS showed an increase in units sold in February over January this year. The number still down from last February was seen as a good sign.

According to estimates released jointly today by the U.S. Census Bureau and the Department of Housing and Urban Development. New home sales were up for the month of February across the nation. AIG, Why Last Week Has me Worried

As a general rule I try to avoid politics on my web pages but after this last week I feel I need to speak up. I see some wrongdoing taking place and I see it very clearly. But unlike the perceived consensus I don't see AIG as the wicked players.

About a month or so ago we got a stimulus bill, loaded with special interest projects at a time when the country doesn't have the funding to pay for it. It's gonna cost us close to a trillion dollars, a million million or $1,000,000,000,000 or 12 zeroes. Can anyone really comprehend how much money that is? Before the Stimulus we had the bank bailout, another $700 billion. And the nation is outraged because AIG paid employees $165 million in bonuses. I'm sorry but that is far south of a drop in the bucket.

Now bear with me, I know $165 million is a significant amount of money. I'm not saying otherwise, but I am saying maybe we should keep it in perspective. Washington just wrote a check that we can't cover and our grandchildren will have to deal with.

Now if it were only that. What really worries me is this, Connecticut Senator Dodd at the alleged urging of the Tim Geithner wrote an amendment into the stimulus bill which made the bonuses legal and obligatory under current contracts. The members of congress and senators screaming the loudest all approved when they voted the bill into law over a month ago. Last week week to a man or woman as the case may be they were shocked. Claiming it as an outrage.

So which is it negligent ommisson or willfull ommission, a lie or incompetence, both very dangerous traits for our leaders to have.

Here are some of the facts as I understand them:

AIG almost went out of business and was bailed out with tax dollars
AIG and/or the recipients of these bonuses broke no laws.
AIG in fact was obligated by contract to pay the bonuses and subject to stiff penalties under Connecticut state law if they did not pay.
The bonuses leave a sour taste in my mouth and many Americans agree.
Washington, congress not only knew about this but voted it into law a month ago
Now that the public is aware Washington is outraged and shocked
The same Polititians that told AIG to pay the bonuses are now out to punish AIG and the recipients

Now we get to why I'm troubled, Congress is punishing a small group of people for following laws they voted for a month ago. Punish is the operative word but ruin is more like it. The ferver is so intense these recipients in some cases fear for their family's lives and our leaders who are culpable themselves are stoking the public's anger. How irresponsible is that. These are the people we depend on to keep us safe.

If the bonuses are so horrible and wicked why is aren't more people asking for explanations from our congressmen and senators for approving of them? Why do they get to claim no involvement when they so clearly were? Where are the question from the investigative reporters? Who thinks they are really safe from politicians who will turn on a dime and ruin people who broke no laws just to gain favor with the masses?

This reminds me of a closing I had about a year ago. The couple was divorcing, in bankruptcy and they were about to go into foreclosure. They contacted me and we met, a CMA showed that they had enough equity to sell and keep several thousand dollars. So we put the home on the market at a discount and listed it with a higher than average ccommission hoping for a fast sell. It worked, one week later we had a full priced contract and 30 days later the home was sold.

The sale was harder than usual to execute because of the bankruptcy but everyone pulled together and made it happen. I'll never forget at the closing table, the wife complained about having to pay the fee, one week earlier I was their savior. I had made thousands of dollars appear where the specter of foreclosure loomed but now I was a bad guy because I was getting paid. Thank god we had a contract and there weren't any politicians around.

A deal is a deal folks. What's gonna happen to business, real estate included, when contracts are subject to the winds of politics and whims of politicians?

Fayetteville NC real estate market reports - Lagrange

As a Fayetteville NC real estate agent I keep up with local market stats so I can properly advise my clients. Yesterday I recieved a request for a report on the Lagragne subdivision. If you are a regular reader or subscriber you already know that I post these reports often and if you want to see one on your area simply email me or post a comment below with your request.

Lagrange is a lower than average priced nieghborhood in the Fayetteville North Carolina real estate market. The homes were built from the mid 1960s through the 70s. The homes are mainly ranch style architecture typical of the era with a few split and tri-levels scattered about. Carports and garages are common. Brick and siding is the most popular exterior. the subdivision is just outside the Reilly gate to Ft Bragg North Carolina, making it popular with people who need easy access to post.

