Miami activist Jack Thompson is trying to spearheading a movement to amend the Florida Constitution so that the Florida Supreme Court and the Florida Bar are stripped of their corrupt self-regulation of their profession. If you are a Florida Resident, please contact him to sign this very important petition! He is hoping to get it on the 2010 ballot. He is asking that lawyers be regulated by the Florida Department of Professional and Business Regulation - the agency that regulates ALL other professions (including Realtors, Notaries, Brokers, etc.) and trades in Florida EXCEPT lawyers at this time. And their self-regulation is clearly not working and needs to be done by an independent agency!

Fight Foreclosure and WIN!

There are so many foreclosures being filed these days, we all hear the stories about it, but did you know most banks are NOT following the law regarding required paperwork to substantiate the filings! And note, I did not say some, or many, I said MOST banks do not file proper paperwork, because hardly anyone stands up to them. THEY must PROVE their case prior to your eviction, yet do your research on the Internet, it is estimated that at least 80%, and most seem to feel it is even well over 90% of the banks do not file the proper paperwork, but because most people walk away and abandon their home, the bank gets the property without having to prove their case.

If you are a homeowner and are being sued by a bank you never heard of, look in your county court records to see if the mortgage and promissory note were recorded and transferred into their name from your previous lender. That is a requirement in Florida, and probably most states! That promissory note is REQUIRED but usually not presented, and the banks just ask the court to create another one to replace it, which is improper, but again, with nobody fighting back against the banks, the judges just grant it anyway. Look into the OH cases, especially Federal Judges Boyko& Rose (Rose is a Federal Appellate Court Judge), as well as many documented cases in FL as well, and look into the Legal Aid Attorney in Jacksonville, FL. All are standing up and saying, "NO!" This must be done correctly and not be a foreclosure mill process without proper documentation and due legal process! Again, if you are being sued by a bank you never heard about, get in touch with me and I will gladly send you all the information I can provide to you to help you in your situation and fight improper case filings. This information is NOT intended to be a deed-in-lieu, or short-sale, or other 'work-out' type options. This information, if done properly, promptly, and researched for your situation, will at least buy you additional time to search your options of staying or moving from the home. But it also has the potential if done correctly and again, promptly, it has the potential to have the mortgages REMOVED from your property giving you full title to the home. Do not ignore the proceedings, or be embarrassed, stand up for your rights, and force the attorneys that are filing these fraudulent cases to be held accountable for their actions!

Has GREED gone to far in America?

About a week ago, I stumbled across some information. That started me thinking (could everyone from CA see the smoke from FL?) and got my curiosity up. And to all those that know me, when I'm curious, I ask everyone here on AR, and I do a bit of research as well.

Here goes - topic: FORECLOSURE

Do you know why the Mortgage Note is so very important to the banks? I didn't, but I do now, but what are your thoughts about their importance? Do you know about the importance of recording the assignment of the note to other banks that purchase that note? This is when Bank A sells the note to Bank B, then to Bank C, etc. Which doing that is common practice, and certainly accepted and legal. But it must be documented! Then when it is with Bank F, suddenly, for what ever your reason (lose job, bad market, economy, hurt on job, whatever the case) you stop making your mortgage payment. And Bank F starts foreclosure because of your lack of payments. OK, seems pretty fair so far, correct? I knew I saw several articles here on AR about the importance of fighting a foreclosure, and the need for the bank to produce the note. That is a big way homeowners are fighting the banks - and successfully fighting a lot of them! Do you see where I am heading with this yet? Let me tell you some information I have found out about some cases, while I am in FL, the second worst state for foreclosures, a lot of my information actually lead me to OH!

