Great article from a fellow Active Rainer!

Dear Mr./Ms. Big Wig in the Foreclosure Department,

I know you don't know me, I am a Realtor® in the very hyper local market where you have homes that you need to sell. For some reason you don't want to know me, I am not sure why that is. Looking on a map perhaps you think that Connecticut is just so small to get from one side to the other is about a 15 minute trip. Au contraire I have to say. Maybe you are related to someone on the other side of the state? Or 10 light years away? Or could it be that you just don't care?

Whatever the real situation is, you are wrong. Let me just tell you a few things.

Winter is coming. You know those people you paid for to winterize the home you now own and want to sell? Believe it or not, sometimes it doesn't get done, or doesn't get done properly. That can make for messy homes when the pipes unfreeze, you know what I mean?

Sometimes up here in the northwest corner of Connecticut we have storms that create problems like snow and ice on the side walk (you know, the entry to the house?) or the driveway. We just had a horrible windstorm blow through here and knock trees down. Wonder if the agent you hired to list the property is making the 2 hour trip to protect your interests. (I rather doubt it). I am wondering how you will respond when someone slips and falls on your property and hurts themselves. Or how you feel about people not bothering to show your house because they can't get in safely?

Connecticut, although small, is a multi MLS state. My area primarily lists on one MLS, yet the agent you hired is not a member. So guess where the listing is NOT? I'm just sayin... It's like a 007 house, if you know what I mean.

So Mr. Big Wig in the Foreclosure Department, you should smarten up. Get out and look for some local agents to handle your foreclosures, it will work out much better. We understand our local market, pricing issues, weather related issues, we can pop over and check on the house on a regular basis. We will probably work very hard to get your house sold, even though you might not be the easiest person to work with.

The general public is already not happy with you. It doesn't take an image consultant to figure out that you need to make/have/keep relationships with local Realtors®. (Although if you would feel better about paying for an image consultant, I know lots of Realtors® who would probably oblige.)

And one more thing, you should really require that your agents communicate with buyers agents. A notation in the MLS remarks that states we are not to call with questions is a bit.... well... ridiculous. Quit looking on the dark side of the moon for your agents! The day and age of the Scrooge mentality, of complete arrogance is gone. It really got you nowhere in the first place you know.

First Time Home Buyer Tax Credit Extension - 2010

B R E A K I N G N E W S ! ! !

Moments ago, the House voted 403-12 to expand and extend the Homebuyer Tax Credit (as part of the Unemployment Insurance Bill). The bill is now on its way to President Obama for his signature... so this is ALMOST a done deal!

The agreement on the extension and expansion of the credit is as follows:

Credit available for purchases before May 1, 2010. Prospective purchasers with binding contracts in place as of April 30, 2010 will be allowed an additional 60 days to complete the transaction.
Credit remains at $8,000 for first-time purchasers. No change to definition of first-time purchaser.
NEW $6,500 tax credit for REPEAT BUYERS who purchase between December 1, 2009 and May 1, 2010. Repeat buyers must have lived in their homes consecutively for 5 of the previous 8 years.
Income limits are expanded to $125,000 on a single return and $225,000 on a joint return. Current law $20,000 phase-out retained.

*New anti-fraud limitations will be imposed. Stay tuned for more details.

Flooding in Georgia is delaying real estate closings -- NEW LENDER REQUIREMENTS!

Governor Sonny Purdue has issued a State of Emergency due to the rain and flooding in Georgia for 17 counties. This will affect any closings you may have in the next 30 - 45 days.

Due to the flooding and water damages, lenders will be requiring final inspections on properties that are closing and had been appraised prior to the declaration. Most of the lenders will require either a final home inspection or a disaster report, as they will need to confirm that they have loans that are insurable and that the properties are still a viable asset. The additional lender requirements are already delaying closings across the city, regardless of the lender.

News Flash!! FHA is squeezed for money!

I found this to be very newsworthy information since many of AR members have been really focused on FHA and the First-Time Tax Credit. What a bumpy ride it's going to be. Tell me what you think! We are about to see a whole lot of lenders disappearing as a result of this. In fact, as of November 18th, FHA borrowers will no longer be able to finance their closing costs into their loans when they refinance, known as a "STREAMLINE REFINANCE" as one of the results of the current announcement. We all better wish for a recovery and fast.