Lagrange's Statistics:

21 Homes sold in 2007 (45% annual reduction)

38 Homes sold in 2006

23 active for sale listings

2 pending sales

The average price in Lagrange not including foreclosure properties was $98,303 last year that's up from 2006's price of $91,104. Sellers are currently getting 95.88% of asking price, Fayetteville NC's market average on existing homes is just over 98%. the average ome in Lagrange was 1500 square feet and was on market 80 days before selling. There is currently 13 months worth of homes inventory in Lagrange, about twice Fayetteville's average.

Fayetteville NC real estate Market Report: End of year 2007

A new year is upon us again. I hope everyone had a wonderful Christmas and Happy New Year. As you probably realize by now I keep up with real estate sales trends and statistics in Fayetteville North Carolina. This keeps me and my associate agents on top of things to better serve our clients. This is a year end update of my series of reports click here to view them.

Wow, 2007 had more than its share of bad news with the mortgage meltdown and all that came with it. If you didn't follow the news that's ok in a nutshell lenders got a little careless and loaned money to people who now can't make the payments and as a result they are losing their homes. don't worry they won't go homeless, they'll probably rent somewhere, but the news reporters don't explain it that way. The lenders didn't get a free lunch though, foreclosures cost money and several have gone out of business. To make matters worse the politicians want to punish the lenders that survived to make an example. It will be interesting to see how the chips fall.

But how did we fare? The real estate market in Fayetteville NC has slowed but it has hardly crashed. On the contrary, it is chugging along at a more than respectable pace considering the "mortgage meltdown" in the news. As you'll see by these numbers Fayetteville is in very good shape.

Please note this only reflects existing construction homes. I'll break down new construction homes in a separate post.

Average Sale Price
The price of homes in the Fayetteville North Carolina market is up 5.86 percent year over year. That's good.

I know I sound like a broken record but news stories make it sound really bad. The news may even be true where they broadcast but in Fayetteville North Carolina homeowners still enjoy growing equity.

Time on market is up from a year ago. This is not so good but it's only up 7 days that's an increase of 2 days over my last market report in September so really it is not so bad either.

Days on Market is a lagging indicator, in other words it tells us what has happened. We use the absorption rate(AR) to help understand and predict how long it will take to sell a home under the current market condition.

As calculated AR indicates we have 5.84 months or 175 days of inventory on the Fayetteville NC homes market, about a month more in inventory than last year. Most homes are selling between 65 and 175 days.

Note that homes can and do sell faster than these numbers indicates. The two most important factors for a quick sale are correct pricing and maximized appeal

The number of homes sold in Fayettevilleis down 17% this year. There are simply fewer buyers looking for homes at the moment. This is due to the fact that mortgages are harder to qualify for so there are fewer buyers to purchase homes.

This chart shows that sellers are getting 97.5% of the price they ask for or buyers are getting very little markdown for homes in Fayetteville NC. The percentage is down but very slightly. Sellers are still getting nearly 98% of what the list for.

Buyers should expect to pay within 2% of the home's listed price to stay competitive in the Fayetteville North Carolina market.

Homeowners are still enjoying growing equity and buyers enjoy the larger inventory. Fayetteville North Carolina's real estate market is stable and balanced and there is very good reason to believe it will appreciate at a healthy pace for years to come.

Fayetteville NC real estate news, Hoke County recreation

A college study has identified, something local citizens of Reaford North Carolina already know. There is a need for recreation in Hoke County. So a recommendation has been made to build a multi-million dollar multi-use facility.

Commissioners would like the building on a seven-acre plot of land across from the main park which is under construction now. A 95-acre sports and recreation complex on NC 210 just outside Raeford, officials plan to open the park by spring. The park, being built on land purchased by the county it will have 4 baseball fields, a soccer field and a walking trail.

The park and proposed facility will be a welcome additon to the small town community of Raeford North Carolina and would undoubtedly enhance the charm and welcome feel to the area.

Fayetteville NC real estate news: Walmart Supercenter in Hoke Co.?

Instead of driving 10-15 minutes to Fayetteville to shop residents of Hoke County may soon have a more local solution. Monday night the Hoke County board of commissioners approved a permit for a 190,000-square-foot anchor and several satellite stores.