1st) Six years ago, a man stopped making payments on his $1.5 million home. Pretty interesting, six years and no mortgage payment, and he has been served foreclosure papers by two different banks! Even more interesting I thought! In both cases, the man said, "produce the mortgage note" to prove I owe you the money for the home. They could not. In one of the articles I read about this case, there was commentary from an angry reader, stating this man is stealing from the banks, not sure who, or which bank, but he was stealing, and the man is a scumbag (his words by the way). OK, at first, (this was early in my research) I thought, yes, he is right, the man is stealing from the banks! I continued with my research. Think about that yourself for a little bit. 2nd) I then saw a Federal District Court Judge in OH who threw out a bunch of foreclosures that were brought to him (17 out of 18 if my memory serves me correctly). But that is an interesting case as well, actually cases to be correct. The judge originally threw out the foreclosures, without prejudice, which to all us non-lawyers means, they needed to fix the paperwork (which was FIND the lost mortgage note) and then they could re-file the foreclosure proceedings. Simple enough, wouldn't you think? The banks reply was amazing. While I am using my own words here, but what it amounted to was this - honestly judge, we own the note, trust us, and believe our word, we own the note, these people are behind in their payments, so just get on with the foreclosure proceedings. Can you imagine being that condescending to a Federal District Judge. WOW! Needless to say, that judge was NOT a happy camper and threw out the cases that they could not document - and he wrote a scathing response to their paperwork that was filed, as I'm sure you can imagine! 3rd) A man was fighting foreclosure for eleven years in OH, and was recently kicked out of the home, but is fighting back still, citing the US district Judges ruling.

Now back to my first case. Did you notice a couple things. First, more than one bank has sued him in foreclosure! How can more than one bank own the note? Getting back to the commenter who called the guy a thief and scumbag. If I owe your neighbor money, lets say $1,000, and I stop making payments to your neighbor. Certainly your neighbor has a case against me, but how or WHY in the world would YOU have a case against me for me not paying your neighbor? When the bank cannot produce the note, OR show proper chain of the note and who is owed the money, even THEY do not know who the money is owed to! So after thinking about that some more, I now disagree with the commenter, the guy is asking who he owes the money to, and they can't even tell him. Sloppy and pathetic I would say. These are multi-million dollar corporations, and they can't even keep their paperwork straight about who owes them money?!?! I know who owes me money, and I keep track of it! Why do these banks think that is acceptable? They took these shortcuts for one reason only - cut corners and SAVE MONEY!

GREED.

So back to my original question, "has GREED gone to far in America?" Your thoughts?

Sever home damaged - WHY hire your own Public Adjuster

Over the past couple of months, on several blog posts about the coming hurricane storms, I've made repeated comments and also wrote a blog entry [SEE BLOG] about how important it was to hire your own public adjuster. BUT, in a conversation last night with an AR member, I realized, I never explained the WHY it was so important. As a victim of Hurricane Charlie [SEE BLOG], I will explain in layman's terms, since I am certainly no expert in this insurance system and how it works, but from the public viewpoint from me to you I learned the hard way why it was so important. Here is a simplistic scenario, but it will give you the explanation of WHY it is so important.

Insurance adjuster comes out to inspect your home. S/He has their little notebook out writing all details, talking to you while looking over the home. Taking pictures, measuring. Then they are done. In THEIR notes and paperwork, they determine you have $100,000 in damages....BUT Mr/Mrs Jones, according to my figures, I have determined you have $35,000 damages, and if your contractor needs any additional money, call me at 555-1234. You look, you have NO IDEA, your not a contractor, and you do not know how much it will cost to rebuild. Plus you don't know all the loopholes in your policy and additional damages that you can claim and get reimbursed for, so you say good, and take the money. Your contractor comes out and say, this will be $55,000 to fix. OK, so dial Mr/Ms Insurance Adjuster, and tell them, hey, I need $20,000 more money to rebuild. OK Mr/Ms Insurance Adjuster says no problem, and send you a check for the additional money. A couple weeks later, your builder informs you they have encountered a few more problems, so it will be $5,000 more, so you call up Mr/Ms Insurance Adjuster again, upset, but you need a little more money. They say no problem again, and send you a check for the additional request. Now you realize some more furniture is damaged that you didn't see before - but rest well assured the insurance adjuster saw it!!! You say it will be $5,000 to replace some of the damaged furniture. Again, call Mr/Ms Insurance Adjuster again, saying you need more money, again, no problem. So here is the recap:

$35,000 original payout
$20,000 in builder additional charges
$ 5,000 in additional damages discovered by the builder
$ 5,000 you see in additional furniture damages
$65,000 now paid out on your claim that they saw $100,000 in damages.

