As an attorney I often consult with homeowners that are in distress along with the Realtors that represent them in trying to accomplish a short sale. Often a detailed explanation of the foreclosure process would be very worth while for my client to have a thorough understanding of what they may be facing as the lender seeks to enforce the promissory note and mortgage. Actual question from a Realtor in Miami, Florida: I am trying to figure out for my clients who are still in the home and have actually had a foreclosure judgment awarded against their property while working on a short sale. At that point, they don't know if they should just give up as the "Foreclosure" has been awarded against them and not even pursue the short sale any longer, OR is there is hope that if they have the short sale approved that they are then "damaged less" than if they allow the auction sale to take place. I have seen so many Land Trust Agreements and Declarations of Trust as a precursor to a Short Sale that I just have to write about it - again! Previously I had written about property flips in SHORT SALE FLIP - QUESTIONABLE METHODS, but I want to touch on the latest "foolproof" craze - Land Trusts. Here is how it works: First you need the distressed homeowner. The Florida Association of Realtors took the lead in making some semblance of consistency, order, and standardized forms for use by Realtors for Short Sale transactions. I doubt many Sellers or brokers realize the draconian conditions of the documents they are using. If you are among them, this article may open your eyes. Because the evolution of Short Sales in 2007 and 2008 has been so dramatic, the forms became problematic at the outset. My belief, which is shared by many informed attorneys, is that that they need dramatic changes to better represent the rights and obligations of the Seller. For those (18 comments)