The identity of the store is not confirmed but based on artist renderings, it's a Walmart supercenter and the smaller retailer spaces that normal follow. Many officials are anxious to get a worthy retail presence in Hoke County considering the boost in sales tax revenue it would mean.

Commissioners passed the permit, and re-zoning of the land on US 401 across from East Hoke Middle School with a unanimous vote. There was very little opposition to the vote from the citizens. Construction may begin as early as next year.

Fayetteville NC real estate Market Reports: Middle Creek 11/29/07

My Fayetteville NC real estate team continuously monitors local real estate conditions to stay ahead of Fayetteville NC real estate trends. This is an up date of a previous post on Middle Creek click here to view it.

Middle Creek is a neighborhood located off Cliffdale Rd. Middle Creek is an active subdivision in an expanding part of the Fayetteville NC landscape. Cliffdale Rd has been recently widened and commercial developement is well underway. The homes, a mixture of ranch, trilevel and 2 story plans, were built in the late 70s through the 80s. Montibello and Beaver Run border Middle Creek and the lines between are blurry at best.

Homes sold Last year (total) 79 Avg sale price: $111,334

Homes sold 2006 through 29 Nov. 78 Avg sale price: $111,428

Homes sold 2007 through 29 Nov. 48 Avg sale price: $117,463

So Far this year sellers are getting 98.78% of listed price. Homes sold this year average 1557 square feet and sold after about 47 days on market.

I'm constantly watcing the Fayetteville NC real estate market to keep my team and clients up to date and ahead of Fayetteville NC real estate trends. This is an update of a market report on the Cottonade neighorhood I posted earlier this year.

The neighborhood of Cottonade is well established in the Fayetteville NC area. The homes sit on ample sized lots with mature trees. Most homes are brick and siding, ranch style houses with single car garages or carports. The subdivision is located near the Yadkin Rd gate to Fort Bragg. Cottonade was developed in the late 1960s but recently about 20 new homes were added to the neighborhood.

Homes sold Last year (total) 46 Avg sale price: $139,822

Homes sold 2006 through Nov 27. 44 Avg sale price: $140,495

Homes sold 2007 through Nov 27. 30 Avg sale price: $150,563

So far this year home sellers are getting 99.39% of listed price. The average home sold sold in Cottonande this year is 1940 square feet and sold after about 41 days on market.

Legion Hills is an entry level neighborhood in the Fayetteville NC homes market. Most homes in Legion Hills have a 1 or 2 car garage. The styling is loosely Cape Cod, traditional with high pitched roof lines, typical of homes built in the 90s and on. The homes of Legion Hills are situated between Legion Rd and Camden Rd.

As everyone knows Yesterday was Punkin' day and my wife and I took our 2 punkins to the Fayetteville NC downtown for trick or treat. My daughter Ana Cristina, 2 and a half, and my son Miguel, 4 months. Miguel is undecided but Ana Cristina had fun to the point of exhaustion. I got pictures to prove it!

Holly Day Fair This weekend at....,

Don't miss the Holly Day Fair in Fayetteville North Carolina at the Charlie Rose Agri-Expo Center, The Crown Expo Center ...., I think I said that right... Anyway, I've been to some of the past fairs and althought it ain't really a guy thing there is usually some neat stuff to be seen and even got. It's worth checking out, maybe I'll see you there.

"Holly Day Fair is the largest holiday gift and craft show in Eastern North Carolina. Holly Day Fair is a one-stop holiday shopping event that draws an average of 21,000 attendees and 201 vendors." And another ghostly bit of folklore about Fayetteville North Carolina

The ghost of a young bride named Charlotte haunts the Prince Charles Hotel in downtown Fayetteville. On her wedding day Charlotte, as the story goes, found her new husband in bed with a bridesmaid in the honeymoon suite on the seventh floor. Unable to deal with the shock and humiliation the young bride jumped to her death from an eighth floor window.

The spirit of Charlotte rides the elevator to the eighth floor around midnight. According to senior housekeepers the ghost will play tricks with the guest-room locks. The presence of what is believed to be the ghost of Charlotte has been sensed at various locations throughout the hotel.