You walk away thinking your back in your home and done. Whew. BUT, this is where I got DISGUSTED!!! Did you know......the Insurance Adjuster gets a cut of the amount of money SAVED from damages to payout. THAT is why it is so important to hire your own adjuster, as they will say NO right in the beginning and say, I have totaled my worksheet and have $100,000 right from the beginning. And because that is the damages that you have, they must payout that amount. While hiring your own adjuster will take 10-15% usually, you then have more money to completely rebuild and replace everything damaged at least as good as what you had.

SO PLEASE, if you or someone you know has damages from any event (fire, tornado, hurricane, anything) HIRE YOUR OWN PUBLIC ADJUSTER!!

Rescind Your Mortgage Loan and Save Your Home From Foreclosure!

The current mortgage crisis has brought about increased awareness of mortgage loans fraught with errors that could allow homeowners to completely rescind their mortgage loan, including those homeowners facing foreclosure.

Violations of the Truth in Lending Act (Regulation Z) have proven to be very effective defenses for homeowners currently facing the prospect of a mortgage loan foreclosure, literally stopped the foreclosure action from continuing forward, once the findings of violations of either HOEPA or Truth in Lending have been found.

Improper calculations of finance charges directly related to the Truth in Lending statement of (TIL) have been found in over 80% of mortgage loans originated by banks and mortgage lenders over the last 5 years, creating huge liability for banks and mortgage lenders to refund ALL of the finance charges and other loan costs associated with the mortgage loan. In addition, the mortgage loan itself could be completely rescinded, leaving a ZERO mortgage balance owed by the homeowner!

However, it does not end there. Violations of both Regulation Z (Truth in Lending) could yield additional penalties to the bank or mortgage lender, including:

*Requiring the bank or mortgage lender to refund ALL sums paid over the life of the mortgage loan

*Reimbursement of all court costs and legal fees

*Triple damages may be awarded to the homeowner if litigated in court.

The violations of Truth in Lending are quite severe, as many of our nation's top banks and mortgage-lending companies are finding. For the tens of thousands of homeowners who fell victim to Predatory Lending by unscrupulous mortgage brokers and loan officers, this news could not have come at a better time.

For a mortgage loan to be considered rescindable under Federal law, a borrower must demonstrate:

*The mortgage loan was secured by a principal dwelling of the person for whom the credit was extended.

*The loan was not used to purchase an existing home or construct a new home.

*The mortgage loan was a refinance of a previous loan either: 1) held by a different mortgage lender than the original lender, or 2) the borrower refinanced with the original lender and took cash out of the subject property.

*The loan was closed less than three (3) years ago.

*AND on e of the following applies:

-The loan is currently in foreclosure and any mortgage broker fee was not included in the finance charge

-The loan is currently in foreclosure and the finance charge was understated by more than $35

-A material disclosure was not provided to the borrower, including the disclosure of the correct:

                *APR (Annual Percentage Rate)

               *Finance Charge

               *Total of Payments

               *Payment Schedule

               *Existence of a variable rate feature, if applicable.

               *Information with respect to the notice of Right to Rescind.



-The loan is not in foreclosure AND the finance charge exceeds .50% of the mortgage loan amount or $100, whichever is greater.

Homeowners interested in having their mortgage loan documents reviewed for Truth in Lending errors should contact an experienced and qualified Mortgage Loan Auditor to see if your mortgage loan has violations of the Truth in Lending law. After that, you should contact a qualified Consumer Law attorney experienced in dealing with Federal lending laws.