The Federal Housing Administration has been hit so hard by the mortgage crisis that for the first time, the agency's cash reserves will drop below the minimum level set by Congress, FHA officials said.

The FHA guaranteed about a quarter of all U.S. home loans made this year, and the reserves are meant as a financial cushion to ensure that the agency can cover unexpected losses.

"It's very serious," FHA Commissioner David H. Stevens said in an interview. "There's nothing more serious that we're addressing right now, outside the housing crisis in general, than this issue."

[Stevens] said he is planning to announce Friday several measures that should help the reserves rebound quickly.
...
An independent audit due out this fall will show that the agency's reserves will drop below the 2 percent level as of Oct. 1, the start of the new fiscal year, Stevens said.

For one, he will propose that banks and other lenders that do business with the FHA have at least $1 million in capital they can use to repay the agency for losses if they were involved in fraud. Now, they are required only to hold $250,000. Second, he will propose that lenders also take responsibility for any losses due to fraud committed by the mortgage brokers with whom they work.

Here is a table of FHA lenders with a 2 year default rate of 15% or more (This consists of lenders with 100+ originations included). There are 10 lenders with "perfect" records (100% default), but they only have one or two originations each. Many of these lenders will probably go away with the new rules.

The FHA is banking on a "recovery in the housing market":

The new audit shows that even without any new measures, the reserves will rebound to the required level within two or three years largely as the result of the recovery in the housing market, Stevens said. This calculation is based on projections of future home prices, interest rates and the volume and credit quality of FHA's business.

Do you "Overpromise and Underdeliver" or "Underpromise and Overdeliver" ?

This is one of my favorite mottos and practices that I practice in the real estate industry and should also be applied for anyone in the services industry. We all can learn from our mistakes but sometimes we may not even know that we are making them and as a result, a client gets disappointed. A disappointed client reduces your chances drastically for referral and residual business whereas a happy client can be a client for life !

Some simple example are as follows:

If you tell someone that you will do something, do it !

Give yourself enough time to return a call and be specific... I like to say "I will get back to you by the end of the day or a certain day" versus "I will get back to you right away" or "I will call you in an hour" when that is not realistic.

Return all emails promptly - at least within 3 or 4 hours. If you do not have a smartphone, get one !

In client communication:

For a buyer when estimating closing costs and mortgage payment, overestimate the closing cost and interest rate. That way come settlement the amount that they need will be less than what is planned as well as the mortgage payment being less than expected to. There is nothing worse when a buyer is short money and you are just looking at each other dumbfounded at settlement.

For a seller, estimate a certain amount of repairs in your estimated proceeds so that is not a shocker come home inspection time. You can remind them that you are included some concessions from repairs. If there are no repairs, super !

On your listing appointment, be conservative with what their final sales price will be and recommend a fair and realistic listing price. If the sales price is going to be $240 to $260K, do not list the property over $300K, or even worse, recommending starting there ! Sometimes we may take a listing that starts higher than we like but at least we made a firm recommendation in the beginning. Which also sets the stage for price reductions.

When working with another agent or professional:

Communicate communicate communicate ! If you know there is going to be a delay in settlement, let the agent know sooner than later. Do not wait until the day before settlement !

If there is an issue that is being worked on that is time sensitive, check in with the other agent even if you do not have a firm update to let that person know that you are on it.

The above also applies to communicating with the mortgage pro or title company.

What this does by practicing simple follow-up and consistent communication is "Under Promise and Over Deliver" ! Your clients as well as your colleagues that you work with will not be set up for disappointment and your reputation will grow as an outstanding professional in your area ! That reputation is huge in our industry as it is the cornerstone for growth and excellence.

The National Association of REALTORS just announced that in July home sales are UP 7.2% - the largest monthly increase in at least 10 years.

Experts say this is primarily due to all of the first time home buyers rushing out to purchase their first home and take advantage of the $8000 tax credit that expires on November 30, 2009.
