Here are some of the most frequently asked questions on the changes to the Homebuyer Tax Credit

Question: Existing homeowner credit: Must the new house cost more than the old house?

Answer: No. Thus, for example, individuals who move from a high cost area to a lower cost area who

meet all eligibility requirements will qualify for the $6500 credit.

Question: I am an existing homeowner. On October 25, 2009, I signed a contract to purchase a new home. I have lived in my current home for more than 5 consecutive years and am within the new income limits. I will go to settlement on November 20. If President Obama has signed the bill by the time I go to settlement, will I qualify for the new $6500 tax credit?

Answer: Yes. The existing homeowner credit goes into effect for purchases after the date of enactment

(when the bill is signed). There is no reference to the date of contract for the new credit. The

provision looks solely to the date of purchase, which is generally the date of settlement.

Question: I am a firsttime home buyer but was not within the prior income limits at the time I entered into my contract to purchase on October 30, 2009. I will be covered, however, by the new income limits. If the new rules have been signed into law by the time I go to settlement, will I be eligible for a credit?

Answer: Yes. The new income limitations go into effect as soon as the President has signed the bill.

The income limit and other eligibility rules will look to your status as of the date of purchase,

which is the settlement date. So if the new rules have been signed when you go to settlement,

you should be eligible for the credit (or a portion of the credit if you're within the phaseout

range).

Question: I am an eligible existing homeowner. I have a fair amount of equity in my home. I have found a home with a nonnegotiable price of $825,000. Will I be able to use any of the $6500 tax credit?

Answer: No. The $800,000 cap on the cost of the purchased home is firm at $800,000. Any amount

above $800,000 makes the home ineligible for any portion of the credit. The $800,000 is an

absolute ceiling.

Question: I owned my home for 10 years, but sold it two years ago year and have been renting since. If I purchase a home, will I be eligible for the $6500 tax credit if I meet all the other eligibility tests?

Answer: Yes. Because you lived in the home for more than 5 consecutive years of the previous 8, you

will qualify for the $6500 credit. For example, Say John and his wife bought a home in 2000

and lived there until 2008 when he got a divorce. Whether John has been renting or bought in

the interim, he WOULD INDEED be eligible for the credit because he owned a home and

occupied it as his principal residence for 5 consecutive years out of the last 8 years. The

keyword here is "consecutive." As long as he lived in that house for 5 years straight what he

did since 3 years doesn't impact eligibility.

Question: I am an eligible first time home buyer. I entered into a contract to purchase on November 1, 2009. Do I have to go to closing before December 1? How does the extension date affect me?

Answer: You do not have to close before December 1. Once the legislation has been signed, it will be as

if the Nov 30 date had never existed. Therefore, so long as the contract settles before April 30

(or July 1, worst case), the purchaser will be eligible for the credit.

Mortgage giant expects further losses and continued need for help

"Fannie Mae, the federally controlled mortgage finance giant, said Thursday it lost $19 billion in the third quarter and had submitted a request to the Treasury Department for $15 billion in more aid to stay afloat."

"District-based Fannie Mae and its McLean sibling, Freddie Mac, were seized in early September 2008 by the federal government. Since then, Fannie Mae has lost $111 billion. The $15 billion in aid it has requested comes on top of $45 billion it already received. Freddie Mac has received $51 billion in aid.

In total, the seizure of Fannie Mae and Freddie Mac has cost taxpayers $121 billion, among the costliest of the government's interventions to stabilize the financial markets.

Fannie Mae said its losses and its need for additional government aid are both likely to continue. And it said activities it was undertaking at the behest of the Treasury Department, such as modifying mortgages to help homeowners avoid foreclosure, were magnifying its losses.

Separately from its earnings announcement, Fannie Mae also unveiled a program to help homeowners facing foreclosure. Under the Deed for Lease Program, the homeowners would transfer ownership to the lender, but could stay in the home for a period of time by leasing the home and paying rent, which is often lower than a mortgage payment."

TAX CREDIT BEING EXPANDED TO BENEFIT CURRENT HOME OWNERS

Buying a home is about to get cheaper for a whole new crop of home buyers - $6,500 cheaper.

First time home buyers have been getting tax credits of up to $8,000 since January as part of the economic stimulus package enacted earlier this year. But with the program scheduled to expire at the end of November, the Senate voted Wednesday to extend and expand the tax credit to include many buyers who already own homes. The House is scheduled to vote on the bill today.

Buyers who have owned their current homes at least five years would be eligible for tax credits of up to $6,500. First time home buyers - or anyone who hasn't owned a home in the last three years - would still get up to $8,000. To qualify, buyers in both groups have to sign a purchase agreement by April 30, 2010, and close by June 30.

The credit is available for the purchase of principal homes costing $800,000 or less, meaning vacation homes are ineligible. The credit would be phased out for individuals with annual incomes above $125,000 and for joint filers with incomes above $225,000.

This is good news for first time home buyers that will unable to get to settlement by the current November 30, 2009 expiration date. By all comments, the pending extension will be the final extension.

Existing home owners that have owned for at least five years were not expecting an incentive to purchase another primary residence. Those that qualify now need to consider the $6,500 tax credit benefit and determine if the assistance will encourage a home purchase by April 30.

"Fannie Mae plans to allow homeowners facing foreclosure to stay in their homes and rent them for up to one year as part of the latest effort to help troubled borrowers while keeping a glut of foreclosed properties from hitting the housing market.