Notaries and the County Clerk of The Court Office - DECLARATION OF DOMICILE

This is part of my continuing education to the residents of Charlotte County about the office of the Clerk of the Circuit Court. While the position as a Notary Public, in the State of Florida, is an appointed position under the Governor of the Great State of Florida, and mainly supervised by the Secretary of State, we work closely in many ways with the County Clerks of the Circuit Courts. This includes the mortgage signings many of us do, marriages, and other various documents which are recorded by the Clerk's Office. So I though it would be a great idea to educate you on some of their many functions. I will only address my local Charlotte County Clerk's office, but many clerks offices throughout Florida, and even the country should have a lot of similar functions. Obviously since laws will vary from county to county as well as state to state, they will not all be entirely the same, but it is a very interesting office with a lot of great services that many people do not realize!

DID YOU KNOW...

The purpose of the Declaration of Domicile is to establish residency. Once the declaration of domicile is filed, it is good throughout the entire state of Florida.

Husband and wife may complete onr form. If only one spouse is present at the time, he or she may complete the form on behalf of the other spouse.

A Declaration of Domicile is inclusive of all children residing within the home. However, when a child becomes eighteen (18) years of age, he or she must complete a form on his or her own.

A Declaration of Domicile must contain the following information:

The City, state and street number of your previous residence prior to moving to the State of Florida
State under oath that you are changing your domicile and becoming a bona fide resident of Florida, along with the date in which you moved to Florida on a permanent basis
The street and city in Charlotte County where you are presently residing
You muct state that you intend to make Florida your permenant residence.

No other proof is necessary. The Declaration of Domicile is signed under oath at which time you are stating that all of the above information is true and correct, in the presence of a deputy clerk.

The Clerk's office will record the Declaration of Domicile for a fee of $10.00. A receipt with the recorded information on it will be issued. We will return the original to you after we have processed it.

You may obtain a Declaration of Domicile from the Clerk of the Circuit Court.

Week in review for Anything Southwest Florida Area - Active Rain group 09/07/08 to 09/13/08

First, as always, I wanted to thank all four new members that have joined this group in the past week - all real estate agents. To date, we have 55 members, including 35 Real Estate Agents, 4 Notaries as well as Real Estate Brokerages, 3 Commercial Real Estate Agents, 2 Property Managers, and one of: Loan Officer; Home Stager; Virtual Assistant; Mortgage Broker; Financial Planner; Insurance Broker, and one Other. From this, you can see we have a wide range of services. While there undoubtedly is some overlap in services, each one of us has our own strengths, and can hopefully show them with your posts here in this group. And if you need help from any one here in the group, please don't hesitate to ask and get to know each other! I'll repeat again, what Sean said a couple weeks ago, WE can all make this the greatest group here on Active Rain!

Also, while this group is growing, I would like to establish at least one (but I would prefer two) additional moderator(s) so we can make sure this groups stays on track, as well as help grow the group. This should be an easy one to moderate, and NO EXPERIENCE is necessary! But any and all help would be appreciated, and of course, you will get additional exposure to this group, and the Active Rain community as well!

Notaries and the County Clerk of The Court Office - PUBLIC TRUSTEE

While the position as a Notary Public, in the State of Florida, is an appointed position under the Governor of the Great State of Florida, and mainly supervised by the Secretary of State, we work closely in many ways with the County Clerks of the Circuit Courts. This includes the mortgage signings many of us do, marriages, and other various documents which are recorded by the Clerk's Office. So I though it would be a great idea to educate you on some of their many functions. I will only address my local Charlotte County Clerk's office, but many clerks offices throughout Florida, and even the country should have a lot of similar functions. Obviously since laws will vary from county to county as well as state to state, they will not all be the same, but it is a very interesting office with a lot of great services that many people do not realize!

DID YOU KNOW...

The Clerk of the Circuit Court is a public trustee, and had their position established by the Florida Constitution in 1838.

Why a Public Trustee?

The concept of checks and balances is one of the major political doctrines, which form the very foundation of the American system of government.

Provisions of the Florida Constitutions, which have governed the people for over 150 years, established the Clerk of the Circuit Court as an elected public trustee and set in place at the county level a system of "checks and balances" which has been proven to serve the public well.

The Role as Public Trustee is Evidenced as Follows:

County Government

- - Accountant and auditor for the Board of County Commissioners.
  - Collector and distributor of statutory assessments.
  - Guardian of the public records, public funds, and public property.

Courts

- - Ensures that the court's orders, judgments or directives are carried out within the parameters allowed by law.
  - Maintains the court's records.
  - Collects and disburses the court fines, fees and assessments.
  - Collects and disburses court ordered child support and alimony payments.

State Government

- - Collects and disburses documentary stamps and intangible taxes for the Department of Revenue.
  - Collects and disburses numerous fees and assessments for the benefit of State Trust Funds.
  - Provides informational, financial and statistical data to the State Legislature, Supreme Court, Florida Department of Law Enforcement, Auditor General, Department of Health and Rehabilitative Services, and other State agencies.

Citizens' Protection

- - As custodian of County funds, the Clerk ensures that the taxpayer's money is managed according to law.
  - Provides internal audits of county government.
  - Provides access to public records.
  - Audits reports of guardians in guardianship cases.
  - Provides assistance to citizens in accessing the courts.
  - Processes and maintains court documents to ensure that litigant's court cases are handled in a timely manner.

Accountability as a Public Trustee

The office of the Clerk is a complex organization that performs a wide range of record keeping, information management and financial management in the judicial system and county government.

In a 1985 study conducted by the Joint Select Committee on Judicial Personnel of the Legislature, it was calculated that the Clerk's office performs 926 different constitutional and statutory functions or duties. Current calculations reflect an increase to approximately 1,000 functions.

With the magnitude of the impact the Clerk's duties have on the peoples' rights and property, it is essential that the Clerk be accountable for his/her actions.

Thus, the constitution and statutes decree that the Clerk be governed by statutory authority in carrying out the duties and functions of the office.

As auditor and custodian of all county funds, the Clerk be subject to State Auditor General rules and regulations. The Clerk be subject to annual audits by an independent audit firm.

Most Important...

Accountability is further derived by the Clerk's duties and actions being constantly subjected to public evaluation and scrutiny through the election process every four (4) years.

THE CONSTITUTION OF THE STATE OF FLORIDA

"A public office is a public trust. The people have the right to secure and sustain that trust." Article I, Section 8 "There shall be in each county a Clerk of the Circuit Court who shall be selected pursuant to the provisions of Article VIII, Section I." Article V, Section 16

"The Clerk of the Circuit Court shall be Ex-Officio Clerk of the Board of County Commissioners, Auditor, Recorder and Custodian of all County funds." Article VIII, Section I(d)

Charlotte County Airport to get Commerical Airline Services again!

The Charlotte Harbor & the Gulf Islands Visitors Bureau announced last week that a new commercial airline, Direct Air, which is based in Myrtle Beach, SC, will begin a new schedule with service the the Port Charlotte area at the Charlotte County Airport (Punta Gorda Airport) (PGA). This service will begin on Saturday November 22, 2008, just before the winter season as well as the Christmas travel season. Of course, this is the busiest time for home and land purchases in the area as well! Service will be from Punta Gorda to Worchester, MA; Niagara Falls, NY; Plattsburgh, NY; and Myrtle Beach, SC.

Their planes will be leased from and staffed by Virgin America and will be Airbus A319 and A320 planes. The A319 has 8 first-class and 111 coach-class seats, and the A320 has 8 first-class and 141 coach-class leather seating. The service also offers plasma TV, touch service screens, satellite radio and telephone, as well as computer connectivity aboard each flight.