The Deed for Lease Program, which Fannie plans to roll out on Thursday, will offer borrowers who fail to complete or don't qualify for a loan modification or other workout to deed their property to the lender in exchange for a lease. Borrowers-turned-tenants will be able to sign leases of up to 12 months and will pay market rents, which in most cases are lower than the cost of mortgage payments."

"Fannie Mae wouldn't say how many homeowners it expects will take advantage of the program. The company acquired 57,000 properties through foreclosure during the first half of the year, bringing its total real-estate owned inventory to 63,000 properties valued at $6 billion. The rental program will allow Fannie to hold inventory off of already saturated housing markets and makes a bet that the housing market will be stronger one year from now.

"If you keep more people in their homes, it's better for the community. It's better for the financial institutions that own those homes," says Jay Ryan, vice president of equity investments at Fannie Mae. "Hopefully less foreclosure product on the market will help stabilize those communities."

Borrowers who haven't missed any mortgage payments aren't eligible for the program, and the borrower's mortgage servicer would have to show that a borrower isn't eligible for a loan modification before the homeowner could apply for the Deed for Lease program."

When searching for homes in Maryland, you will want to use Homes Prospector at www.roykelley.com This is a service of MRIS, the regional multiple listing service, and you will find the most accurate up to date information on properties that are available for purchase.

Most of the homes that are sold at trustee sale auctions at the court house entrance are purchased by the secured mortgage lenders. The lenders then offer the homes for sale when they become part of the REO inventory. All of the lender owned homes are listed with area agents and are available on MRIS.

Why are buyers focusing on the REO inventory? The simple reason is that is where the purchase bargains are being found. Lenders are highly motivated sellers and they reduce the prices until the properties are under contract. This is a very active market and well priced prices attract multiple contracts.

What about short sales? Are bargains to be found in the inventory of short sale listings? Yes, lenders have become more liberal with short sales. Short sales do take more time and more frustrations should be anticipated. Short sale transactions require third party approval. The secured lenders must approve the contracts since the proceeds will not fully cover the amounts of the mortgage loans.

WASHINGTON (Reuters) - "U.S. House of Representatives Majority Leader Steny Hoyer said on Tuesday he expected the lower chamber to back a Senate plan to extend and expand an $8,000 housing tax credit due to expire at the end of this month, which is aimed at jumpstarting the struggling housing market.

"I would prefer that they had not done the changes that they affected, but they did and I think that they'll be acceptable and I was pleased that April 30th is their date for eliminating this program," Hoyer told reporters on Capitol Hill."

"The Senate is considering extending popular housing amendment as part of a larger piece of legislation aimed at extending insurance benefits for jobless workers.

The House of Representatives, which have to approve the measure before sending it to President Barack Obama for his signature, is expected to take up the measure next week."

"Some House Democrats, including Hoyer, had expressed concern about the cost of expanding the $8,000 tax credit, which now applies only to first-time homebuyers and is set to expire at the end of this month.

Under the new language, homeowners who have lived in their home for five of the past eight years would be eligible to receive the $8,000 tax credit. That's intended to boost the so-called step-up home market.

The tax credit would run for homes under contract by the end of April, though buyers would have until the end of June to close on the purchase."

This has been a busy year for foreclosure sales. Home buyers are looking for bargain prices. Trustee sales are open to the public and all qualified bidders. These auctions are ordered by the secured mortgage lenders when borrowers default on their payment obligations. The indicated deposits must be in cash or certified funds. Most of the bidders use cashier's checks payable to themselves. Prospective bidders should carefully read the newspaper advertisements that appear for three weeks before the sales dates. If you do have experience and know the risks, seek professional advice before placing any bids at these auctions. Always check for cancellations since bankruptcy filings or reinstatements may stop sales. Normally, these properties are not offered for inspection. Purchasers that plan to use mortgage financing should obtain a pre-approval letter from their mortgage lender. The lender needs to know that the property is being purchased in "as-is"condition and repairs may be required. Appraisers may not be able to access the interiors.

Five Reasons the U.S. Doesn't Need More Home-Buyer Perks

"Congress is working on a new and even more generous set of perks for house buyers. A tentative deal in the U.S. Senate would extend the closing deadline for an $8,000 subsidy for first-time buyers to July 1 from Nov. 30. It would also boost the program's income limits for singles to $125,000 from $75,000 and for couples to $250,000 from $150,000, and would offer a new $6,500 reward for existing homeowners who buy again. (More on the home buyer tax credit.)"

"The National Association of Realtors has called such an extension "essential." The Mortgage Bankers Association agrees. The National Association of Home Builders says, "Failure to act now could derail the fragile housing recovery even before it has time to take root."

I respectfully disagree for perhaps a dozen reasons. Let me offer five.

Subsidies raise prices, and house prices are already too high.
The house subsidy has little value as economic stimulus.
The benefits of stimulus spending are unproven.
America has no money.

We already spend plenty on housing stimulus.

We already have programs that draw funds from all taxpayers and divert them to house buyers. The mortgage interest deduction does just that, only its benefits are reserved for those who borrow to buy houses, and for those whose incomes are high enough to make hunting for deductions come tax time more worthwhile than claiming the standard deduction. The interest deduction is what's called a tax expenditure. It will cost just over $100 billion this year, or about $850 per taxpaying household. Not enough? There's more. Interest rates are kept low at the moment by aggressive buying of mortgage securities by the Federal Reserve. We can't say for sure how much that will cost. It depends on how many of the underlying borrowers make good on their payments, which depends in part on how much of their own money they put into the deal to begin with."