The Charlotte County Airport is a 16,000 square-foot $5.5 million terminal building rebuilt after Hurricane Charlie in 2004 and is is less than 15 minutes from most of port Charlotte and Punta Gorda. It is also close to many newly rebuilt hotels and meeting facilities (also rebuilt after Hurricane Charlie came through in 2004) with many amenities that are open or will be opening by November 2008 to Spring 2009.

Columbus, OH
Newark, NJ
Niagara Falls, NY
Pittsburgh, PA

I know this will be a tremendous boost to the economy as well as the area in general to have regular commercial airline flights into the county airport.

Notaries: To Complete Or Instructions Not To Complete

Today, I went to an assignment in Sarasota, Florida from a lady visiting from IL. With her, she brought paperwork that basically amounted to a sale of her property (although not quite - but that is an unimportant detail for this blog) and in addition to a lot of the typical sale/purchase paperwork, included a deed. A very specific deed, and again the exact type is irrelevant for this discussion. Included were instructions to her, as well as instructions to the notary in how they wanted the paperwork done.

One of the very first things I noticed was in bold lettering "do not complete date in body of deed." I explained to her that in FL, I MUST complete this, as nothing could be altered or changed after my notarization seal and signature were affixed. But she saw no problem anyway, as it did not appear to be in the 'body' of the deed. (see below description) There was also a place for me to Acknowledge with the date acknowledged before me etc., in the notarial wording section. But just to check on the instructions, she called the company that generated the documents. To give you an idea the 3 page DEED document looked like this:

Notarial wording, location, etc. and date for my notarization as well.

The person CLEARLY stated this section above her signature was what they were referencing, and it was NOT to be filled in. I explained to him, according to FL law, I MUST complete it or I could not complete the notarization, as it would not be valid. Now understand one VERY IMPORTANT THING HERE - This may NOT be required in ALL states, but it IS required in FL. I also called one of my help lines to get the exact statute number of the law, and while on the phone with them asked if it was also required in IL, where this document was generated, and I was told it IS required there as well. This is why it is so important notaries out there to KNOW and FOLLOW your state guidelines as I have no doubt many even in this gentleman's home state of IL, that many follow their instructions, BUT that can invalidate the notarization, and then you can have a tremendous court battle at that time. Honestly, the woman stated, "if that is your law and you must do that, then that is fine with me." But some are not so understanding, and would insist you not following your state laws. However, it is IMPERATIVE that you KNOW and DO follow your state laws, as that can lead to troubles down the road, no matter what instructions you are given, your state laws supersede instructions from title/escrow/attorney, etc.

I am not sure what they are going to do when they get the paperwork, but I know my notarization will stand up to any court challenge, as I followed state law. I have no doubt they might alter it, or re-execute another deed, but that is not my concern as I obeyed all my state laws. If they don't follow laws, they run the risk, whatever risk that may be. I also made this woman aware IL state law has the same requirement about a completed document when notarized. I can't worry about what they do afterwards, but I did note my journal what happened, and if there ever is a court challenge, and it is the same document and it has been altered, someone else will face court sanctions, not me!

Week in review for Anything Southwest Florida Area - Active Rain group

First, as always, I wanted to thank all the new members that have joined this group in the last couple of weeks! Like Sean said a couple weeks ago, WE can all make this a great group, and certainly one of the best in all of Active Rain! I continue to look forward to seeing each and every one of you post blogs here, and getting to know each of you and what you have to offer! Maybe we can meet in person in my many travels! As I have said before, while many of us might do the 'same thing,' we still all have our strengths and differences and can all bring a lot 'to the table' to offer each other and the public at large!

Also, while this group is growing, I would like to establish at least one (but two would be preferable) additional moderator(s) so we can make sure this groups stays on track. Some Pros & Cons about Reverse Mortgages

Are you considering a reverse mortgage to get some much needed cash in these trying economic time? If yes, you need to make sure you are fully aware of all the reverse mortgage pros and cons. Although many that get a reverse mortgage, are getting it to help get through some tough financial times, it can be used by people with many different incomes or assets! But it is important to know exactly what you will be getting when you apply for a reverse mortgage.

Because so much publicity seems to be negative on reverse mortgages (usually because of a lack of correct information) let me start with the negatives:

Although many feel the reverse mortgage closings costs are a lot more than regular mortgages, I actually did a study which showed the costs (not including the required HUD Mortgage Insurance) were 4.0% to 4.3%. So they were close, although the mortgages insurance does add 2%, but that also protects you, the lender, and your heirs from ever owing more than the house is worth. Another point about this though, IF, and that is an important if, you keep the reverse mortgage for a longer period of time, at least 10-15 years or more, the APR (bottom line cost to you) is around 5-7% which is right in line, and even better than a lot of regular mortgages!

A reverse mortgage will probably reduce the amount of equity in your home that you will leave to your heirs. Your heirs will be responsible for paying off the balance of the reverse mortgage when you die - and that can be done with their own mortgage if they want to keep the home, or put the house up for sale. You must keep the property taxes, homeowners insurance and if it applies any Homeowners Association or Condominium Fees paid and current. You must also keep the home in good condition. If you fail to make the required taxes, insurance, or fees current, the lender can require that the reverse mortgage balance be paid or foreclose on the property. While this is extremely rare, it can happen.

A reverse mortgage might impact your ability to receive Medicaid and Social Security, although this is rare. You must receive independent reverse mortgage counseling before you can be approved for the reverse mortgage. But this is an excellent safeguard!

On the positive sides of a reverse mortgage:

A reverse mortgage will provide you with a tax free source of income or line of credit for the rest of your life. You can choose how you want to receive your money - lump sum, monthly payment (fixed number of years OR the rest of your life!) or a line of credit. A reverse mortgage is designed to keep you in your home the rest of your life.

Another great thing about a reverse mortgage, is that you will never owe more than the value of your home when it comes time for repayment. You can have a mortgage currently on the home, or be free and clear of all mortgages, and still qualify for the reverse mortgage (providing you have enough equity). Your credit score and income are not used in the approval process for the reverse mortgage. (Although they will do a credit check to look for liens or judgments) Your age, and home value and mortgages if any, are taken into consideration for approval. You never have to make a monthly payment on a reverse mortgage. This repayment becomes due only upon your death (or both of you if married), if you sell, or move from your home. The amount of money you receive will not impact your social security or Medicare eligibility.

The more you know about all the correct reverse mortgage facts, the less likely anyone will try to take advantage of you. So there you have the reverse mortgage pros and cons. Read over them carefully before you make your decision. A reverse mortgage is a big decision, and may even seem 'too good to be true' but they are regulated by FHA and HUD, so there is many restrictions in place to make sure you get the best loan possible for your situation. A reverse mortgage literally can be a lifesaver if you are having financial difficulties later in life. But it can also help you enjoy your retirement years with vacations, or just peace of mind knowing you have a secure roof over year head, and a little more money available to use if needed!

Contest Anyone? UPDATED with Contest Framework

Patricia has offered to try and put out a post every week (I think weekly, correct Pat?) highlighting posts from within the group. This should help spur more posts - although this has been doing well with over 1200 posts in just over three weeks, it could spur even more!

Patricia has an idea about starting a contest (if members and posts to A2AR of course) to attract new members. While our group has been growing in double digits every day, this could increase it even more. What are your thoughts everyone? Like the idea? Is so what type of contest??

Below is my draft - PLEASE edit it - add or delete other things you think should be in here and I'll submit it to ActiveRain for approval

DRAFT FRAMEWORK FOR CONTEST

From now to the end of the year, have a weekly contest. And then an overall contest winner for the entire contest time. A weekly review will be done by Pat of all the wild, crazy, humorous, ways in which we are all Addicted to ActiveRain. The stories can include video, but they should not have a preference over none-video. The entries submitted MUST be submitted to the A2AR group, which would force the member to be a part of the group

Patricia can do the "top 10" or "top 15" or "top 20" (do we think we can guesstimate how many entries we might have each week???) review of all the posts. Then a panel of 5 judges can pick the 'top 3' for points on:

JUDGING POINTS ONLY -
1. 10 points creativity
2. 10 points content
3. 10 points ingenuity
4. 10 points how humorous
5. 10 points popular (unique comments)
6. and ??????????? Any other categories you can think of!!!!

The first weeks contest, ask two (2) AR or Addicted to Active Rain members NOT wanting to have any entries judged to be two of the judges, and the remaining 3 judges from our moderator group.

The following weeks ask in the order of 1st/2nd/3rd/etc place for the two additional judges. So this will be a changing group each week. If we cannot get two willing additional judges, go to previous weeks winners again asking from highest to lowest. If they intend to submit additional entries for the week, they may not want to be a judge. And fall back option to go back to up to 2 AR employees again for additional judge positions.

Weekly winner will get: (Are these too high or too low????)

1. 200 points - 1st Place
2. 100 points - 2nd Place
3. 50 points - 3rd Place
4. Should we have 25 for 4th place??????

Overall contest winner will get: (Are these too high or too low????)

1. 1500 additional bonus points - 1st Place
2. 750 additional bonus points - 2nd Place
3. 250 additional bonus points - 3rd Place
4. ** 100 additional bonus points - 4th Place (IF WE AWARD 4th & 5th Place)
5. ** 50 additional bonus points - 5th Place (IF WE AWARD 4th & 5th Place)

I have two thoughts on an overall winner

1. OPTION ONE
  - An entire new review of all the top 3 from each week. Overall winner will be judged from 3 of our moderators, 1 AR employee, 3 other Addicted to ActiveRain members (MUST be in Addicted To Active Rain Group of course) - and I am thinking it would be pulled first from Pat's Weekly Review - IE: people that were in the top 10/15/20 - BUT not part of the weekly winning top 3.
2. OPTION TWO
  - Just do a summation of weekly winning points (of the content/ingenuity/etc) and if there is a clear winner from that, for top 3 or 5 positions, and bring in additional judges if necessary to break a tie.

First, I hope all is well with everyone reading this post, and if anything detrimental is happening in your life, I wish you only the best for a quick turn-around. That statement was for one of our bloggers that I am quite sure is going through a tremendously difficult time in his life right now, but there can obviously be others in similar situations, Keith Elliott Jr -"Prince William County Real Estate Expert" - RE/MAX Olympic Realty (Manassas, VA) and check out his blog Coping with tragedy - On valuing life, love, and those who are important to you and you will certainly understand my concern for him and his family!

On a much lighter, and much more enjoyable note from my perspective, just a few minutes ago, my group, Addicted to Active Rain that was founded Aug 13, 2008, but really didn't start growing until August 18, 2008, just passed 500 members with over 750 posts! The is a testimony to the group, as well as Active Rain and it's power. The 500'th member was Gayle Causey - Keller Williams Realty (Monroe, LA) but I also wanted to thank all the 500+ members for their posts and just joining in general. This was all accomplished in about three weeks! Hopefully we can all grow this group together, and help one another in our businesses!

I really appreciate you spreading the information about SHARE. I would like to correct something and that is that SHARE is not only for the needy or poor. SHARE is open to anyone who wants to participate. There are 2 common misconceptions about SHARE 1 is that the food is not first quality and the other is that if I buy SHARE I will taking food from someone who really needs it. Neither are true, SHARE purchases all of the food on the open market much the same way as local grocery stores do. On the second point the larger the volume the better bargaining power SHARE has on purchases and it lowers the freight cost. Since all of the overhead to run the SHARE operation comes from the sale of the food the higher the volume the better service SHARE can provide the each community it serves.
